6865 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -159, is
6966 amended to read as follows:
7067 Section 1-159. The area or space officially set apart within a

10298 SECTION 2. AMENDATORY 47 O.S. 2021, Section 11 -203, is
10399 amended to read as follows:
104100 Section 11-203. Whenever special pedestrian-control signals
105101 exhibiting the words "Walk" or "Wait" or "Don't Walk", or WALKING
106102 PERSON or UPRAISED HAND symbols are in place, such signals shall
107103 indicate as follows:
108104 1. Steady Walk or steady WALKING PERSON. Pedestrians facing
109105 such signal may proceed across start to cross the roadway in the
110106 direction of the signal after yielding right-of-way to vehicles
111107 lawfully within the intersection at the time the signal indications
112108 begins, and shall be given the right of way in the direc tion of the
113109 signal by the drivers of all vehicles.
114110 2. Wait or Flashing Don't Walk or flashing UPRAISED HAN D. No
115111 pedestrian shall start to cros s the roadway in the direction of such
116112 signal, but any pedestrian who has partially com pleted his or her
117113 crossing on the walk signal shall proceed to a sidewalk or safety
118114 island pedestrian refuge while the wait steady Don't Walk or
119115 UPRAISED HAND signal is showing.
120116 3. Steady Don't Walk or steady UPRAISED HAND. No pedestrian
121117 shall enter the roadway in the direction of the signal indication.

149-SECTION 3. AMENDATORY 47 O. S. 2021, Section 11-308, is
150-amended to read as follows:
151146 Section 11-308. (a) The State Highway Transportation Commission
152147 or local authorities, within their respective jurisdicti ons, may
153148 designate any street or highway or any separate roadway under their
154149 respective jurisdictions for one -way traffic and shall erect
155150 appropriate signs giving notice thereof.
156151 (b) Upon a roadway designated and signposted for one -way traffic
157152 a vehicle shall be driven only in the direction designated.
158153 (c) A vehicle passing around a rotary traffic the central island
159154 of a circular intersection shall be driven only to the right of
160155 counterclockwise around such islands.
161156 SECTION 4. AMENDATORY 47 O.S. 2021, Section 11-309, is
162157 amended to read as follows:
163158 Section 11-309. Whenever any roadway has been divided in to two
164159 or more clearly marked lanes for traffic, the following requirements
165160 in addition to all others consistent herewith shall ap ply.
166161 1. A vehicle shall be driven as nearly as practicable entirely
167162 within a single lane.
168163 2. A vehicle shall not be moved fr om the lane until the driver
169164 has first ascertained that the movement can be made with safety and
170165 then given a signal, not less tha n the last one hundred (100) feet
171166 traveled by the vehicle, of his or her intention to change lanes.
167+3. Upon a roadway which i s divided into three lanes, a vehicle
168+shall not be driven in the center lane except when overtaking and

199-3. Upon a roadway which is divided into three lanes, a vehicle
200-shall not be driven in the center lane except when overtaking and
201-passing another vehicle wh ere the roadway is clearly visible and the
202196 center lane is clear of traffic within a safe distance, or in
203197 preparation for a lef t turn or where the center lane is at the time
204198 allocated exclusively to traffic moving in the direction the vehicle
205199 is proceeding and is signposted to give notice of the allocation.
206200 4. A two-way left-turn lane is a lane near the center of the
207201 highway set aside for use by vehicles making left turns in both
208202 directions from or into the roadway. Two -way left-turn lanes shall
209203 be designated by distinctive roadway markings consisting of parallel
210204 double yellow lines, interior line dashed and exterior line solid,
211205 on each side of the lane. A vehicle shall not be driven in a
212206 designated two-way left-turn lane except when preparing for or
213207 making a left turn from or into a roadway. Vehicles turning left
214208 from the roadway shall not be driven in the two -way left-turn lane
215209 for more than two hundred (200) feet while preparing for and making
216210 the turn. A vehicle turning left onto the roadway may utili ze the
217211 two-way left-turn lane as a staging area by stopping and waiting for
218212 traffic proceeding in the same direction to clear before merging
219213 into the adjacent lanes of travel. A left turn shall not be made
220214 from any other lane where a two -way left-turn lane has been
221215 designated. Provided, however, this section shall not prohibit
216+driving across a two -way left-turn lane when moving from a service
217+drive onto such marked roadway.
218+5. 4. A vehicle shall not be driven in the left lane of a
219+roadway except when ove rtaking and passing another vehicle;

249-driving across a two -way left-turn lane when moving from a service
250-drive onto such marked roadway.
251-5. 4. A vehicle shall not be driven in the left lane of a
252-roadway except when ove rtaking and passing another vehicle;
253246 provided, however, this paragraph shall not prohibit driving in the
254247 left lane when traffic conditions, flow or road configuration, such
255248 as the potential of merging traffic, require the use of the left
256249 lane to maintain safe traffic conditions; provided further, this
257250 paragraph shall not prohibit driving in the left lane of a roadway
258251 within the city limits of a municipality or upon a county road as
259252 long as such roadway is not part of the National System of
260253 Interstate and Defense Highways or a turnpike.
261254 6. 5. Official signs may be erected directing slow-moving
262255 traffic to use a designated lane or des ignating those lanes to be
263256 used by traffic moving in a particular direction regardless of the
264257 center of the roadway, and drivers of vehicles shall obey the
265258 directions of every such sign.
266259 Any person convicted of violating any provision of this section
267260 shall be punished as provided for in Section 17-101 of this title.
268261 SECTION 5. AMENDATORY 47 O.S. 20 21, Section 11-803, is
269262 amended to read as follows:
270263 Section 11-803. A. Whenever local authorities in thei r
271264 respective jurisdictions determine on the bas is of an engineering
272265 and traffic investigation that the maximum speed permitted under
266+this article is greater or less than is reasonable and safe under
267+the conditions found to exist upon a highway or part of a highway,
268+the local authority may determine and declare a reasonable and safe
269+maximum limit thereon which:

300-this article is greater or less than is reasonable and safe under
301-the conditions found to exist upon a highway or part of a highway,
302-the local authority may determine and declare a reasonable and safe
303-maximum limit thereon which:
304296 1. Decreases the limit at intersectio ns; or
305297 2. Increases the limit within an urban district, but not to
306298 more than sixty-five (65) miles per hour; o r
307299 3. Decreases the limit outside an urban dist rict, but not to
308300 less than thirty (30) miles per hour.
309301 B. Local authorities in their respective j urisdictions shall
310302 determine by an engineering and traffic investigation the proper
311303 maximum speed for all arter ial streets and shall declare a
312304 reasonable and safe maximum limit thereon which may be greater or
313305 less than the maximum speed permitted under Sec tion 1-101 et seq. of
314306 this title for an urban district.
315307 C. Any altered limit established as hereinabove author ized
316308 shall be effective at all times or during hours of darkness or at
317309 other times as may be determined when appropriate signs giving
318310 notice thereof are erected upon such street or highway.
319311 D. As to streets and highways within the corporate limits which
320312 have been constructed or reconstructed with stat e or federal funds
321313 are maintained by the Oklahoma Department of Transportation , local
322314 authorities shall have j oint authority with the Transportation
323315 Commission to establish or alter speed limits; provided, how ever,
316+the speed limit on an interstate highway within such corporate
317+limits shall not be decreased to less than sixty (60) miles per
318+hour; and provided furth er, that no local authority shall impose
319+speed limits on any such street or highway substantially l ower than

351-the speed limit on an interstate highway within such corporate
352-limits shall not be decreased to less than sixty (60) miles per
353-hour; and provided furth er, that no local authority shall impose
354-speed limits on any such street or highway substantially l ower than
355346 those justified by the highway design , capacity, and traffic volume
356347 as determined by engineering studies.
357348 E. Not more than six such alterations as hereinabove authorized
358349 shall be made per mile along a street or highway except in the case
359350 of reduced limits at intersections, and the difference between
360351 adjacent limits shall not be more than ten (10) miles per hour.
361352 SECTION 6. AMENDATORY 69 O.S. 2021, Section 241, is
362353 amended to read as follows:
363354 Section 241. The portion of the roadway contiguous with the
364355 traveled way for accommodation of stopped vehicles, for emergency
365356 use, for travel under certain conditions, and for lateral support of
366357 base and surface courses.
367358 SECTION 7. AMENDATORY 69 O.S. 2021, Section 242, is
368359 amended to read as follows:
369360 Section 242. The system of state roads designated by the State
370361 Highway Transportation Commission, including necess ary urban
371362 extension, the responsibility for which is lodged in the Oklahoma
372363 Department of Highways Transportation.
373364 SECTION 8. AMENDATORY 69 O.S. 2021, Section 301, is
374365 amended to read as follows:
366+Section 301. (a) There is hereby c reated a an Oklahoma
367+Department of Highways Transportation and a State Highway
368+Transportation Commission in and for the State of Oklahoma, pursuan t
369+to the provisions of Section 1, of Article 16, XVI of the

402-Section 301. (a) There is hereby c reated a an Oklahoma
403-Department of Highways Transportation and a State Highway
404-Transportation Commission in and for the State of Oklahoma, pursuant
405-to the provisions of Section 1, of Article 16, XVI of the
406396 Constitution of the State of Okl ahoma, and such depar tment shall be
407397 governed by the State Highway Director of the Oklahoma Department of
408398 Transportation, provided for by Section 305 of this Code, u nder such
409399 reasonable rules, regulations and policies and road improvement
410400 programs as may be prescribed by the Co mmission. Such rules and
411401 regulations and amendments thereto as adopted by the Commission
412402 shall be filed and recorded in the office of the Secr etary of State.
413403 (b) The Department and the Commission created by the preceding
414404 paragraph and the State Highway Director of the Oklahoma Department
415405 of Transportation provided for by Section 305 of this Code shall be
416406 the legal successors of, and unless and e xcept as otherwise provided
417407 by this Code shall also hav e the powers and duties vested by oth er
418408 laws in, and shall take immediate charge of all equipment, supplies
419409 and property now in the possession of, the Department, Commission
420410 and Director, respectively, created and provided for by 69 O.S.
421411 1961, Sections 20.1 and 20.6, as amended, and shall be liable for
422412 their respective obligations.
423413 SECTION 9. This act shall become effective November 1, 2023.
