67	64		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
68	65		SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -159, is
69	66		amended to read as follows:
70	67		Section 1-159. The area or space officially set apart within a
71	68		roadway for the exclusive use of pedestrians and which is protected

102	98		SECTION 2. AMENDATORY 47 O.S. 2021, Section 11 -203, is
103	99		amended to read as follows:
104	100		Section 11-203. Whenever special pedestrian-control signals
105	101		exhibiting the words "Walk" or "Wait" or "Don't Walk", or WALKING
106	102		PERSON or UPRAISED HAND symbols are in place, such signals shall
107	103		indicate as follows:
108	104		1. Steady Walk or steady WALKING PERSON. Pedestrians facing
109	105		such signal may proceed across start to cross the roadway in the
110	106		direction of the signal after yielding right-of-way to vehicles
111	107		lawfully within the intersection at the time the signal indications
112	108		begins, and shall be given the right of way in the direc tion of the
113	109		signal by the drivers of all vehicles.
114	110		2. Wait or Flashing Don't Walk or flashing UPRAISED HAN D. No
115	111		pedestrian shall start to cros s the roadway in the direction of such
116	112		signal, but any pedestrian who has partially com pleted his or her
117	113		crossing on the walk signal shall proceed to a sidewalk or safety
118	114		island pedestrian refuge while the wait steady Don't Walk or
119	115		UPRAISED HAND signal is showing.
120	116		3. Steady Don't Walk or steady UPRAISED HAND. No pedestrian
121	117		shall enter the roadway in the direction of the signal indication.

149		-	SECTION 3. AMENDATORY 47 O. S. 2021, Section 11-308, is
150		-	amended to read as follows:
151	146		Section 11-308. (a) The State Highway Transportation Commission
152	147		or local authorities, within their respective jurisdicti ons, may
153	148		designate any street or highway or any separate roadway under their
154	149		respective jurisdictions for one -way traffic and shall erect
155	150		appropriate signs giving notice thereof.
156	151		(b) Upon a roadway designated and signposted for one -way traffic
157	152		a vehicle shall be driven only in the direction designated.
158	153		(c) A vehicle passing around a rotary traffic the central island
159	154		of a circular intersection shall be driven only to the right of
160	155		counterclockwise around such islands.
161	156		SECTION 4. AMENDATORY 47 O.S. 2021, Section 11-309, is
162	157		amended to read as follows:
163	158		Section 11-309. Whenever any roadway has been divided in to two
164	159		or more clearly marked lanes for traffic, the following requirements
165	160		in addition to all others consistent herewith shall ap ply.
166	161		1. A vehicle shall be driven as nearly as practicable entirely
167	162		within a single lane.
168	163		2. A vehicle shall not be moved fr om the lane until the driver
169	164		has first ascertained that the movement can be made with safety and
170	165		then given a signal, not less tha n the last one hundred (100) feet
171	166		traveled by the vehicle, of his or her intention to change lanes.

199		-	3. Upon a roadway which is divided into three lanes, a vehicle
200		-	shall not be driven in the center lane except when overtaking and
201		-	passing another vehicle wh ere the roadway is clearly visible and the
202	196		center lane is clear of traffic within a safe distance, or in
203	197		preparation for a lef t turn or where the center lane is at the time
204	198		allocated exclusively to traffic moving in the direction the vehicle
205	199		is proceeding and is signposted to give notice of the allocation.
206	200		4. A two-way left-turn lane is a lane near the center of the
207	201		highway set aside for use by vehicles making left turns in both
208	202		directions from or into the roadway. Two -way left-turn lanes shall
209	203		be designated by distinctive roadway markings consisting of parallel
210	204		double yellow lines, interior line dashed and exterior line solid,
211	205		on each side of the lane. A vehicle shall not be driven in a
212	206		designated two-way left-turn lane except when preparing for or
213	207		making a left turn from or into a roadway. Vehicles turning left
214	208		from the roadway shall not be driven in the two -way left-turn lane
215	209		for more than two hundred (200) feet while preparing for and making
216	210		the turn. A vehicle turning left onto the roadway may utili ze the
217	211		two-way left-turn lane as a staging area by stopping and waiting for
218	212		traffic proceeding in the same direction to clear before merging
219	213		into the adjacent lanes of travel. A left turn shall not be made
220	214		from any other lane where a two -way left-turn lane has been
221	215		designated. Provided, however, this section shall not prohibit
	216	+	driving across a two -way left-turn lane when moving from a service
	217	+	drive onto such marked roadway.
	218	+	5. 4. A vehicle shall not be driven in the left lane of a
	219	+	roadway except when ove rtaking and passing another vehicle;

249		-	driving across a two -way left-turn lane when moving from a service
250		-	drive onto such marked roadway.
251		-	5. 4. A vehicle shall not be driven in the left lane of a
252		-	roadway except when ove rtaking and passing another vehicle;
253	246		provided, however, this paragraph shall not prohibit driving in the
254	247		left lane when traffic conditions, flow or road configuration, such
255	248		as the potential of merging traffic, require the use of the left
256	249		lane to maintain safe traffic conditions; provided further, this
257	250		paragraph shall not prohibit driving in the left lane of a roadway
258	251		within the city limits of a municipality or upon a county road as
259	252		long as such roadway is not part of the National System of
260	253		Interstate and Defense Highways or a turnpike.
261	254		6. 5. Official signs may be erected directing slow-moving
262	255		traffic to use a designated lane or des ignating those lanes to be
263	256		used by traffic moving in a particular direction regardless of the
264	257		center of the roadway, and drivers of vehicles shall obey the
265	258		directions of every such sign.
266	259		Any person convicted of violating any provision of this section
267	260		shall be punished as provided for in Section 17-101 of this title.
268	261		SECTION 5. AMENDATORY 47 O.S. 20 21, Section 11-803, is
269	262		amended to read as follows:
270	263		Section 11-803. A. Whenever local authorities in thei r
271	264		respective jurisdictions determine on the bas is of an engineering
272	265		and traffic investigation that the maximum speed permitted under
	266	+	this article is greater or less than is reasonable and safe under
	267	+	the conditions found to exist upon a highway or part of a highway,
	268	+	the local authority may determine and declare a reasonable and safe
	269	+	maximum limit thereon which:

300		-	this article is greater or less than is reasonable and safe under
301		-	the conditions found to exist upon a highway or part of a highway,
302		-	the local authority may determine and declare a reasonable and safe
303		-	maximum limit thereon which:
304	296		1. Decreases the limit at intersectio ns; or
305	297		2. Increases the limit within an urban district, but not to
306	298		more than sixty-five (65) miles per hour; o r
307	299		3. Decreases the limit outside an urban dist rict, but not to
308	300		less than thirty (30) miles per hour.
309	301		B. Local authorities in their respective j urisdictions shall
310	302		determine by an engineering and traffic investigation the proper
311	303		maximum speed for all arter ial streets and shall declare a
312	304		reasonable and safe maximum limit thereon which may be greater or
313	305		less than the maximum speed permitted under Sec tion 1-101 et seq. of
314	306		this title for an urban district.
315	307		C. Any altered limit established as hereinabove author ized
316	308		shall be effective at all times or during hours of darkness or at
317	309		other times as may be determined when appropriate signs giving
318	310		notice thereof are erected upon such street or highway.
319	311		D. As to streets and highways within the corporate limits which
320	312		have been constructed or reconstructed with stat e or federal funds
321	313		are maintained by the Oklahoma Department of Transportation , local
322	314		authorities shall have j oint authority with the Transportation
323	315		Commission to establish or alter speed limits; provided, how ever,
	316	+	the speed limit on an interstate highway within such corporate
	317	+	limits shall not be decreased to less than sixty (60) miles per
	318	+	hour; and provided furth er, that no local authority shall impose
	319	+	speed limits on any such street or highway substantially l ower than

351		-	the speed limit on an interstate highway within such corporate
352		-	limits shall not be decreased to less than sixty (60) miles per
353		-	hour; and provided furth er, that no local authority shall impose
354		-	speed limits on any such street or highway substantially l ower than
355	346		those justified by the highway design , capacity, and traffic volume
356	347		as determined by engineering studies.
357	348		E. Not more than six such alterations as hereinabove authorized
358	349		shall be made per mile along a street or highway except in the case
359	350		of reduced limits at intersections, and the difference between
360	351		adjacent limits shall not be more than ten (10) miles per hour.
361	352		SECTION 6. AMENDATORY 69 O.S. 2021, Section 241, is
362	353		amended to read as follows:
363	354		Section 241. The portion of the roadway contiguous with the
364	355		traveled way for accommodation of stopped vehicles, for emergency
365	356		use, for travel under certain conditions, and for lateral support of
366	357		base and surface courses.
367	358		SECTION 7. AMENDATORY 69 O.S. 2021, Section 242, is
368	359		amended to read as follows:
369	360		Section 242. The system of state roads designated by the State
370	361		Highway Transportation Commission, including necess ary urban
371	362		extension, the responsibility for which is lodged in the Oklahoma
372	363		Department of Highways Transportation.
373	364		SECTION 8. AMENDATORY 69 O.S. 2021, Section 301, is
374	365		amended to read as follows:
	366	+	Section 301. (a) There is hereby c reated a an Oklahoma
	367	+	Department of Highways Transportation and a State Highway
	368	+	Transportation Commission in and for the State of Oklahoma, pursuan t
	369	+	to the provisions of Section 1, of Article 16, XVI of the

402		-	Section 301. (a) There is hereby c reated a an Oklahoma
403		-	Department of Highways Transportation and a State Highway
404		-	Transportation Commission in and for the State of Oklahoma, pursuant
405		-	to the provisions of Section 1, of Article 16, XVI of the
406	396		Constitution of the State of Okl ahoma, and such depar tment shall be
407	397		governed by the State Highway Director of the Oklahoma Department of
408	398		Transportation, provided for by Section 305 of this Code, u nder such
409	399		reasonable rules, regulations and policies and road improvement
410	400		programs as may be prescribed by the Co mmission. Such rules and
411	401		regulations and amendments thereto as adopted by the Commission
412	402		shall be filed and recorded in the office of the Secr etary of State.
413	403		(b) The Department and the Commission created by the preceding
414	404		paragraph and the State Highway Director of the Oklahoma Department
415	405		of Transportation provided for by Section 305 of this Code shall be
416	406		the legal successors of, and unless and e xcept as otherwise provided
417	407		by this Code shall also hav e the powers and duties vested by oth er
418	408		laws in, and shall take immediate charge of all equipment, supplies
419	409		and property now in the possession of, the Department, Commission
420	410		and Director, respectively, created and provided for by 69 O.S.
421	411		1961, Sections 20.1 and 20.6, as amended, and shall be liable for
422	412		their respective obligations.
423	413		SECTION 9. This act shall become effective November 1, 2023.
