58 | 63 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

59 | 64 | | SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.2, as |
---|

61 | 66 | | Section 60.2), is amended to read as follows: |

94 | 100 | | the provisions of the Protection from Domestic Abuse Act. |
---|
95 | 101 | | 1. The person seeking relief may file a petition for a |
---|
96 | 102 | | protective order with the dist rict court in the county in which the |
---|
97 | 103 | | victim resides, the county in which the defendant resides, or the |
---|
98 | 104 | | county in which the domestic violence occurred. If the person |
---|
99 | 105 | | seeking relief is not a family or household member or an indivi dual |
---|
100 | 106 | | who is or has been in a dating relationship with t he defendant, the |
---|
101 | 107 | | person seeking relief must fi le a complaint against the defendant |
---|
102 | 108 | | with the proper law enforcement agency before filing a petition for |
---|
103 | 109 | | a protective order with the district court . The person seeking |
---|
104 | 110 | | relief shall provide a copy of the compl aint that was filed with the |
---|
105 | 111 | | law enforcement agency at the full hearing if the complaint is no t |
---|
106 | 112 | | available from the law enforcement agency. Failure to provide a |
---|
107 | 113 | | copy of the complaint filed with the law enforcement agency shall |
---|
108 | 114 | | constitute a frivolous filing and the court may assess attorney fees |
---|
109 | 115 | | and court costs against the plaintiff pursuant to para graph 2 of |
---|
110 | 116 | | subsection C of this section. The filing of a petition for a |
---|
111 | 117 | | protective order shall not require jurisdiction or venue of the |
---|
112 | 118 | | criminal offense if eithe r the plaintiff or defendant resides in the |
---|
113 | 119 | | county. If a petition has been filed in an action for divorce or |
---|
114 | 120 | | separate maintenance and either party to the action files a petition |
---|
143 | 150 | | protective order may be heard by the court he aring the divorce or |
---|
144 | 151 | | separate maintenance action if: |
---|
145 | 152 | | a. there is no established protective order docket in |
---|
146 | 153 | | such court, or |
---|
147 | 154 | | b. the court finds that, in the interest of judicial |
---|
148 | 155 | | economy, both actions may be heard together; provided, |
---|
149 | 156 | | however, the petition fo r a protective order, |
---|
150 | 157 | | including, but not limited to, a petition in which |
---|
151 | 158 | | children are named as petitioners, shall remain a |
---|
152 | 159 | | separate action and a separate order shal l be entered |
---|
153 | 160 | | in the protective order action . Protective orders may |
---|
154 | 161 | | be dismissed in favor of restraining orders in the |
---|
155 | 162 | | divorce or separate maintenance action if the court |
---|
156 | 163 | | specifically finds, upon hea ring, that such dismissal |
---|
157 | 164 | | is in the best interests of the parties and does not |
---|
158 | 165 | | compromise the safety of any petitioner. |
---|
159 | 166 | | If the defendant is a minor child, the petition shall be filed |
---|
160 | 167 | | with the court having jurisdiction over juvenile matters. |
---|
161 | 168 | | 2. When the abuse occurs when the court is not open for |
---|
162 | 169 | | business, such person may request an emergency temporary order of |
---|
163 | 170 | | protection as authorized by Section 40. 3 of this title. |
---|
193 | 201 | | C. 1. Except as otherwise provided by this section, no filing |
---|
194 | 202 | | fee, service of process fee, attorney fees or any other fee or costs |
---|
195 | 203 | | shall be charged the plaintiff or victim at any time f or filing a |
---|
196 | 204 | | petition for a protective order whether a protect ive order is |
---|
197 | 205 | | granted or not granted . The court may assess court costs, service |
---|
198 | 206 | | of process fees, attorney fees, other fees and filing fees against |
---|
199 | 207 | | the defendant at the hearing on the petition, if a protective order |
---|
200 | 208 | | is granted against the defendant; provide d, the court shall have |
---|
201 | 209 | | authority to waive the costs and fees if the court finds that th e |
---|
202 | 210 | | party does not have the ability to pay the costs and fees. |
---|
203 | 211 | | 2. If the court makes specific findings that a petition for a |
---|
204 | 212 | | protective order has been filed frivolously and no victim exists, |
---|
205 | 213 | | the court may assess atto rney fees and court costs against the |
---|
206 | 214 | | plaintiff. |
---|
207 | 215 | | D. The person seeking relief shall prepare the petition or, at |
---|
208 | 216 | | the request of the plaintiff, the court clerk or the victim-witness |
---|
209 | 217 | | coordinator, victim support person, and court case manager shall |
---|
210 | 218 | | prepare or assist the plaintiff in preparing the petition. |
---|
211 | 219 | | E. The person seeking a protective order may further request |
---|
212 | 220 | | the exclusive care, possession, or control of any animal owned, |
---|
213 | 221 | | possessed, leased, kept, or held b y either the petitioner, defendant |
---|
243 | 252 | | encumbering, concealing, m olesting, attacking, striking, |
---|
244 | 253 | | threatening, harming, or otherwise disposing of the an imal. |
---|
245 | 254 | | F. A court may not require the victim to seek legal sanctions |
---|
246 | 255 | | against the defendant including, but not limited to, divor ce, |
---|
247 | 256 | | separation, paternity or criminal procee dings prior to hearing a |
---|

249 | 258 | | G. A victim of rape, forci ble sodomy, a sex offense, |

250 | 259 | | kidnapping, assault and battery with a deadly weapon or member of |

251 | 260 | | the immediate family of a victim of first-degree murder, as such |

252 | 261 | | terms are defined in Section 40 of this title, may petitio n for an |

---|
254 | 263 | | any relationship or scenario pursuant to the provisions of this |

504 | 518 | | 1. A court clerk issuing a misdemeanor warr ant is entitled to |

505 | 519 | | ten percent (10%) of the sheriff's service fee, provided for in |

506 | 520 | | paragraph 9 of subsection A of this section, co llected on a warrant |
---|
507 | 521 | | referred to the contractor for the misdemeanor warrant noti fication |

508 | 522 | | program governed by Sections 514.4 an d 514.5 of Title 19 of the |

509 | 523 | | Oklahoma Statutes. This ten-percent sum shall be deposited into the |

510 | 524 | | issuing Court Clerk's Revolving Fund, created pursuant to Section |

511 | 525 | | 220 of Title 19 of the Oklahoma Statutes, of the court clerk issuing |
