5863 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5964 SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.2, as
6065 amended by Section 6, Chapter 318, O.S.L. 2022 (22 O.S. Supp. 2022,
6166 Section 60.2), is amended to read as follows:

97+household member who is a minor or incompetent , any minor age
98+sixteen (16) or seventeen (17) years, or any adult victim of a crime
9399 with a need to prevent further victimization, may seek relief under
94100 the provisions of the Protection from Domestic Abuse Act.
95101 1. The person seeking relief may file a petition for a
96102 protective order with the dist rict court in the county in which the
97103 victim resides, the county in which the defendant resides, or the
98104 county in which the domestic violence occurred. If the person
99105 seeking relief is not a family or household member or an indivi dual
100106 who is or has been in a dating relationship with t he defendant, the
101107 person seeking relief must fi le a complaint against the defendant
102108 with the proper law enforcement agency before filing a petition for
103109 a protective order with the district court . The person seeking
104110 relief shall provide a copy of the compl aint that was filed with the
105111 law enforcement agency at the full hearing if the complaint is no t
106112 available from the law enforcement agency. Failure to provide a
107113 copy of the complaint filed with the law enforcement agency shall
108114 constitute a frivolous filing and the court may assess attorney fees
109115 and court costs against the plaintiff pursuant to para graph 2 of
110116 subsection C of this section. The filing of a petition for a
111117 protective order shall not require jurisdiction or venue of the
112118 criminal offense if eithe r the plaintiff or defendant resides in the
113119 county. If a petition has been filed in an action for divorce or
114120 separate maintenance and either party to the action files a petition
115-for a protective order in the same county where the action for
116-divorce or separate maintenance is filed, the pet ition for the

148+for a protective order in the same county where the action for
149+divorce or separate maintenance is filed, the petition for th e
143150 protective order may be heard by the court he aring the divorce or
144151 separate maintenance action if:
145152 a. there is no established protective order docket in
146153 such court, or
147154 b. the court finds that, in the interest of judicial
148155 economy, both actions may be heard together; provided,
149156 however, the petition fo r a protective order,
150157 including, but not limited to, a petition in which
151158 children are named as petitioners, shall remain a
152159 separate action and a separate order shal l be entered
153160 in the protective order action . Protective orders may
154161 be dismissed in favor of restraining orders in the
155162 divorce or separate maintenance action if the court
156163 specifically finds, upon hea ring, that such dismissal
157164 is in the best interests of the parties and does not
158165 compromise the safety of any petitioner.
159166 If the defendant is a minor child, the petition shall be filed
160167 with the court having jurisdiction over juvenile matters.
161168 2. When the abuse occurs when the court is not open for
162169 business, such person may request an emergency temporary order of
163170 protection as authorized by Section 40. 3 of this title.
164-B. The petition forms shall be provided by the clerk of the
165-court. The Administrative O ffice of the Courts shall develop a
166-standard form for the pe tition.

198+B. The petition forms shall be provided by the clerk of the
199+court. The Administrative O ffice of the Courts shall develop a
200+standard form for the pe tition.
193201 C. 1. Except as otherwise provided by this section, no filing
194202 fee, service of process fee, attorney fees or any other fee or costs
195203 shall be charged the plaintiff or victim at any time f or filing a
196204 petition for a protective order whether a protect ive order is
197205 granted or not granted . The court may assess court costs, service
198206 of process fees, attorney fees, other fees and filing fees against
199207 the defendant at the hearing on the petition, if a protective order
200208 is granted against the defendant; provide d, the court shall have
201209 authority to waive the costs and fees if the court finds that th e
202210 party does not have the ability to pay the costs and fees.
203211 2. If the court makes specific findings that a petition for a
204212 protective order has been filed frivolously and no victim exists,
205213 the court may assess atto rney fees and court costs against the
206214 plaintiff.
207215 D. The person seeking relief shall prepare the petition or, at
208216 the request of the plaintiff, the court clerk or the victim-witness
209217 coordinator, victim support person, and court case manager shall
210218 prepare or assist the plaintiff in preparing the petition.
211219 E. The person seeking a protective order may further request
212220 the exclusive care, possession, or control of any animal owned,
213221 possessed, leased, kept, or held b y either the petitioner, defendant
214-or minor child residing in the residence of the petitioner or
215-defendant. The court may order the defendant to make no contact

250+defendant. The court may order the defendant to make no contact
251+with the animal and forbid the defendant from taking, transferring,
243252 encumbering, concealing, m olesting, attacking, striking,
244253 threatening, harming, or otherwise disposing of the an imal.
245254 F. A court may not require the victim to seek legal sanctions
246255 against the defendant including, but not limited to, divor ce,
247256 separation, paternity or criminal procee dings prior to hearing a
248257 petition for protective order.
249258 G. A victim of rape, forci ble sodomy, a sex offense,
250259 kidnapping, assault and battery with a deadly weapon or member of
251260 the immediate family of a victim of first-degree murder, as such
252261 terms are defined in Section 40 of this title, may petitio n for an
253262 emergency temporary order or em ergency ex parte order regardless of
254263 any relationship or scenario pursuant to the provisions of this
255264 section. The Administrative Office of the Courts shall modify the
256265 petition forms as necessary to effectuate the pr ovisions of this
257266 subsection.
258267 SECTION 2. AMENDATORY 28 O.S. 2021, Section 153, as
259268 amended by Section 2, Chapter 237, O.S.L. 2022 (28 O.S. Supp. 2022,
260269 Section 153), is amended to read as follo ws:
261270 Section 153. A. The clerks of the courts shall collect as
262271 costs in every criminal case for each o ffense of which the defendant
263272 is convicted, irrespect ive of whether or not the sentence is
264-deferred, the following flat c harges and no more, except for
265-standing and parking violations and for charges otherwise provided

400412 ($6.00) shall be assessed and credited to the Law Library Fund
401413 pursuant to Section 1201 e t seq. of Title 20 of the Oklahoma
402414 Statutes.
403415 C. In addition to the amount collected pursuant to subsection A
404416 of this section, the sum of Twenty Dollars ($20.00) shall be
405417 assessed and collected in every traffic case for each offense other
406418 than for driving under the influence of alcohol or other
407419 intoxicating substance; the sum of Thirty Dollars ($30.00 ) shall be
408420 assessed and collected in every misdemeanor case for each of fense;
409421 the sum of Thirty Dollars ($30.00) shall be assessed and collected
410422 in every misdemeanor case for each offense for driving under the
411423 influence of alcohol or other intoxicating sub stance; the sum of
412424 Fifty Dollars ($50.00) shall be assessed and collect ed in every
413-felony case for each offense; and the sum of Fifty Dollars ($50.00)

452+felony case for each offense; and the sum of Fifty Dollars ($50.00)
453+shall be assessed and collected in every felony case for each
441454 offense for driving under the influence of alcohol or other
442455 intoxicating substance.
443456 D. In addition to the amounts collected pursuant to subsections
444457 A and B of this section, the sum of Twenty -five Dollars ($25.00)
445458 shall be assessed and credited to the Okl ahoma Court Information
446459 System Revolving Fun d created pursuant to Section 1315 of Title 20
447460 of the Oklahoma Statutes .
448461 E. In addition to the amount collected pursuant to paragraphs 1
449462 through 6 of subsecti on A of this section, the sum of Ten Dollars
450463 ($10.00) shall be assessed and credited to the Sheri ff's Service Fee
451464 Account in the county in which the conviction occurred for the
452465 purpose of enhancing existing or providing additional courthouse
453466 security.
454467 F. In addition to the amounts collected pursuant to para graphs
455468 1 through 6 of subsection A of this s ection, the sum of Three
456469 Dollars ($3.00) shall be assessed and credited to the Office of the
457470 Attorney General Victim Services Unit.
458471 G. In addition to the amou nts collected pursuant to paragraphs
459472 1 through 6 of subsection A of this section, the sum of Thre e
460473 Dollars ($3.00) shall be assessed and credited to the Child Abuse
461474 Multidisciplinary Account . This fee shall not be used for purposes
462475 of hiring or employing any law enforcement officers.
463-H. In addition to the amount collected pursuant to paragraphs 5
464-and 6 of subsection A of this section, the sum of Fifteen Dollars

503+H. In addition to the amount collected pursuant to paragraphs 5
504+and 6 of subsection A of this section, the sum of Fifteen Dollars
491505 ($15.00) shall be assessed in every misdemeanor or felony case for
492506 each offense of driving unde r the influence of alcohol or other
493507 intoxicating substance and credited to the Oklahoma Impaired Driver
494508 Database Revolving Fund created pursuant to Section 11-902d of Title
495509 47 of the Oklahoma Statutes .
496510 I. Prior to conviction, parties in criminal cases shall not be
497511 required to pay, advance, or post securit y for the issuance or
498512 service of process to ob tain compulsory attendance of witnesses.
499513 J. The amounts to be assessed as court costs upon filing of a
500514 case shall be those am ounts above-stated in paragraph 3 or 4 of
501515 subsection A and subsection s B, C, D and E of this secti on.
502516 K. The fees collected pursu ant to this section shall be
503517 deposited into the court fund, except the following :
504518 1. A court clerk issuing a misdemeanor warr ant is entitled to
505519 ten percent (10%) of the sheriff's service fee, provided for in
506520 paragraph 9 of subsection A of this section, co llected on a warrant
507521 referred to the contractor for the misdemeanor warrant noti fication
508522 program governed by Sections 514.4 an d 514.5 of Title 19 of the
509523 Oklahoma Statutes. This ten-percent sum shall be deposited into the
510524 issuing Court Clerk's Revolving Fund, created pursuant to Section
511525 220 of Title 19 of the Oklahoma Statutes, of the court clerk issuing
512526 the warrant with the bala nce of the sheriff's service fee to be
513-deposited into the Sheriff 's Service Fee Account, created p ursuant
514-to the provisions of Sec tion 514.1 of Title 19 of the Oklahoma

554+deposited into the Sheriff 's Service Fee Account, created p ursuant
555+to the provisions of Sec tion 514.1 of Title 19 of the Oklahoma
541556 Statutes, of the sheriff in the county in which service is made or
542557 attempted. Otherwise, the sheriff's service fee, when co llected,
543558 shall be deposited in i ts entirety into the Sheriff 's Service Fee
544559 Account of the sheriff in the county in which service is made or
545560 attempted;
546561 2. The sheriff's fee provided for in Section 153.2 of this
547562 title;
548563 3. The witness fees paid by the dis trict attorney pursuant to
549564 the provisions of Section 82 of this title which, if collected by
550565 the court clerk, shall be transferred to the district attorney 's
551566 office in the county where witness attendance was required . Fees
552567 transferred pursuant to this par agraph shall be deposited in the
553568 district attorney's maintenance and operating expense account;
554569 4. The fees provided for in subsection C of this section shall
555570 be forwarded to the District Attorneys Council Revolving Fund to
556571 defray the costs of prosecutio n; and
557572 5. The following amounts of the fees provided for in par agraphs
558573 2, 3, 5 and 6 of subsect ion A of this section, when collected, shall
559574 be deposited in the Trauma Care Ass istance Revolving Fund, created
560575 pursuant to the provisions of Section 1 -2530.9 of Title 63 of the
561576 Oklahoma Statutes:
562-a. Ten Dollars ($10.00) of the Ninety-eight-Dollar fee
563-provided for in paragraph 2 of subsection A of this

600616 L. As used in this section , "convicted" means any final
601617 adjudication of guilt, whether pursuant to a plea of guilty or nolo
602618 contendere or otherw ise, and any deferred judgm ent or suspended
603619 sentence.
604620 M. A court clerk may accept in payment for any fee, fine,
605621 forfeiture payment, cost, penalty assessment or other charge or
606622 collection to be assessed or c ollected by a court clerk pursuant to
607623 this section a nationally recogniz ed credit card or debit card or
608624 other electronic payment method as provided in paragraph 1 of
609625 subsection B of Secti on 151 of this title.
610-N. Upon receipt of payment of fines and c osts for offenses
611-charged prior to July 1 , 1992, the court clerk shall ap portion and
612-pay Thirteen Dollars ($13.00) pe r conviction to the court fund.
613-SECTION 3. This act shall become effective November 1, 2023.
