	101	+	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
48	102		SECTION 1. NEW LAW A new section of law to be codified
49	103		in the Oklahoma Statutes as Section 3011 of Title 20, unless there
50	104		is created a duplication in numbering, reads as follows:

52	105		This act shall be known and may be cited as the "Oklahoma
53	106		Judicial Security and Privacy Act of 2023 ".
54		-
55	107		SECTION 2. NEW LAW A new section of law to be codified
56	108		in the Oklahoma Statutes as Section 3012 of Title 20, unless there
57	109		is created a duplication in numbering, reads as follows:
58		-
59	110		As used in this act:
60		-
61	111		1. The term "at-risk individual" means any active or retired
62	112		member of the State Judiciary, and shall also include municipal,
63	113		county, tribal, and federal judges;
64		-
65	114		2. The term "commercial entity" means any corporation,
66	115		partnership, limited partnership, proprietorship, sole
67	116		proprietorship, firm, enterprise, fra nchise, or association engaged
68	117		in the buying or selling of goods or services for profit;
69		-
70	118		3. The term "covered information" means:
71		-
72	119		a. a home address, including primary residence or
73	120		secondary residences of an at-risk individual,
74		-
75	121		b. a home or personal mobile telephone number, or the
76	122		direct telephone number of a government-issued cell
77	123		phone or private extension in the chambers of an at-
78	124		risk individual,

93	161		which an at-risk individual resides for part of a

96	163		g. a license plate number or home address displayed on
97	164		vehicle registration information of an at-risk
98	165		individual,

100	166		h. the identification of children under the age of
101	167		eighteen (18) of an at-risk individual or any child
102	168		under the age of twenty-six (26) whose permanent
103	169		residence is the home of the at -risk individual,

105	170		i. the full date of birt h,

107	171		j. a photograph of any vehicle that legibly displays the
108	172		license plate or a phot ograph of a residence tha t
109	173		legibly displays the address of the residence of an
110	174		at-risk individual,

122	208		4. The term "immediate family" means a spouse, child, or parent
123	209		of an at-risk individual or any other familial relative of an at -
124	210		risk individual whose permanen t residence is the same as the at-risk
125	211		individual;

127	212		5. The term "social media" means any online electronic medium
128	213		or a live chat system that:

130	214		a. primarily serves as a medium for users to interact
131	215		with content generated by other third-party users of
132	216		the medium,
133		-
134	217		b. enables users to create accounts or profiles specific
135	218		to the medium or to import profiles from another

138	220		c. enables one or more users to generate content that can
139	221		be viewed by other third-party users of the medium;
	222	+	6. The term "state agency" means:
	223	+	a. an executive agency, as defined by Oklahoma Statute,

151	254		7. The term "transfer" means to sell, license, trade, or
152	255		exchange for consideration the covered information of an at-risk
153	256		individual or immediate family.

155	257		SECTION 3. NEW LAW A new section of law to be codified
156	258		in the Oklahoma Statutes as Section 3013 of Title 20, unless there
157	259		is created a duplication in numbering, reads as follows:

159	260		A. Each at-risk individual may:
160		-
161	261		1. File written notice of the status of the individual as an
162	262		at-risk individual, for themselves and immediate family, with each
163	263		state agency that includes information necessary to ensure
164	264		compliance with this section, as determined by the Administrative
165	265		Director of the Courts; and
166		-
167	266		2. Request that each state agency described in Section 2 of
168	267		this act mark as private their covered information and that of their
169	268		immediate family.

171	269		B. State agencies shall not publicly post or publicly display
172	270		content that includes covered information of an at-risk individual
173	271		or immediate family. State agencies, upon receipt of a written
174	272		request under paragraph 1 of subsection A of this section, shall
175	273		remove the covered information of the at-risk individual or

179	302		C. Nothing in this section shall prohibit a state agency from
180	303		providing access to records containing the covered information of a

183	305		1. Possesses a signed release from the judge or a lawful court
184	306		order;

186	307		2. Is subject to the requirement s of Title V of the federal
187	308		Gramm-Leach-Bliley Act, 15 U.S.C., Section 6801 et seq.; or
188		-
189	309		3. Executes a confidentiality agreement with the state agency.

191	310		SECTION 4. NEW LAW A new section of law to be codified
192	311		in the Oklahoma Statutes as Section 3014 of Title 20, unless there
193	312		is created a duplication in numbe ring, reads as follows:

195	313		Upon written request of an at-risk individual, the
196	314		Administrative Director of the Courts is authorized to make any
197	315		notice or request required or authorized by this act on behalf of
198	316		the at-risk individual. The notice or request shal l include
199	317		information necessary to ensure compliance with this act. The
200	318		Director may delegate this authority to an appropriate state agency.
201	319		Any notice or request made under this act shall be deemed to have
202	320		been made by the at-risk individual and comply with the notice and
203	321		request requirements of this act.

205	322		In lieu of individual notices or requests, the Administrative
206	323		Director of the Courts, may provide state agencies, county and

208	351		associations with a list of at-risk individuals and their immediate
209	352		family that includes information necessary to ensure compliance with
210	353		this act, as determined by the Administrative Director of Courts for
211	354		the purpose of maintaining compliance with this act. Such list
212	355		shall be deemed to comply with individual notice and request
213	356		requirements of this act.

215	357		SECTION 5. NEW LAW A new section of law to be codified
216	358		in the Oklahoma Statutes as Section 3015 of Title 20, unless there
217	359		is created a duplication in numbering, reads as follows:
218		-
219	360		Not later than one (1) year after the date of enactment of this
220	361		act, and biennially thereafter, the Administrative Director of the
221	362		Courts shall submit to the Legislature an annual report that
222	363		includes:
223		-
224	364		1. A detailed amount spent by the state and local governments
225	365		on protecting judges' covered information;

227	366		2. Where the judges' covered information was found; and
228		-
229	367		3. The collection of any new types of personal data found to be
230	368		used to identify judg es who have received threats, including prior
231	369		home addresses, employers, and institutio nal affiliations such as
232	370		nonprofit boards.

234	371		SECTION 6. NEW LAW A new section of law to be codified
235	372		in the Oklahoma Statutes as Section 3016 of Title 20, unless there
236	373		is created a duplication in numbering, reads as follows:

238	400		A. Except as provided in subsection B of this section, no
239	401		person, business, or association shall publicly post or publicly
240	402		display on the Internet covered information of an at-risk individual
241	403		or immediate family if the at-risk individual has made a written
242	404		request to that person, business , or association to not disclose the
243	405		covered information of the at-risk individual or immediate family.

245	406		B. Subsection A of this section shall not apply to:

247	407		1. Covered information that the at -risk individual or immediate
248	408		family voluntarily publishes on the Internet after the date of
249	409		enactment of this act; or

251	410		2. Covered information lawfully received from a state
252	411		government source or from an employee or agent of the state
253	412		government.

255	413		C. After receiving a written request under this section, the
256	414		person, business, or association shall remove within seventy-two
257	415		(72) hours the covered information from the Internet and ensure that
258	416		the information is not made available on any publicly available
259	417		website controlled by that person, business, or association, and
260	418		ensure that the covered information of the at-risk individual or
261	419		immediate family is not made available on any publicly available
262	420		website controlled by that person, business, or associati on.

271	452		that is necessary to effe ctuate a request to the person, business,
272	453		or association from the at-risk individual.

274	454		SECTION 7. NEW LAW A new section of law to be codified
275	455		in the Oklahoma Statutes as Section 3017 of Title 20, unless there
276	456		is created a duplication in numbering, reads as follows:

278	457		A. An at-risk individual or their immediate family whose
279	458		covered information is made public as a result of a violation of
280	459		this act may bring an action seeking injunctive or declaratory
281	460		relief in any court of competent juris diction. If the court grants
282	461		injunctive or declaratory relief, the person, business, or
283	462		association responsible for the violation shall be required to pay
284	463		the costs and reasonable attorney fees of the at-risk individual or
285	464		immediate family, as applicable .

287	465		B. If a person, business, or association knowingly violates an
288	466		order granting injunctive or declaratory relief under subsection A
289	467		of this section, the court issuing such order may:

291	468		1. If the person, business, or association i s a government
292	469		agency:

294	470		a. impose a fine not greater than Four Thousand Dollars
295	471		($4,000.00), and

316	511		1. To prohibit, restrain, or limit the lawful investigation or
317	512		reporting by the press of any unlawful activity or misconduct
318	513		alleged to have been committed by an at-risk individual or their
319	514		immediate family;

321	515		2. To impair access to decisions and opinions from a member of
322	516		the State Judiciary in the course of carrying out their public
323	517		functions;

325	518		3. To limit the publication or transfer of co vered information
326	519		that the at-risk individual or their immediate family member
327	520		voluntarily publishes on the Internet after the date of enactment of
328	521		this act; or

341	556		If any provision of this act, an amendment made by this act, or
342	557		the application of such provision or amendment to any person or
343	558		circumstance is held to be unconstitutional, the remainder of this
344	559		act and the amendments made by this act and the application of t he
345	560		remaining provisions of this act and amendments to any person or
346	561		circumstance shall not be affected.
