101+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
48102 SECTION 1. NEW LAW A new section of law to be codified
49103 in the Oklahoma Statutes as Section 3011 of Title 20, unless there
50104 is created a duplication in numbering, reads as follows:

52105 This act shall be known and may be cited as the "Oklahoma
53106 Judicial Security and Privacy Act of 2023 ".
54-
55107 SECTION 2. NEW LAW A new section of law to be codified
56108 in the Oklahoma Statutes as Section 3012 of Title 20, unless there
57109 is created a duplication in numbering, reads as follows:

59110 As used in this act:
60-
61111 1. The term "at-risk individual" means any active or retired
62112 member of the State Judiciary, and shall also include municipal,
63113 county, tribal, and federal judges;
64-
65114 2. The term "commercial entity" means any corporation,
66115 partnership, limited partnership, proprietorship, sole
67116 proprietorship, firm, enterprise, fra nchise, or association engaged
68117 in the buying or selling of goods or services for profit;
69-
70118 3. The term "covered information" means:
71-
72119 a. a home address, including primary residence or
73120 secondary residences of an at-risk individual,
74-
75121 b. a home or personal mobile telephone number, or the
76122 direct telephone number of a government-issued cell
77123 phone or private extension in the chambers of an at-
78124 risk individual,

82152 d. the Social Security number, driver license number, or
83153 home address displayed on voter registration

86155 e. bank account or credit or debit card information of an

89157 f. the home or other address displayed on property tax
90158 records or held by a federal, state, or local
91-government agency of an at-risk individual, including ENR. H. B. NO. 2794 Page 3

92160 any secondary residence and any investment pro perty at
93161 which an at-risk individual resides for part of a
94162 year,

96163 g. a license plate number or home address displayed on
97164 vehicle registration information of an at-risk
98165 individual,

100166 h. the identification of children under the age of
101167 eighteen (18) of an at-risk individual or any child
102168 under the age of twenty-six (26) whose permanent
103169 residence is the home of the at -risk individual,

105170 i. the full date of birt h,

107171 j. a photograph of any vehicle that legibly displays the
108172 license plate or a phot ograph of a residence tha t
109173 legibly displays the address of the residence of an

113202 attended by immediate family of an at-risk individual,

115203 l. the name and address of an employer of imm ediate
116204 family of an at-risk individual, or

118205 m. the name and address of a place of worship the at-risk
119206 individual or immediate family of an at -risk
120207 individual attends;

122208 4. The term "immediate family" means a spouse, child, or parent
123209 of an at-risk individual or any other familial relative of an at -
124210 risk individual whose permanen t residence is the same as the at-risk
125211 individual;

127212 5. The term "social media" means any online electronic medium
128213 or a live chat system that:

130214 a. primarily serves as a medium for users to interact
131215 with content generated by other third-party users of
132216 the medium,

134217 b. enables users to create accounts or profiles specific
135218 to the medium or to import profiles from another

138220 c. enables one or more users to generate content that can
139221 be viewed by other third-party users of the medium;
222+6. The term "state agency" means:
223+a. an executive agency, as defined by Oklahoma Statute,

145250 b. any county, local or municipal governing body, or

148252 c. any state agency in the judicial branch or legislative
149253 branch; and

151254 7. The term "transfer" means to sell, license, trade, or
152255 exchange for consideration the covered information of an at-risk
153256 individual or immediate family.

155257 SECTION 3. NEW LAW A new section of law to be codified
156258 in the Oklahoma Statutes as Section 3013 of Title 20, unless there
157259 is created a duplication in numbering, reads as follows:

159260 A. Each at-risk individual may:
160-
161261 1. File written notice of the status of the individual as an
162262 at-risk individual, for themselves and immediate family, with each
163263 state agency that includes information necessary to ensure
164264 compliance with this section, as determined by the Administrative
165265 Director of the Courts; and
166-
167266 2. Request that each state agency described in Section 2 of
168267 this act mark as private their covered information and that of their
169268 immediate family.

171269 B. State agencies shall not publicly post or publicly display
172270 content that includes covered information of an at-risk individual
173271 or immediate family. State agencies, upon receipt of a written
174272 request under paragraph 1 of subsection A of this section, shall
175273 remove the covered information of the at-risk individual or

177301 seventy-two (72) hours after such receipt.

179302 C. Nothing in this section shall prohibit a state agency from
180303 providing access to records containing the covered information of a
181-member of the judiciary to a third party if the third party: ENR. H. B. NO. 2794 Page 5

304+member of the judiciary to a third party if the third party:
183305 1. Possesses a signed release from the judge or a lawful court
184306 order;

186307 2. Is subject to the requirement s of Title V of the federal
187308 Gramm-Leach-Bliley Act, 15 U.S.C., Section 6801 et seq.; or
188-
189309 3. Executes a confidentiality agreement with the state agency.

191310 SECTION 4. NEW LAW A new section of law to be codified
192311 in the Oklahoma Statutes as Section 3014 of Title 20, unless there
193312 is created a duplication in numbe ring, reads as follows:

195313 Upon written request of an at-risk individual, the
196314 Administrative Director of the Courts is authorized to make any
197315 notice or request required or authorized by this act on behalf of
198316 the at-risk individual. The notice or request shal l include
199317 information necessary to ensure compliance with this act. The
200318 Director may delegate this authority to an appropriate state agency.
201319 Any notice or request made under this act shall be deemed to have
202320 been made by the at-risk individual and comply with the notice and
203321 request requirements of this act.

205322 In lieu of individual notices or requests, the Administrative
206323 Director of the Courts, may provide state agencies, county and

207350 municipal governments, commercial entity, persons, businesses, or
208351 associations with a list of at-risk individuals and their immediate
209352 family that includes information necessary to ensure compliance with
210353 this act, as determined by the Administrative Director of Courts for
211354 the purpose of maintaining compliance with this act. Such list
212355 shall be deemed to comply with individual notice and request
213356 requirements of this act.

215357 SECTION 5. NEW LAW A new section of law to be codified
216358 in the Oklahoma Statutes as Section 3015 of Title 20, unless there
217359 is created a duplication in numbering, reads as follows:

219360 Not later than one (1) year after the date of enactment of this
220361 act, and biennially thereafter, the Administrative Director of the
221362 Courts shall submit to the Legislature an annual report that
222363 includes:
223-
224364 1. A detailed amount spent by the state and local governments
225365 on protecting judges' covered information;

227366 2. Where the judges' covered information was found; and

229367 3. The collection of any new types of personal data found to be
230368 used to identify judg es who have received threats, including prior
231369 home addresses, employers, and institutio nal affiliations such as
232370 nonprofit boards.

234371 SECTION 6. NEW LAW A new section of law to be codified
235372 in the Oklahoma Statutes as Section 3016 of Title 20, unless there
236373 is created a duplication in numbering, reads as follows:

238400 A. Except as provided in subsection B of this section, no
239401 person, business, or association shall publicly post or publicly
240402 display on the Internet covered information of an at-risk individual
241403 or immediate family if the at-risk individual has made a written
242404 request to that person, business , or association to not disclose the
243405 covered information of the at-risk individual or immediate family.

245406 B. Subsection A of this section shall not apply to:
246-
247407 1. Covered information that the at -risk individual or immediate
248408 family voluntarily publishes on the Internet after the date of
249409 enactment of this act; or
250-
251410 2. Covered information lawfully received from a state
252411 government source or from an employee or agent of the state
253412 government.

255413 C. After receiving a written request under this section, the
256414 person, business, or association shall remove within seventy-two
257415 (72) hours the covered information from the Internet and ensure that
258416 the information is not made available on any publicly available
259417 website controlled by that person, business, or association, and
260418 ensure that the covered information of the at-risk individual or
261419 immediate family is not made available on any publicly available
262420 website controlled by that person, business, or associati on.

267449 family voluntarily publishes on the Internet after the date of
268450 enactment of this act; or

271452 that is necessary to effe ctuate a request to the person, business,
272453 or association from the at-risk individual.

274454 SECTION 7. NEW LAW A new section of law to be codified
275455 in the Oklahoma Statutes as Section 3017 of Title 20, unless there
276456 is created a duplication in numbering, reads as follows:

278457 A. An at-risk individual or their immediate family whose
279458 covered information is made public as a result of a violation of
280459 this act may bring an action seeking injunctive or declaratory
281460 relief in any court of competent juris diction. If the court grants
282461 injunctive or declaratory relief, the person, business, or
283462 association responsible for the violation shall be required to pay
284463 the costs and reasonable attorney fees of the at-risk individual or
285464 immediate family, as applicable .

287465 B. If a person, business, or association knowingly violates an
288466 order granting injunctive or declaratory relief under subsection A
289467 of this section, the court issuing such order may:

291468 1. If the person, business, or association i s a government
292469 agency:

294470 a. impose a fine not greater than Four Thousand Dollars
295471 ($4,000.00), and

302502 agency, award to the at-risk individual or their immediate family,

305504 a. an amount equal to the actual damages sustained by the
306505 at-risk individual or their immediate family, and

308506 b. court costs and reasonable attorney fees.

310507 SECTION 8. NEW LAW A new section of law to be codified
311508 in the Oklahoma Statutes as Section 3018 of Title 20, unless there
312509 is created a duplication in numbering, reads as follows:

510+A. Nothing in this act shall be construed:
316511 1. To prohibit, restrain, or limit the lawful investigation or
317512 reporting by the press of any unlawful activity or misconduct
318513 alleged to have been committed by an at-risk individual or their
319514 immediate family;

321515 2. To impair access to decisions and opinions from a member of
322516 the State Judiciary in the course of carrying out their public
323517 functions;

325518 3. To limit the publication or transfer of co vered information
326519 that the at-risk individual or their immediate family member
327520 voluntarily publishes on the Internet after the date of enactment of
328521 this act; or

330548 4. To prohibit information sharing by a commercial entity to a
331549 federal, state, tribal, or local government, or any unit thereof.

333550 B. This act shall be broadly construed to favor the protection
334551 of the covered information of at-risk individuals and their
335552 immediate family.

337553 SECTION 9. NEW LAW A new section of law to be codified
338554 in the Oklahoma Statutes as Section 3019 of Title 20, unless there
339555 is created a duplication in numbering, reads as follows:

341556 If any provision of this act, an amendment made by this act, or
342557 the application of such provision or amendment to any person or
343558 circumstance is held to be unconstitutional, the remainder of this
344559 act and the amendments made by this act and the application of t he
345560 remaining provisions of this act and amendments to any person or
346561 circumstance shall not be affected.
562+SECTION 10. This act shall become effective November 1, 2023.
