2451 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2652 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -1001, is
2753 amended to read as follows:

2954 Section 2-1001. A. There is hereby created until Ju ly 1, 2023
3055 2025, in accordance with the Oklahoma Sunset Law, the Opioid
3156 Overdose Fatality Review Board within the D epartment of Mental
3257 Health and Substance Abuse Services. The Board shall have the powe r
3358 and duty to:

3559 1. Coordinate and integrate state and local efforts to address
3660 overdose deaths and create a body of information to prevent overdose

3989 2. Conduct case reviews of deaths of persons eigh teen (18)
4090 years of age or older due to licit or il licit opioid use in this

4996 5. Improve policies, pro cedures and practices within the
5097 agencies in order to prevent fatal opioid overdoses and to serve
5198 victims of unintentional overdose; and

5399 6. Enter into agreements with other state, local or private
54100 entities as necessary to carry out the duties of the Opioi d Overdose
55101 Fatality Review Board, including but no t limited to, conducting
56102 joint reviews with the Child Death Review Board on unintentional
57103 overdose cases involving child death and child near -death incidents.

59104 B. In carrying out its duties and responsibili ties, the Board

62106 1. Promulgate rules establ ishing criteria for identifying cases
63107 involving an opioid overdose death subject to specific, in-depth
64108 review by the Board;

66109 2. Conduct a specific case review of those c ases where the
67110 cause of death is or m ay be related to overdose of opioid drugs;

74142 regarding opioid overdose deaths from la w enforcement agencies;

77144 systems and law enforcement systems and other overdose protection
78145 and prevention systems, and make specific recommendatio ns to those
79146 entities for actions necessary for the improvement of the system;

118197 Confidential information provided to the Board shall be mainta ined
119198 by the Board in a confidential manner as otherwis e required by state
120199 and federal law. Any person damaged by disclosure of such
121200 confidential information by the Boar d or its members which is not
122201 authorized by law may maintain an action for damages, cos ts and
123202 attorney fees pursuant to The Governmental Tort Claims Act;

125203 7. Maintain all confidential information, documents and records
126204 in possession of the Board as confide ntial and not subject to
127205 subpoena or discovery in any civil or criminal proceedings; pr ovided
128206 however, information, documents and records oth erwise available from
129207 other sources shall not be exempt from subpoena or discovery through
130208 those sources solely bec ause such information, documents and records
131209 were presented to or reviewed by the Board ;

133210 8. Conduct reviews of specific cases of opioid over dose deaths
134211 and request the preparation of additional information and reports as

137241 contact and second-opinion autopsies;

139242 9. Report, if recommended by a majority vote of the Board, to
140243 the Governor, the President Pro Tempore of the Senate and the
141244 Speaker of the House of Represen tatives any information and guidance
142245 regarding the prevention and protection system to advise on changin g
143246 trends in overdose rates, substances, methods or any other factor
144247 impacting overdose deaths, including any system ic issue within the
145248 medical, law enforcement or other relevant systems discovered by th e
146249 Board while performing its duties; and

148250 10. Exercise all incidental powers necessary and proper for the
149251 implementation and administration of the Opioid Overdose Fatali ty
150252 Review Board.

152253 C. The review and d iscussion of individual cases of an opioid
153254 overdose death shall be conducted in executive session. All other
154255 business shall be conducted in accordance with the provisions of the
155256 Oklahoma Open Meeting Act. All discussi ons of individual cases and
156257 any writings produced by or created for the Board in the co urse of
157258 determining a remedial measure to be recommend ed by the Board, as
158259 the result of a review of an individual case of an opioid overdose
159260 death, shall be privileged a nd shall not be admissible in evidenc e
160261 in any proceeding. The Board shall periodically conduct meetings to
161262 discuss organization and business matters and any actions or
162263 recommendations aimed at improvement of the medical system or law

163291 enforcement system wh ich shall be subject to the Oklahoma Open
164292 Meeting Act. Part of any meeting of the Boar d may be specifically
165293 designated as a business meeting of the Board subject to the
166294 Oklahoma Open Meeting Act.

168295 D. The Board shall submit an annual statistical report on the
169296 incidence and causes of opioid ov erdose deaths in this state for
170297 which the Board has completed its review during the past calendar
171298 year including its recommendations, if any, to the medical and law
172299 enforcement system. The Board shall also prepare and make available
173300 to the public, on an a nnual basis, a report containing a summary of
174301 the activities of the Board relating to the review of opio id
175302 overdose deaths, the extent to which the state medical and law
176303 enforcement system is coordinated and an evaluati on of whether the
177304 state is efficiently discharging its responsibilities to prevent
178305 opioid overdose deaths. The report shall be completed no later than
179306 February 1 of the subsequent year.
