5354 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5455 SECTION 1. NEW LAW A new section of law to be codified
5556 in the Oklahoma Statu tes as Section 1210.198 of Title 70, unless
5657 there is created a duplication in numbering, reads as follows:
5758 A. The State Board of Education shall award grants subject to
5859 the availability of funds, to public school district s for the
5960 purpose of employing school nurses, school counselors, and mental
6061 health professionals to provide services and support to students.
6162 B. The grants shall be awarded to public school districts
6263 annually based upon the following conditions:

9090 1. The districts shall provide half of the funding for the
9191 grants and the State Board of Education shal l provide the other half
9292 of the grant funding;
9393 2. School nurses, school counselors, and mental health
9494 professionals employed through the grant program shall com plete a
9595 training program prescribe d by the State Department of Education;
9696 3. School nurses, school counselors, and mental health
9797 professionals may be employed by a district on a full -time or part-
9898 time basis, or may be employed on a contract basis with a private,
9999 third-party provider; and
100100 4. School nurses, school counselors, and mental health
101101 professionals employed through the grant program shall spend a
102102 minimum amount of time on their respective nursing and counseling
103103 duties as required by the State Depa rtment of Education.
104104 C. As used in this section:
105105 1. "Mental health professio nals" means:
106106 a. licensed professional counselors (LPCs),
107107 b. licensed alcohol and drug counselors (LADCs) ,
108108 c. school psychologists,
109109 d. licensed marriage and family t herapists (LMFTs),
110110 e. licensed clinical social w orkers (LCSWs), or
111111 f. licensed recreational therapists (CTRS/ L);

139138 2. "School counselor" means a person certified as a school
140139 counselor by the State Board of Education who provides student
141140 support counseling, academic counseling, or both; and
142141 3. "School nurse" shall have the same meaning a s defined in
143142 paragraph 7 of Section 1-116 of Title 70 of the Oklahoma Statutes.
144143 D. The State Board of Education may promulgate rules to
145144 implement the provisions of this section.
146145 SECTION 2. This act shall become effective July 1, 2023.
147146 SECTION 3. It being immediately necessary for the preservation
148147 of the public peace, health or safety, an emergency is hereby
149148 declared to exist, by reason whereof thi s act shall take effect and
150149 be in full force from and after its passage and approval.
