53	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	55		SECTION 1. NEW LAW A new section of law to be codified
55	56		in the Oklahoma Statu tes as Section 1210.198 of Title 70, unless
56	57		there is created a duplication in numbering, reads as follows:
57	58		A. The State Board of Education shall award grants subject to
58	59		the availability of funds, to public school district s for the
59	60		purpose of employing school nurses, school counselors, and mental
60	61		health professionals to provide services and support to students.
61	62		B. The grants shall be awarded to public school districts
62	63		annually based upon the following conditions:

90	90		1. The districts shall provide half of the funding for the
91	91		grants and the State Board of Education shal l provide the other half
92	92		of the grant funding;
93	93		2. School nurses, school counselors, and mental health
94	94		professionals employed through the grant program shall com plete a
95	95		training program prescribe d by the State Department of Education;
96	96		3. School nurses, school counselors, and mental health
97	97		professionals may be employed by a district on a full -time or part-
98	98		time basis, or may be employed on a contract basis with a private,
99	99		third-party provider; and
100	100		4. School nurses, school counselors, and mental health
101	101		professionals employed through the grant program shall spend a
102	102		minimum amount of time on their respective nursing and counseling
103	103		duties as required by the State Depa rtment of Education.
104	104		C. As used in this section:
105	105		1. "Mental health professio nals" means:
106	106		a. licensed professional counselors (LPCs),
107	107		b. licensed alcohol and drug counselors (LADCs) ,
108	108		c. school psychologists,
109	109		d. licensed marriage and family t herapists (LMFTs),
110	110		e. licensed clinical social w orkers (LCSWs), or
111	111		f. licensed recreational therapists (CTRS/ L);

139	138		2. "School counselor" means a person certified as a school
140	139		counselor by the State Board of Education who provides student
141	140		support counseling, academic counseling, or both; and
142	141		3. "School nurse" shall have the same meaning a s defined in
143	142		paragraph 7 of Section 1-116 of Title 70 of the Oklahoma Statutes.
144	143		D. The State Board of Education may promulgate rules to
145	144		implement the provisions of this section.
146	145		SECTION 2. This act shall become effective July 1, 2023.
147	146		SECTION 3. It being immediately necessary for the preservation
148	147		of the public peace, health or safety, an emergency is hereby
149	148		declared to exist, by reason whereof thi s act shall take effect and
150	149		be in full force from and after its passage and approval.
