56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -204.2, is
58	58	amended to read as follows:
59	59	Section 6-204.2 A. The Oklahoma Commission for Teacher
60	60	Preparation Educational Quality and Accoun tability and the State
61	61	Board of Education are authori zed to establish the Educati on
62	62	Leadership Oklahoma program.
63	63	B. The purposes of the Education Leadership O klahoma program
64	64	are to:

92	92	National Board certification and the Education Leadership Oklahoma
93	93	program services;
94	94	2. Provide technical assistance and National -Board-certified
95	95	mentors to all teachers s eeking National Board certification upon
96	96	request;
97	97	3. Reward teachers who are seeking National Board certification
98	98	by awarding them a portion of the a pplication processing charge and
99	99	assessment fee and a scholarship as provided in subsection D of this
100	100	section; and
101	101	4. Provide recognition to National -Board-certified teachers.
102	102	C. To fulfill the objectives of the Education Leadership
103	103	Oklahoma Act, the Oklahoma Commission for Teacher Preparation
104	104	Educational Quality and Accoun tability shall:
105	105	1. Inform teachers of the Education Leadership Oklahoma pro gram
106	106	and services it provides to teachers seeking National Board
107	107	certification, emphasizing recruiting effort s toward teachers at
108	108	high-poverty schools, schools identified as in need of improvement
109	109	and in counties with the lowest percentage of teachers who have
110	110	achieved National Board certification; and
111	111	2. Ensure that all teachers seeking National Board
112	112	certification receive adequate inform ation regarding the level of
113	113	commitment required to acquire National Board certification.

140	140	D. The Commission shall sele ct not more than one hundred
141	141	applicants to participate in the program each fiscal year for whom
142	142	the Commission shall pay one-half (1/2) of the application
143	143	processing charge and assessment fee for National Board
144	144	certification. The total amount paid by the Commission shall not
145	145	exceed One Thousand Three Hundred Dollars ($1,300.00) per applicant.
146	146	In addition the Commission shall also provide to the selected
147	147	applicants a scholarship in the amount of Five Hundred Dollars
148	148	($500.00) to cover other expenses associated with obta ining National
149	149	Board certification.
150	150	E. The Commission shall promulgate rules establishing a pr ocess
151	151	for accepting applications for the Education Leadership Oklahoma
152	152	program and for providing to applicants selected for the program up -
153	153	front payment of the a pplication processing charge and assessment
154	154	fee and scholarship. If a selected applicant who r eceives the up-
155	155	front payment does not complete National Board certification within
156	156	three (3) years, the applicant shall repay the Commission the full
157	157	amount paid by the Commission pursuant to subsection D of this
158	158	section. All selected applicants who do no t receive an up-front
159	159	payment and successfully complete National Board certification shall
160	160	be reimbursed by the Commission for the application processing
161	161	charge and assessment fee. The total amount of reimbursement paid
162	162	by the Commission shall not exceed One Thousand Three Hundred
163	163	Dollars ($1,300.00) per applicant.

190	190	F. It is the intent of the Legislature that the Oklahoma
191	191	Commission for Teacher Preparation Educational Quality and
192	192	Accountability contract with Southe astern Oklahoma State University
193	193	to establish Education Leadership Okl ahoma program training in
194	194	higher education teacher preparation programs in the state to assist
195	195	teachers in meeting the requirements to obtain National Board
196	196	certification.
197	197	G. All teachers seeking National Board certification sh all be
198	198	eligible to participa te in Education Leadership Oklahoma program
199	199	training to assist them in meeting the requirements of the National
200	200	Board certification process, free of charge.
201	201	H. Subject to district board of education policy or collective
202	202	bargaining agreement, additional pr ofessional leave days may be
203	203	granted to teachers seeking National Board certification for
204	204	National Board certification portfolio development. During the two
205	205	(2) days of the additional p rofessional days granted to teachers for
206	206	National Board certification portfolio development, a substitute
207	207	teacher shall be provided by the school district at no cost to the
208	208	teacher.
209	209	I. 1. The State Board of Education shall provide to teachers
210	210	who attained National Board certification prior to Ju ne 30, 2013, a
211	211	bonus in the amount of Five Thousand Dollars ($5,000.00) annually
212	212	over a ten-year period, to be paid no later than January 31 each
213	213	year. The Beginning July 1, 2023, the Board shall provide a bonus

241	241	five-year period, to be paid not later than January 31 each year to

243	243	a. attains National Board certification after June 30,
244	244	2013, if the teacher was selected for the Education
245	245	Leadership Oklahoma program before June 30, 2013, or
246	246	the teacher has submitted an application for National
247	247	Board certification to the National Board for
248	248	Professional Teaching Standards before June 30, 2013
249	249	July 1, 2023,
250	250	b. attained National Board cert ification before July 1,
251	251	2023, and was receiving a bonus in the amount of Five
252	252	Thousand Dollars ($5,000.00) annually, for the
253	253	remaining time of the ten-year period, or
254	254	c. attained National Board certification before July 1,
255	255	2023, and was receiving an additional salary increment
256	256	pursuant to the Minimum Salary Schedule in Section 18-
257	257	114.14 of this title, for the remaining time of the
258	258	ten-year period.
259	259	2. The teachers eligible to receive the annual bonus as
260	260	provided for in paragraph 1 of this subsection shall receive the
261	261	annual bonus for the ten-year five-year duration of their Nat ional
262	262	Board certification or for the remaining duration of their National
263	263	Board certification if they attained National Board certification

291	291	their certification and so long as they are teaching in the
292	292	classroom full-time in an Oklahoma public school. No school or
293	293	school district shall be liable for payment of bonuses pursuant to
294	294	this section.
295	295	3. The bonus shall not be included in the calculation of the
296	296	teacher's salary for purposes of meeting the district or statutory
297	297	minimum salary schedule Minimum Salary Schedule or for purposes of
298	298	compensating Oklahoma Teachers ' Retirement System contributions or
299	299	benefits.
300	300	4. Teachers eligible to receive the annual bonus as p rovided
301	301	for in paragraph 1 o f this subsection shall not be eligible to
302	302	receive the additional salary increment for National Board
303	303	certification as set forth in the minimum salary schedule in Section
304	304	3 of this act.
305	305	5. Teachers who attain National Board cer tification after June
306	306	30, 2013, shall be eligible to receive the additional salary
307	307	increments for National Board certification as set forth in the
308	308	minimum salary schedule in Section 3 of this act.
309	309	6. The State Board of Education shall promulgate rules for a
310	310	process by which a Nation al-Board-certified teacher will verify
311	311	that:
312	312	a. the National Board certification has not lapsed,
313	313	b. the teacher is still a full -time teacher, and

341	341	not exceeded the limit of annual bonus payments as
342	342	provided for in paragraph 1 of this subsection.
343	343	J. It is the intent of the Legislature that the Oklahoma State
344	344	Regents for Higher Education incorporate the National Board
345	345	certification portfolio development into all programs in ed ucation
346	346	leading to a master's level degree.
347	347	SECTION 2. AMENDATORY 70 O.S. 2021, Section 18 -114.14,
348	348	is amended to read as follows:
349	349	Section 18-114.14 A. Beginning with the 2018-2019 2023-2024
350	350	school year, certified personnel, as d efined in Section 26 -103 of
351	351	this title, in the public schools of Oklahoma shall r eceive in
352	352	salary and/or fringe benefits not less than the amounts specified in
353	353	the following schedule:

491	491	B. 1. When determining the Minimum Salary Schedule, "fringe
492	492	benefits" shall mean all or part of retirement benefits, exc luding
493	493	the contributions made pursuant to subsection A of Section 17 -108.1

495	495	26-105 of this title from the flexible benefit allowan ce funds
496	496	disbursed by the State Board of Education and the State Board of
497	497	Career and Technology Education pursuant to Section 26 -104 of this

499	499	2. If a school district in tends to provide retirement benefits
500	500	to a teacher such that the teacher 's salary would be less than the
501	501	amounts set forth in the minimum salary schedule Minimum Salary
502	502	Schedule specified in subsection A of this section, the district
503	503	shall be required to pr ovide written notification t o the teacher
504	504	prior to his or her employment or, if a lready employed by the
505	505	district, no later than thirty (30) days prior to the date the
506	506	district elects to provide retirement benefits such that the
507	507	teacher's salary would be le ss than the minimum salary schedule
508	508	Minimum Salary Schedule.
509	509	C. Any of the degre es referred to in this section shall be from
510	510	a college recognized by the State Board of Education. The Bo ard
511	511	shall accept teaching experience from out -of-state school distric ts
512	512	that are accredited by th e state board of education or appropriate
513	513	state accrediting agency for the districts. The Board shall accept

541	541	or otherwise endorsed by the appropriate national or regional
542	542	accrediting or endorsement authority. Out -of-country certification
543	543	documentation in a language other than English shall be analyzed by
544	544	an educational credential evaluation se rvice in accordance with
545	545	industry standards and guidelines and approv ed by the State
546	546	Department of Education. The person seeking to have credit grant ed
547	547	for out-of-country teaching experience shall be responsible for all
548	548	costs of the analysis by a credenti al evaluation service. The Board
549	549	shall accept teaching experience fr om primary and secondary sch ools
550	550	that are operated by the United States Departmen t of Defense or are
551	551	affiliated with the United States Department of State.
552	552	D. For the purpose of state sa lary increments and retirement,
553	553	no teacher shall be granted credit fo r more than five (5) years o f
554	554	active duty in the military service or out -of-state or out-of-
555	555	country teaching experience as a certified teacher or its
556	556	equivalent. Nothing in this section shall prohibit boards of
557	557	education from crediting more years of exper ience on district salary
558	558	schedules than those allowed for state purposes.
559	559	E. The State Board of Education shall recognize, for purposes
560	560	of certification and salary increments, all the ye ars of experience
561	561	of a:
562	562	1. Certified teacher who teaches in the educ ational program of
563	563	the Department of Corrections, beginning with fiscal year 1981 ;

591	591	Human Services if the counselor was empl oyed as a certified teacher
592	592	by the State Department of Education when the Division of Vocational
593	593	Rehabilitation was transferred from the State Board o f Career and
594	594	Technology Education or the State Board of Education to the Oklahoma
595	595	Public Welfare Commissio n on July 1, 1968;
596	596	3. Vocational rehabilitation counselor which were completed
597	597	while employed by the Department of Human Services if such counselor
598	598	was certified as a teacher or was eligible for certification as a
599	599	teacher in Oklahoma;
600	600	4. Certified teache r which were completed while employed by the
601	601	Child Study Center locat ed at University Hospital, i f the teacher
602	602	was certified as a teacher in Oklahoma; and
603	603	5. Certified school psychologist or psychometrist which were
604	604	completed while employed as a doctoral intern, psychological
605	605	assistant, or psychologist with any agency of t he State of Oklahoma
606	606	if the experience primarily involved work with persons of sc hool- or
607	607	preschool-age and if the person was, at the time the experience was
608	608	acquired, certified as, or el igible for certification as, a school
609	609	psychologist or psychometrist.
610	610	F. The provisions of this s ection shall not apply to teachers
611	611	who have entered into postretirement employment with a public school
612	612	in Oklahoma and are still receiving a monthly retiremen t benefit.

639	639	G. If a person employed as certified personnel, as define d in
640	640	Section 26-103 of this title, by a school district during the 2017 -
641	641	2018 school year was receiving a salary above the step level
642	642	indicated by the State state Minimum Salary Schedule for the 2017-
643	643	2018 school year, the person shall receive a salary incre ase amount
644	644	equal to the amount indicated in subsection A of this section for
645	645	the step level indicated for the person, provided they remain
646	646	employed by the same district, unless the hours or the duties of the
647	647	certified personnel are reduced proportionately.
648	648	SECTION 3. This act shall become effective July 1, 2023.
649	649	SECTION 4. It being immediately necessary for the preservation
650	650	of the public peace, health or safety, an emergency is hereby
651	651	declared to exist, by reason whereof th is act shall take effect and
652	652	be in full force from and after its passage and approval.
