2249 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:

2450 SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
2551 amended by Section 1, Chapter 347, O.S.L. 2022 (29 O.S. Supp. 2022,
2652 Section 4-112), is amended to read as follows:

2853 Section 4-112. A. Except as otherwise provided for in the
2954 Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
3055 Act, no person may hunt , pursue, trap, harass, catch, kill, take or
3156 attempt to take in any manner, use, have in possession, sell, or
3257 transport all or any portion of any wildlife except fish, without
3358 having first procure d a license from the Department of Wildlife
3459 Conservation. The Wildlife Conservation Commission shall designate
3560 a consecutive Saturday and Sunday in September of each year as free
3661 hunting days in which residents of this state may hunt without first

4091 B. The following legal residents of Oklahoma shall be exempt
4192 from the annual hunting license requirement of paragraph 1 of
4293 subsection F of this section and the following nonresidents shall b e
4394 exempt from the annual nonresident hunting licenses requir ed
4495 pursuant to paragraphs 1 and 2 of subsection C of this section:

68138 8. Any legal resident or nonresident under eighteen (18) years
69139 of age who is in the physical custody of a child care facility as
70140 defined by Section 402 of Title 10 of the Oklahoma Statutes; and

74143 take in any manner any species of rattlesnake during an organized
75144 rattlesnake-hunting event or festival and who has a rattlesnake

78146 C. Except as otherwise provided for in the Oklahoma Wildlife
79147 Conservation Code, the nonr esident hunting licenses issued pursuant
80148 to this section and the fe e for each license shall be:

82149 1. Annual hunting license for nonresidents hunting game other
83150 than deer, antelope, elk or bear which expires on December 31 of the
84151 year purchased – One Hundred Forty-one Dollars ($141.00).
85152 Nonresidents hunting big game, combi nation big game and upland game
86153 or exotic wildlife in a comm ercial hunting area shall be required to
87154 have this license;

89155 2. Annual hunting license for nonresidents hunting game other
90156 than deer, antelope, elk or bear which expires on June 30 of the

187342 of the licenses issued d uring the most recent respective deer
188343 hunting seasons compared to previous years a nd whether the deer
189344 hunting license structure i s beneficial to the Department.

191345 E. Of the fees collected pursuant t o the provisions of
192346 subsection C of this section:

194347 1. Five Dollars ($5.00) of the license fee of each license
195348 issued pursuant to paragraphs 1 through 7 of subsection C of this
196349 section and Two Dollars and fifty cents ($2.50) of the license fee
197350 for each license issued pursuant to paragraph 8 of subsection C of
198351 this section shall be deposited in the Wildlife Land Acquisition
199352 Fund created pursuant to the provisions of Section 4 -132 of this

311546 G. Residents hunting big game, combination big game and upland
312547 game or exotic wildlife in a commercial hunting area shall be
313548 required to have one of the following license s:
314549 1. An annual hunting license issued pursuant to paragraph 1, 2,
315550 3 or 4 of subsection F of this section;

317551 2. An annual hunting and fishing combination license issued
318552 pursuant to Section 4-113 of this title;

320553 3. A five-year hunting license or five-year combination hunting
321554 and fishing license issued pursuant to Section 4 -113.1 of this

324556 4. A lifetime hunting license or lifetime combination hunting
325557 and fishing license issued pursuant to Section 4 -114 of this title.

327558 H. Of the fees collected pursuan t to the provisions of
328559 paragraphs 1 and 2 of subsection F of this section, Five Dollars
329560 ($5.00) of the license fee shall be for the Oklahoma Wildlife Land
330561 Stamp and shall be deposited in the Oklahoma Wildlife Land Fund
331562 created pursuant to the provisions of Section 4-141 of this title.

333563 I. The provisions of this section shall not be construed to
334564 require a hunting license, resident or nonresident, of any person
335565 merely because the person participates, as owner or handler of an
336566 entry, as an official, or as a sp ectator in the conduct of a field
337567 trial or performance test of dogs, whether a resident or no nresident

338595 of the State of Oklahoma. No license to hunt shall be req uired of
339596 any person engaged in training or working dogs, pr ovided that person
340597 is in no way engaged in hunting and does not take or attempt to take
341598 in any manner any game.

343599 J. 1. Any person arrested for hunting game other than deer,
344600 antelope, elk, bear or turkey without a valid hunting license as
345601 required by the provisions of subsection A of this se ction may
346602 purchase a substitute temporary thirty -day license from the
347603 arresting game warden i n lieu of posting bond. Proof of hunter
348604 safety certification will n ot be required for the temporary
349605 substitute license. The f ee for a substitute license purchase d
350606 pursuant to the provisions of this subsection shall be:
351-
352607 a. for legal residents, Fifty Dolla rs ($50.00), and
353-
354608 b. for nonresidents, One Hundred Forty -five Dollars
355609 ($145.00).

358610 2. Except as otherwise provided for by this su bsection, the
359611 fees from licenses pur chased pursuant to the provisions of this
360-subsection shall be deposited in the Wildlife Conse rvation Fund to ENR. H. B. NO. 2868 Page 9
612+subsection shall be deposited in the Wildlife Conse rvation Fund to
361613 be used exclusively for developing, managing, preser ving, and
362614 protecting wildlife and wildlife habitat.

364615 K. Any person producing proof in court tha t a current hunting
365616 license issued by the Department of Wildlife Conservation to that
366617 person was in force at the time of the alleged offense shall be
367618 entitled to dismissal of a charge of violating this section upon

368646 payment of court costs. If proof of a cu rrent hunting license
369647 issued by the Department to the person that was in force at the time
370648 of the alleged offense is presented to the court or district
371649 attorney within seventy-two (72) hours after the violation, the
372650 charge shall be dismissed without paymen t of court costs.

374651 L. Unless a substitute license is purchased as provided for by
375652 subsection J of this section, any resident convicted of violating
376653 the provisions of this section shall be punished by the imposition
377654 of a fine of not less than Twenty-five Dollars ($25.00) nor more
378655 than Two Hundred Dollars ($200.00), or by imprisonment in the county
379656 jail for a period not to exceed thirty (30) days, or by both.

381657 M. Unless a substitute license is purchased as provided for by
382658 subsection J of this section, any non resident convicted of violating
383659 the provisions of this section shall be punished by the impos ition
384660 of a fine of not less than Two Hundred Dollars ($200.00) nor m ore
385661 than Five Hundred Dollars ($500.00), or by imprisonment in the
386662 county jail for a period not to exceed six (6) months, or by both .

388663 SECTION 2. This act shall become effe ctive November 1, 2023.
