22	49		BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:

24	50		SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
25	51		amended by Section 1, Chapter 347, O.S.L. 2022 (29 O.S. Supp. 2022,
26	52		Section 4-112), is amended to read as follows:

28	53		Section 4-112. A. Except as otherwise provided for in the
29	54		Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
30	55		Act, no person may hunt , pursue, trap, harass, catch, kill, take or
31	56		attempt to take in any manner, use, have in possession, sell, or
32	57		transport all or any portion of any wildlife except fish, without
33	58		having first procure d a license from the Department of Wildlife
34	59		Conservation. The Wildlife Conservation Commission shall designate
35	60		a consecutive Saturday and Sunday in September of each year as free
36	61		hunting days in which residents of this state may hunt without first

40	91		B. The following legal residents of Oklahoma shall be exempt
41	92		from the annual hunting license requirement of paragraph 1 of
42	93		subsection F of this section and the following nonresidents shall b e
43	94		exempt from the annual nonresident hunting licenses requir ed
44	95		pursuant to paragraphs 1 and 2 of subsection C of this section:

	96	+	1. Legal residents under sixteen (16) years of age;
48	97		2. Legal residents sixty-five (65) years of age or older
49	98		provided they have obtained a senior citizen lifetime hunting or
50	99		combination hunting and fishing license pursuant to the provisions
51	100		of Section 4-114 of this title;

53	101		3. Legal residents born on or before Janua ry 1, 1923;
54		-
55	102		4. Legal resident veterans having a disability of sixt y percent
56	103		(60%) or more;

58	104		5. Legal resident owners or tenant s who hunt on land owned or
59	105		leased by them;

61	106		6. Any nonresident under fourteen (14) years of age;
62		-
63	107		7. Legal residents having a pr oven disability which renders
64	108		them nonambulatory and confines them to a wheelchair, as certified
65	109		by a physician licensed in thi s state or in any state which borders
66	110		this state;

70	140		defined by Section 402 of Title 10 of the Oklahoma Statutes; and

73	142		trapping, harassing, catching, killing, taking, or attempting to
74	143		take in any manner any species of rattlesnake during an organized
75	144		rattlesnake-hunting event or festival and who has a rattlesnake
76	145		permit issued pursuant to Section 4-143 of this title.

78	146		C. Except as otherwise provided for in the Oklahoma Wildlife
79	147		Conservation Code, the nonr esident hunting licenses issued pursuant
80	148		to this section and the fe e for each license shall be:

82	149		1. Annual hunting license for nonresidents hunting game other
83	150		than deer, antelope, elk or bear which expires on December 31 of the
84	151		year purchased – One Hundred Forty-one Dollars ($141.00).
85	152		Nonresidents hunting big game, combi nation big game and upland game
86	153		or exotic wildlife in a comm ercial hunting area shall be required to
87	154		have this license;

89	155		2. Annual hunting license for nonresidents hunting game other
90	156		than deer, antelope, elk or bear which expires on June 30 of the

176	306		D. The Department of Wildl ife Conservation shall provide a
177	307		report to both the President Pro Tempore of the S enate and the
178	308		Speaker of the House of Represent atives by February 1 of 2019 and
179	309		2020 setting forth information rega rding licenses issued pursuant to
180	310		paragraphs 3, 4 and 5 of subsection C of this section, which shall

183	312		1. The number of licenses issued during the most recen t
184	313		respective deer hunting seasons; and

187	342		of the licenses issued d uring the most recent respective deer
188	343		hunting seasons compared to previous years a nd whether the deer
189	344		hunting license structure i s beneficial to the Department.

191	345		E. Of the fees collected pursuant t o the provisions of
192	346		subsection C of this section:
193		-
194	347		1. Five Dollars ($5.00) of the license fee of each license
195	348		issued pursuant to paragraphs 1 through 7 of subsection C of this
196	349		section and Two Dollars and fifty cents ($2.50) of the license fee
197	350		for each license issued pursuant to paragraph 8 of subsection C of
198	351		this section shall be deposited in the Wildlife Land Acquisition
199	352		Fund created pursuant to the provisions of Section 4 -132 of this
200	353		title; and
201		-
202	354		2. Five Dollars ($5.00) of the license fee for each license
203	355		issued pursuant to paragraphs 1 through 8 of subsection C o f this
204	356		section shall be for the Oklahoma Wildlife Land Stamp and shall be
205	357		deposited in the Oklahoma Wildlife Land Fund created pu rsuant to the
206	358		provisions of Section 4-141 of this title.

208	359		F. Except as otherwise provided, the resident hunting licenses
209	360		issued pursuant to this section and the fee for each license shall
210	361		be:

212	362		1. Annual hunting license for residents eighteen (18) years of
213	363		age and older which expires on December 31 of the year purchased -
214	364		Twenty-four Dollars ($24.00);

235	407		Section 231a, or residen ts who are one-hundred-percent disabled and
236	408		are receiving disability payments from the Multiple Injury Trust
237	409		Fund pursuant to Section 31 of Title 85A of the Oklahoma Statutes -
238	410		Ten Dollars ($10.00);

240	411		7. Gun hunting license for deer for residents eighteen ( 18)
241	412		years of age or older - Nineteen Dollars ($19.00). The following
242	413		persons shall be exempt:

	509	+	15. Bonus, special or additional gun hunting license for deer
	510	+	for residents - Nineteen Dollars ($19.00). The following persons
	511	+	shall be exempt:

245	513		States Department of Veterans Affairs or its
246	514		successor, certifying that the person is a disabled
247	515		veteran in receipt of compensation at the one -hundred-
248	516		percent rate, and

324	556		4. A lifetime hunting license or lifetime combination hunting
325	557		and fishing license issued pursuant to Section 4 -114 of this title.

327	558		H. Of the fees collected pursuan t to the provisions of
328	559		paragraphs 1 and 2 of subsection F of this section, Five Dollars
329	560		($5.00) of the license fee shall be for the Oklahoma Wildlife Land
330	561		Stamp and shall be deposited in the Oklahoma Wildlife Land Fund
331	562		created pursuant to the provisions of Section 4-141 of this title.

333	563		I. The provisions of this section shall not be construed to
334	564		require a hunting license, resident or nonresident, of any person
335	565		merely because the person participates, as owner or handler of an

343	599		J. 1. Any person arrested for hunting game other than deer,
344	600		antelope, elk, bear or turkey without a valid hunting license as
345	601		required by the provisions of subsection A of this se ction may
346	602		purchase a substitute temporary thirty -day license from the
347	603		arresting game warden i n lieu of posting bond. Proof of hunter
348	604		safety certification will n ot be required for the temporary
349	605		substitute license. The f ee for a substitute license purchase d
350	606		pursuant to the provisions of this subsection shall be:

352	607		a. for legal residents, Fifty Dolla rs ($50.00), and

354	608		b. for nonresidents, One Hundred Forty -five Dollars
355	609		($145.00).

358	610		2. Except as otherwise provided for by this su bsection, the
359	611		fees from licenses pur chased pursuant to the provisions of this

369	647		issued by the Department to the person that was in force at the time
370	648		of the alleged offense is presented to the court or district
371	649		attorney within seventy-two (72) hours after the violation, the
372	650		charge shall be dismissed without paymen t of court costs.

374	651		L. Unless a substitute license is purchased as provided for by
375	652		subsection J of this section, any resident convicted of violating
376	653		the provisions of this section shall be punished by the imposition
377	654		of a fine of not less than Twenty-five Dollars ($25.00) nor more
378	655		than Two Hundred Dollars ($200.00), or by imprisonment in the county
379	656		jail for a period not to exceed thirty (30) days, or by both.

381	657		M. Unless a substitute license is purchased as provided for by
382	658		subsection J of this section, any non resident convicted of violating
383	659		the provisions of this section shall be punished by the impos ition
384	660		of a fine of not less than Two Hundred Dollars ($200.00) nor m ore
385	661		than Five Hundred Dollars ($500.00), or by imprisonment in the
386	662		county jail for a period not to exceed six (6) months, or by both .
