3258 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

3459 SECTION 1. NEW LAW A new section of law not to be
3560 codified in the Oklahoma Sta tutes reads as follows:

3761 There is hereby appropriated to the State Board of Education
3862 from any monies not otherwise appropriated fr om the General Revenue
3963 Fund of the State Treasur y for the fiscal year ending June 30, 2024,
4064 the sum of Five Hundred Million Do llars ($500,000,000.00) for the
4165 financial support of public schools.

4694 There is hereby appropriated to the State Board of Education for
4795 deposit in the State Public Common School Building Equalization Fund
4896 created in Section 32 of Article X of the Oklahoma Consti tution,
4997 from any monies not otherwise appropriat ed from the General Reven ue
5098 Fund of the State Treasury for the fiscal year end ing June 30, 2024,
5199 One Hundred Twenty-five Million Dollars ($125,000,000.00) to be
52100 distributed as redbud school grants as provided in Section 3-104 of
53101 Title 70 of the Oklahoma Statutes.

55102 SECTION 3. NEW LAW A new section of law to be codified
56103 in the Oklahoma Statutes as Section 28-100A of Title 70, unless
57104 there is created a duplication in numbering, reads as fol lows:

59105 A. It is the intent of the Legislature that appropriations made
60106 in House Bill No. 2901 of the 1st Session of the 59th O klahoma
61107 Legislature in conjunction with other funds appropriated to the
62108 State Board of Education during the 1st Session of the 59t h Oklahoma
63109 Legislature establish a new baseline appropriation level for public
64110 schools in this state, and that maintaining such baseline levels in
65111 future years should be a requirement prior to resources being made
66112 available for programs such a s the Oklahoma Parental Choice Tax
67113 Credit Act, created pursuant to House Bill No. 19 34 of the 1st
68114 Session of the 59th Oklahoma Legislature. For this reason,
69115 subsection B of this section is necessary.

71142 B. Beginning July 1, 2024 , and at the beginning of each
72143 succeeding state fiscal year, if the amount of money ap propriated to
73144 the State Board of Education:

75145 1. For the financial support of publi c schools and support of
76146 public schools activities in such fiscal year; and

78147 2. To be distributed through redbud school grants pro vided for
79148 in Section 3-104 of Title 70 of the Oklahoma Statutes,

81149 is less than such amounts appropriated for the fiscal year e nding
82150 June 30, 2024, the tax credits otherwise authorized in the Oklahoma
83151 Parental Choice Tax Cre dit Act shall be reduced proportionally to
84152 reflect the proportion such appropriat ions fail to reach the
85153 baseline amounts appropriated for the fiscal year endin g June 30,

88155 SECTION 4. This act shall become effective July 1, 2023.

90156 SECTION 5. It being immediately necessary fo r the preservation
91157 of the public peace, health or safety, an emergency is hereby
92158 declared to exist, by r eason whereof this act shall take effect and
93159 be in full force from and after its passage and approval.
