32	58		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

34	59		SECTION 1. NEW LAW A new section of law not to be
35	60		codified in the Oklahoma Sta tutes reads as follows:

37	61		There is hereby appropriated to the State Board of Education
38	62		from any monies not otherwise appropriated fr om the General Revenue
39	63		Fund of the State Treasur y for the fiscal year ending June 30, 2024,
40	64		the sum of Five Hundred Million Do llars ($500,000,000.00) for the
41	65		financial support of public schools.

47	95		deposit in the State Public Common School Building Equalization Fund
48	96		created in Section 32 of Article X of the Oklahoma Consti tution,
49	97		from any monies not otherwise appropriat ed from the General Reven ue
50	98		Fund of the State Treasury for the fiscal year end ing June 30, 2024,
51	99		One Hundred Twenty-five Million Dollars ($125,000,000.00) to be
52	100		distributed as redbud school grants as provided in Section 3-104 of
53	101		Title 70 of the Oklahoma Statutes.

55	102		SECTION 3. NEW LAW A new section of law to be codified
56	103		in the Oklahoma Statutes as Section 28-100A of Title 70, unless
57	104		there is created a duplication in numbering, reads as fol lows:

59	105		A. It is the intent of the Legislature that appropriations made
60	106		in House Bill No. 2901 of the 1st Session of the 59th O klahoma
61	107		Legislature in conjunction with other funds appropriated to the
62	108		State Board of Education during the 1st Session of the 59t h Oklahoma
63	109		Legislature establish a new baseline appropriation level for public
64	110		schools in this state, and that maintaining such baseline levels in
65	111		future years should be a requirement prior to resources being made
66	112		available for programs such a s the Oklahoma Parental Choice Tax
67	113		Credit Act, created pursuant to House Bill No. 19 34 of the 1st
68	114		Session of the 59th Oklahoma Legislature. For this reason,
69	115		subsection B of this section is necessary.

71	142		B. Beginning July 1, 2024 , and at the beginning of each
72	143		succeeding state fiscal year, if the amount of money ap propriated to
73	144		the State Board of Education:

75	145		1. For the financial support of publi c schools and support of
76	146		public schools activities in such fiscal year; and

78	147		2. To be distributed through redbud school grants pro vided for
79	148		in Section 3-104 of Title 70 of the Oklahoma Statutes,

81	149		is less than such amounts appropriated for the fiscal year e nding
82	150		June 30, 2024, the tax credits otherwise authorized in the Oklahoma
83	151		Parental Choice Tax Cre dit Act shall be reduced proportionally to
84	152		reflect the proportion such appropriat ions fail to reach the
85	153		baseline amounts appropriated for the fiscal year endin g June 30,
86	154		2024.

88	155		SECTION 4. This act shall become effective July 1, 2023.

90	156		SECTION 5. It being immediately necessary fo r the preservation
91	157		of the public peace, health or safety, an emergency is hereby
92	158		declared to exist, by r eason whereof this act shall take effect and
