45	65		SECTION 1. NEW LAW A new section of la w not to be

47	67		There is hereby appropriated to the Oklahoma A rts Council from
48	68		any monies not otherwise appropriated from the Statewide Recovery
49	69		Fund of the State Treasury created in Enrolled House Bill No. 3 349

50	96		of the 2nd Session of the 58th Oklahoma Legislature, the sum of Ten
51	97		Million Dollars ($10,000,000.00) or so much t hereof as may be
52	98		necessary to address th e negative economic impacts of the pandemic
53	99		by providing assistance to impacted nonprofit organizat ions. Such
54	100		funds shall be utilized in a manner consistent with the
55	101		recommendations adopted by the Joint Committee on Pandemic Relief
56	102		Funding on September 20 , 2022.

58	103		SECTION 2. NEW LAW A new section of law not to be
59	104		codified in the Oklahoma Statutes reads as follows:
60		-
61	105		A. There is hereby created in the State Tre asury a Statewide
62	106		Recovery Special Acc ount for the Oklahoma Arts Council. The
63	107		duration of such accounts shall continue for the period of time that
64	108		monies related to the Americ an Rescue Plan Act of 2021 are being
65	109		budgeted, expended, or managed in the state . The ending of such
66	110		period shall be determined by the State Treasurer and sh all result
67	111		in the closing of such accounts as a matter of law. Such accounts
68	112		shall be continuing a ccounts as otherwise provided in this section,
69	113		not subject to fiscal year limita tions, and shall exclusively
70	114		consist of monies related to the relevant appropr iations made in
71	115		this act and as otherwise directed by law. All monies deposited to
72	116		the credit of such accounts are hereby appropriated and may be
73	117		budgeted and expended by the Ok lahoma Arts Council in accordance
74	118		with the provisions of this act. Expenditures from such accounts
75	119		shall be made upon warrants issued by the State Treasurer against

77	147		Management and Enterp rise Services for approval and payment .

79	148		B. The Oklahoma Arts Council is autho rized to request in
80	149		writing that the monies appropriated by the provisions of this act
81	150		be deposited or transferred to the accounts created pursuant to
82	151		subsection A of this sectio n. No later than seven (7) calendar d ays
83	152		from the date of such request, the D irector of the Office of
84	153		Management and Enterprise Services shall comply with such request
85	154		and verify to the requesting agency that such deposit or transfer
86	155		has been completed.

88	156		SECTION 3. NEW LAW A new section of law not to be
89	157		codified in the Oklahoma Statu tes reads as follows:

91	158		The Oklahoma Arts Council may enter into memorandum s of
92	159		understanding with other agencies of the State of Oklahoma for the
93	160		auditing, documentation, evaluation, implement ation, oversight,
94	161		reporting, and managem ent of funds and associat ed efforts related to
95	162		the appropriations made in this act; provided, that no such
96	163		memorandum of understanding shall require or include, as an option
97	164		or condition, the direct or practical tran sfer or relinquishment of
98	165		control by the agency appropriated such funds to budget, expend,
99	166		allocate, and request the distribution of the f unds appropriated by
100	167		this act.

105	196		The Oklahoma Arts Council may promulgate rules, utilize existing
106	197		rules, establish procedures, an d utilize existing procedures to
107	198		implement the provisions of this act; provided, su ch rules and
108	199		procedures do not conflic t with or impede the provisions of this

111	201		SECTION 5. NEW LAW A new section of law not to be
112	202		codified in the Oklahoma Statutes reads as follows:

114	203		The Oklahoma Arts Council shall retain no more than two percent
115	204		(2%) of the funds app ropriated by this act to reimburse:

117	205		1. Costs incurred by the Ok lahoma Arts Council; or
118		-
119	206		2. Costs incurred on the agency 's behalf, associated with the
120	207		administration of the appropriated funds and programming required by
121	208		the Oklahoma Arts Council under the pr ovisions of this act;
122	209		provided, that no funds shall be retained that would be disallowable
123	210		under the provisions of the American Rescue P lan Act of 2021.

125	211		SECTION 6. NEW LAW A new section of law n ot to be
126	212		codified in the Oklahoma Stat utes reads as follows:

128	213		A. The Oklahoma Arts Council shall:

130	214		1. Submit to the Chairs of the Joint Committee on Pandemic
131	215		Relief Funding, or any successor Senate legislative or House of
132	216		Representatives legislative commit tee or joint committee, as
133	217		designated by the President Pro Tempore of the Oklahoma State Senate
134	218		and the Speaker of the Oklahoma House of Representatives:

142	250		Oklahoma Arts Council to f acilitate, assist, or
143	251		administer powers and duties provided to the Oklahoma
144	252		Arts Council under the provisions of this act; and

146	253		2. At the Joint Committee on Pandemic Reli ef Funding's request,
147	254		appear before the Joint Committee no later than six (6) months af ter
148	255		the effective date of this act, and as otherwise requested by the
149		-	Joint Committee, to ~~provide~~ a status update regarding the
	256	+	Joint Committee to pr ovide a status update regarding the
150	257		implementation of the provisions of this a ct.

152	258		B. The provisions of subsec tion A of this section shall remain
153	259		applicable for the p eriod of time that monies appropriated under
154	260		this act are being budgeted, expended, or man aged in the state. The
155	261		ending of such period shall be determined by the State Treasurer,
156	262		and shall be reporte d to the Governor, President Pro Tempore of the
157	263		Senate, and the Speaker of the House of Representatives.

159	264		SECTION 7. It being immediately necessary for the preservation
160	265		of the public peace, health or safety, an emergency is hereby
161	266		declared to exist, by reason whereof this act shall take effect and
162	267		be in full force from and after its passage and approval.
