50	50	BE IT RESOLVED BY TH E HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
51	51	1ST SESSION OF THE 5 9TH OKLAHOMA LEGISLATURE:
52	52	SECTION 1. The Secretary of State shall refer to the people for
53	53	their approval or rejection, as and in the manner provided by law,
54	54	the following proposed amendment to Section 21 of Article V of the
55	55	Constitution of the State of Oklahoma to read as follows:
56	56	Section 21. A. The Legislature shall enact laws to prohibit
57	57	members of the Legislature from engaging in activities or having
58	58	interests which conflict with the proper discharge of their duties
59	59	and responsibilities.
60	60	B. The Board on Legislative Compensation is hereby created.
61	61	Said Board shall be composed of five members appointed by the
62	62	Governor, two members appointed by the President Pro Tempore of the

89	89	Senate, and two members appointed by the Speaker of the House of
90	90	Representatives. The members appointed by the Governor shall be
91	91	from religious organizations, communications media, nonstate -
92	92	supported educational institutions, labor organizations, and retail
93	93	business; the members appointed by the President Pro Tempore of the
94	94	Senate shall be from agricultural and civic organizations; and the
95	95	members appointed by the Speaker of the House of Representatives
96	96	shall be from manufacturing and from professi onal fields not
97	97	otherwise specified. No member of the Legislature may be appointed
98	98	to or serve on the Board. In addition to the members above provided
99	99	for, the Chairman of the Oklahoma Tax Commission and the Director of
100	100	State Finance shall serve as ex of ficio nonvoting members of said
101	101	Board. The Chairman of said Board shall be designated by the
102	102	Governor. Members of the Legislature shall receive such
103	103	compensation as shall be fixed by the Board on Legislative
104	104	Compensation. If a member of the Legislature is incarcerated due to
105	105	being charged with a criminal offense and subsequently is found
106	106	guilty of the offense or pleads guilty or nolo contendere to the
107	107	offense, the legislator shall return to the state any compensation
108	108	the legislator received from the stat e while the legislator was
109	109	incarcerated prior to the guilty verdict or plea or nolo contendere
110	110	plea and shall not receive any compensation from the state during
111	111	any incarceration following such verdict or plea. Said Board shall
112	112	each two years review the c ompensation paid to the members of the

139	139	Legislature and shall be empowered authorized to change such
140	140	compensation; such change to become effective on the fifteenth day
141	141	following the succeeding general election pursuant to subsection C
142	142	of this section. The members of the Board shall serve without
143	143	compensation, but shall be entitled to receive necessary travel and
144	144	subsistence expense as provided by law for other state officers.
145	145	C. Any recommendation by the Board to change compensation paid
146	146	to the members of the Legislature shall be referred to a vote of the
147	147	people in the form of a state question at the next General Election
148	148	and shall take effect upon the approval of a majority vote of
149	149	electors. The Board may seek the advice and counsel of the Attorney
150	150	General and the Office of the Secretary of State to implement the
151	151	provisions of this subsection.
152	152	SECTION 2. The Ballot Title for the proposed Constitutional
153	153	amendment as set forth in SECTION 1 of this resolution shall be in
154	154	the following form:

157	157	THE GIST OF THE PROPOSITION IS AS FOLLOWS:
158	158	This measure amends Section 2 1 of Article 5 of the Oklahoma
159	159	Constitution. It makes any recommendation by the Board to
160	160	change compensation paid t o members of the Legislature be
161	161	referred to a vote of the people in the form of a state
162	162	question. It requires a majority vote of the people to make any
