5050 BE IT RESOLVED BY TH E HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
5151 1ST SESSION OF THE 5 9TH OKLAHOMA LEGISLATURE:
5252 SECTION 1. The Secretary of State shall refer to the people for
5353 their approval or rejection, as and in the manner provided by law,
5454 the following proposed amendment to Section 21 of Article V of the
5555 Constitution of the State of Oklahoma to read as follows:
5656 Section 21. A. The Legislature shall enact laws to prohibit
5757 members of the Legislature from engaging in activities or having
5858 interests which conflict with the proper discharge of their duties
5959 and responsibilities.
6060 B. The Board on Legislative Compensation is hereby created.
6161 Said Board shall be composed of five members appointed by the
6262 Governor, two members appointed by the President Pro Tempore of the

8989 Senate, and two members appointed by the Speaker of the House of
9090 Representatives. The members appointed by the Governor shall be
9191 from religious organizations, communications media, nonstate -
9292 supported educational institutions, labor organizations, and retail
9393 business; the members appointed by the President Pro Tempore of the
9494 Senate shall be from agricultural and civic organizations; and the
9595 members appointed by the Speaker of the House of Representatives
9696 shall be from manufacturing and from professi onal fields not
9797 otherwise specified. No member of the Legislature may be appointed
9898 to or serve on the Board. In addition to the members above provided
9999 for, the Chairman of the Oklahoma Tax Commission and the Director of
100100 State Finance shall serve as ex of ficio nonvoting members of said
101101 Board. The Chairman of said Board shall be designated by the
102102 Governor. Members of the Legislature shall receive such
103103 compensation as shall be fixed by the Board on Legislative
104104 Compensation. If a member of the Legislature is incarcerated due to
105105 being charged with a criminal offense and subsequently is found
106106 guilty of the offense or pleads guilty or nolo contendere to the
107107 offense, the legislator shall return to the state any compensation
108108 the legislator received from the stat e while the legislator was
109109 incarcerated prior to the guilty verdict or plea or nolo contendere
110110 plea and shall not receive any compensation from the state during
111111 any incarceration following such verdict or plea. Said Board shall

139139 Legislature and shall be empowered authorized to change such
140140 compensation; such change to become effective on the fifteenth day
141141 following the succeeding general election pursuant to subsection C
142142 of this section. The members of the Board shall serve without
143143 compensation, but shall be entitled to receive necessary travel and
144144 subsistence expense as provided by law for other state officers.
145145 C. Any recommendation by the Board to change compensation paid
146146 to the members of the Legislature shall be referred to a vote of the
147147 people in the form of a state question at the next General Election
148148 and shall take effect upon the approval of a majority vote of
149149 electors. The Board may seek the advice and counsel of the Attorney
150150 General and the Office of the Secretary of State to implement the
151151 provisions of this subsection.
152152 SECTION 2. The Ballot Title for the proposed Constitutional
153153 amendment as set forth in SECTION 1 of this resolution shall be in
154154 the following form:

157157 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
158158 This measure amends Section 2 1 of Article 5 of the Oklahoma
159159 Constitution. It makes any recommendation by the Board to
160160 change compensation paid t o members of the Legislature be
161161 referred to a vote of the people in the form of a state
162162 question. It requires a majority vote of the people to make any
