54	54	BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
55	55	1ST SESSION OF THE 58TH OK LAHOMA LEGISLATURE:
56	56	SECTION 1. The Secretary of State shall refer to the people for
57	57	their approval or rejection, as and in the manner provided by law,
58	58	the following proposed amendment to the Constitution of the State of
59	59	Oklahoma by adding a new Section 33A to Article V thereof, to read
60	60	as follows:
61	61	A. If any state question, whether in the form of an amendment
62	62	to the Oklahoma Constitution or amendments, new law enactments or
63	63	repeals, in any combination thereof, with respect to the Oklahoma
64	64	Statutes, submitted to a popular v ote either by initiative petition

91	91	or in the form of a measure referred by the Legislature, would
92	92	require an increase in the expenditures of any branch or department
93	93	of state government, such question shall require the appro val of
94	94	sixty percent (60%) of tho se voting on the question or such question
95	95	shall not become effective or binding as law.
96	96	B. Prior to the time that an initiative petition is filed with
97	97	the Secretary of State, the proponents of the proposal shall obtain
98	98	a certification from the State Audi tor and Inspector or an entity ,
99	99	including any successor entity, designated for such purpose by the
100	100	Legislature by statute enacted after the approval of this question,
101	101	whether the proposal will or will not increase state expenditures as
102	102	described in subsect ion A of this section. If the certification
103	103	concludes that there would be an increase in expenditures, the
104	104	ballot title for the initiative petition shall contain the following
105	105	statement at the beginning of the ballot title and shall precede any
106	106	other wording: "The approval of this proposal has been determined
107	107	by the State of Oklahoma to require an increase in state government
108	108	expenditures and requires sixty percent (60%) approval in order to
109	109	become adopted as law. " The wording for the ballot title as
110	110	prescribed by this section may not be modified by the Attorney
111	111	General.
112	112	C. If any measure referred to a vote of the people by the
113	113	Legislature, whether in the form of statutes or amendments to the
114	114	Oklahoma Constitution, is determined to require an increase in state

142	142	requirements of subsection A and B of this section, and the chamber
143	143	from which such measure originates shall obtain the certification
144	144	from either the State Auditor and Inspector or the entity designated
145	145	by law to provide the certification. The certification shall be
146	146	obtained prior to the final passage of the measure and shall be
147	147	obtained so that if the certification determines that an increase in
148	148	state expenditures would be require d if the measure is approved, the
149	149	ballot title for the measure shall conform to the requirements of
150	150	subsection B of this section. The wording for the ballot title as
151	151	prescribed by this section may not be modified by the At torney
152	152	General.
153	153	SECTION 2. The Ballot Title for the proposed Constitutional
154	154	amendment as set forth in SECTION 1 of this resolution shall be in
155	155	the following form:

158	158	THE GIST OF THE PROPOSITION IS AS FOLLOW S:
159	159	This measure amends the Oklahoma Constitution. It would add a
160	160	new Section 33A to Article V. This amendment to the Oklahoma
161	161	Constitution would apply to initiative petitions and to measures
162	162	referred to the statewide ball ot by the Legislature. The
163	163	measure would require a supermajority approval of certain types
164	164	of state questions. It would apply to amendments to the

201	201	sentence in the ballot title. The sentence will read as
202	202	follows: "The approval of this proposal has been determined by
203	203	the State of Oklahoma to require an increase in state government
204	204	expenditures and requires sixty percent (60%) approval in order
205	205	to become adopted as law."
