44	44	rejection a proposed amendment to Section 26 of

47	47	bear arms; updating lang uage; providing ballot title;

54	54	BE IT RESOLVED BY THE HOUSE OF REPRESENTATI VES AND THE SENATE OF THE
55	55	1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
56	56	SECTION 1. The Secretary of State shall refer to the people for
57	57	their approval or rejection, as and in the manner provided by law,
58	58	the following proposed amendment to Section 26 of Article II of the
59	59	Constitution of the State of Oklahoma to read as follows:
60	60	Section 26. A. The fundamental right of a each individual
61	61	citizen to keep and to bear arms in defense of his home, or her
62	62	person, or property, or including handguns, rifles, shotguns,
63	63	knives, nonlethal defensive weapons, and other arms in common use,
64	64	as well as ammunition and the components of arms and ammunition, for

91	91	self-defense, lawful hunting and recreation, in aid of the civil
92	92	power, when thereunto legally lawfully summoned, or for any other
93	93	legitimate purpose, shall never be prohibited; but nothing herein
94	94	contained not be infringed.
95	95	B. This section shall not prevent the Legislature from
96	96	regulating the carrying of weapons enforcing or adopting narrowly
97	97	tailored time, place, and manner regulations, or authorizing
98	98	political subdivisions to adopt and enforce such regulations, to
99	99	serve a compelling state interest.
100	100	C. No law shall impose reg istration or special ta xation upon
101	101	the keeping of arms including the acquisit ion, ownership,
102	102	possession, or transfer of arms, ammunition , or the components of
103	103	arms or ammunition.
104	104	SECTION 2. The Ballot Title for the proposed Constitutional
105	105	amendment as set forth in SECTION 1 of this resolution shall be in
106	106	the following form:

109	109	THE GIST OF THE PROPOSITION IS AS FOLLOWS:
110	110	This measure would amend Section 26 of Article 2 of the Oklahoma
111	111	Constitution. This measure w ould prevent infringement of the
112	112	fundamental right of a citizen to keep and to bear arms. This
113	113	measure will not prevent the Legisla ture from adopting
114	114	regulations that serv e a narrowly tailored compelling state

151	151	SECTION 2 hereof, with the Secretary of State and one copy with the
152	152	Attorney General.
