5454 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
5555 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
5656 SECTION 1. The Secretary of State shall refer to the people for
5757 their approval or rejec tion, as and in the manner provided by l aw,
5858 the following proposed amendment to the Oklahoma Constitution which
5959 would add a new article to be designated as Article XXXI:
6060 Section 1. As used in this article :
6161 1. A state interest is "compelling" only if it is for the
6262 limited purpose of protecting the health of an individual seeking
6363 care, consistent with accepted clinical standards of practice and

9090 evidence-based medicine, and does not infringe on that individual 's
9191 autonomous decision making;
9292 2. "Fetal viability" means the point in pregnancy where, in the
9393 professional judgment of an attending health care professional and
9494 based on the particular facts of the case, there is a significant
9595 likelihood of the fetus 's sustained survival outside the uterus
9696 without the application of extraordinary medical mea sures;
9797 3. "Health care professional" means any medical staff and
9898 physicians who provide reproductive health care and are licensed to
9999 perform reproductive hea lth care services; and
100100 4. "Individual" means anyone sixteen (16) years of age and
101101 above, the age of consent in Oklahoma, or if under the age of
102102 consent, the consent of his or her parent or legal guardian.
103103 Section 2. Right to Reproductive Freedom .
104104 A. Every individual has a fundamental right to reproductive
105105 freedom, which entails the right to make and effectuate decisions
106106 about all matters relating to pregnan cy, including, but not limited
107107 to, prenatal care, childbirth, postpartum care, contraception,
108108 sterilization, abortion care, miscarriage management, and
109109 infertility care. An individual's right to reproductive freedom
110110 shall not be denied, burdened , nor infringed upon unless justified
111111 by a "compelling" state interest achieved by the least restrictive
112112 means. Notwithstanding the above, in no circumstance shall the
113113 state prohibit an abortion that, in th e professional judgment of an

140140 attending health care professional, is medically indicated to
141141 protect the life or physical or mental health of the pregnant
142142 individual.
143143 B. The state shall not discriminate in the protec tion or
144144 enforcement of this fundamental right.
145145 C. The state shall not penalize, prosecute, or ot herwise take
146146 adverse action against an individual based upon his or her actual,
147147 potential, perceived , or alleged pregnancy outcomes, including , but
148148 not limited to, miscarriage, stillbirth, or abortio n, nor shall the
149149 state penalize, prosecute, or otherwise take adverse action ag ainst
150150 someone aiding or assisting a pregnant individual in exercising his
151151 or her right to reproductive freedom with their voluntary consent.
152152 The state shall not penalize, prose cute, or otherwise take adverse
153153 action against any health care professional providing reproductive
154154 health services.
155155 Section 3. Severability.
156156 This article shall be self-executing. The provisions of this
157157 article are severable, and if any p art or provision hereof shall be
158158 void, invalid, or unconstitutional, t he decision of the court so
159159 holding shall not affect or impair any of the remaining parts or
160160 provisions hereof, and the remaining provisions here of shall
161161 continue in full force and effect.

193193 THE GIST OF THE PROPOSITION IS AS F OLLOWS:
194194 This proposed constitutional amendment would a dd Article 31 and
195195 establish a new individual right to reproductive freedom,
196196 including the right to make and carry out all decisions about
197197 pregnancy, such as prena tal care, childbirth, pos tpartum care,
198198 contraception, sterilization, abortion, miscarriage manage ment,
199199 and infertility; allow the state to regulate abortion after
200200 viability, but not prohibit it if medically needed to protect a
201201 patient's life or physical or me ntal health; forbid state
202202 discrimination in enforcement of this right; prohibit
203203 prosecution of an individual, or person helping a pregnant
204204 individual, for exercising rights established by this amendment;
205205 and invalidate state laws conflicting with this amen dment.
