7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 47 O.S. 2021, Section 2-305, as
7979 amended by Section 2, Chapter 255, O.S.L. 2022 (47 O.S. Supp. 2022,
8080 Section 2-305), is amended to read as follows:
8181 Section 2-305. A. Except as otherwise provided in this title,
8282 at any time after attaining normal retirement date, a ny member of
8383 the Oklahoma Law Enforcement Retiremen t System upon application for
8484 unreduced retirement be nefits made and approved, may retire, and,
8585 during the remainder of the member’s lifetime, receive annual
8686 retirement pay, payable in equal monthly paymen ts, equal to two and
8787 one-half percent (2 1/2%) of t he final average salary times years of
8888 credited service. If such retired member is reemployed by a state

140140 agency in a position which is not covered by the System, such
141141 retired member shall continue to rece ive in-service distributions
142142 from the System.
143143 1. Prior to September 19, 2002, if such retired member was
144144 reemployed by a state agency in a position which is covered by the
145145 System, such member shall continue to receive in -service
146146 distributions from the Sys tem and shall not accrue any further
147147 credited service. If such a member is reemployed by a state agency
148148 in a position which is covered by the System on or after September
149149 19, 2002, but prior to the effective date of this act , such member’s
150150 monthly retirement payments shall be suspended until such member
151151 retires and is not reemployed by a state agen cy in a position whic h
152152 is covered by the System.
153153 2. Beginning on the effective date of this act , if a retired
154154 member has received in-service distributions for no less than one
155155 (1) year and is reemployed by a state agency in a position which is
156156 covered by the System, such member shall continue to rec eive in-
157157 service distributions from the system while being employed in that
158158 position. Such a member shall not be eligi ble to accrue any further
159159 credited service during the reemployment period.
160160 B. Beginning July 1, 1994, members who retired or were eligible
161161 to retire prior to J uly 1, 1980, or their surviving spouses shall
162162 receive annual retirement pay, payable in equ al monthly payments,
163163 equal to the greater of their cur rent retirement pay, or two and

216216 currently paid to a highway patrol officer, at the time each such
217217 monthly retirement payment is made, mult iplied by the retired
218218 member’s years of credited servi ce.
219219 C. Except as otherwise provid ed by this subsection, members of
220220 the System whose salary is set by statute w ho have retired after
221221 completion of the mandatory twenty (20) years of service, and those
222222 members with statutory salaries who retire after reachi ng the
223223 mandatory twenty-year retirement shall receive an annual retirement
224224 pay, payable in equal monthly instal lments, based upon the greater
225225 of either:
226226 1. The top base salary currently paid to the hig hest
227227 nonsupervisory position in the participating agen cy at the time each
228228 such monthly retirement payment is made, limited to the annual
229229 salary limit of the Economic Growth and Tax Relief Reconciliation
230230 Act of 2001, as described in paragraph 9 of Section 2 -300 of this
231231 title, multiplied by two and one -half percent (2 1/2%) multiplied by
232232 the number of years of credited service and fraction thereof for the
233233 following positions:
234234 a. Oklahoma Highway Patrolman,
235235 b. Communications Dispatcher,
236236 c. Capitol Patrolman,
237237 d. Lake Patrolman, and

291291 2. The member’s final average salary as set forth in paragraph
292292 9 of Section 2-300 of this title, multiplied by two and one-half
293293 percent (2 1/2%), and multip lied by the number of years of credited
294294 service and fraction thereof.
295295 No member of the System retired prior to July 1, 2002, shall
296296 receive a benefit less than the am ount the member is receiving as of
297297 June 30, 2002.
298298 The provisions of paragraph 1 of this sub section shall not be
299299 applicable to any member whose fi rst participating service with the
300300 System occurs on or after November 1, 2012, except for those members
301301 who died in the performance of their duties pursuant to Section 2 -
302302 306 of this title.
303303 D. Other members of the System whose retirement benefit is not
304304 otherwise prescribed by this section who have retired after
305305 completion of the mandatory twenty (20) years of serv ice, and those
306306 members who retire after reaching the mandatory twenty -year
307307 retirement shall receive an annual retirement pay, payable in equal
308308 monthly payments, based upon the greater of either:
309309 1. The actual average salary currently paid to the highest
310310 nonsupervisory position in the part icipating agency at the time each
311311 such monthly payment is made, limited to the annual salary limit of
312312 the Economic Growth and Tax Relief Reconciliation Act of 20 01, as

382382 receive a benefit less than the amount the member is receiving as of
383383 June 30, 2002. The participating employer must certify to th e
384384 System in writing the actual average gross salary currently paid to
385385 the highest nonsupervisory positi on. The Board of Trustees shall
386386 promulgate such rules as are necessary to implement the provisions
387387 of this section.

439439 The provisions of paragraph 1 of th is subsection shall not be
440440 applicable to any member whose first partic ipating service with the
441441 System occurs on or after May 24, 2013, except for those members who
442442 died in the performance of their duties pursuant to Section 2-306 of
443443 this title.
444444 E. A member who meets the definition of disability as defined
445445 in paragraph 11 of Section 2-300 of this title by direct reason of
446446 the performance of the member’s duties as an officer shall receive a
447447 monthly benefit equal to:
448448 1. Two and one-half percent (2 1/2%);
449449 2. Multiplied by:
450450 a. twenty (20) years of credited service, if the member
451451 had performed less than twenty (20) years of credited
452452 service, notwithstanding the actual numbe r of years of
453453 credited service performed by the member prior to the
454454 date of disability, or
455455 b. the actual number of years of credited service and
456456 fraction thereof performed by the member prior to the
457457 date of disability, if the member had performed twenty
458458 (20) or more years of credited service;
459459 3. Multiplied by the greater of subparagraph a of this
460460 paragraph and division 1 of subparagraph b of this paragraph or
461461 division 2 of subparagraph b of this paragraph, as applic able:

662662 5. The Board of Trustees shall promulgate rules as necessary to
663663 implement the provisions of this subsection ; and
664664 6. If such member participates in the Oklahoma Law Enforcement
665665 Deferred Option Plan pursuant to S ection 2-305.2 of this title, then
666666 such member’s disability pension provided pursuant to this
667667 subsection shall be red uced to account for such member’s
668668 participation in the Oklahoma Law Enforcement Deferred Option Plan.
669669 F. A member who meets the definition of disability as defined
670670 in paragraph 11 of Section 2 -300 of this title and whose disability
671671 is by means of personal and traumatic injury of a catastro phic
672672 nature and in the line of duty, shall receive a monthly benefi t
673673 equal to:
674674 1. Two and one-half percent (2 1/2%);
675675 2. Multiplied by:
676676 a. twenty (20) years of service, regardless of the actual
677677 number of years of credite d service performed by the
678678 member prior to the date of disability, if the member
679679 had performed less th an twenty (20) years of service,
680680 or
681681 b. the actual number of years of service performed by th e
682682 member if the member had performed twenty (20) or more
683683 years of service;
684684 3. Multiplied by a final average salary equal to:

736736 a. the salary which the member would h ave received
737737 pursuant to statutory sa lary schedules in effect upon
738738 the date of the disabilit y for twenty (20) years of
739739 service prior to disability . The final average salary
740740 for a member who performed less than twenty (20) years
741741 of service prior to disabil ity shall be computed
742742 assuming that the member was paid the highest salary
743743 allowable pursuant to the law in effect at the time of
744744 the member’s disability based upon twenty (20) years
745745 of service and with an assumption that the member was
746746 eligible for any and all increases in pay based upon
747747 rank during the entire period. If the salary of a
748748 member is not prescribed by a specific salary schedule
749749 upon the date of the member’s disability, the fin al
750750 average salary for the member shall be computed by the
751751 member’s actual final average salary or the hi ghest
752752 median salary amount for a member whose salary wa s
753753 prescribed by a specific salary schedule upon the date
754754 of the member’s disability, whichever fi nal average
755755 salary amount would be greater, or
756756 b. the actual final ave rage salary of the member if the
757757 member had performed twenty (20) or more years of
758758 service prior to disability.

810810 If such member participates in the Okla homa Law Enforcement
811811 Deferred Option Plan pursuant to Section 2-305.2 of this title, such
812812 member’s disability pension provided pursuant to this subsection
813813 shall be adjusted as provided in Sectio n 2-305.2 of this title to
814814 account for such member ’s participation in the Oklahoma Law
815815 Enforcement Deferred Option Plan.
816816 G. A member who meets the definition of disab ility as defined
817817 in Section 2-300 of this title and whose disability occurred prior
818818 to the member’s normal retirement date but after completing three
819819 (3) years of vesting service and no t by reason of the performance of
820820 the member’s duties or as a result of the member’s willful
821821 negligence shall receive a monthly benefit equal to two and one -half
822822 percent (2 1/2%) of final average salary multiplied by the n umber of
823823 years of the member’s credited service.
824824 H. Payment of a disability pension shall commence as of the
825825 first day of the month coinci ding or next following the date of
826826 retirement and shall continue as long as the member meets the
827827 definition of total and permanent disability provided in this
828828 section.
829829 I. For the purpose of determining the member ’s disability under
830830 subsection E, F or G of this section, the member shall be required
831831 by the Board to be examined by a minimum of two recognized
832832 physicians selected by the Board to determine th e extent of the
833833 member’s injury or illness. The examining physicians s hall furnish

885885 the Board a detailed written report of the injury or illness of the
886886 examined member establishing the extent of disability and the
887887 possibilities of the disabled member being returned to his or her
888888 regular duties or an alternate occupation or se rvice covered by the
889889 System after a normal recuperation period. The Board shall require
890890 all retired disabled members who have not attained their norma l
891891 retirement date to submit to a p hysical examination once each year
892892 for a minimum of three (3) years fol lowing retirement. The Board
893893 shall select a minimum of two physicians to examine the ret ired
894894 members and pay for their services from the fund Oklahoma Law
895895 Enforcement Retirement Fund . Any retired disabled member found no
896896 longer disabled by the examining physicians to perform the
897897 occupation of the member or an alternate occupati on or service
898898 covered by the System shall be required t o return to duty and
899899 complete twenty (20) years of service as provided in subsection A of
900900 this section, or forfeit all his or her rights and claims under
901901 Section 2-300 et seq. of this title.
902902 J. The disability benefit under this section shall be for the
903903 lifetime of the member unless such member is found no longer
904904 disabled pursuant to subsection I of this section. Such member
905905 shall not be entitled to the retirement bene fit pursuant to
906906 subsection A of this section unless such member returns to active
907907 duty and is eligible for a retirement benefit as provided in
908908 subsection A of this section.

960960 K. At the postoffer, preemployment physical examination
961961 required under paragraph 6 of Section 2-300 of this title, the
962962 physician selected by the Board shall determine the extent to which
963963 a new member is disabled. If a member is determined to be partially
964964 disabled, the physician shall assign a percentage of disability to
965965 such partial disability. If such member then becomes entitled to a
966966 disability benefit under either subs ection E or subsection G of this
967967 section, the benefit payable shall be reduced by the percentage
968968 which such member was determined to be disabled at the postoffer,
969969 preemployment physical unles s the Board makes a determination that
970970 the initially determined p ercentage of disability at the
971971 preemployment physical examinat ion is unrelated to the reason for
972972 the disability currently sought pursuant to subsection E or
973973 subsection G of this section. Upon employment, the member shall
974974 disclose to the Board any disabili ty payments received from any
975975 source. The amount of disabilit y to be paid to any member cannot
976976 exceed one hundred percent (100%) disability from all sources . The
977977 provisions of this subsecti on shall apply only to members whose
978978 effective date of membership is on or after July 1, 2000.
979979 L. In addition to the pension p rovided for under subsection F
980980 of this section, if the member has one or more children under the
981981 age of eighteen (18) years or under the ag e of twenty-two (22) years
982982 if the child is enrolled ful l time in and is regularly attending a
983983 public or private schoo l or any institution of higher education,

10351035 Four Hundred Dollars ($400.00) a month shall be paid from the F und

10421042 M. Notwithstanding any other provisions in Section 2 -300
10431043 through 2-315 of this title, in order to be eligible to receive
10441044 disability benefits, a member who meets the d efinition of disability
10451045 as defined in paragraph 11 of Section 2-300 of this title shall f ile
10461046 the member’s completed application for disability benefits with the
10471047 System before such member’s date of termination from service and
10481048 provide such additional inform ation that the System’s rules require
10491049 within six (6) months of the System’s receipt of such application.
10501050 If the member’s completed application for dis ability benefits is not
10511051 filed with the System before the member’s date of termination from
10521052 service or such additional information as is req uired under the
10531053 System’s rules is not provided within s ix (6) months of the System’s
10541054 receipt of such application, suc h member shall be eligible only for
10551055 such other benefits as are available to members of the System and
10561056 shall not be eligible to receive any disability benefits. For good
10571057 cause shown, the Board o f Trustees may waive the requirement that
10581058 the disability appli cation be filed before the member’s date of

11191119 insurance premiums by deduction from his or her mont hly disability
11201120 benefit or monthly retirement payment, a fter December 31, 2006, in
11211121 accordance with Section 402(1) of t he Internal Revenue Code of 1986,
