77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78		SECTION 1. AMENDATORY 47 O.S. 2021, Section 2-305, as
79	79		amended by Section 2, Chapter 255, O.S.L. 2022 (47 O.S. Supp. 2022,
80	80		Section 2-305), is amended to read as follows:
81	81		Section 2-305. A. Except as otherwise provided in this title,
82	82		at any time after attaining normal retirement date, a ny member of
83	83		the Oklahoma Law Enforcement Retiremen t System upon application for
84	84		unreduced retirement be nefits made and approved, may retire, and,
85	85		during the remainder of the member’s lifetime, receive annual
86	86		retirement pay, payable in equal monthly paymen ts, equal to two and
87	87		one-half percent (2 1/2%) of t he final average salary times years of
88	88		credited service. If such retired member is reemployed by a state

140	140		agency in a position which is not covered by the System, such
141	141		retired member shall continue to rece ive in-service distributions
142	142		from the System.
143	143		1. Prior to September 19, 2002, if such retired member was
144	144		reemployed by a state agency in a position which is covered by the
145	145		System, such member shall continue to receive in -service
146	146		distributions from the Sys tem and shall not accrue any further
147	147		credited service. If such a member is reemployed by a state agency
148	148		in a position which is covered by the System on or after September
149	149		19, 2002, but prior to the effective date of this act , such member’s
150	150		monthly retirement payments shall be suspended until such member
151	151		retires and is not reemployed by a state agen cy in a position whic h
152	152		is covered by the System.
153	153		2. Beginning on the effective date of this act , if a retired
154	154		member has received in-service distributions for no less than one
155	155		(1) year and is reemployed by a state agency in a position which is
156	156		covered by the System, such member shall continue to rec eive in-
157	157		service distributions from the system while being employed in that
158	158		position. Such a member shall not be eligi ble to accrue any further
159	159		credited service during the reemployment period.
160	160		B. Beginning July 1, 1994, members who retired or were eligible
161	161		to retire prior to J uly 1, 1980, or their surviving spouses shall
162	162		receive annual retirement pay, payable in equ al monthly payments,
163	163		equal to the greater of their cur rent retirement pay, or two and

215	215		one-half percent (2 1/2%) of the actual paid gross salary being
216	216		currently paid to a highway patrol officer, at the time each such
217	217		monthly retirement payment is made, mult iplied by the retired
218	218		member’s years of credited servi ce.
219	219		C. Except as otherwise provid ed by this subsection, members of
220	220		the System whose salary is set by statute w ho have retired after
221	221		completion of the mandatory twenty (20) years of service, and those
222	222		members with statutory salaries who retire after reachi ng the
223	223		mandatory twenty-year retirement shall receive an annual retirement
224	224		pay, payable in equal monthly instal lments, based upon the greater
225	225		of either:
226	226		1. The top base salary currently paid to the hig hest
227	227		nonsupervisory position in the participating agen cy at the time each
228	228		such monthly retirement payment is made, limited to the annual
229	229		salary limit of the Economic Growth and Tax Relief Reconciliation
230	230		Act of 2001, as described in paragraph 9 of Section 2 -300 of this
231	231		title, multiplied by two and one -half percent (2 1/2%) multiplied by
232	232		the number of years of credited service and fraction thereof for the
233	233		following positions:
234	234		a. Oklahoma Highway Patrolman,
235	235		b. Communications Dispatcher,
236	236		c. Capitol Patrolman,
237	237		d. Lake Patrolman, and

291	291		2. The member’s final average salary as set forth in paragraph
292	292		9 of Section 2-300 of this title, multiplied by two and one-half
293	293		percent (2 1/2%), and multip lied by the number of years of credited
294	294		service and fraction thereof.
295	295		No member of the System retired prior to July 1, 2002, shall
296	296		receive a benefit less than the am ount the member is receiving as of
297	297		June 30, 2002.
298	298		The provisions of paragraph 1 of this sub section shall not be
299	299		applicable to any member whose fi rst participating service with the
300	300		System occurs on or after November 1, 2012, except for those members
301	301		who died in the performance of their duties pursuant to Section 2 -
302	302		306 of this title.
303	303		D. Other members of the System whose retirement benefit is not
304	304		otherwise prescribed by this section who have retired after
305	305		completion of the mandatory twenty (20) years of serv ice, and those
306	306		members who retire after reaching the mandatory twenty -year
307	307		retirement shall receive an annual retirement pay, payable in equal
308	308		monthly payments, based upon the greater of either:
309	309		1. The actual average salary currently paid to the highest
310	310		nonsupervisory position in the part icipating agency at the time each
311	311		such monthly payment is made, limited to the annual salary limit of
312	312		the Economic Growth and Tax Relief Reconciliation Act of 20 01, as

370	370		b. Oklahoma State Bureau of Narcotics and Dangerous Dru gs
371	371		Control - Narcotics Agent III,
372	372		c. Oklahoma Tourism and Recreation Department - Park
373	373		Ranger II,
374	374		d. State Board of Pharmacy - Pharmacy Inspector,
375	375		e. University of Oklahoma - Police Officer, and
376	376		f. Oklahoma State Universit y - Police Officer; or
377	377		2. The other member’s final average salary as set forth in
378	378		paragraph 9 of Section 2-300 of this title, multi plied by two and
379	379		one-half percent (2 1/2%), multiplied b y the number of years of
380	380		credited service and fraction thereof.
381	381		No member of the System retired prior to July 1, 2002, shall
382	382		receive a benefit less than the amount the member is receiving as of
383	383		June 30, 2002. The participating employer must certify to th e
384	384		System in writing the actual average gross salary currently paid to
385	385		the highest nonsupervisory positi on. The Board of Trustees shall
386	386		promulgate such rules as are necessary to implement the provisions
387	387		of this section.

439	439		The provisions of paragraph 1 of th is subsection shall not be
440	440		applicable to any member whose first partic ipating service with the
441	441		System occurs on or after May 24, 2013, except for those members who
442	442		died in the performance of their duties pursuant to Section 2-306 of
443	443		this title.
444	444		E. A member who meets the definition of disability as defined
445	445		in paragraph 11 of Section 2-300 of this title by direct reason of
446	446		the performance of the member’s duties as an officer shall receive a
447	447		monthly benefit equal to:
448	448		1. Two and one-half percent (2 1/2%);
449	449		2. Multiplied by:
450	450		a. twenty (20) years of credited service, if the member
451	451		had performed less than twenty (20) years of credited
452	452		service, notwithstanding the actual numbe r of years of
453	453		credited service performed by the member prior to the
454	454		date of disability, or
455	455		b. the actual number of years of credited service and
456	456		fraction thereof performed by the member prior to the
457	457		date of disability, if the member had performed twenty
458	458		(20) or more years of credited service;
459	459		3. Multiplied by the greater of subparagraph a of this
460	460		paragraph and division 1 of subparagraph b of this paragraph or
461	461		division 2 of subparagraph b of this paragraph, as applic able:

531	531		nonsupervisory position for division (1) of subparagraph b of this
532	532		paragraph, or
533	533		(2) the actual average salary currently paid to the
534	534		highest nonsupervisory position in the
535	535		participating agency of the member at the time
536	536		each monthly payment is made, limited to the

606	606		of this paragraph;
607	607		4. No member of the System receiving benefits prescribed by
608	608		this subsection who retired prior to July 1, 2002, shall receive a
609	609		benefit of less than the amount th e member was receiving as of June
610	610		30, 2002;

662	662		5. The Board of Trustees shall promulgate rules as necessary to
663	663		implement the provisions of this subsection ; and
664	664		6. If such member participates in the Oklahoma Law Enforcement
665	665		Deferred Option Plan pursuant to S ection 2-305.2 of this title, then
666	666		such member’s disability pension provided pursuant to this
667	667		subsection shall be red uced to account for such member’s
668	668		participation in the Oklahoma Law Enforcement Deferred Option Plan.
669	669		F. A member who meets the definition of disability as defined
670	670		in paragraph 11 of Section 2 -300 of this title and whose disability
671	671		is by means of personal and traumatic injury of a catastro phic
672	672		nature and in the line of duty, shall receive a monthly benefi t
673	673		equal to:
674	674		1. Two and one-half percent (2 1/2%);
675	675		2. Multiplied by:
676	676		a. twenty (20) years of service, regardless of the actual
677	677		number of years of credite d service performed by the
678	678		member prior to the date of disability, if the member
679	679		had performed less th an twenty (20) years of service,
680	680		or
681	681		b. the actual number of years of service performed by th e
682	682		member if the member had performed twenty (20) or more
683	683		years of service;
684	684		3. Multiplied by a final average salary equal to:

736	736		a. the salary which the member would h ave received
737	737		pursuant to statutory sa lary schedules in effect upon
738	738		the date of the disabilit y for twenty (20) years of
739	739		service prior to disability . The final average salary
740	740		for a member who performed less than twenty (20) years
741	741		of service prior to disabil ity shall be computed
742	742		assuming that the member was paid the highest salary
743	743		allowable pursuant to the law in effect at the time of
744	744		the member’s disability based upon twenty (20) years
745	745		of service and with an assumption that the member was
746	746		eligible for any and all increases in pay based upon
747	747		rank during the entire period. If the salary of a
748	748		member is not prescribed by a specific salary schedule
749	749		upon the date of the member’s disability, the fin al
750	750		average salary for the member shall be computed by the
751	751		member’s actual final average salary or the hi ghest
752	752		median salary amount for a member whose salary wa s
753	753		prescribed by a specific salary schedule upon the date
754	754		of the member’s disability, whichever fi nal average
755	755		salary amount would be greater, or
756	756		b. the actual final ave rage salary of the member if the
757	757		member had performed twenty (20) or more years of
758	758		service prior to disability.

810	810		If such member participates in the Okla homa Law Enforcement
811	811		Deferred Option Plan pursuant to Section 2-305.2 of this title, such
812	812		member’s disability pension provided pursuant to this subsection
813	813		shall be adjusted as provided in Sectio n 2-305.2 of this title to
814	814		account for such member ’s participation in the Oklahoma Law
815	815		Enforcement Deferred Option Plan.
816	816		G. A member who meets the definition of disab ility as defined
817	817		in Section 2-300 of this title and whose disability occurred prior
818	818		to the member’s normal retirement date but after completing three
819	819		(3) years of vesting service and no t by reason of the performance of
820	820		the member’s duties or as a result of the member’s willful
821	821		negligence shall receive a monthly benefit equal to two and one -half
822	822		percent (2 1/2%) of final average salary multiplied by the n umber of
823	823		years of the member’s credited service.
824	824		H. Payment of a disability pension shall commence as of the
825	825		first day of the month coinci ding or next following the date of
826	826		retirement and shall continue as long as the member meets the
827	827		definition of total and permanent disability provided in this
828	828		section.
829	829		I. For the purpose of determining the member ’s disability under
830	830		subsection E, F or G of this section, the member shall be required
831	831		by the Board to be examined by a minimum of two recognized
832	832		physicians selected by the Board to determine th e extent of the
833	833		member’s injury or illness. The examining physicians s hall furnish

885	885		the Board a detailed written report of the injury or illness of the
886	886		examined member establishing the extent of disability and the
887	887		possibilities of the disabled member being returned to his or her
888	888		regular duties or an alternate occupation or se rvice covered by the
889	889		System after a normal recuperation period. The Board shall require
890	890		all retired disabled members who have not attained their norma l
891	891		retirement date to submit to a p hysical examination once each year
892	892		for a minimum of three (3) years fol lowing retirement. The Board
893	893		shall select a minimum of two physicians to examine the ret ired
894	894		members and pay for their services from the fund Oklahoma Law
895	895		Enforcement Retirement Fund . Any retired disabled member found no
896	896		longer disabled by the examining physicians to perform the
897	897		occupation of the member or an alternate occupati on or service

899	899		complete twenty (20) years of service as provided in subsection A of
900	900		this section, or forfeit all his or her rights and claims under
901	901		Section 2-300 et seq. of this title.
902	902		J. The disability benefit under this section shall be for the
903	903		lifetime of the member unless such member is found no longer
904	904		disabled pursuant to subsection I of this section. Such member
905	905		shall not be entitled to the retirement bene fit pursuant to
906	906		subsection A of this section unless such member returns to active
907	907		duty and is eligible for a retirement benefit as provided in
908	908		subsection A of this section.

960	960		K. At the postoffer, preemployment physical examination
961	961		required under paragraph 6 of Section 2-300 of this title, the
962	962		physician selected by the Board shall determine the extent to which
963	963		a new member is disabled. If a member is determined to be partially
964	964		disabled, the physician shall assign a percentage of disability to
965	965		such partial disability. If such member then becomes entitled to a
966	966		disability benefit under either subs ection E or subsection G of this
967	967		section, the benefit payable shall be reduced by the percentage
968	968		which such member was determined to be disabled at the postoffer,
969	969		preemployment physical unles s the Board makes a determination that
970	970		the initially determined p ercentage of disability at the
971	971		preemployment physical examinat ion is unrelated to the reason for
972	972		the disability currently sought pursuant to subsection E or
973	973		subsection G of this section. Upon employment, the member shall
974	974		disclose to the Board any disabili ty payments received from any
975	975		source. The amount of disabilit y to be paid to any member cannot
976	976		exceed one hundred percent (100%) disability from all sources . The
977	977		provisions of this subsecti on shall apply only to members whose
978	978		effective date of membership is on or after July 1, 2000.
979	979		L. In addition to the pension p rovided for under subsection F
980	980		of this section, if the member has one or more children under the
981	981		age of eighteen (18) years or under the ag e of twenty-two (22) years
982	982		if the child is enrolled ful l time in and is regularly attending a
983	983		public or private schoo l or any institution of higher education,

1036	1036		for the support of each surviv ing child to the member or person
1037	1037		having the care and c ustody of such children until each child
1038	1038		reaches the age of ei ghteen (18) years or reaches the age of twenty-
1039	1039		two (22) years if the child is enrolled full time in and i s
1040	1040		regularly attending a public or private school or any institution of
1041	1041		higher education.
1042	1042		M. Notwithstanding any other provisions in Section 2 -300
1043	1043		through 2-315 of this title, in order to be eligible to receive
1044	1044		disability benefits, a member who meets the d efinition of disability
1045	1045		as defined in paragraph 11 of Section 2-300 of this title shall f ile
1046	1046		the member’s completed application for disability benefits with the
1047	1047		System before such member’s date of termination from service and
1048	1048		provide such additional inform ation that the System’s rules require
1049	1049		within six (6) months of the System’s receipt of such application.
1050	1050		If the member’s completed application for dis ability benefits is not
1051	1051		filed with the System before the member’s date of termination from
1052	1052		service or such additional information as is req uired under the
1053	1053		System’s rules is not provided within s ix (6) months of the System’s
1054	1054		receipt of such application, suc h member shall be eligible only for
1055	1055		such other benefits as are available to members of the System and
1056	1056		shall not be eligible to receive any disability benefits. For good
1057	1057		cause shown, the Board o f Trustees may waive the requirement that
1058	1058		the disability appli cation be filed before the member’s date of

1114	1114		N. If the requirements of Section 2-305.1C of this title are
1115	1115		satisfied, a member who, by re ason of disability or attainment o f
1116	1116		normal retirement date or age, is separated from serv ice as a public
1117	1117		safety officer with the member’s participating employer may elect to
1118	1118		have payment made directly to the provider for qualified health
1119	1119		insurance premiums by deduction from his or her mont hly disability
1120	1120		benefit or monthly retirement payment, a fter December 31, 2006, in
1121	1121		accordance with Section 402(1) of t he Internal Revenue Code of 1986,
1122	1122		as amended.
