7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 26 O.S. 2021, Section 14 -105, as
7979 amended by Section 1, Chapter 292, O.S.L. 2022 (26 O.S. Supp. 2022,
8080 Section 14-105), is amended to read as follows:
8181 Section 14-105. A. 1. Any registered voter may apply for an
8282 absentee ballot in person at the county election board, by United
8383 States mail, by facsimile device as defined in Sec tion 1862 of Title
8484 21 of the Oklahoma Statute s or by a means of electronic
8585 communication designated by the Secretary of the State Election
8686 Board. The Secretary of the State Election Board shall prescribe a
8787 form to be used for the application, although any application
8888 setting forth substantially the same facts shall be valid.

140140 2. The form to be used for the application required pursuant to
141141 this section shall contain a list of valid reasons for requesting
142142 the absentee ballot. To receive an absentee ballot, the voter shall
143143 select one reason for which the voter is unable to vote in person
144144 early or on election day, described as follows:
145145 a. absent from the jurisdiction,
146146 b. illness or disability,
147147 c. employment-related,
148148 d. education-related,
149149 e. military service,
150150 f. religion,
151151 g. serving as an election official,
152152 h. seventy-five (75) years of age or older,
153153 i. incarcerated or institutionalized,
154154 j. serving on jury duty, or
155155 k. participation in a confidentiality program.
156156 B. 1. A registered voter applying for an absentee ballot by
157157 means of electronic communication shall provide his or her name,
158158 birth date, an identification number, and other informatio n as may
159159 be prescribed by the Secretary of the S tate Election Board. The
160160 name, birth date, and identification number provided on the
161161 application must match the name, birth date, and identification
162162 number in the voter registration record in order to apply for an
163163 absentee ballot pursuant to this subsection .

215215 2. If the voter does not recall which identificatio n number he
216216 or she included in the voter registration record, the voter may
217217 provide multiple identification numbers, at least one of which must
218218 match the identification number in the voter registration record if
219219 such record included an identification numbe r. If the name, birth
220220 date, or any identification number provided does not match the voter
221221 registration record, the voter shall be informed of the failure to
222222 match the voter registration rec ord and shall be provided
223223 information and instruction to contact the county election board.
224224 3. If the voter registration record on file with the county
225225 election board does not contain a birth date or identification
226226 number, the voter shall not be eligible to apply for an absentee
227227 ballot by means of electronic communicat ion but may apply for an
228228 absentee ballot pursuant to subsection C of this section.
229229 4. Identifying information such as birth date and
230230 identification number shall not be modified online in an existing
231231 voter registration except as provided in Section 4 -109.4 of this
232232 title.
233233 5. No later than January 1, 2023, a registered voter applying
234234 for an absentee ballot pursuant to this subsection who meets the
235235 criteria provided in Section 7-115.1 of this title shall be required
236236 to confirm his or her address prior to submitting an application for
237237 absentee ballot by means of electronic communication.

289289 C. 1. A registered voter applying for an absentee ballot in
290290 person, by United States mail, or by facsimile device shall provide
291291 his or her name, birth date, an identification number, and other
292292 information as may be prescribed by the Secretary of the State
293293 Election Board. The name, birth date, and identification number
294294 provided on the application must match the name, birth date, and
295295 identification number in the voter registration record.
296296 2. If the voter does not recall which identification number he
297297 or she included in the voter registration record, the voter may
298298 provide multiple identification numbers, at least one of which must
299299 match the identification number in the voter registration record if
300300 such record included an identification number. If the voter
301301 registration record does not contain a birth date or an
302302 identification number, the absentee ballot application shall be
303303 accepted without a match of a birth date or an identification
304304 number.
305305 D. For purposes of this section, “identification number” means
306306 a number submitted on the regist ration application pursuant to
307307 paragraph 3 of subsection A of Section 4-112 of this title.
308308 SECTION 2. This act shall become effective November 1, 2023.
