73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
74	74	SECTION 1. AMENDATORY 2 O.S. 2021, Section 7 -403, is
75	75	amended to read as follows:
76	76	Section 7-403. As used in the Oklahoma Milk and Milk Products
77	77	Act:
78	78	1. “Bulk milk hauler/sampler ” means any person collecting
79	79	official samples who may transport raw milk from a farm or raw milk
80	80	products to or from a milk plant, receiving station , or transfer
81	81	station and has in his or her possession a permit from any state to
82	82	sample these products;
83	83	2. “Dairy farm” means any premises owned or operated by a “milk
84	84	producer” where one or more cows or goats are kept, and from which a
85	85	part or all of the milk or milk products is sold or offered for
86	86	sale;

138	138	3. “Donkey milk” means the lacteal secretion, practically free
139	139	from colostrum, obtained by the complete milking of one or more
140	140	healthy donkeys;
141	141	4. “Goat milk” means the lacteal secretion, practically f ree
142	142	from colostrum, obtained by the complete milking of one or more
143	143	healthy goats;
144	144	4. 5. “Grade A milk and milk products ” means milk and milk
145	145	products at any stage from production through pasteurization an d
146	146	packaging, that are of the minimum quality and a re produced, hauled,
147	147	processed and distributed under conditions which meet the
148	148	requirements of the Oklahoma Milk and Milk Produ cts Act;
149	149	5. 6. “Inhibitor” means any chemical or antibiotic substance
150	150	which inhibits or retards the growth of bacteria in milk;
151	151	6. 7. “Milk” means the lacteal secretion, practically free from
152	152	colostrum, obtained by the complete milking of one or more hea lthy
153	153	cows, which contains no t less than eight and one -fourth percent (8
154	154	1/4%) milk solids-not-fat and not less than three and one -fourth
155	155	percent (3 1/4%) milk fat. The term “milk” shall include goat milk,
156	156	fluid market milk, and milk products for the purpo se of distribution
157	157	to the consumer, and may contain optional ingredients define d by the
158	158	State Board of Agriculture and shall incl ude ungraded and Grade A

211	211	7. 8. “Milk contact surface ” means any pipe, tank, equipment,
212	212	or facility which contacts or may contact milk during the produc ing,
213	213	transporting, processing, or distributing o f milk and milk products;
214	214	8. 9. “Milk distribution center” means any premises, owned or
215	215	operated by a “milk distributor”, which distributes and sells or
216	216	offers to sell milk and milk products but does not includ e an
217	217	establishment which sells or offers to s ell Grade A milk and milk
218	218	products at retail;
219	219	9. 10. “Milk facility” means the producing, processing,
220	220	transporting, or distributing premises and facilities which operate
221	221	under an appropriate and valid permit issued by the Commissioner, in
222	222	compliance with the Oklahoma Milk and Milk Products Act and the
223	223	rules of the Board;
224	224	10. 11. “Milk fat” or “butter fat” means the fat of milk;
225	225	11. 12. “Milk plant” means any premises owned or operated by a
226	226	“milk processor” where milk or milk products are collected,
227	227	manufactured, processed, pasteurized, bottled, stored, or prepared
228	228	for distribution for commercial purposes including, but not limited
229	229	to, a receiving or transfer station;
230	230	12. 13. “Milk products” means those products produced or
231	231	obtained from milk or any compo nent or product of milk and defined
232	232	by the Board, including Grade A milk products, ungraded raw milk and
233	233	ungraded milk products;

285	285	13. 14. “Milk tank truck cleaning facility ” means any premises
286	286	or establishment, separate from a milk plant, receiving station , or
287	287	transfer station, where a milk tank truck is cleaned and sanitized;
288	288	14. 15. “Milk tank truck driver ” means any person transporting
289	289	raw or pasteurized milk products between a milk plant, receiving
290	290	station, or transfer station;
291	291	15. 16. “Milk transportation company” means any person
292	292	responsible for a milk tank truck;
293	293	16. 17. “Pasteurized milk” means Grade A raw milk which has
294	294	been pasteurized and stored in accordance with th e chemical,
295	295	bacteriological, and temperature standards required by the Board;
296	296	17. 18. “Receiving station” means any premises whe re raw milk
297	297	is received, collected, handled, stored, or cooled and prepared for
298	298	further transporting;
299	299	18. 19. “Retail food store” means any establishment which
300	300	offers for retail sale packaged or bulk food goods for human
301	301	consumption;
302	302	19. 20. “Transfer station” means any establishment or premises
303	303	where milk or milk products are transferred directly from one milk
304	304	tank truck to another; and
305	305	20. 21. “Ungraded milk products ” and “manufacture grade milk
306	306	products” include, but are not limited to, butter, cheese , dry milk,
307	307	condensed milk, filled or evaporated milk, frozen dairy dessert and
308	308	mello-drink products.

360	360	SECTION 2. AMENDATORY 2 O.S. 2021, Section 7 -414, is
361	361	amended to read as follow s:
362	362	Section 7-414. A. The provisions of the Oklahoma Milk and Milk
363	363	Products Act shall not be construed to:
364	364	1. Include incidental sales of raw milk directly to consumers
365	365	at the farm where the milk is produced;
366	366	2. Preclude the advertising of the incidental sale of goat milk
367	367	or donkey milk; and
368	368	3. Prohibit any farmer or producer from making cheese using
369	369	milk or cream produced on the farm of such farmer or producer.
370	370	B. For purposes of this section, incidental sales of goat milk
371	371	or donkey milk are those sales where the average monthly number of
372	372	gallons sold does not exceed one hundred (100).
373	373	SECTION 3. This act shall become effective November 1, 2023.
