7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 2 O.S. 2021, Section 5 -4.1, is
7979 amended to read as follows:
8080 Section 5-4.1. This act shall be known and may be cite d as the
8181 “Homemade Home Food Freedom Processing Act”.
8282 SECTION 2. AMENDATORY 2 O.S. 2021, Section 5 -4.2, is
8383 amended to read as follows:
8484 Section 5-4.2. As used in the Homemade Home Food Processing
8585 Freedom Act:

139139 2. “Department” means the Oklahoma Department of Agriculture ,
140140 Food, and Forestry;
141141 3. “Home food establishment ” shall mean means a business on the
142142 premises of a residence in which homemade non-time/temperature-
143143 controlled for safety food products are is created for sale or
144144 resale at farmers markets, on site, at cooperatives, through
145145 membership-based buying clubs, at retail establishments, at
146146 restaurants, or for delivery, if the business has gross annual sales
147147 of prepared non-time/temperature-controlled for safety food of less
148148 than Seventy-five Thousand Dollars ($75,000.00) One Hundred Thousand
149149 Dollars ($100,000.00) . Gross annual sales includes all sales of
150150 prepared food produced by the business at any location;
151151 2. “Delivered” shall mean transferred to the customer, either
152152 immediately upon sale or at a time thereafter;
153153 3. 4. “Homemade food product ” shall mean food, including a
154154 beverage, which is produced and, if package d, packaged at a
155155 residence; provided, however, homemade food product shall not mean
156156 alcoholic beverages or unpasteurized milk or canna bis or marijuana
157157 products;
158158 4. 5. “Non-time- or -temperature-controlled for safety food”
159159 shall mean means a food product that does is not require time or
160160 temperature control time/temperature control led for safety
161161 including, but not limited to, baked goods, jams and jellies,

215215 infectious or toxigenic micro organisms, including foo ds that have a
216216 pH level of four and six-tenths (4.6) or below or a water activity
217217 (aw) value of eighty -five one-hundredths (0.85) or less ;
218218 5. 6. “Time- or temperature-controlled for safety food” shall
219219 mean means a food that requires time or temperature control for
220220 safety to limit infectious or toxigenic microorganisms and is in a
221221 form capable of supporting rapid and progressive growth of
222222 infectious or toxigenic microorganisms; pr ovided, however, time- or
223223 temperature-controlled for safety shall not include foods that hav e
224224 a pH level of four and six-tenths (4.6) or below or a water activity
225225 (aw) value of eighty -five one-hundredths (0.85) or less pathogenic
226226 microorganism growth or to xin formation including, but not limited
227227 to, refrigerated or frozen products, low -acid canned foods, d airy
228228 products, seafood products , and bottled water, and:
229229 a. time- or temperature-controlled for safety food
230230 includes an animal food, meaning a food of ani mal
231231 origin that is raw or heat-treated, a food of plant
232232 origin that is heat-treated or consists of raw seed
233233 sprouts, cut melons, cut leafy greens, cut tomatoes or
234234 mixtures of cut tomatoes that are not modified in a
235235 way so that they are unable to support pa thogenic
236236 microorganism growth or toxic for mation, or garlic-in-
237237 oil mixtures that are not modified in a way that

292292 not include an air-cooled hard-boiled egg with shell
293293 intact, or a shell egg that is not hard -boiled but has
294294 been treated to destroy all viable Salmonellae ; a food
295295 with a water activity (aw) value of 0.85 or less ; a
296296 food with a potential of Hydrogen (pH) level of 4.6 or
297297 below when measured at twenty -four degrees Celsius
298298 (24°C) or seventy-five degrees Fahrenheit (75°F) ; a
299299 food, in an unopened hermetically sealed container,
300300 that is commercially processed to achieve and maintain
301301 commercial sterility under conditions of non -
302302 refrigerated storage and distribution ; a food for
303303 which laboratory evidence demonstrates that the rapid
304304 and progressive growth of infectious or toxigenic
305305 microorganisms or the growth of S. Enteritidis in eggs
306306 or C. botulinum cannot occur, such as a food that has
307307 an aw and a pH that are above the levels id entified in
308308 this definition and that may contain a pre servative,
309309 other barrier to the growth of microorganisms, or a
310310 combination of barriers that inhibit the growth of
311311 microorganisms; or a food that does not support the
312312 growth of microorganisms, even thoug h the food may

365365 chemical or physical contaminant at a level sufficient
366366 to cause illness;
367367 6. 7. “Produce” shall mean to prepare a food product by
368368 cooking, baking, drying, mixing, cutting, canning, fermenting,
369369 preserving, dehydrating, growing, raising or other process; and
370370 7. 8. “Producer” shall mean the person who produces a homemade
371371 food product in a home food establishment .
372372 SECTION 3. AMENDATORY 2 O.S. 2021, Section 5 -4.3, is
373373 amended to read as follows:
374374 Section 5-4.3. A. The production and sale of homemade food
375375 products that meet the following conditions shall be exempt from all
376376 licensing and other requirements of the State Depart ment of Health
377377 and the Oklahoma Dep artment of Agriculture, Food, and Forestry:
378378 1. Non-time- or -temperature-controlled-for-safety homemade
379379 food products shall be sold:
380380 a. by the producer directly to the consumer, either in
381381 person or by remote means, inclu ding, but not limited
382382 to, the Internet or telephone, or
383383 b. by a producer’s designated agent or a third-party
384384 vendor, such as a retail or grocery store, farm, farm
385385 stand, farmers market, membership -based buying club,
386386 craft fair or flea market, to the consum er; provided,
387387 the third-party vendor displays a placard where

439439 homemade food products are displayed for sale with the
440440 following disclosure : “This product was produced in a
441441 private residence that is exempt from government
442442 licensing and inspection . This product may contain
443443 allergens.”;
444444 2. Non-time- or -temperature-controlled-for-safety homemade
445445 food products shall be delivered:
446446 a. by the producer or producer ’s designated agent
447447 directly to the consumer or third -party vendor, or
448448 b. by a third-party vendor or a third-party carrier, such
449449 as a parcel delivery service, to the consumer or a
450450 third-party vendor;
451451 3. Time- or temperature-controlled-for-safety homemade food
452452 products shall be sold by the producer directly to the consumer,
453453 either in person or by remote m eans, including, but not limited to ,
454454 the Internet or telephone;
455455 4. Time- or temperature-controlled-for-safety homemade food
456456 products shall be delivered by the producer directly to the
457457 consumer;
458458 5. Before a producer produces and sells time - or temperature-
459459 controlled-for-safety homemade food products, the producer shall
460460 complete and pass food safety training from a list of providers,
461461 including the ServSafe Food Handler Training, approved by the
462462 Oklahoma Department of Agriculture, Food, and Forestry . The food

514514 safety training shall be availab le to complete online and shall not
515515 exceed eight (8) hours in length. The Oklahoma Department of
516516 Agriculture, Food, and Forestry shall make the list of approved
517517 training available on its website by the effective date of this act
518518 November 1, 2021;
519519 6. The following informa tion shall be provided to the consumer
520520 in the format required by subsection B of this section:
521521 a. the name and phone number of the producer,
522522 b. the physical address where the product was produced,
523523 c. a description of the homemade food product,
524524 d. the ingredients of the homemade food product in
525525 descending order of proportion,
526526 e. a statement indicating the presence of any of the
527527 eight most common allergens, including milk, eggs,
528528 peanuts, tree nuts, soy and w heat, and
529529 f. legible print stating, “This product was produced in a
530530 private residence that is exempt from government
531531 licensing and inspection. ”;
532532 7. If the homemade food product is packaged and distributed in
533533 interstate commerce, it shall also be sold and labeled in accordance
534534 with federal law; and
535535 8. Homemade food products shall not contain seafood or meat,
536536 meat by-products or meat food products as defined by Section 301.2
537537 of Title 9 of the Code of Federal Regulations or poultry, poultry

589589 products or poultry food products as defined for purposes of the
590590 federal Poultry Products Inspection Act.
591591 B. The information required by paragraph 6 of subsection A of
592592 this section shall be provided in a legible format of at least 10 -
593593 point font, in the following manner:
594594 1. On a label affixed to the package if the homemad e food
595595 product is packaged;
596596 2. On a label affixed to a container, if the homemade food
597597 product is offered for sale from a bulk container directly to the
598598 consumer;
599599 3. On a placard displayed at the point o f sale, and on a card
600600 or other item that is made av ailable to the consumer and is readily
601601 carriable if the homemade food product is not packaged; and
602602 4. Displayed on the webpage from which the homemade food
603603 product is offered for sale if it is sold on the Internet, provided
604604 that each item sold over the In ternet shall be properly labeled or
605605 shall have a label included in the shipping container .
606606 C. A home food establishment may sell non-time/non-temperature
607607 controlled for safety food on site, by delivery , at a farmers
608608 market, through a cooperative, at retai l establishments, at
609609 restaurants, or through a membership-based buying club. The
610610 Department may promulgate rules to allow sales at other locations or
611611 by other means.

663663 D. A home food establishment shall be exempt from the licensing
664664 and other requirements o f the State Department of Health.
665665 E. The Department may, upon a consumer complaint, request
666666 written documentation to verify the gross annual sales of a home
667667 food establishment.
668668 SECTION 4. AMENDATORY 2 O.S. 2021, Section 5 -4.4, is
669669 amended to read as follows:
670670 Section 5-4.4. A. Nothing in the Homemade Home Food Freedom
671671 Processing Act shall be construed to impede the State Department of
672672 Health in any investigation of a reported food borne illness. Upon
673673 receipt of a consumer complaint, the Oklahoma Department of
674674 Agriculture, Food, and Forestry shall have the authority to request
675675 proof of completion of the food safety training, verify a producer ’s
676676 gross sales, and ensure a producer has complied with the act’s
677677 labeling and delivery require ments. The Oklahoma Department of
678678 Agriculture, Food, and Forestry may fine a producer who violates
679679 this act in accordance with Section 5 -4.5 of this title.
680680 B. A home food establishment that sells non-time or non-
681681 temperature controlled for safety food sha ll affix a label, in a
682682 format approved by the Food and Drug Administration , that contains
683683 the following information:
684684 1. The name, address, and telephone number or web address of
685685 the home food establish ment;
686686 2. The name of the prepared food;

740740 4. A list of ingredients.
741741 C. The following statement printed in at least 10-point type in
742742 a color that provides a clear contrast to the background of the
743743 label: “Made in a home food establishment that is not licensed by
744744 the State Department of Health. ” must be affixed.
745745 SECTION 5. AMENDATORY 2 O.S. 2021, Section 5 -4.5, is
746746 amended to read as follows:
747747 Section 5-4.5. Violation of the Homemade Home Food Processing
748748 Freedom Act shall be a misdemeanor and shall be punishable by a fine
749749 not exceeding Three Hundred Dollars ($300.00) One Hundred Dollars
750750 ($100.00).
751751 SECTION 6. AMENDATORY 2 O.S. 2021, Section 5-4.6, is
752752 amended to read as follows:
753753 Section 5-4.6. Nothing in the Homemade Home Food Processing
754754 Freedom Act shall be construed to prevent counties from enacting
755755 ordinances regulating the operation of home food establishme nts,
756756 provided such ordinances do not conflict with the provisions of the
757757 Homemade Home Food Processing Freedom Act or impede or restrict the
758758 sale of homemade food products in compliance with the law .
759759 SECTION 7. This act shall become effect ive November 1, 2023.
