77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 2 O.S. 2021, Section 5 -4.1, is
79	79	amended to read as follows:
80	80	Section 5-4.1. This act shall be known and may be cite d as the
81	81	“Homemade Home Food Freedom Processing Act”.
82	82	SECTION 2. AMENDATORY 2 O.S. 2021, Section 5 -4.2, is
83	83	amended to read as follows:
84	84	Section 5-4.2. As used in the Homemade Home Food Processing
85	85	Freedom Act:
86	86	1. “Delivered” shall mean transferred to the customer, either

139	139	2. “Department” means the Oklahoma Department of Agriculture ,
140	140	Food, and Forestry;
141	141	3. “Home food establishment ” shall mean means a business on the
142	142	premises of a residence in which homemade non-time/temperature-
143	143	controlled for safety food products are is created for sale or
144	144	resale at farmers markets, on site, at cooperatives, through
145	145	membership-based buying clubs, at retail establishments, at
146	146	restaurants, or for delivery, if the business has gross annual sales
147	147	of prepared non-time/temperature-controlled for safety food of less
148	148	than Seventy-five Thousand Dollars ($75,000.00) One Hundred Thousand
149	149	Dollars ($100,000.00) . Gross annual sales includes all sales of
150	150	prepared food produced by the business at any location;
151	151	2. “Delivered” shall mean transferred to the customer, either
152	152	immediately upon sale or at a time thereafter;
153	153	3. 4. “Homemade food product ” shall mean food, including a
154	154	beverage, which is produced and, if package d, packaged at a
155	155	residence; provided, however, homemade food product shall not mean
156	156	alcoholic beverages or unpasteurized milk or canna bis or marijuana
157	157	products;
158	158	4. 5. “Non-time- or -temperature-controlled for safety food”
159	159	shall mean means a food product that does is not require time or
160	160	temperature control time/temperature control led for safety
161	161	including, but not limited to, baked goods, jams and jellies,
162	162	candies, dried mixes, spices, some sauces and liquids, pickles , and

215	215	infectious or toxigenic micro organisms, including foo ds that have a
216	216	pH level of four and six-tenths (4.6) or below or a water activity
217	217	(aw) value of eighty -five one-hundredths (0.85) or less ;
218	218	5. 6. “Time- or temperature-controlled for safety food” shall
219	219	mean means a food that requires time or temperature control for
220	220	safety to limit infectious or toxigenic microorganisms and is in a
221	221	form capable of supporting rapid and progressive growth of
222	222	infectious or toxigenic microorganisms; pr ovided, however, time- or
223	223	temperature-controlled for safety shall not include foods that hav e
224	224	a pH level of four and six-tenths (4.6) or below or a water activity
225	225	(aw) value of eighty -five one-hundredths (0.85) or less pathogenic
226	226	microorganism growth or to xin formation including, but not limited
227	227	to, refrigerated or frozen products, low -acid canned foods, d airy
228	228	products, seafood products , and bottled water, and:
229	229	a. time- or temperature-controlled for safety food
230	230	includes an animal food, meaning a food of ani mal
231	231	origin that is raw or heat-treated, a food of plant
232	232	origin that is heat-treated or consists of raw seed
233	233	sprouts, cut melons, cut leafy greens, cut tomatoes or
234	234	mixtures of cut tomatoes that are not modified in a
235	235	way so that they are unable to support pa thogenic
236	236	microorganism growth or toxic for mation, or garlic-in-
237	237	oil mixtures that are not modified in a way that

293	293	intact, or a shell egg that is not hard -boiled but has
294	294	been treated to destroy all viable Salmonellae ; a food
295	295	with a water activity (aw) value of 0.85 or less ; a
296	296	food with a potential of Hydrogen (pH) level of 4.6 or
297	297	below when measured at twenty -four degrees Celsius
298	298	(24°C) or seventy-five degrees Fahrenheit (75°F) ; a
299	299	food, in an unopened hermetically sealed container,
300	300	that is commercially processed to achieve and maintain
301	301	commercial sterility under conditions of non -
302	302	refrigerated storage and distribution ; a food for
303	303	which laboratory evidence demonstrates that the rapid
304	304	and progressive growth of infectious or toxigenic
305	305	microorganisms or the growth of S. Enteritidis in eggs
306	306	or C. botulinum cannot occur, such as a food that has
307	307	an aw and a pH that are above the levels id entified in
308	308	this definition and that may contain a pre servative,
309	309	other barrier to the growth of microorganisms, or a
310	310	combination of barriers that inhibit the growth of
311	311	microorganisms; or a food that does not support the
312	312	growth of microorganisms, even thoug h the food may

365	365	chemical or physical contaminant at a level sufficient
366	366	to cause illness;
367	367	6. 7. “Produce” shall mean to prepare a food product by
368	368	cooking, baking, drying, mixing, cutting, canning, fermenting,
369	369	preserving, dehydrating, growing, raising or other process; and
370	370	7. 8. “Producer” shall mean the person who produces a homemade
371	371	food product in a home food establishment .
372	372	SECTION 3. AMENDATORY 2 O.S. 2021, Section 5 -4.3, is
373	373	amended to read as follows:
374	374	Section 5-4.3. A. The production and sale of homemade food
375	375	products that meet the following conditions shall be exempt from all
376	376	licensing and other requirements of the State Depart ment of Health
377	377	and the Oklahoma Dep artment of Agriculture, Food, and Forestry:
378	378	1. Non-time- or -temperature-controlled-for-safety homemade
379	379	food products shall be sold:
380	380	a. by the producer directly to the consumer, either in
381	381	person or by remote means, inclu ding, but not limited
382	382	to, the Internet or telephone, or
383	383	b. by a producer’s designated agent or a third-party
384	384	vendor, such as a retail or grocery store, farm, farm
385	385	stand, farmers market, membership -based buying club,
386	386	craft fair or flea market, to the consum er; provided,
387	387	the third-party vendor displays a placard where

440	440	following disclosure : “This product was produced in a
441	441	private residence that is exempt from government
442	442	licensing and inspection . This product may contain
443	443	allergens.”;
444	444	2. Non-time- or -temperature-controlled-for-safety homemade
445	445	food products shall be delivered:
446	446	a. by the producer or producer ’s designated agent
447	447	directly to the consumer or third -party vendor, or
448	448	b. by a third-party vendor or a third-party carrier, such
449	449	as a parcel delivery service, to the consumer or a
450	450	third-party vendor;
451	451	3. Time- or temperature-controlled-for-safety homemade food
452	452	products shall be sold by the producer directly to the consumer,
453	453	either in person or by remote m eans, including, but not limited to ,
454	454	the Internet or telephone;
455	455	4. Time- or temperature-controlled-for-safety homemade food
456	456	products shall be delivered by the producer directly to the
457	457	consumer;
458	458	5. Before a producer produces and sells time - or temperature-
459	459	controlled-for-safety homemade food products, the producer shall
460	460	complete and pass food safety training from a list of providers,
461	461	including the ServSafe Food Handler Training, approved by the
462	462	Oklahoma Department of Agriculture, Food, and Forestry . The food

515	515	exceed eight (8) hours in length. The Oklahoma Department of
516	516	Agriculture, Food, and Forestry shall make the list of approved
517	517	training available on its website by the effective date of this act
518	518	November 1, 2021;
519	519	6. The following informa tion shall be provided to the consumer
520	520	in the format required by subsection B of this section:
521	521	a. the name and phone number of the producer,
522	522	b. the physical address where the product was produced,
523	523	c. a description of the homemade food product,
524	524	d. the ingredients of the homemade food product in
525	525	descending order of proportion,
526	526	e. a statement indicating the presence of any of the
527	527	eight most common allergens, including milk, eggs,
528	528	peanuts, tree nuts, soy and w heat, and
529	529	f. legible print stating, “This product was produced in a
530	530	private residence that is exempt from government
531	531	licensing and inspection. ”;
532	532	7. If the homemade food product is packaged and distributed in
533	533	interstate commerce, it shall also be sold and labeled in accordance
534	534	with federal law; and
535	535	8. Homemade food products shall not contain seafood or meat,
536	536	meat by-products or meat food products as defined by Section 301.2
537	537	of Title 9 of the Code of Federal Regulations or poultry, poultry

590	590	federal Poultry Products Inspection Act.
591	591	B. The information required by paragraph 6 of subsection A of
592	592	this section shall be provided in a legible format of at least 10 -
593	593	point font, in the following manner:
594	594	1. On a label affixed to the package if the homemad e food
595	595	product is packaged;
596	596	2. On a label affixed to a container, if the homemade food
597	597	product is offered for sale from a bulk container directly to the
598	598	consumer;
599	599	3. On a placard displayed at the point o f sale, and on a card
600	600	or other item that is made av ailable to the consumer and is readily
601	601	carriable if the homemade food product is not packaged; and
602	602	4. Displayed on the webpage from which the homemade food
603	603	product is offered for sale if it is sold on the Internet, provided
604	604	that each item sold over the In ternet shall be properly labeled or
605	605	shall have a label included in the shipping container .
606	606	C. A home food establishment may sell non-time/non-temperature
607	607	controlled for safety food on site, by delivery , at a farmers
608	608	market, through a cooperative, at retai l establishments, at
609	609	restaurants, or through a membership-based buying club. The
610	610	Department may promulgate rules to allow sales at other locations or
611	611	by other means.

664	664	and other requirements o f the State Department of Health.
665	665	E. The Department may, upon a consumer complaint, request
666	666	written documentation to verify the gross annual sales of a home
667	667	food establishment.
668	668	SECTION 4. AMENDATORY 2 O.S. 2021, Section 5 -4.4, is
669	669	amended to read as follows:
670	670	Section 5-4.4. A. Nothing in the Homemade Home Food Freedom
671	671	Processing Act shall be construed to impede the State Department of
672	672	Health in any investigation of a reported food borne illness. Upon
673	673	receipt of a consumer complaint, the Oklahoma Department of
674	674	Agriculture, Food, and Forestry shall have the authority to request
675	675	proof of completion of the food safety training, verify a producer ’s
676	676	gross sales, and ensure a producer has complied with the act’s
677	677	labeling and delivery require ments. The Oklahoma Department of
678	678	Agriculture, Food, and Forestry may fine a producer who violates
679	679	this act in accordance with Section 5 -4.5 of this title.
680	680	B. A home food establishment that sells non-time or non-
681	681	temperature controlled for safety food sha ll affix a label, in a
682	682	format approved by the Food and Drug Administration , that contains
683	683	the following information:
684	684	1. The name, address, and telephone number or web address of
685	685	the home food establish ment;
686	686	2. The name of the prepared food;

742	742	a color that provides a clear contrast to the background of the
743	743	label: “Made in a home food establishment that is not licensed by
744	744	the State Department of Health. ” must be affixed.
745	745	SECTION 5. AMENDATORY 2 O.S. 2021, Section 5 -4.5, is
746	746	amended to read as follows:
747	747	Section 5-4.5. Violation of the Homemade Home Food Processing
748	748	Freedom Act shall be a misdemeanor and shall be punishable by a fine
749	749	not exceeding Three Hundred Dollars ($300.00) One Hundred Dollars
750	750	($100.00).
751	751	SECTION 6. AMENDATORY 2 O.S. 2021, Section 5-4.6, is
752	752	amended to read as follows:
753	753	Section 5-4.6. Nothing in the Homemade Home Food Processing
754	754	Freedom Act shall be construed to prevent counties from enacting
755	755	ordinances regulating the operation of home food establishme nts,
756	756	provided such ordinances do not conflict with the provisions of the
757	757	Homemade Home Food Processing Freedom Act or impede or restrict the
758	758	sale of homemade food products in compliance with the law .
759	759	SECTION 7. This act shall become effect ive November 1, 2023.
