75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
76	76	SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.3, as
77	77	last amended by Section 1, Chapter 402, O.S.L. 2022 (51 O.S. Supp.
78	78	2022, Section 24A.3), is amended to read as follows:
79	79	Section 24A.3. As used in the Oklahoma Open Rec ords Act:
80	80	1. “Record” means all documents including, but not limited to,
81	81	any book, paper, photograph, microfilm, data files created by or
82	82	used with computer software, computer tape, disk, rec ord, sound
83	83	recording, film recording, video record or other mate rial regardless
84	84	of physical form or characteristic , created by, received by, under
85	85	the authority of, or coming into the custody, control or possession
86	86	of public officials, public bodies or their representatives in
87	87	connection with the transaction of public business, the expenditure

147	147	d. personal financial information, credit reports or
148	148	other financial data obtained by or submitted to a
149	149	public body for the purpose of evaluating credit
150	150	worthiness, obtaining a licen se, permit or for the
151	151	purpose of becoming qualified to contract with a
152	152	public body,
153	153	e. any digital audio/video recordings of the toll
154	154	collection and safeguarding activities of the Oklahoma
155	155	Transportation Authority,
156	156	f. any personal information provided by a guest at any
157	157	facility owned or operated by the Oklahoma Tourism and
158	158	Recreation Department to obtain any service at t he
159	159	facility or by a purchaser of a product sold by or
160	160	through the Oklahoma Tourism and Re creation

223	223	defined by the Driver ’s Privacy Protection Act,
224	224	18 United States Code, Sections 2721 through
225	225	2725, which are stored and maintained by the
226	226	Department of Public Safety, or
227	227	i. any portion of any document or information provided to
228	228	an agency or entity of the state or a political
229	229	subdivision to obtain licensure under the laws of this
230	230	state or a political subdivision that contains an
231	231	applicant’s personal address, personal phone number,
232	232	personal electronic mail address or other contact
233	233	information. Provided , however, lists of persons
234	234	licensed, the existence of a license of a person, or a
235	235	business or commercial address, or other business or
236	236	commercial information disclosable under state law

289	289	public record;
290	290	2. “Public body” shall include, but not be limited to , any
291	291	office, department, board, bureau, commission, agency, trusteeship,
292	292	authority, council, committee, trust or any entity cr eated by a
293	293	trust, county, city, village, town, township, distri ct, school
294	294	district, fair board, court, executive office, advisory group, tas k
295	295	force, study group or any subdivision thereof, s upported in whole or
296	296	in part by public funds or entrusted with th e expenditure of public
297	297	funds or administering or operating pub lic property, and all
298	298	committees, or subcommittees thereof. Except for the re cords
299	299	required by Section 24A.4 of this title, “public body” does not mean
300	300	judges, justices, the Council on Judicia l Complaints, the
301	301	Legislature or legislators. “Public body” shall not include an
302	302	organization that is exempt from federal income tax under S ection
303	303	501(c)(3) of the Internal Revenue Code of 1 986, as amended, and
304	304	whose sole beneficiary is a college or university, or an affiliated
305	305	entity of the college or university, that is a member of The
306	306	Oklahoma State System of Higher Education . Such organization shall
307	307	not receive direct appropria tions from the Oklahoma Legislature.
308	308	The following persons shall not b e eligible to serve as a voting
309	309	member of the governing bo ard of the organization:
310	310	a. a member, officer, or employee of the Oklahoma State
311	311	Regents for Higher Education ,

365	365	beneficiary of the organization, or
366	366	c. an officer or employee of the college or university
367	367	that is the sole beneficiary of th e organization;
368	368	3. “Public office” means the physical location where public
369	369	bodies conduct business or keep record s;
370	370	4. “Public official” means any official or employee of any
371	371	public body as defined herein; and
372	372	5. “Law enforcement agency” means any public body charged with
373	373	enforcing state or local crim inal laws and initiating criminal
374	374	prosecutions including, but not limited to, police departments,
375	375	county sheriffs, the Departm ent of Public Safety, the Oklahoma State
376	376	Bureau of Narcotics and Dangerous Drugs Control, the Alcoholic
377	377	Beverage Laws Enforcement Commission, and the Oklahoma State Bureau
378	378	of Investigation.
379	379	SECTION 2. This act shall become effective November 1, 2023.
