7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 21 O.S. 20 21, Section 1533, is
7777 amended to read as follows:
7878 Section 1533. A. Except as provided in subsection B of this
7979 section, every person who falsely personates any public officer,
8080 civil or military, any firefig hter, any law enforcement officer, any
8181 emergency medical technician or other emergency medical care
8282 provider, or any private individual having special au thority by law
8383 to perform any act affecting the rights or interests of another, or
8484 who assumes, without authority, any uniform or badge by which such
8585 officers or persons are usually distinguished, and in such assumed
8686 character does any act whereby another person is injured, defrauded,
8787 harassed, vexed or annoyed, upon conviction, is guilty of a

139139 misdemeanor punishable by imprisonment in the county jail not
140140 exceeding six (6) months, or by a fine not exceeding Two Thousand
141141 Dollars ($2,000.00), or by both such f ine and imprisonment.
142142 B. Every person who falsely personates any public officer or
143143 any law enforcement officer in connection with or relating to any
144144 sham legal process shall, upon conviction, be guilty of a felony,
145145 punishable by imprisonment in the custod y of the Department of
146146 Corrections for not more than two (2) years, or a fine not exceeding
147147 Five Thousand Dollars ($5,000.00), or both such fine and
148148 imprisonment.
149149 C. Every person who falsely asserts authority of law not
150150 provided for by federal or state la w in connection with any sham
151151 legal process shall, upon conviction, be guilty of a felony,
152152 punishable by imprisonment in the custody of the Department o f
153153 Corrections for not more than two (2) years, or a fine not exceeding
154154 Five Thousand Dollars ($5,000.00) , or both such fine and
155155 imprisonment.
156156 D. Every person who, while acting falsely in asserting
157157 authority of law, attempts to intimidate or hinder a publi c official
158158 or law enforcement officer in the discharge of official duties by
159159 means of threats, harassmen t, physical abuse, or use of sham legal
160160 process shall, upon conviction, be guilty of a felony punishabl e by
161161 imprisonment in the custody of the Departmen t of Corrections for not

215215 E. Any person who, without authority under federal or state
216216 law, acts as a supreme court justice, a district c ourt judge, an
217217 associate district judge, a special judge, a magistrate, a clerk of
218218 the court or deputy, a notary public, a juror or other official
219219 holding authority to determine a controversy or adjudicate t he
220220 rights or interests of others, or signs a docu ment in such capacity,
221221 shall, upon conviction, be guilty of a felony punishable by
222222 imprisonment in the c ustody of the Department of Corrections for not
223223 more than two (2) years, or a fine not exceeding Five T housand
224224 Dollars ($5,000.00), or both such fine an d imprisonment.
225225 F. Any person who, without authority under federal or state
226226 law, acts as a supreme cour t justice, a district c ourt judge, an
227227 associate district ju dge, a special judge, a magistrate, a clerk of
228228 the court or deputy, a notary public, a juro r, or other official
229229 holding authority signs a document in such capacity to wrongfully
230230 transfer real proper ty which is the personal residence of another ,
231231 shall, upon conviction, be guilty of a felony punishabl e by
232232 imprisonment in the custody of the Departme nt of Corrections for not
233233 more than ten (10) years, or a fine not exceeding Fi fty Thousand
234234 Dollars ($50,000.00), or both such fine an d imprisonment.
235235 G. Every person who uses any motor vehicle or motor -driven
236236 cycle usually distinguished as a law enforcement vehicle or equips

288288 any motor vehicle or motor -driven cycle with any spot lamps, audible
289289 sirens, or flashing lights, in violation of Section 12-217, 12-218
290290 or 12-227 of Title 47 of the Oklahoma Statutes, or i n any other
291291 manner uses any motor vehicle or motor -driven cycle:
292292 1. Which, by markings that conform to or imitate the markings
293293 required or authorized in subsection B of Section 151 of Title 47 of
294294 the Oklahoma Statutes and used by the Oklahoma Highway Patr ol
295295 Division of the Department of Public Safety, co nveys to any person
296296 the impression or appearance that it is a vehicle of the Oklahoma
297297 Highway Patrol shall, upon conviction, be gui lty of a misdemeanor
298298 punishable by imprisonment in the county jail for not more than one
299299 (1) year, or by a fine not exceeding Five Hundred Dollars ($500.00),
300300 or both fine and imprisonment; provided, nothing in this paragraph
301301 shall be construed to prohibit the use of such a vehicle for
302302 exhibitions, club activities, parades, and ot her functions of public
303303 interest and which is not used on the public roads, streets, and
304304 highways for regular transportation; or
305305 2. For the purpose of f alsely personating a law enf orcement
306306 officer and who in such assumed character commits any act whereby
307307 another person is injured, defrauded, harassed, ve xed or annoyed
308308 shall, upon conviction, be guilty of a felony punishable by
309309 imprisonment in the custody of the Department of Correct ions not
310310 exceeding ten (10) years, or by a fine not exceeding Ten Thousand
311311 Dollars ($10,000.00), or by both such fine and imp risonment.

363363 G. H. 1. Any person who displays or causes to be displayed the
364364 words “State Police” alone or in conjunction with any othe r word or
365365 words on any motor vehicle, badge, clothing, identification ca rd, or
366366 any other object or document with the inten t to communicate peace
367367 officer or investigating authority shall, upon conviction, be guilty
368368 of a misdemeanor punishable by a fine not exceeding One Thousand
369369 Dollars ($1,000.00). This paragraph shall not ap ply to any officer
370370 with statewide investigatory or law enforcement authority.
371371 2. Any person who displays or causes to display such words as
372372 provided in this subsection for the purpose of falsely personating a
373373 law enforcement officer and as such commits an y act whereby another
374374 person is injured, defrauded , harassed, vexed or annoyed shall, upon
375375 conviction, be guilty of a felony punishable by imprisonment i n the
376376 custody of the Department of Corrections not exceeding ten (10)
377377 years, or by a fine not exceeding Ten Thousand Dollars ($10,000.00),
378378 or by both such fine and imprisonment.
379379 H. I. As used in this section:
380380 1. “Sham legal process” means the issuance, d isplay, delivery,
381381 distribution, reliance on as lawful authority, or other use of an
382382 instrument that is not lawfully issued, whether or not the
383383 instrument is produced for inspection or actually exists, and
384384 purports to do any of the following:
385385 a. to be a summons, subpoena, judgment, arrest w arrant,
386386 search warrant, or other order of a court recognized

438438 by the laws of this state, a law enforcement officer
439439 commissioned pursuant to state or federal law or the
440440 law of a federally recognized Indian tribe, or a
441441 legislative, executive, or administrativ e agency
442442 established by state or federal law or the law of a
443443 federally recognized Indian tribe,
444444 b. to assert jurisdicti on or authority over or determine
445445 or adjudicate the legal or equitable status, rights,
446446 duties, powers, or privileges of any person or
447447 property, or
448448 c. to require or authorize the search, seizure,
449449 indictment, arrest, trial, or sentencing of any person
450450 or property; and
451451 2. “Lawfully issued” means adopted, issued, or rendered in
452452 accordance with the applicable s tatutes, rules, regulations, and
453453 ordinances of the United States, a state, or a political subdivision
454454 of a state.
455455 I. J. It shall not be a defense to a p rosecution under
456456 subsection B, C, D or E of this section that:
457457 1. The recipient of the sham legal proc ess did not accept or
458458 believe in the authority falsely asserted in the sham legal process;
459459 2. The person violating subsection B, C, D or E of this secti on
460460 does not believe in the jurisdiction or authority of this state or
461461 of the United States government; or

513513 3. The office the person violatin g subsection B, C, D or E of

515515 office recognized by state or federal law.
516516 SECTION 2. This act shall become effective November 1, 2023.
