75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 21 O.S. 20 21, Section 1533, is
77	77	amended to read as follows:
78	78	Section 1533. A. Except as provided in subsection B of this
79	79	section, every person who falsely personates any public officer,
80	80	civil or military, any firefig hter, any law enforcement officer, any
81	81	emergency medical technician or other emergency medical care
82	82	provider, or any private individual having special au thority by law
83	83	to perform any act affecting the rights or interests of another, or
84	84	who assumes, without authority, any uniform or badge by which such
85	85	officers or persons are usually distinguished, and in such assumed
86	86	character does any act whereby another person is injured, defrauded,
87	87	harassed, vexed or annoyed, upon conviction, is guilty of a

140	140	exceeding six (6) months, or by a fine not exceeding Two Thousand
141	141	Dollars ($2,000.00), or by both such f ine and imprisonment.
142	142	B. Every person who falsely personates any public officer or
143	143	any law enforcement officer in connection with or relating to any
144	144	sham legal process shall, upon conviction, be guilty of a felony,
145	145	punishable by imprisonment in the custod y of the Department of
146	146	Corrections for not more than two (2) years, or a fine not exceeding
147	147	Five Thousand Dollars ($5,000.00), or both such fine and
148	148	imprisonment.
149	149	C. Every person who falsely asserts authority of law not
150	150	provided for by federal or state la w in connection with any sham
151	151	legal process shall, upon conviction, be guilty of a felony,
152	152	punishable by imprisonment in the custody of the Department o f
153	153	Corrections for not more than two (2) years, or a fine not exceeding
154	154	Five Thousand Dollars ($5,000.00) , or both such fine and
155	155	imprisonment.
156	156	D. Every person who, while acting falsely in asserting
157	157	authority of law, attempts to intimidate or hinder a publi c official
158	158	or law enforcement officer in the discharge of official duties by
159	159	means of threats, harassmen t, physical abuse, or use of sham legal
160	160	process shall, upon conviction, be guilty of a felony punishabl e by
161	161	imprisonment in the custody of the Departmen t of Corrections for not

215	215	E. Any person who, without authority under federal or state
216	216	law, acts as a supreme court justice, a district c ourt judge, an
217	217	associate district judge, a special judge, a magistrate, a clerk of
218	218	the court or deputy, a notary public, a juror or other official
219	219	holding authority to determine a controversy or adjudicate t he
220	220	rights or interests of others, or signs a docu ment in such capacity,
221	221	shall, upon conviction, be guilty of a felony punishable by
222	222	imprisonment in the c ustody of the Department of Corrections for not
223	223	more than two (2) years, or a fine not exceeding Five T housand
224	224	Dollars ($5,000.00), or both such fine an d imprisonment.
225	225	F. Any person who, without authority under federal or state
226	226	law, acts as a supreme cour t justice, a district c ourt judge, an
227	227	associate district ju dge, a special judge, a magistrate, a clerk of
228	228	the court or deputy, a notary public, a juro r, or other official
229	229	holding authority signs a document in such capacity to wrongfully
230	230	transfer real proper ty which is the personal residence of another ,
231	231	shall, upon conviction, be guilty of a felony punishabl e by
232	232	imprisonment in the custody of the Departme nt of Corrections for not
233	233	more than ten (10) years, or a fine not exceeding Fi fty Thousand
234	234	Dollars ($50,000.00), or both such fine an d imprisonment.
235	235	G. Every person who uses any motor vehicle or motor -driven
236	236	cycle usually distinguished as a law enforcement vehicle or equips

288	288	any motor vehicle or motor -driven cycle with any spot lamps, audible
289	289	sirens, or flashing lights, in violation of Section 12-217, 12-218
290	290	or 12-227 of Title 47 of the Oklahoma Statutes, or i n any other
291	291	manner uses any motor vehicle or motor -driven cycle:
292	292	1. Which, by markings that conform to or imitate the markings
293	293	required or authorized in subsection B of Section 151 of Title 47 of
294	294	the Oklahoma Statutes and used by the Oklahoma Highway Patr ol
295	295	Division of the Department of Public Safety, co nveys to any person
296	296	the impression or appearance that it is a vehicle of the Oklahoma
297	297	Highway Patrol shall, upon conviction, be gui lty of a misdemeanor
298	298	punishable by imprisonment in the county jail for not more than one
299	299	(1) year, or by a fine not exceeding Five Hundred Dollars ($500.00),
300	300	or both fine and imprisonment; provided, nothing in this paragraph
301	301	shall be construed to prohibit the use of such a vehicle for
302	302	exhibitions, club activities, parades, and ot her functions of public
303	303	interest and which is not used on the public roads, streets, and
304	304	highways for regular transportation; or
305	305	2. For the purpose of f alsely personating a law enf orcement
306	306	officer and who in such assumed character commits any act whereby
307	307	another person is injured, defrauded, harassed, ve xed or annoyed
308	308	shall, upon conviction, be guilty of a felony punishable by
309	309	imprisonment in the custody of the Department of Correct ions not
310	310	exceeding ten (10) years, or by a fine not exceeding Ten Thousand
311	311	Dollars ($10,000.00), or by both such fine and imp risonment.

363	363	G. H. 1. Any person who displays or causes to be displayed the
364	364	words “State Police” alone or in conjunction with any othe r word or
365	365	words on any motor vehicle, badge, clothing, identification ca rd, or
366	366	any other object or document with the inten t to communicate peace
367	367	officer or investigating authority shall, upon conviction, be guilty
368	368	of a misdemeanor punishable by a fine not exceeding One Thousand
369	369	Dollars ($1,000.00). This paragraph shall not ap ply to any officer
370	370	with statewide investigatory or law enforcement authority.
371	371	2. Any person who displays or causes to display such words as
372	372	provided in this subsection for the purpose of falsely personating a
373	373	law enforcement officer and as such commits an y act whereby another
374	374	person is injured, defrauded , harassed, vexed or annoyed shall, upon
375	375	conviction, be guilty of a felony punishable by imprisonment i n the
376	376	custody of the Department of Corrections not exceeding ten (10)
377	377	years, or by a fine not exceeding Ten Thousand Dollars ($10,000.00),
378	378	or by both such fine and imprisonment.
379	379	H. I. As used in this section:
380	380	1. “Sham legal process” means the issuance, d isplay, delivery,
381	381	distribution, reliance on as lawful authority, or other use of an
382	382	instrument that is not lawfully issued, whether or not the
383	383	instrument is produced for inspection or actually exists, and
384	384	purports to do any of the following:
385	385	a. to be a summons, subpoena, judgment, arrest w arrant,
386	386	search warrant, or other order of a court recognized

439	439	commissioned pursuant to state or federal law or the
440	440	law of a federally recognized Indian tribe, or a
441	441	legislative, executive, or administrativ e agency
442	442	established by state or federal law or the law of a
443	443	federally recognized Indian tribe,
444	444	b. to assert jurisdicti on or authority over or determine
445	445	or adjudicate the legal or equitable status, rights,
446	446	duties, powers, or privileges of any person or
447	447	property, or
448	448	c. to require or authorize the search, seizure,
449	449	indictment, arrest, trial, or sentencing of any person
450	450	or property; and
451	451	2. “Lawfully issued” means adopted, issued, or rendered in
452	452	accordance with the applicable s tatutes, rules, regulations, and
453	453	ordinances of the United States, a state, or a political subdivision
454	454	of a state.
455	455	I. J. It shall not be a defense to a p rosecution under
456	456	subsection B, C, D or E of this section that:
457	457	1. The recipient of the sham legal proc ess did not accept or
458	458	believe in the authority falsely asserted in the sham legal process;
459	459	2. The person violating subsection B, C, D or E of this secti on
460	460	does not believe in the jurisdiction or authority of this state or
461	461	of the United States government; or
