85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. AMENDATORY Rule 2.30 of the Rules of the
87	87	Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
88	88	as follows:
89	89	Rule 2.30. A candidate committee shall not accept a
90	90	contribution from the aut horized committee of a candidate for
91	91	federal office. A candidate committee shall not make a contribution
92	92	to any other candidate for s tate or federal office.

144	144	SECTION 2. AMENDATORY Rule 2.33 of the Rules of the
145	145	Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
146	146	as follows:
147	147	Rule 2.33. (A) A. No person shall make, and no limited
148	148	committee shall accept, a contribution to an y limited committee in
149	149	excess of Five Thousand Dollars ($5,000.00) in any calendar year,
150	150	except as otherwise permitted by law or these Rules. A contribution
151	151	to a limited committee that is designated directly or indirectly to
152	152	be used for the benefit of a p articular candidate or candidates
153	153	shall be considered a contribution by the contributor to the
154	154	candidate or candidates.
155	155	(B) B. No limited committee shall make, and no political party
156	156	committee shall accept, a contribution to the political party
157	157	committee in excess of Ten Thousand Dollars ($10,00 0.00) in any
158	158	calendar year.
159	159	(C) C. No limited committee or unlimited committee shall make,
160	160	and no other limited committee or unlimited committee shall accept,
161	161	a contribution to another limited committee or unlimited committee
162	162	in excess of Five Thousand Dollars ($5,000.00) in any calendar year.
163	163	(D) D. No limited committee shall make, and no candidate
164	164	committee shall accept, a contribution to any candida te committee in
165	165	excess of Five Thousand Dollars ($5,000.00) prio r to a primary

220	220	a candidate whose name will appear on the b allot for a runoff
221	221	primary election in excess of Five Thousan d Dollars ($5,000.00)
222	222	prior to a runoff primar y election. Provided, however, after the
223	223	primary election a limited committee that has made a contribution of
224	224	Five Thousand Dollars ($5,000.00) or l ess to the candidate committee
225	225	prior to the primary election may make an additional contribution of
226	226	no more than Five Thousand Dollars ($5,000.00) to the can didate
227	227	committee prior to the runoff primary election.
228	228	(F) F. No limited committee shall make, and no candidate
229	229	committee shall accept, a contribution to any c andidate committee
230	230	prior to a general election in excess of Five Thousand Dollars
231	231	($5,000.00). Provided, however, after the primary election or
232	232	runoff primary election, whichever is the last for det ermining a
233	233	political party’s nominee, a limited committee that has made a
234	234	contribution of Five Thousand Dollars ($5,000.00) or less to the
235	235	candidate committee prior to the primary election or runoff primary
236	236	election, or both, may make an additional contrib ution of no more
237	237	than Five Thousand Dollars ($5,000.00) t o the candidate committ ee
238	238	prior to the general election.
239	239	(G) G. After the general election, a l imited committee that has
240	240	made no contribution to a candidate or a contribution of less than
241	241	Five Thousand Dollars ($5,000.00) in the aggregate under the

299	299	subsections (D) D, (E) E and (F) F or in excess of Five Thousand
300	300	Dollars ($5,000.00) to the candidate co mmittee of a candidate who is
301	301	unopposed for election.
302	302	(I) I. For purposes of this se ction, “contribution” shall
303	303	include multiple contr ibutions, the amounts of which shall be
304	304	aggregated.
305	305	(J) J. A limited committee may make contributions to candidates
306	306	for county, municipal or school district of fice as permitted by la w.
307	307	SECTION 3. AMENDATORY Rule 2.35 of the Rules of the
308	308	Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
309	309	as follows:
310	310	Rule 2.35. Any person not otherwise prohibited by law,
311	311	including but not limited to individuals, partnerships, limited
312	312	liability companies, corporations and labor union s, may A limited
313	313	committee, partnership, limited liability company, corporati on, or
314	314	labor union shall not make contributions in any amount t o an
315	315	unlimited committee organized exclusively for the purpose of making

373	373	SECTION 4. AMENDATORY Rule 2.42 of the Rules of the
374	374	Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
375	375	as follows:
376	376	Rule 2.42. Contributions to an un limited political action
377	377	committee may be used to make expenditures for independent
378	378	expenditures or electioneering communications , for contributions to
379	379	another unlimited politic al action committee organized exclusively
380	380	for the purpose of making independent expenditures or electioneering
381	381	communications, for operating expenses of the unlimited committee or
382	382	for other purposes not otherwise prohibited by law or these Rules
383	383	that further purposes of the committee. “Purposes of the committee”
384	384	shall mean purposes expressed in the committee ’s bylaws, articles of
385	385	organization or similar document or, if there is no such document,
386	386	in the committee’s statement of organi zation as those purpose s are
387	387	stated prior to the making of an expenditure.
388	388	SECTION 5. AMENDATORY Rule 2.50 of the Rules of the
389	389	Ethics Commission (74 O.S . 2021, Ch. 62, App. I), is amended to read

442	442	Rule 2.50. A. An independent expenditure may be made in any
443	443	amount by a political party committee, by a political action
444	444	committee or by any other entity not oth erwise prohibited by law or
445	445	these Rules from making an indep endent expenditure; provided, such
446	446	committee or entity must be formed and domiciled in this state. The
447	447	treasurer and compliance officer of such committee or entity shall
448	448	be residents of this stat e with a valid street address and telephone
449	449	number where such officers may be reached during working hours.
450	450	B. An individual or entity who receives compensation directl y
451	451	or indirectly from an unlimited political ac tion committee that
452	452	makes an independent expenditure on behalf of a candidate or
453	453	candidate committee shall not receive compensation direc tly or
454	454	indirectly from such candidate or candidate committee. Re ceipt of
455	455	such compensation shall constitute coordinati on prohibited by these
456	456	Rules.
457	457	SECTION 6. AMENDATORY Rule 2.52 of the Rules of the
458	458	Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
459	459	as follows:
460	460	Rule 2.52. An electioneering communication may be made in any
461	461	amount by a political party committee, by a political action
462	462	committee or by any other entity not otherwise prohibite d by law or
463	463	these Rules from makin g an independent expendit ure; provided, such
464	464	committee or entity must be formed and domiciled in this state. The
465	465	treasurer and compliance officer of suc h committee or entity shall

522	522	Rule 2.79. A political action co mmittee is any group of two or
523	523	more persons that receives contributions o r makes expenditures for
524	524	any of the following purp oses:
525	525	(1) 1. Making contributions to candidates or candidate
526	526	committees;
527	527	(2) making contributions to other political action commi ttees;
528	528	(3) making 2. Making independent expenditures;
529	529	(4) making 3. Making electioneering communications; or
530	530	(5) advocating 4. Advocating the approval or defeat of a state
531	531	question.
532	532	Unless they choose to be considered as suc h, family members, as
533	533	defined by these Rules, or members of the same household shall not
534	534	be considered a political action committee.
535	535	SECTION 8. AMENDATORY R ule 2.98 of the Rules of the
536	536	Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
537	537	as follows:
538	538	Rule 2.98. A political action committee registered with the
539	539	Federal Election Commission that makes a contribution or
540	540	contributions to a candidate or candidates for state o ffice shall

600	600	SECTION 9. AMENDATORY Rule 2.99 of the Rules of the
601	601	Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to re ad
602	602	as follows:
603	603	Rule 2.99. A political action co mmittee or an organization
604	604	exempt from taxation pursuant to 26 U.S.C., Section 501 (c)(4),
605	605	Internal Revenue Code that is registered in another state that makes
606	606	a contribution or contributions to a candidate or candidates for
607	607	state office shall file a Report o f Contributions and Ex penditures
608	608	for Non-Oklahoma Committees but not registered in this state shall
609	609	be prohibited from making contributions to candidates for any office
610	610	in this state.
611	611	SECTION 10. This act shall become effective November 1, 2023.
