6363 An Act relating to campaign finance; amending Rules
6464 2.30, 2.33, 2.35, 2.42, 2.50, 2.5 2, 2.79, 2.98, and
6565 2.99 of the Rules of the Ethics Commission (74 O.S.

7676 modifying allowable purposes for certain committees;

8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY Rule 2.30 of the Rules of the
8787 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
8888 as follows:
8989 Rule 2.30. A candidate committee shall not accept a
9090 contribution from the aut horized committee of a candidate for
9191 federal office. A candidate committee shall not make a contribution
9292 to any other candidate for s tate or federal office.

144144 SECTION 2. AMENDATORY Rule 2.33 of the Rules of the
145145 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
146146 as follows:
147147 Rule 2.33. (A) A. No person shall make, and no limited
148148 committee shall accept, a contribution to an y limited committee in
149149 excess of Five Thousand Dollars ($5,000.00) in any calendar year,
150150 except as otherwise permitted by law or these Rules. A contribution
151151 to a limited committee that is designated directly or indirectly to
152152 be used for the benefit of a p articular candidate or candidates
153153 shall be considered a contribution by the contributor to the
154154 candidate or candidates.
155155 (B) B. No limited committee shall make, and no political party
156156 committee shall accept, a contribution to the political party
157157 committee in excess of Ten Thousand Dollars ($10,00 0.00) in any
158158 calendar year.
159159 (C) C. No limited committee or unlimited committee shall make,
160160 and no other limited committee or unlimited committee shall accept,
161161 a contribution to another limited committee or unlimited committee
162162 in excess of Five Thousand Dollars ($5,000.00) in any calendar year.
163163 (D) D. No limited committee shall make, and no candidate
164164 committee shall accept, a contribution to any candida te committee in
165165 excess of Five Thousand Dollars ($5,000.00) prio r to a primary

218218 (E) E. No limited committee shall make, and no candidate
219219 committee shall accept, a contribution to any candidate committee of
220220 a candidate whose name will appear on the b allot for a runoff
221221 primary election in excess of Five Thousan d Dollars ($5,000.00)
222222 prior to a runoff primar y election. Provided, however, after the
223223 primary election a limited committee that has made a contribution of
224224 Five Thousand Dollars ($5,000.00) or l ess to the candidate committee
225225 prior to the primary election may make an additional contribution of
226226 no more than Five Thousand Dollars ($5,000.00) to the can didate
227227 committee prior to the runoff primary election.
228228 (F) F. No limited committee shall make, and no candidate
229229 committee shall accept, a contribution to any c andidate committee
230230 prior to a general election in excess of Five Thousand Dollars
231231 ($5,000.00). Provided, however, after the primary election or
232232 runoff primary election, whichever is the last for det ermining a
233233 political party’s nominee, a limited committee that has made a
234234 contribution of Five Thousand Dollars ($5,000.00) or less to the
235235 candidate committee prior to the primary election or runoff primary
236236 election, or both, may make an additional contrib ution of no more
237237 than Five Thousand Dollars ($5,000.00) t o the candidate committ ee
238238 prior to the general election.
239239 (G) G. After the general election, a l imited committee that has
240240 made no contribution to a candidate or a contribution of less than
241241 Five Thousand Dollars ($5,000.00) in the aggregate under the

293293 provisions of subsections (D) D, (E) E or (F) F may make an
294294 additional contribution or contributions i n an amount or amounts
295295 that, aggregated with any prior contributions, do not exceed Five
296296 Thousand Dollars ($5,00 0.00) to that candidate committee.
297297 (H) H. No limited committee shall m ake a total contributio n to
298298 a candidate in excess of the aggregate contri bution limits of
299299 subsections (D) D, (E) E and (F) F or in excess of Five Thousand
300300 Dollars ($5,000.00) to the candidate co mmittee of a candidate who is
301301 unopposed for election.
302302 (I) I. For purposes of this se ction, “contribution” shall
303303 include multiple contr ibutions, the amounts of which shall be
304304 aggregated.
305305 (J) J. A limited committee may make contributions to candidates
306306 for county, municipal or school district of fice as permitted by la w.
307307 SECTION 3. AMENDATORY Rule 2.35 of the Rules of the
308308 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
309309 as follows:
310310 Rule 2.35. Any person not otherwise prohibited by law,
311311 including but not limited to individuals, partnerships, limited
312312 liability companies, corporations and labor union s, may A limited
313313 committee, partnership, limited liability company, corporati on, or
314314 labor union shall not make contributions in any amount t o an
315315 unlimited committee organized exclusively for the purpose of making
316316 independent expenditures or electioneering communications. An

369369 independent expenditures or electioneering communica tions may make
370370 contributions in any amount to another unlimited co mmittee organized
371371 exclusively for the purpose of m aking independent expenditures or
372372 electioneering communications.
373373 SECTION 4. AMENDATORY Rule 2.42 of the Rules of the
374374 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
375375 as follows:
376376 Rule 2.42. Contributions to an un limited political action
377377 committee may be used to make expenditures for independent
378378 expenditures or electioneering communications , for contributions to
379379 another unlimited politic al action committee organized exclusively
380380 for the purpose of making independent expenditures or electioneering
381381 communications, for operating expenses of the unlimited committee or
382382 for other purposes not otherwise prohibited by law or these Rules
383383 that further purposes of the committee. “Purposes of the committee”
384384 shall mean purposes expressed in the committee ’s bylaws, articles of
385385 organization or similar document or, if there is no such document,
386386 in the committee’s statement of organi zation as those purpose s are
387387 stated prior to the making of an expenditure.
388388 SECTION 5. AMENDATORY Rule 2.50 of the Rules of the
389389 Ethics Commission (74 O.S . 2021, Ch. 62, App. I), is amended to read

442442 Rule 2.50. A. An independent expenditure may be made in any
443443 amount by a political party committee, by a political action
444444 committee or by any other entity not oth erwise prohibited by law or
445445 these Rules from making an indep endent expenditure; provided, such
446446 committee or entity must be formed and domiciled in this state. The
447447 treasurer and compliance officer of such committee or entity shall
448448 be residents of this stat e with a valid street address and telephone
449449 number where such officers may be reached during working hours.
450450 B. An individual or entity who receives compensation directl y
451451 or indirectly from an unlimited political ac tion committee that
452452 makes an independent expenditure on behalf of a candidate or
453453 candidate committee shall not receive compensation direc tly or
454454 indirectly from such candidate or candidate committee. Re ceipt of
455455 such compensation shall constitute coordinati on prohibited by these
456456 Rules.
457457 SECTION 6. AMENDATORY Rule 2.52 of the Rules of the
458458 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
459459 as follows:
460460 Rule 2.52. An electioneering communication may be made in any
461461 amount by a political party committee, by a political action
462462 committee or by any other entity not otherwise prohibite d by law or
463463 these Rules from makin g an independent expendit ure; provided, such
464464 committee or entity must be formed and domiciled in this state. The
465465 treasurer and compliance officer of suc h committee or entity shall

519519 SECTION 7. AMENDATORY Rule 2.79 of the Rules of the
520520 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
521521 as follows:
522522 Rule 2.79. A political action co mmittee is any group of two or
523523 more persons that receives contributions o r makes expenditures for
524524 any of the following purp oses:
525525 (1) 1. Making contributions to candidates or candidate
526526 committees;
527527 (2) making contributions to other political action commi ttees;
528528 (3) making 2. Making independent expenditures;
529529 (4) making 3. Making electioneering communications; or
530530 (5) advocating 4. Advocating the approval or defeat of a state
531531 question.
532532 Unless they choose to be considered as suc h, family members, as
533533 defined by these Rules, or members of the same household shall not
534534 be considered a political action committee.
535535 SECTION 8. AMENDATORY R ule 2.98 of the Rules of the
536536 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to read
537537 as follows:
538538 Rule 2.98. A political action committee registered with the
539539 Federal Election Commission that makes a contribution or
540540 contributions to a candidate or candidates for state o ffice shall

595595 are available to the public in the same manner as a political action
596596 committee registered under the laws of this state. The treasurer

599599 officers may be reached during working hours.
600600 SECTION 9. AMENDATORY Rule 2.99 of the Rules of the
601601 Ethics Commission (74 O.S. 2021, Ch. 62, App. I), is amended to re ad
602602 as follows:
603603 Rule 2.99. A political action co mmittee or an organization
604604 exempt from taxation pursuant to 26 U.S.C., Section 501 (c)(4),
605605 Internal Revenue Code that is registered in another state that makes
606606 a contribution or contributions to a candidate or candidates for
607607 state office shall file a Report o f Contributions and Ex penditures
608608 for Non-Oklahoma Committees but not registered in this state shall
609609 be prohibited from making contributions to candidates for any office
610610 in this state.
611611 SECTION 10. This act shall become effective November 1, 2023.
