7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -4-704, is
7979 amended to read as follows:
8080 Section 1-4-704. A. The Department of Human Ser vices or
8181 licensed child-placing agency shall prepa re and maintain a written
8282 individualized service plan for any child that has been adjudicated
8383 to be a deprived child.
8484 B. The plan shall b e furnished to the court within thirty (30)
8585 days after the adjudicat ion of the child and shall be made available
8686 to counsel for the parties and any applicable tribe by the
8787 Department or the licensed child -placing agency having custody of
8888 the child or responsibility for the supervision of the case.

140140 C. 1. The individualize d service plan shall be based upon a
141141 comprehensive assessment and evaluation of the child and family and
142142 shall be developed with the participation of the parent, legal
143143 guardian, or legal c ustodian of the child, the attorney for the
144144 child, the guardian ad l item for the child, if any, the child ’s
145145 tribe, and the child, if appropriate. The health and safety of the
146146 child shall be the paramount concern in the development of the plan.
147147 2. If any part of the plan is disputed or not approved by the
148148 court, an evidentiary hearing may be held and at its conclusion, t he
149149 court shall determine the content of the individualized service plan
150150 in accord with the evidence presented and the best interests of th e
151151 child.
152152 3. When approved by the court, each individualized service plan
153153 shall be incorporated and made a part of the dispositional order of
154154 the court.
155155 4. The plan shall be signed by:
156156 a. the parent or parents or legal guardian of the child,
157157 b. the attorney for the parent or parents or legal
158158 guardian of the child,
159159 c. the child’s attorney,
160160 d. the guardian ad litem of the child, which may be a
161161 court-appointed special advocate,
162162 e. a representative of the child ’s tribe,
163163 f. the child, if possible, and

215215 g. the Department or other responsible agency.
216216 D. 1. Every service plan pre pared shall be individualized and
217217 specific to each child and the family of the child.
218218 2. The individualized service plan shall be written in simple
219219 and clear English. If English is not the principal language of the
220220 parent, legal guardian, or custodian of the child, and such person
221221 is unable to read or c omprehend the English language, to the extent
222222 possible the plan shall be written in the principal language of the
223223 person.
224224 3. The individualized service plan may be modified based on
225225 changing circumstances consistent with the correction of the
226226 conditions that led to the adjudication of the child or other
227227 conditions inconsistent with the health, safety, or welfare of the
228228 child.
229229 4. The individualized service plan shall be measurable,
230230 realistic and consistent with the requirements of other court
231231 orders.
232232 E. The individualized service plan shall include, but not be
233233 limited to:
234234 1. A history of the child and family, including identification
235235 of the problems or conditions leading to the deprived child
236236 adjudication and the changes the parent or parents must make in
237237 order for the child to safely remain in or return to the home;

289289 2. Identification of time -limited reunification services to be
290290 provided to the parent, legal guardian, or legal custodian,
291291 stepparent, other adult person living in the home, or other family
292292 members;
293293 3. Identification of the specific services to be provided to
294294 the child including, but not limited to, educational, vocational
295295 educational, medical, drug or alcohol abuse treatment, or counseling
296296 or other treatment services. The most recent availa ble health and
297297 educational records of the child shall be provided to the court upon
298298 the court’s request including:
299299 a. the names and addresses of the child’s health and
300300 educational providers,
301301 b. the child’s grade-level performance,
302302 c. the child’s school record,
303303 d. a record of the child ’s immunizations,
304304 e. the child’s known medical problems, including any
305305 known communicable diseases,
306306 f. the child’s medications, and
307307 g. any other relevant health and education in formation;
308308 4. A schedule of the frequency of serv ices and the means by
309309 which delivery of the services will be assured or, as necessary, the
310310 proposed means by which support services or o ther assistance will be
311311 provided to enable the parent or the child to obtain the services;
312312 5. The name of the social wo rker assigned to the case;

364364 6. A projected date for the completion of the individualized
365365 service plan;
366366 7. Performance criteria that wil l measure the progress of the
367367 child and family toward completion of th e individualized service
368368 plan including, but not l imited to, time frames for achieving
369369 objectives and addressing the identified problems;
370370 8. The name and business address of the attorne y representing
371371 the child;
372372 9. If the child is placed outside the home, the individualized
373373 service plan shall further pro vide:
374374 a. the sequence and time frame for services to be
375375 provided to the parent, the child, and if the child is
376376 placed in foster care, the foster parent, to
377377 facilitate the child ’s return home or to another
378378 permanent placement,
379379 b. a description of the child ’s placement and explanation
380380 about whether it is the least -restrictive placement
381381 available and in as close proximity as possible to the
382382 home of the parent or parents or legal guardian of the
383383 child when the case plan is reunification, and how the
384384 placement is consistent with the best interests and
385385 special needs of the child,
386386 c. a description of any services or resources that were
387387 requested by the child or the parent or legal guardian

439439 of the child since the dat e of the child’s placement,
440440 and whether those serv ices or resources were provided
441441 and if not, the basis for the denial of the services
442442 or resources,
443443 d. efforts to be made by the parent of the child and the
444444 Department to enable the child to return to his or her
445445 home,
446446 e. a description of the transition plan ning for a
447447 successful adulthood for a child age fourteen (14) or
448448 older that includes how the following objectives will
449449 be met:
450450 (1) education, vocational, or employment planning,
451451 (2) health care planning and medical coverage,
452452 (3) transportation including, w here appropriate,
453453 assisting the child in obtaining a driver
454454 license,
455455 (4) money management,
456456 (5) planning for housing,
457457 (6) social and recreational skills, and
458458 (7) establishing and maintaining connections with the
459459 child’s family and community,
460460 f. for a child in placement due solely or in part to the
461461 child’s behavioral health or medical health issues,
462462 diagnostic and assessment informat ion, specific

514514 services relating to meeting the applicable behavioral
515515 health and medical care needs of the child, and
516516 desired treatment outcomes,
517517 g. a plan and schedule for regular and frequent
518518 visitation for the child and the child ’s parent or
519519 parents or legal guardian and siblings, unless the
520520 court has determined that visitation, e ven if
521521 supervised, would be harmful to the child, and
522522 h. a plan for ensuring the educational stability of the
523523 child while in out-of-home placement, including:
524524 (1) assurances that the placement of the child
525525 considers the appropriateness of the current
526526 educational setting and the proximity to the
527527 school in which the child was enrolled at the
528528 time of placement, and
529529 (2) where appropriate, an assurance that the
530530 Department has coordinat ed with appropriate local
531531 educational agencies to ensure that the child
532532 remains in the school in which the child was
533533 enrolled at the time of placement, or
534534 (3) if remaining in the school in which the child was
535535 enrolled at the time of placement is not in the
536536 best interests of the child, assurances by the
537537 Department and the local educa tional agencies to

589589 provide immediate and appropria te enrollment in a
590590 new school with all of the educational records of
591591 the child provided to the school; and
592592 10. The permanency p lan for the child, the reason for selection
593593 of that plan and a description of the steps being taken by the
594594 Department to finaliz e the plan.
595595 a. When the permanency plan is adoption or legal
596596 guardianship, the Department shall describe, at a
597597 minimum, child-specific recruitment efforts such as
598598 relative searches conducted and the use of state,
599599 regional, and national adoption exchanges t o
600600 facilitate the orderly and timely placement of the
601601 child, whether in or outside of the state.
602602 b. When the child is age fourteen (14) or older, the
603603 permanency plan and any revision or addition to the
604604 plan, shall include planning for the transition of the
605605 child to a successful adulthood.
606606 c. When the child is an infant, age twelve (12) months or
607607 younger, the permanency plan shall include a goal that
608608 the infant be placed in a prospective permanent
609609 placement within one (1) year after the child has been
610610 adjudicated to be a deprived child .
611611 F. Each individualized service plan shall specifically provide
612612 for the safety of the child , in accordance with state and federal

664664 law, and clearly define what actions or precaut ions will, or may, be
665665 necessary to provide for the safety and protection of the child.
666666 G. The individualized service plan shall include the following
667667 statement:
668668 TO THE PARENT: THIS IS A VERY IMPORTANT DOCUMENT. ITS PURPOSE
669669 IS TO HELP YOU PROVIDE YOUR CH ILD WITH A SAFE HOME WITHIN THE
670670 REASONABLE PERIOD SPECIFIED IN THE PLAN. IF YOU ARE UNWILLING OR
671671 UNABLE TO PROVIDE YOUR CHILD WITH A SAFE HOME OR ATTEND COURT
672672 HEARINGS, YOUR PARENTAL AND CUSTODIAL DUTIES AND RIGHTS MAY BE
673673 RESTRICTED OR TERMINATED OR YOUR CHILD MAY NOT BE RETURNED TO YOU.
674674 H. Whenever a child who is subject to the provisions of this
675675 section is committed for inpatient behavioral health or substance
676676 abuse treatment pursuant to the Inpatient Mental Health and
677677 Substance Abuse Treatment of Minor s Act, the individualized service
678678 plan shall be amended as necessary and appropriate, including, but
679679 not limited to, identification of the treatment and services to be
680680 provided to the child and the child ’s family upon discharge of the
681681 child from inpatient behavioral health or substance abuse treatment.
682682 SECTION 2. AMENDATORY 10A O.S. 2021, Section 1 -4-809, is
683683 amended to read as follows:
684684 Section 1-4-809. A. At any time prior to or following the
685685 adjudicatory hearing the court, on its own motion or upon the motion
686686 of a party, may find that reasonable efforts to prevent the removal
687687 of a child from home or to reunify the child and fami ly are not

739739 required if the court determines, based upon a preponderance of the
740740 evidence, that:
741741 1. The parent or legal guardian of the child, who is an i nfant
742742 age twelve (12) months or younger, has abandoned the child;
743743 2. The parent or legal guardian of the child has:
744744 a. committed murder or manslaughter of any child,
745745 b. aided or abetted, at tempted, conspired, or solicited
746746 to commit the murder or manslaugh ter of any child,
747747 c. committed a felony assault upon any child that
748748 resulted in the child receiving serious bodily injury,
749749 or
750750 d. subjected any child to aggravated circumstances
751751 including, but not limited to, heinous and shocking
752752 abuse or heinous and shocki ng neglect;
753753 3. The parental rights of a parent to the child ’s sibling have
754754 been terminated involuntarily;
755755 4. The parent has been found by a court of competent
756756 jurisdiction to have committ ed sexual abuse against the child or
757757 another child of the parent; o r
758758 5. The parent is required to register with a sex offender
759759 registry pursuant to Section 113(a) of the Adam Walsh Child
760760 Protection and Safety Act of 2006, 42 U.S.C., Section 16913(a).
761761 B. The court shall conduct a permanency hearing within thirty
762762 (30) days of a determination by the court that any of the conditions

814814 specified in subsection A of this section exist. Reasonable efforts
815815 shall be made to place the child in a timely manner in acco rdance
816816 with the permanency plan. If the child is an abandoned infa nt age
817817 twelve (12) months or younger as described in paragraph 1 of
818818 subsection A of this section, a timely manner for purposes of this
819819 paragraph means three (3) months after the court has m ade the
820820 determination.
821821 SECTION 3. This act shall become effective November 1, 2023.
