55 | 52 | | Section 152. As used in The Governmental T ort Claims Act: |
---|
56 | 53 | | 1. “Action” means a proceeding in a court of competent |
---|
57 | 54 | | jurisdiction by which one party brings a suit against another; |
---|
58 | 55 | | 2. “Agency” means any board, commission, comm ittee, department |
---|
59 | 56 | | or other instrumentality or entity designated to act in b ehalf of |
---|
60 | 57 | | the state or a political subdivision; |
---|
61 | 58 | | 3. “Charitable health care provider ” means a person who is |
---|
62 | 59 | | licensed, certified, or othe rwise authorized by the laws of this |
---|
92 | 88 | | indigent person, as defined in par agraph 9 of this section, with no |
---|
93 | 89 | | expectation of or acceptance of compensation of any kind; |
---|
94 | 90 | | 4. “Claim” means any written demand presented by a claimant or |
---|
95 | 91 | | the claimant’s authorized representative in accordance with the |
---|
96 | 92 | | Governmental Tort Claims Ac t to recover money from the state or |
---|
97 | 93 | | political subdivisio n as compensation for an act or omissi on of a |
---|
98 | 94 | | political subdivision or the state or an employee; |
---|
99 | 95 | | 5. “Claimant” means the person or the person’s authorized |
---|
100 | 96 | | representative who files notice of a claim in accordance with The |
---|
101 | 97 | | Governmental Tort Claims Act. On ly the following persons and no |
---|
102 | 98 | | others may be claimants: |
---|
103 | 99 | | a. any person holding an interest in real or personal |
---|
104 | 100 | | property which suffers a loss, provided that the claim |
---|
105 | 101 | | of the person shall be aggregated with claims of all |
---|
106 | 102 | | other persons holding an interest in the property and |
---|
107 | 103 | | the claims of all othe r persons which are derivative |
---|
108 | 104 | | of the loss, and that multiple claimants shall be |
---|

---|

---|
111 | 107 | | occurrence who suffers a loss, provided that the |

145 | 140 | | 6. “Community health care provider” means: |
---|
146 | 141 | | a. a health care provider who volunteers services at a |

---|
148 | 143 | | U.S. Department of Health and Human Services as a |
---|
149 | 144 | | federally qualified health center as defined by 42 |
---|
150 | 145 | | U.S.C., Section 1396d(l)(2)(B), |
---|
151 | 146 | | b. a health provider who provides services to an |
---|
152 | 147 | | organization that has been deemed a federally |
---|
153 | 148 | | qualified look-alike community health center, and |
---|
154 | 149 | | c. a health care provider who provides services to a |
---|
155 | 150 | | community health center that h as made application to |
---|
156 | 151 | | the U.S. Department of Health and Human Services for |
---|
157 | 152 | | approval and deeming as a federally qualified look- |
---|
158 | 153 | | alike community health cent er in compliance with |
---|
159 | 154 | | federal application guidance, and has received |
---|
160 | 155 | | comments from the U.S. Department of Health and Human |
---|
161 | 156 | | Services as to the status of such application with the |
---|
162 | 157 | | established intent of resubmitting a modified |
---|
163 | 158 | | application, or, if denied, a ne w application, no |
---|
164 | 159 | | later than six (6) months from the date of the |
---|
193 | 187 | | Health and Human Services requiring resubmission of a |
---|
194 | 188 | | new application; |
---|
195 | 189 | | 7. “Employee” means any person who is authorized to act in |
---|
196 | 190 | | behalf of a political subdivision or the state whether that person |
---|
197 | 191 | | is acting on a permanent or temporary basis, with or without being |
---|
198 | 192 | | compensated or on a full-time or part-time basis. |
---|
199 | 193 | | a. Employee also includes: |
---|
200 | 194 | | (1) all elected or appointed officers, members of |
---|
201 | 195 | | governing bodies and other persons designated to |
---|
202 | 196 | | act for an agency or political subdivision, but |
---|

210 | 204 | | prenatal, delivery or infant care services to |
---|
211 | 205 | | State Department of Health clients pursuant to a |
---|
212 | 206 | | contract entered into with the State Department |
---|
213 | 207 | | of Health in accordance with paragraph 3 of |
---|
214 | 208 | | subsection B of Section 1 -106 of Title 63 of the |
---|
215 | 209 | | Oklahoma Statutes but only insofar as services |
---|
244 | 237 | | the contract and the requirements of Se ction 1- |
---|
245 | 238 | | 233 of Title 63 of the Oklahoma Statutes, and |
---|
246 | 239 | | (3) any volunteer, full-time or part-time firefighter |
---|

415 | 405 | | provide for needed health care; |

416 | 406 | | 10. “Municipality” means any incorporated city or town, and all |
