73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY 63 O.S. 2 021, Section 2-415, is
75	75	amended to read as follows:
76	76	Section 2-415. A. The provisions of the Trafficking in Illegal
77	77	Drugs Act shall apply to persons convicted of violations with
78	78	respect to the following substan ces:
79	79	1. Marijuana;
80	80	2. Cocaine or coca leaves ;
81	81	3. Heroin;
82	82	4. Amphetamine or metham phetamine;
83	83	5. Lysergic acid diethylamide (LSD);
84	84	6. Phencyclidine (PCP);
85	85	7. Cocaine base, commonly known as “crack” or “rock”;

144	144	B. Except as otherwise authorized by the Uniform Controlled
145	145	Dangerous Substances Act, it shall be unl awful for any person to:
146	146	1. Knowingly distribute, manufacture, bring into this state or
147	147	possess a controlled substance specified in subsection A of this
148	148	section in the quantities specified in subsection C of this section;
149	149	2. Possess any controlled substa nce with the intent to
150	150	manufacture a controlle d substance specified in subsection A o f this
151	151	section in quantities specified in subsection C of this section; or
152	152	3. Use or solicit the use of services of a person less than
153	153	eighteen (18) years of age to distr ibute or manufacture a controlled
154	154	dangerous substance specified in subsection A of th is section in
155	155	quantities specified in subsection C of this section.
156	156	Violation of this section shall be known as “trafficking in
157	157	illegal drugs”. Separate types of controll ed substances described
158	158	in subsection A of thi s section when possessed at the same ti me in
159	159	violation of any provision of this section shall constitute a
160	160	separate offense for each substance.

213	213	or 3 of this subsection and represents the quanti ty of the
214	214	controlled substance to be an amount described in subsection C of
215	215	this section shall be punished under the provisions appropriate for
216	216	the amount of controlled substance represented, regardless of the
217	217	actual amount.
218	218	C. In the case of a violation of the provisions of subsection B
219	219	of this section, involving:
220	220	1. Marijuana:
221	221	a. twenty-five (25) pounds or more of a mixture or
222	222	substance containing a detectable amount o f marijuana
223	223	shall be punishable by a fin e of not less than Twenty -
224	224	five Thousand Dollar s ($25,000.00) and not more than
225	225	One Hundred Thousand Dollars ($100,000.00), or
226	226	b. one thousand (1,000) pounds or more of a mixture or
227	227	substance containing a detectable amount o f marijuana
228	228	shall be deemed aggra vated trafficking punishable by a
229	229	fine of not less than One Hundred Thousand Dollars
230	230	($100,000.00) and not more than Five Hundred Thousand
231	231	Dollars ($500,000.00);
232	232	2. Cocaine, coca leaves or cocaine base:
233	233	a. twenty-eight (28) grams or more of a mixture or
234	234	substance containing a detectable amount of coc aine,

745	745	respect to marijuana, cocaine, coca leaves, cocaine base, heroin,
746	746	amphetamine or methamphetamine in a quantity specified in paragraphs
747	747	1, 2, 3 and 4 of subsection C of this section shall, in addition to
748	748	any fines specified by this section, be punishable by a term of
749	749	imprisonment as follows:
750	750	1. For trafficking, a first viola tion of this section, a term
751	751	of imprisonment in the custody of the Department of Co rrections not
752	752	to exceed twenty (20) years;
753	753	2. For trafficking, a second violation of t his section, a term
754	754	of imprisonment in the Department of Corrections of not less than
755	755	four (4) years nor more than life, for which the person shall serve
756	756	fifty percent (50%) of the sentence before being eligible for parole
757	757	consideration;
758	758	3. For trafficking, a third or subsequent violation o f this
759	759	section, a term of imprisonment in the cust ody of the Department of

814	814	Persons convicted of trafficking shall not be el igible for
815	815	earned credits or any other type of credits which have the effect of
816	816	reducing the length of sentence to less than fifty percent (50%) o f
817	817	the sentence imposed; and
818	818	If the person is conv icted of aggravated trafficking , the person
819	819	shall serve eighty-five percent (85%) of such sentence before being
820	820	eligible for parole consideratio n.
821	821	E. The penalties specified in subsections C and D of this
822	822	section are subject to th e enhancements enumerated in subsect ions E
823	823	and F of Section 2-401 of this title.
824	824	F. Any person convicted of any offense described in this
825	825	section shall, in addition to any fine imposed, pay a special
826	826	assessment trauma-care fee of One Hundred Dollars ($100 .00) to be
827	827	deposited into the Trauma Care Assistance Revolving Fund created in
828	828	Section 1-2530.9 of this title and the assessment pursuant to
829	829	Section 2-503.2 of this title.
830	830	SECTION 2. This act shall become effective November 1, 2023.
