7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 26 O.S. 2021, Section 13A -103, is
7777 amended to read as follows:
7878 Section 13A-103. A. 1. The general election of members of the
7979 board of education of every school district and technology center
8080 school district shall be conducted on the first second Tuesday of
8181 April November of each odd-numbered year, and on the first Tuesday
8282 after the first Monday of November in each even -numbered year.
8383 2. The primary elect ion of members of the board of education of
8484 every school district and technology center sch ool district, if
8585 necessary, shall be conducted on the second Tuesday in February
8686 September of each odd-numbered year, except in any year when a
8787 Presidential Preferen tial Primary is held in February, then th e

139139 election shall be held on the same day as the Pr esidential
140140 Preferential Primary and on the fourth Tuesday of August in each
141141 even-numbered year.
142142 3. If only two candidates qualify to have their names appear on
143143 the ballot, the names of both candidates shal l appear on the ballot
144144 at the board of education g eneral election.
145145 4. If more than two candidates qualify to have their names
146146 appear on the ballot, the names of all such candidates shall appear
147147 on the ballot at the board of education primary election. A
148148 candidate receiving more than fifty percent (50%) of the votes cast
149149 in the board of education primary election shall be elected to the
150150 office. If no candidate receives more than fifty percent (50%) of
151151 the votes cast in the board of education primary elect ion, then the
152152 two candidates with the highest numb er of votes shall appear on the
153153 ballot at the board of education general election.
154154 B. Elections on the question of making a levy or levies for
155155 schools under Section 9, Section 9B or Section 10 of Article X of
156156 the Oklahoma Constitution shall be held on the second Tuesday in
157157 February of each year, except in any year when a Presidential
158158 Preferential Primary i s held in February, then the election shall be
159159 held on the same day as the Presidential Preferential Pr imary.
160160 C. The board of education of every school district or
161161 technology center school district may call a special election for
162162 the purpose of voting on any matter or question authorized by law.

214214 SECTION 2. AMENDATORY 26 O.S. 2021, Section 13A-105, is
215215 amended to read as follows:
216216 Section 13A-105. Candidates for member of the board of
217217 education of every school district or t echnology center school
218218 district shall file declarations of candidacy i n the same place and
219219 with the same offici als as candidates for county office. The
220220 declaration of candidacy to be signed by the candidate shall have an
221221 attachment to be signed by the ca ndidate listing the requirements of
222222 a candidate for election or reelect ion to a school board as set
223223 forth in Sections 13A-106 and 5-105a of this title and Section s 5-
224224 110, 5-110.1, and 5-113 of Title 70 of the Oklahoma Statutes, and
225225 the candidate shall swea r or affirm that he or she is eligible to
226226 run for the office or serve i n the office if elected. Candidates
227227 shall file no earlier than 8:00 a.m. on the first Monday second
228228 Wednesday in December April through no later than 5:00 p.m. on the
229229 following Wednesday next succeeding Friday . For school districts
230230 and technology center school districts located in more than one
231231 county, filing may be either in the county wherei n supervision of
232232 the district is located or in the county where the candidate
233233 resides.
234234 SECTION 3. This act shall become effective November 1, 2023 .
