81	81		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82		SECTION 1. AMENDATORY 25 O.S. 2021, Section 304, as
83	83		amended by Section 1, Chapter 123, O.S.L. 2022 (25 O.S. Supp. 2022,
84	84		Section 304), is amended to read as follows:
85	85		Section 304. As used in the Oklahoma Open Meeting Act:
86	86		1. “Public body” means the governing bodies of all
87	87		municipalities located within this state, boards of coun ty
88	88		commissioners of the countie s in this state, boards of pub lic and
89	89		higher education in this state and all boards, bureaus, commissions,
90	90		agencies, trusteeships, au thorities, councils, committees, public

142	142		trusts or any entity created by a public trust including any
143	143		committee or subcommi ttee composed of any of the me mbers of a public
144	144		trust or other legal entit y receiving funds from the Rural Economic
145	145		Action Plan Fund as authorized by Section 2007 of Title 62 of the
146	146		Oklahoma Statutes, task forces or study gro ups in this state
147	147		supported in whole or in part by public fun ds or entrusted with the
148	148		expending of public funds, or administering public property, and
149	149		shall include all committees or subcommittees of any public body.
150	150		Public body shall include the Judicial Nominating Commission .
151	151		Public body shall not include the stat e judiciary, the Council on
152	152		Judicial Complaints when conducting, discussing, or deliberating any
153	153		matter relating to a complaint received or filed with t he Council,
154	154		the Legislature, or administrati ve staffs of public bodies
155	155		including, but not limited to, f aculty meetings and athletic st aff
156	156		meetings of institutions of higher education when those staffs are
157	157		not meeting with the public body, or entry -year assistance
158	158		committees. Furthermore, public bo dy shall not include the
159	159		multidisciplinary teams provided fo r in Section 1-9-102 of Title 10A
160	160		of the Oklahoma Statutes, in Section 2 of this act, and in
161	161		subsection C of Section 1-502.2 of Title 63 of the Oklahoma Statutes
162	162		or any school board meeting for th e sole purpose of considerin g
163	163		recommendations of a multidisc iplinary team and deciding the
164	164		placement of any child who is the subject of the recommendations.
165	165		Furthermore, public body shall not include meetings con ducted by

217	217		stewards designated by the Oklaho ma Horse Racing Commission p ursuant
218	218		to Section 203.4 of Titl e 3A of the Oklahoma Statutes w hen the
219	219		stewards are officiating at races or otherwise enforcing rules of
220	220		the Commission. Furthermore, public body shall not include the
221	221		board of directors of a Fed erally Qualified Health Cent er;
222	222		2. “Meeting” means the conduct of business of a public bo dy by
223	223		a majority of its members being personally together or, as
224	224		authorized by Section 307.1 of this title, together pursua nt to a
225	225		videoconference. Meeting shall not include informal gatherings of a
226	226		majority of the members of the public body when no busin ess of the
227	227		public body is discussed;
228	228		3. “Regularly scheduled meeting” means a meeting at which the
229	229		regular business of the public body is conducted;
230	230		4. “Special meeting” means any meeting of a public body other
231	231		than a regularly scheduled meeting or eme rgency meeting;
232	232		5. “Emergency meeting” means any meeting called for the purpose
233	233		of dealing with an emergency. For purposes of the Oklahoma Open
234	234		Meeting Act, an emerge ncy is defined as a situatio n involving injury
235	235		to persons or injury and damage to publi c or personal property or
236	236		immediate financial loss when the time requirements for public
237	237		notice of a special meeting would mak e such procedure impractical
238	238		and increase the likelihood of injury or d amage or immediate
239	239		financial loss;

291	291		6. “Continued or reconvened meeting” means a meeting which is
292	292		assembled for the purpose of finishing business appearing on an
293	293		agenda of a previous me eting. For the purposes of the Oklahoma Op en
294	294		Meeting Act, only matters on the agenda of the previous m eeting at
295	295		which the announcement of the continuance is made may be discussed
296	296		at a continued or reconvened meeting;
297	297		7. “Videoconference” means a conference among members of a
298	298		public body remote fr om one another who are linke d by interactive
299	299		telecommunication devices or technology and/or technology permitting
300	300		both visual and auditory communication between and among members of
301	301		the public body and/or between and among members of the public body
302	302		and members of the public. During any videoconference, both the
303	303		visual and auditory commun ications functions shall attempt to be
304	304		utilized; and
305	305		8. “Teleconference” means a conference among members of a
306	306		public body remote from one another who are linked by
307	307		telecommunication devices and/or technology permitting auditory
308	308		communication between and among members of the public body and/or
309	309		between and among members of the public body and members of the
310	310		public.
311	311		SECTION 2. AMENDATORY 25 O.S. 2021, Section 307, as
312	312		amended by Section 1 , Chapter 182, O.S.L. 2022 (25 O.S. Supp. 2022,

365	365		Section 307. A. No public body shall hold executive sessions
366	366		unless otherwise specifically provided in this section.
367	367		B. Executive sessions of public bodies will be permitted only
368	368		for the purpose of:
369	369		1. Discussing the employment, hirin g, appointment, promotion,
370	370		demotion, disciplining or resignation of any individual sa laried
371	371		public officer or employee;
372	372		2. Discussing negotiations concerning employees and
373	373		representatives of employee groups;
374	374		3. Discussing the purchase or appraisal of rea l property;
375	375		4. Confidential communications between a public body and its
376	376		attorney concerning a pending investigation, claim, or action if the
377	377		public body, with the advice of its attorney, determines that
378	378		disclosure will seriously impair the ability of the public body to
379	379		process the claim or conduct a pending investigation, litigation, or
380	380		proceeding in the public interest;
381	381		5. Permitting district boards of education to hear evidence and
382	382		discuss the expulsion or suspension of a student when requested by
383	383		the student involved or the student’s parent, attorney or legal
384	384		guardian;
385	385		6. Discussing matters involving a specific handicapped child;
386	386		7. Discussing any matter where disclosure of information would
387	387		violate confidentiality requirements of state or federal la w;

439	439		8. Engaging in deliberations or rendering a final or
440	440		intermediate decision in an individual proceeding pursuant to
441	441		Article II of the Administrative Procedures Act;
442	442		9. Discussing matters involving safety and security at state
443	443		penal institutions or corr ectional facilities used to house state
444	444		inmates;
445	445		10. Discussing contract negotiation s involving contracts
446	446		requiring approval of the State Board of Corrections, which shall be
447	447		limited to members of the public body, the attorney for the public
448	448		body, and the immediate staff of the public body. No person who may
449	449		profit directly or indirectly by a proposed transaction which is
450	450		under consideration may be present or participate in the executive
451	451		session; or
452	452		11. Discussing the following:
453	453		a. the investigation of a plan or scheme to commit an act
454	454		of terrorism,
455	455		b. assessments of the vulnerability of government
456	456		facilities or public improvements to an act of
457	457		terrorism,
458	458		c. plans for deterrence or prevention of or protection
459	459		from an act of terrorism,
460	460		d. plans for response or remediation after an act of
461	461		terrorism,

514	514		the discussion specifically identifies:
515	515		(1) design or functional schematics that demonstrate
516	516		the relationship or connections between devices
517	517		or systems,
518	518		(2) system configuration information,
519	519		(3) security monitoring and response equipment
520	520		placement and configuration,
521	521		(4) specific location or placement of systems,
522	522		components or devices,
523	523		(5) system identification numbers, names, or
524	524		connecting circuits,
525	525		(6) business continuity and disaster planning, or
526	526		response plans, or
527	527		(7) investigation inform ation directly related to
528	528		security penetrations or denial of services, or
529	529		f. the investigation of an act of terrorism that has
530	530		already been committed.
531	531		For the purposes of this subsection, the term “terrorism” means any
532	532		act encompassed by the definitions se t forth in Section 1268.1 of
533	533		Title 21 of the Oklahoma Statutes.
534	534		C. Notwithstanding the provisions of subsection B of this
535	535		section, the following public bodies may hold ex ecutive sessions:

593	593		4. The Oklahoma Center for the Advancement of Science and
594	594		Technology, as provided for in Section 5060.7 of Title 74 of the
595	595		Oklahoma Statutes;
596	596		5. The Oklahoma Health Research Committee for purposes of
597	597		conferring on matters pertaining to res earch and development of
598	598		products, if public disclosure of the matter discussed would
599	599		interfere with the development of patents, copyrights, products, or
600	600		services;
601	601		6. The Workers’ Compensation Commission for the purposes
602	602		provided for in Section 20 of Titl e 85A of the Oklahoma Statutes;
603	603		7. A review committee, as provided for in Section 855 of Title
604	604		62 of the Oklahoma Statutes;
605	605		8. The Child Death Review Board for purposes of receiving and
606	606		conferring on matters pertaining to materials declared confidential
607	607		by law;
608	608		9. The Domestic Violence Fatality Review Board as provided in
609	609		Section 1601 of Title 22 of the Oklahoma Statutes;

661	661		10. The Opioid Overdose Fatality Review Board, a s provided in
662	662		Section 2-1001 of Title 63 of the Oklahoma Statutes;
663	663		11. All nonprofit foundations, boards, bureaus, commissions,
664	664		agencies, trusteeships, authorities, councils, committees, public
665	665		trusts, task forces or study groups supported in whole or par t by
666	666		public funds or entrusted with the expenditure of public funds for
667	667		purposes of conferring on matters pertaining to economic development
668	668		including the transfer of property, financing, or the creation of a
669	669		proposal to entice a business to remain or to l ocate within their
670	670		jurisdiction if public disclosure of the matter discussed would
671	671		interfere with the development of products or services or if public
672	672		disclosure would violate the confidentiality of the business;
673	673		12. The Oklahoma Indigent Defense System B oard for purposes of
674	674		discussing negotiating strategies in connection with making pos sible
675	675		counteroffers to offers to contract to provide legal representation
676	676		to indigent criminal defendants and indigent juveniles in cases for
677	677		which the System must provide representation pursuant to the
678	678		provisions of the Indigent Defense Act;
679	679		13. The Quality Investment Committee for purposes of discussing
680	680		applications and confidential materials pursuant to the terms of the
681	681		Oklahoma Quality Investment Act;
682	682		14. The Oklahoma Municipal Power Authority established pursuant
683	683		to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and
684	684		in its role as an electric utility regulated by the federal

736	736		government, for purposes of discussing security plans and procedures
737	737		including, but not limited to, cybersecurity matters; and
738	738		15. The Oklahoma Tax Commis sion for purposes of discussing
739	739		confidential taxpayer matters as provided in Secti on 205 of Title 68
740	740		of the Oklahoma Statutes, and in compliance with subsection E of
741	741		this section; and
742	742		16. The Judicial Nominating Commission for the purposes of
743	743		discussing the merits and qualific ations of candidates for judicial
744	744		office to determine which candidates will be interviewed or sol ely
745	745		to meet with a candidate to discuss confide ntial information
746	746		relating to financial disclos ure information or background checks.
747	747		Candidate interviews shall not be conducted in execu tive sessions
748	748		and Commissioners shall not vote or indi cate how they intend to vote
749	749		in executive session.
750	750		D. Except as otherwise specified in this subsection, an
751	751		executive session for the purpose of discussing the purchase or
752	752		appraisal of real property shall be limited to members of the public
753	753		body, the attorney f or the public body and the immediate staff of
754	754		the public body. No landowner, real estate salesperson, broker,
755	755		developer or any other person who may profit directly or indirec tly
756	756		by a proposed transaction concerning real property which is under
757	757		consideration may be present or participate in the executive
758	758		session, unless they are operating under an existing agreement to
759	759		represent the public body.

811	811		E. No public body may go into a n executive session unless the
812	812		following procedures are strictly complied with:
813	813		1. The proposed executive session is noted on the agenda as
814	814		provided in Section 311 of this title;
815	815		2. The executive session is authorized by a majority vote of a
816	816		quorum of the members present and the vote is a recorded vote; and
817	817		3. Except for matters con sidered in executive sessions of the
818	818		State Banking Board and the Oklahoma Tax Commission, and which are
819	819		required by state or federal law to be confidential, any vote or
820	820		action on any item of business considered in an executive session
821	821		shall be taken in public meeting with t he vote of each member
822	822		publicly cast and recorded.
823	823		F. A willful violation of the provisions of this section shall:
824	824		1. Subject each member of the public bod y to criminal sanctions
825	825		as provided in Section 314 of this title; and
826	826		2. Cause the minutes and all other records of the execut ive
827	827		session including tape recordings, to be immediately made public.
828	828		SECTION 3. AMENDATORY 25 O.S. 202 1, Section 310, is
829	829		amended to read as follows:
830	830		Section 310. Any member of the Legislature appointed as a
831	831		member of a committee of either house of the Legislature or joint
832	832		committee thereof shall be permitt ed to attend any executive session
833	833		authorized by the Oklahoma Open Meeting Act of any state agency,
834	834		board or commission whenever the jurisdiction of such committee

887	887		a member of the Legislature shall not be permitted to attend an
888	888		executive session of the Judicial Nominating Commission authorized
889	889		pursuant to paragraph 16 of subsection C of Section 307 of this

891	891		SECTION 4. This act shall become effective November 1, 2023.
