8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 25 O.S. 2021, Section 304, as
8383 amended by Section 1, Chapter 123, O.S.L. 2022 (25 O.S. Supp. 2022,
8484 Section 304), is amended to read as follows:
8585 Section 304. As used in the Oklahoma Open Meeting Act:
8686 1. “Public body” means the governing bodies of all
8787 municipalities located within this state, boards of coun ty
8888 commissioners of the countie s in this state, boards of pub lic and
8989 higher education in this state and all boards, bureaus, commissions,
9090 agencies, trusteeships, au thorities, councils, committees, public

142142 trusts or any entity created by a public trust including any
143143 committee or subcommi ttee composed of any of the me mbers of a public
144144 trust or other legal entit y receiving funds from the Rural Economic
145145 Action Plan Fund as authorized by Section 2007 of Title 62 of the
146146 Oklahoma Statutes, task forces or study gro ups in this state
147147 supported in whole or in part by public fun ds or entrusted with the
148148 expending of public funds, or administering public property, and
149149 shall include all committees or subcommittees of any public body.
150150 Public body shall include the Judicial Nominating Commission .
151151 Public body shall not include the stat e judiciary, the Council on
152152 Judicial Complaints when conducting, discussing, or deliberating any
153153 matter relating to a complaint received or filed with t he Council,
154154 the Legislature, or administrati ve staffs of public bodies
155155 including, but not limited to, f aculty meetings and athletic st aff
156156 meetings of institutions of higher education when those staffs are
157157 not meeting with the public body, or entry -year assistance
158158 committees. Furthermore, public bo dy shall not include the
159159 multidisciplinary teams provided fo r in Section 1-9-102 of Title 10A
160160 of the Oklahoma Statutes, in Section 2 of this act, and in
161161 subsection C of Section 1-502.2 of Title 63 of the Oklahoma Statutes
162162 or any school board meeting for th e sole purpose of considerin g
163163 recommendations of a multidisc iplinary team and deciding the
164164 placement of any child who is the subject of the recommendations.
165165 Furthermore, public body shall not include meetings con ducted by

218218 to Section 203.4 of Titl e 3A of the Oklahoma Statutes w hen the
219219 stewards are officiating at races or otherwise enforcing rules of
220220 the Commission. Furthermore, public body shall not include the
221221 board of directors of a Fed erally Qualified Health Cent er;
222222 2. “Meeting” means the conduct of business of a public bo dy by
223223 a majority of its members being personally together or, as
224224 authorized by Section 307.1 of this title, together pursua nt to a
225225 videoconference. Meeting shall not include informal gatherings of a
226226 majority of the members of the public body when no busin ess of the
227227 public body is discussed;
228228 3. “Regularly scheduled meeting” means a meeting at which the
229229 regular business of the public body is conducted;
230230 4. “Special meeting” means any meeting of a public body other
231231 than a regularly scheduled meeting or eme rgency meeting;
232232 5. “Emergency meeting” means any meeting called for the purpose
233233 of dealing with an emergency. For purposes of the Oklahoma Open
234234 Meeting Act, an emerge ncy is defined as a situatio n involving injury
235235 to persons or injury and damage to publi c or personal property or
236236 immediate financial loss when the time requirements for public
237237 notice of a special meeting would mak e such procedure impractical
238238 and increase the likelihood of injury or d amage or immediate
239239 financial loss;

291291 6. “Continued or reconvened meeting” means a meeting which is
292292 assembled for the purpose of finishing business appearing on an
293293 agenda of a previous me eting. For the purposes of the Oklahoma Op en
294294 Meeting Act, only matters on the agenda of the previous m eeting at
295295 which the announcement of the continuance is made may be discussed
296296 at a continued or reconvened meeting;
297297 7. “Videoconference” means a conference among members of a
298298 public body remote fr om one another who are linke d by interactive
299299 telecommunication devices or technology and/or technology permitting
300300 both visual and auditory communication between and among members of
301301 the public body and/or between and among members of the public body
302302 and members of the public. During any videoconference, both the
303303 visual and auditory commun ications functions shall attempt to be
304304 utilized; and
305305 8. “Teleconference” means a conference among members of a
306306 public body remote from one another who are linked by
307307 telecommunication devices and/or technology permitting auditory
308308 communication between and among members of the public body and/or
309309 between and among members of the public body and members of the
310310 public.
311311 SECTION 2. AMENDATORY 25 O.S. 2021, Section 307, as

365365 Section 307. A. No public body shall hold executive sessions
366366 unless otherwise specifically provided in this section.
367367 B. Executive sessions of public bodies will be permitted only
368368 for the purpose of:
369369 1. Discussing the employment, hirin g, appointment, promotion,
370370 demotion, disciplining or resignation of any individual sa laried
371371 public officer or employee;
372372 2. Discussing negotiations concerning employees and
373373 representatives of employee groups;
374374 3. Discussing the purchase or appraisal of rea l property;
375375 4. Confidential communications between a public body and its
376376 attorney concerning a pending investigation, claim, or action if the
377377 public body, with the advice of its attorney, determines that
378378 disclosure will seriously impair the ability of the public body to
379379 process the claim or conduct a pending investigation, litigation, or
380380 proceeding in the public interest;
381381 5. Permitting district boards of education to hear evidence and
382382 discuss the expulsion or suspension of a student when requested by
383383 the student involved or the student’s parent, attorney or legal
384384 guardian;
385385 6. Discussing matters involving a specific handicapped child;
386386 7. Discussing any matter where disclosure of information would
387387 violate confidentiality requirements of state or federal la w;

439439 8. Engaging in deliberations or rendering a final or
440440 intermediate decision in an individual proceeding pursuant to
441441 Article II of the Administrative Procedures Act;
442442 9. Discussing matters involving safety and security at state
443443 penal institutions or corr ectional facilities used to house state
444444 inmates;
445445 10. Discussing contract negotiation s involving contracts
446446 requiring approval of the State Board of Corrections, which shall be
447447 limited to members of the public body, the attorney for the public
448448 body, and the immediate staff of the public body. No person who may
449449 profit directly or indirectly by a proposed transaction which is
450450 under consideration may be present or participate in the executive
451451 session; or
452452 11. Discussing the following:
453453 a. the investigation of a plan or scheme to commit an act
454454 of terrorism,
455455 b. assessments of the vulnerability of government
456456 facilities or public improvements to an act of
457457 terrorism,
458458 c. plans for deterrence or prevention of or protection
459459 from an act of terrorism,
460460 d. plans for response or remediation after an act of
461461 terrorism,

513513 e. information technology of the public b ody but only if
514514 the discussion specifically identifies:
515515 (1) design or functional schematics that demonstrate
516516 the relationship or connections between devices
517517 or systems,
518518 (2) system configuration information,
519519 (3) security monitoring and response equipment
520520 placement and configuration,
521521 (4) specific location or placement of systems,
522522 components or devices,
523523 (5) system identification numbers, names, or
524524 connecting circuits,
525525 (6) business continuity and disaster planning, or
526526 response plans, or
527527 (7) investigation inform ation directly related to
528528 security penetrations or denial of services, or
529529 f. the investigation of an act of terrorism that has
530530 already been committed.
531531 For the purposes of this subsection, the term “terrorism” means any
532532 act encompassed by the definitions se t forth in Section 1268.1 of
533533 Title 21 of the Oklahoma Statutes.
534534 C. Notwithstanding the provisions of subsection B of this
535535 section, the following public bodies may hold ex ecutive sessions:

592592 in Section 5062.6 of Title 74 of the Okla homa Statutes;
593593 4. The Oklahoma Center for the Advancement of Science and
594594 Technology, as provided for in Section 5060.7 of Title 74 of the
595595 Oklahoma Statutes;
596596 5. The Oklahoma Health Research Committee for purposes of
597597 conferring on matters pertaining to res earch and development of
598598 products, if public disclosure of the matter discussed would
599599 interfere with the development of patents, copyrights, products, or
600600 services;
601601 6. The Workers’ Compensation Commission for the purposes
602602 provided for in Section 20 of Titl e 85A of the Oklahoma Statutes;
603603 7. A review committee, as provided for in Section 855 of Title
604604 62 of the Oklahoma Statutes;
605605 8. The Child Death Review Board for purposes of receiving and
606606 conferring on matters pertaining to materials declared confidential
607607 by law;
608608 9. The Domestic Violence Fatality Review Board as provided in
609609 Section 1601 of Title 22 of the Oklahoma Statutes;

661661 10. The Opioid Overdose Fatality Review Board, a s provided in
662662 Section 2-1001 of Title 63 of the Oklahoma Statutes;
663663 11. All nonprofit foundations, boards, bureaus, commissions,
664664 agencies, trusteeships, authorities, councils, committees, public
665665 trusts, task forces or study groups supported in whole or par t by
666666 public funds or entrusted with the expenditure of public funds for
667667 purposes of conferring on matters pertaining to economic development
668668 including the transfer of property, financing, or the creation of a
669669 proposal to entice a business to remain or to l ocate within their
670670 jurisdiction if public disclosure of the matter discussed would
671671 interfere with the development of products or services or if public
672672 disclosure would violate the confidentiality of the business;
673673 12. The Oklahoma Indigent Defense System B oard for purposes of
674674 discussing negotiating strategies in connection with making pos sible
675675 counteroffers to offers to contract to provide legal representation
676676 to indigent criminal defendants and indigent juveniles in cases for
677677 which the System must provide representation pursuant to the
678678 provisions of the Indigent Defense Act;
679679 13. The Quality Investment Committee for purposes of discussing
680680 applications and confidential materials pursuant to the terms of the
681681 Oklahoma Quality Investment Act;
682682 14. The Oklahoma Municipal Power Authority established pursuant
683683 to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and
684684 in its role as an electric utility regulated by the federal

736736 government, for purposes of discussing security plans and procedures
737737 including, but not limited to, cybersecurity matters; and
738738 15. The Oklahoma Tax Commis sion for purposes of discussing
739739 confidential taxpayer matters as provided in Secti on 205 of Title 68
740740 of the Oklahoma Statutes, and in compliance with subsection E of
741741 this section; and
742742 16. The Judicial Nominating Commission for the purposes of
743743 discussing the merits and qualific ations of candidates for judicial
744744 office to determine which candidates will be interviewed or sol ely
745745 to meet with a candidate to discuss confide ntial information
746746 relating to financial disclos ure information or background checks.
747747 Candidate interviews shall not be conducted in execu tive sessions
748748 and Commissioners shall not vote or indi cate how they intend to vote
749749 in executive session.
750750 D. Except as otherwise specified in this subsection, an
751751 executive session for the purpose of discussing the purchase or
752752 appraisal of real property shall be limited to members of the public
753753 body, the attorney f or the public body and the immediate staff of
754754 the public body. No landowner, real estate salesperson, broker,
755755 developer or any other person who may profit directly or indirec tly
756756 by a proposed transaction concerning real property which is under
757757 consideration may be present or participate in the executive
758758 session, unless they are operating under an existing agreement to
759759 represent the public body.

811811 E. No public body may go into a n executive session unless the
812812 following procedures are strictly complied with:
813813 1. The proposed executive session is noted on the agenda as
814814 provided in Section 311 of this title;
815815 2. The executive session is authorized by a majority vote of a
816816 quorum of the members present and the vote is a recorded vote; and
817817 3. Except for matters con sidered in executive sessions of the
818818 State Banking Board and the Oklahoma Tax Commission, and which are
819819 required by state or federal law to be confidential, any vote or
820820 action on any item of business considered in an executive session
821821 shall be taken in public meeting with t he vote of each member
822822 publicly cast and recorded.
823823 F. A willful violation of the provisions of this section shall:
824824 1. Subject each member of the public bod y to criminal sanctions
825825 as provided in Section 314 of this title; and
826826 2. Cause the minutes and all other records of the execut ive
827827 session including tape recordings, to be immediately made public.
828828 SECTION 3. AMENDATORY 25 O.S. 202 1, Section 310, is
829829 amended to read as follows:
830830 Section 310. Any member of the Legislature appointed as a
831831 member of a committee of either house of the Legislature or joint
832832 committee thereof shall be permitt ed to attend any executive session
833833 authorized by the Oklahoma Open Meeting Act of any state agency,
834834 board or commission whenever the jurisdiction of such committee
