148 | 148 | | B. This act Section 1101 et seq. of this title shall be |

149 | 149 | | construed according to the fair import of its terms to further the |
---|
150 | 150 | | general purposes stated in this section and the special purposes of |

151 | 151 | | the particular provision involved. |
---|
152 | 152 | | SECTION 3. NEW LAW A new section of law to be codified |
---|
153 | 153 | | in the Oklahoma Statutes as Section 191.1 of Title 40, unless there |
---|
154 | 154 | | is created a duplication in nu mbering, reads as follows: |
---|
155 | 155 | | A. Any public or private employer operating in this state who |
---|
156 | 156 | | requires an employee or contractor to participate in vaccination or |
---|
157 | 157 | | immunization for COVID-19, as defined in Section 111 of Title 76 of |
---|
158 | 158 | | the Oklahoma Statutes, any variant, or future variants thereof as |
---|
159 | 159 | | part of an employer’s policy, whether written or verbal, shall allow |
---|
160 | 160 | | for a privacy exemption for an employee or contractor to refuse |
---|
161 | 161 | | disclosure of his or her vaccination or immunization status. The |
---|
162 | 162 | | requirement of this subsection shall not be required of an employee |
---|
163 | 163 | | who can provide proof of natural immunity by presenting a positive |
---|
164 | 164 | | antibody test to his or her employer. |
---|
165 | 165 | | B. Every employee or contractor employed by a public or private |
---|
166 | 166 | | employer operating in this state shall be provided a certification |
---|

223 | 223 | | thereof for employees or contractors. The certification of |

224 | 224 | | disclosure exemption provided to an employee or contractor by the |
---|
225 | 225 | | employer, as required by this section, shall meet the following |
---|
226 | 226 | | requirements: |
---|
227 | 227 | | 1. Upon adoption of any policy or regulation by a public or |
---|
228 | 228 | | private employer operating in this state, the employer shall provide |
---|
229 | 229 | | immediate notice to all employees or contractors of the policy |
---|
230 | 230 | | adopted by the employer. Such notice shall include a certification |
---|
231 | 231 | | of disclosure exemption for the employee or contractor. An employee |
---|
232 | 232 | | seeking to refuse disclosure shall complete the employer-provided |
---|
233 | 233 | | certification of disclosure exemption; |
---|
234 | 234 | | 2. Upon receipt of the certification of disclosure exemption, |
---|
235 | 235 | | the employee or contractor shall be given thirty (30) calendar days |
---|
236 | 236 | | to complete and submit the certification to the employer; |
---|
237 | 237 | | 3. Upon submission of the completed certification of disclosure |
---|
238 | 238 | | exemption by the employee or contractor, the employer shall accept, |
---|
239 | 239 | | without question, the certification of exemption and shall sign t he |
---|
240 | 240 | | document acknowledging receipt; |

297 | 297 | | shall maintain a signed copy of an employe e’s or contractor’s |
---|
298 | 298 | | completed certification of disclosure exemption in the employe e’s or |
---|
299 | 299 | | contractor’s employment file and shall provide a signed copy to the |
---|
300 | 300 | | employee or contractor upon request. |
---|
301 | 301 | | C. Any policy or regulation adopted by an employer to implement |
---|
302 | 302 | | the provisions of this section shall not: |
---|
303 | 303 | | 1. Disclose an employee’s or contractor’s vaccination or |
---|
304 | 304 | | immunization status for COVID-19, any variant, or future variants |
---|
305 | 305 | | thereof; |
---|
306 | 306 | | 2. Provide incentives, bonuses, or any other reward for |
---|
307 | 307 | | disclosing an employee’s or contractor’s vaccination or immunization |
---|
308 | 308 | | status for COVID-19, any variant, or future variants thereof; |
---|
309 | 309 | | 3. Discriminate against an employee or contactor due to his or |
---|
310 | 310 | | her refusal to disclose his or her immunization or vaccination |
---|
311 | 311 | | status for COVID-19, any variant, or future variants thereof. |
---|
312 | 312 | | Discrimination includes, but is not limited to, harassment, |
---|
313 | 313 | | different treatment, denial of benefits, or retaliation against an |
---|
314 | 314 | | employee or contractor; |

374 | 374 | | 6. Require an employee or contractor to wear or display any |

375 | 375 | | insignia or mark, or otherwise directly or indirectly disclose his |
---|
376 | 376 | | or her refusal to disclose vaccination or immunization status for |
---|
377 | 377 | | COVID-19, any variant, or future variants thereof. |
---|
378 | 378 | | An employer may offer reasona ble accommodations for those who |
---|
379 | 379 | | refuse to disclose and provide an exemption from disclosure of |
---|
380 | 380 | | vaccination status. For the purposes of this section, “reasonable |
---|
381 | 381 | | accommodation” shall mean requiring the wearing of a mask when |
---|
382 | 382 | | interacting with or in close proximity of others or requiring |
---|
383 | 383 | | periodic testing not to exceed more than once weekly. Any costs |
---|
384 | 384 | | incurred by the implementation of these accommodations shall be paid |
---|
385 | 385 | | for by the employer. |
---|
386 | 386 | | D. An employee or contractor seeking an exemption from |
---|
387 | 387 | | disclosure of his or her vaccination or immunization status shall |
---|
388 | 388 | | complete the certification of exemption form included in this |
---|
389 | 389 | | subsection and deliver it to his or her employer. |
