8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. NEW LAW A new section of law not to be
8787 codified in the Oklahoma Statutes reads as f ollows:
8888 This act shall be known and may be cited as the “Privacy and
8989 Conscience Protection Act”.

143143 Section 1101. A. This act Section 1101 et seq. of this title
144144 provides for exclusive remedies within the state of the policies for
145145 individuals alleging discrimination in employment on the basis of
146146 race, color, national origin, sex, religion, creed, age, disability
147147 or, genetic information, or disclosure of medical privacy.
148148 B. This act Section 1101 et seq. of this title shall be
149149 construed according to the fair import of its terms to further the
150150 general purposes stated in this section and the special purposes of
151151 the particular provision involved.
152152 SECTION 3. NEW LAW A new section of law to be codified
153153 in the Oklahoma Statutes as Section 191.1 of Title 40, unless there
154154 is created a duplication in nu mbering, reads as follows:
155155 A. Any public or private employer operating in this state who
156156 requires an employee or contractor to participate in vaccination or
157157 immunization for COVID-19, as defined in Section 111 of Title 76 of
158158 the Oklahoma Statutes, any variant, or future variants thereof as
159159 part of an employer’s policy, whether written or verbal, shall allow
160160 for a privacy exemption for an employee or contractor to refuse
161161 disclosure of his or her vaccination or immunization status. The
162162 requirement of this subsection shall not be required of an employee
163163 who can provide proof of natural immunity by presenting a positive
164164 antibody test to his or her employer.
165165 B. Every employee or contractor employed by a public or private
166166 employer operating in this state shall be provided a certification

218218 of disclosure exemption, which shall release the employee or
219219 contractor from disclosing his or her vaccination or immunization
220220 status due to an employer-mandated policy or regulation, whether
221221 written or verbal, that involves or governs the vaccination or
222222 immunization status for COVID-19, any variant, or future variants
223223 thereof for employees or contractors. The certification of
224224 disclosure exemption provided to an employee or contractor by the
225225 employer, as required by this section, shall meet the following
226226 requirements:
227227 1. Upon adoption of any policy or regulation by a public or
228228 private employer operating in this state, the employer shall provide
229229 immediate notice to all employees or contractors of the policy
230230 adopted by the employer. Such notice shall include a certification
231231 of disclosure exemption for the employee or contractor. An employee
232232 seeking to refuse disclosure shall complete the employer-provided
233233 certification of disclosure exemption;
234234 2. Upon receipt of the certification of disclosure exemption,
235235 the employee or contractor shall be given thirty (30) calendar days
236236 to complete and submit the certification to the employer;
237237 3. Upon submission of the completed certification of disclosure
238238 exemption by the employee or contractor, the employer shall accept,
239239 without question, the certification of exemption and shall sign t he
240240 document acknowledging receipt;

292292 4. Upon submission of the completed certification of disclosure
293293 exemption, the employer shall not disclose employees or contractors
294294 who refused to disclose their vaccination or immunizations statuses
295295 for COVID-19, any variant, or future variants thereof; and
296296 5. All public or private employers operating in this state
297297 shall maintain a signed copy of an employe e’s or contractor’s
298298 completed certification of disclosure exemption in the employe e’s or
299299 contractor’s employment file and shall provide a signed copy to the
300300 employee or contractor upon request.
301301 C. Any policy or regulation adopted by an employer to implement
302302 the provisions of this section shall not:
303303 1. Disclose an employee’s or contractor’s vaccination or
304304 immunization status for COVID-19, any variant, or future variants
305305 thereof;
306306 2. Provide incentives, bonuses, or any other reward for
307307 disclosing an employee’s or contractor’s vaccination or immunization
308308 status for COVID-19, any variant, or future variants thereof;
309309 3. Discriminate against an employee or contactor due to his or
310310 her refusal to disclose his or her immunization or vaccination
311311 status for COVID-19, any variant, or future variants thereof.
312312 Discrimination includes, but is not limited to, harassment,
313313 different treatment, denial of benefits, or retaliation against an
314314 employee or contractor;

366366 4. Terminate, discipline, deny employment benefits to, or
367367 otherwise penalize an employee or contractor by a reduction in pay
368368 or benefits based on the employee’s refusal to disclose immunization
369369 or vaccination status for COVID-19, any variant, or future variants
370370 thereof;
371371 5. Segregate employees or contractors based on immunization or
372372 vaccination status for COVID-19, any variant, or future variants
373373 thereof; or
374374 6. Require an employee or contractor to wear or display any
375375 insignia or mark, or otherwise directly or indirectly disclose his
376376 or her refusal to disclose vaccination or immunization status for
377377 COVID-19, any variant, or future variants thereof.
378378 An employer may offer reasona ble accommodations for those who
379379 refuse to disclose and provide an exemption from disclosure of
380380 vaccination status. For the purposes of this section, “reasonable
381381 accommodation” shall mean requiring the wearing of a mask when
382382 interacting with or in close proximity of others or requiring
383383 periodic testing not to exceed more than once weekly. Any costs
384384 incurred by the implementation of these accommodations shall be paid
385385 for by the employer.
386386 D. An employee or contractor seeking an exemption from
387387 disclosure of his or her vaccination or immunization status shall
388388 complete the certification of exemption form included in this
389389 subsection and deliver it to his or her employer.

532532 SECTION 4. AMENDATORY 40 O.S. 2021, Section 192, is
533533 amended to read as follows:
534534 Section 192. A. Each and every viola tion of any provision of
535535 Section 1 of this act 191 of this title shall constitute a
536536 misdemeanor, punishable by a fine in any amount not exceeding One
537537 Hundred Dollars ($100.00).
538538 B. Any and every violation by the employer in subsection A of
539539 Section 4 of this act shall be under the jurisdiction of the Office
540540 of the Attorney General.
541541 SECTION 5. It being immediately necessary for the preservation
542542 of the public peace, health , or safety, an emergency is hereby
