53179 BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
54180 SECTION 1. NEW LAW A new section of law to be codified
55181 in the Oklahoma Statutes as Section 802 of Title 40, unless there is
56182 created a duplication in numbering, reads as follows:
57183 As used in this act:
58184 1. “Applicable agency” means a department or agency of the
59185 state that by law regulates a business acti vity and person engage d
60186 in such business activity including the issuances of licenses or
61187 other types of authorization, which the office determines would
62188 otherwise regulate a participant;

90240 2. “Applicant” means a person that purcha ses or otherwise
91241 enters into a transaction or ag reement to receive an offering
92242 pursuant to a demonstration by a participant;
93243 3. “Commission” means the General Regulatory Business Program
94244 Advisory Commission;
95245 4. “Commissioner” means the Commissioner of Labor;
96246 5. “Consumer” means a person that purchases or otherwise enters
97247 into a transaction or agreement to receive an offering pursuant to a
98248 demonstration by a participant;
99249 6. “Demonstrate” or “demonstration” means to temporarily
100250 provide an offering in accordance with the provisions of this act;
101251 7. “Director” means the Director of the General Regulatory
102252 Business Relief Office;
103253 8. “Innovation” means the use or incorporation of a new idea, a
104254 new or emerging technology, or a new use of existing technology to
105255 address a problem, provide a benefit, or otherwise offer a product,
106256 production method, o r service;
107257 9. “Innovative offering” means an offering that includes an
108258 innovation;
109259 10. “Participant” means a person whose appli cation to
110260 participate in the General Regulatory Business Program is in
111261 accordance with the provisions of this act;
112262 11. “Product” means a commercially distributed good th at is:
113263 a. tangibly personal property,

144318 12. “Production” means the method or process of creating or
145319 obtaining a good, which may include assembling, bre eding, capturing,
146320 collecting, extracting, fabricating, farming, fishing, gathering,
147321 growing, harvesting, hunting, manufacturing, mining, processing,
148322 raising, or trapping a g ood;
149323 13. “Program” means the General Regulatory Business Program
150324 created in Section 5 of this act, which allows a per son to
151325 temporarily demonstrate an offering under a waiver or suspension of
152326 one or more state laws and regulation ;
153327 14. “Regulatory relief office” means the General Regulatory
154328 Business Relief Office created in Section 2 of this act; and
155329 15. “Service” means any commercial activity, duty, or labor
156330 performed for another person.
157331 SECTION 2. NEW LAW A new section of law to be codified
158332 in the Oklahoma Statutes as Sec tion 802.1 of Title 40, unless there
159333 is created a duplication in numbering, reads as follows:
160334 A. There is created within the Department of Labor the General
161335 Regulatory Business Relief Office.
162336 B. 1. The regulatory relief office shall be administered by
163337 the Director of the General Regulatory Business Relief Office.

191389 2. The Director shall report to the Commissioner of Labor and
192390 may appoint staff subject to the approval of the Commissioner.
193391 C. The regulatory relief office shall:
194392 1. Administer the provisions of this act ;
195393 2. Administer the General Regulatory Business Program; and
196394 3. Act as a liaison between private businesses and applicable
197-agencies to identify state laws or agency rules that could

198396 potentially be repealed or suspended under the Program.
199397 D. The regulatory relief office may:
200398 1. Review state laws and regulations that may un necessarily
201399 inhibit the creation and success of new c ompanies or industries and
202400 provide recommendations to the Governor and the Legislature on
203401 modifying such laws and regulations ;
204402 2. Create a framework for analyzing the risk level to the
205403 health, safety, and financial well -being of consumers related to
206404 permanently removing or temporarily suspending laws and agency rules
207405 inhibiting the creation or success of new and existing com panies or
208406 industries;
209407 3. Propose potential reciprocity agreements between states that
210408 use or are proposing to use similar programs as described in this
211409 act; and
212410 4. In accordance with administrative rules and this act,
213411 establish rules regarding:

246468 SECTION 3. NEW LAW A new sec tion of law to be codified
247469 in the Oklahoma Statutes as Section 802.2 of Title 40, unless there
248470 is created a duplication in numbering, reads as follows:
249471 A. There is hereby created the General Regulatory Business
250472 Program Advisory Commission.
251473 B. The Commission shall consist of eleven (11) members to be
252474 appointed and serve as f ollows:
253475 1. Six members appointed by the Director of the General
254476 Regulatory Business Relief Office who represent business interests
255477 and are selected from a variety of industries;
256478 2. Three members appointed by the Director who represent state
257479 agencies that regulate business;
258480 3. One member of the Senate, appointed by the President Pro
259481 Tempore of the Senate; and
260482 4. One member of the House of Representatives, appointed by the
261483 Speaker of the House of Representatives.
262484 C. 1. Except as otherwise provided in paragraph 2 of this
263485 subsection, members of the Commission who are not members of the
264486 Legislature shall be appointed to four -year terms.

292538 2. The Director may adjust the length of terms of appointments
293539 and reappointments to the Commission so the majority of members are
294540 appointed every two years.
295541 D. The Director shal l appoint a chair for the Commission
296542 annually.
297543 E. A majority of the Commission shall constitute a quorum for
298544 purposes of conducting the business of the Commission, and the
299545 actions of the majority shall constitute the actions of the
300546 Commission.
301547 F. The Commission shall advise and make recommendations to the
302548 regulatory relief office as described in this act.
303549 G. The regulatory relief office shall provide administrative
304550 staff support for the Commission.
305551 H. Members shall not receive a salary for duties performed as
306552 members of the Commission but shall be reimbursed for their actual
307553 and necessary expenses incurred in the perfo rmance of Commission
308554 duties pursuant to the provisions of the State Travel Reimbursement
309555 Act.
310556 I. The Commission shall be subject to the Oklahoma Open Meeting
311557 Act and the Oklahoma Open Records Act.

342612 A. The Director of the General Regulatory Business Relief
343613 Office shall prepare a report on the activities of the General
344614 Regulatory Business Relief Office, which shall include:
345615 1. Information regarding each participant in the General
346616 Regulatory Business P rogram created in this act including which
347617 industries each participant represents and the anticipated or actual
348618 cost savings that each participant experienced;
349619 2. Recommendations regarding any laws or agency rules that
350620 should be permanently amended;
351621 3. Information regarding outcomes for consumers; and
352622 4. Recommendations for changes to the Program or other duties
353623 of the regulatory re lief office.
354624 B. By October 1 of each year, the Director shall provide the
355625 report to the Legislature.
356626 SECTION 5. NEW LAW A new section of law to be codified
357627 in the Oklahoma Statutes as Section 802.4 of Title 40, unless there
358628 is created a duplication in numbering, reads as follows:
359629 A. There is hereby created in the General Regulatory Business
360630 Relief Office the General Regulatory Business Program.
361631 B. In administering th e Program, the regulatory relief office:
362632 1. Shall consult with each applicable agency;
363633 2. Shall establish a program to enable a person to obtain legal
364634 protections and limited access to the market in this state to

393687 other authorization that mi ght otherwise be required;
394688 3. May enter into agreements with or adopt the best prac tices
395689 of corresponding federal regulatory agencies or other states that
396690 are administering similar programs; and
397691 4. May consult with business es in this state about existing or
398692 potential proposals for the Program.
399693 C. 1. An applicant for the Program may contact the regulatory
400694 relief office to request a consultation regarding the Program before
401695 submitting an application.
402696 2. The regulatory relief office may provide assistance to an
403697 applicant in preparing an application for submission.
404698 D. An applicant for the Program shall provide the regulatory
405699 relief office an application in a form prescrib ed by the regulatory
406700 relief office that:
407701 1. Confirms the applicant is subject to the jurisdiction of
408702 this state;
409703 2. Confirms the applicant has established a physical or virtual
410704 location in this state, from which the d emonstration of an
411705 innovative offering will be developed and performed and where all
412706 required records, documents, and data will be maintained;
413707 3. Contains relevant personal and contact information for th e
414708 applicant including legal names, addresses, telephone numbers, email

448766 a. how the offering is subject to licensing, legal
449767 prohibition, or other authorization requirements
450768 outside of the Program,
451769 b. each law or rule that that the applicant seeks to have
452770 waived or suspended while participating in the
453771 Program,
454772 c. how the offering would benefit cons umers,
455773 d. how the offering is different from other offerings
456774 available in this state,
457775 e. what risks may exist for consumers who use or purchase
458776 the offering,
459777 f. how participating in the Program would enable a
460778 successful demonstration of the off ering,
461779 g. a description of the proposed demonstration plan
462780 including estimated time periods for beginning and
463781 ending the demonstration,
464782 h. recognition that the applicant will be subject to all
465783 laws and agency rules pertaining to the applicant’s
466784

494836 and
495837 i. how the applicant shall end the demonstration and
496838 protect consumers if the demonstration fails;
497839 6. Lists each gover nment agency, if any, that the applicant
498840 knows regulates the applicant’s business; and
499841 7. Provides any other required information as determined by the
500842 regulatory relief office.
501843 E. The regulatory relief office may collect an applicati on fee
502844 from an applicant set in administrative rules by the Department of
503845 Labor.
504846 F. An applicant shall file a separate application fo r each
505847 innovative offering that the applicant wishes to demonstrate.
506848 G. After an application is filed, the regulatory rel ief office:
507849 1. Shall classify the application and any related information
508850 provided by the applicant as confidential;
509851 2. Consult with each applicable government agency that
510852 regulates the applicant’s business regarding whether more
511853 information is needed fr om the applicant; and
512854 3. Seek additional informat ion from the applicant that the
513855 regulatory relief office determines is necessary.
514856 H. No later than five (5) business days after the day on which
515857 a completed application is received, the regulatory relief o ffice
516858 shall:

544910 1. Review the application an d refer the application to each
545911 applicable government agency tha t regulates the applicant’s
546912 business; and
547913 2. Provide to the applicant:
548914 a. an acknowledgement of receipt of the application, and
549915 b. the identity and contact information of each
550916 regulatory agency to which the application h as been
551917 referred for review.
552918 I. 1. Subject to paragraphs 3 and 7 of this subsection, no
553919 later than thirty (30) days after the applicable agency receives a
554920 completed application for re view, the applicable agency shall
555921 provide a written report to the Director of the applicable agency’s
556922 findings.
557923 2. The report shall:
558924 a. describe any identifiable, likely, and significant
559925 harm to the health, safety, or financial wellbeing of
560926 consumers that the relevant law or rule protects
561927 against, and
562928 b. make a recommendation to the re gulatory relief office
563929 that the applicant either be admitted or denied
564930 entrance into the Program.
565931 3. a. the applicable agency may request an additional five
566932 (5) business days to deliver the written report by

596986 b. the applicable agency may only request on e extension
597987 per application.
598988 4. If the applicable agency recommends an applicant under this
599989 section be denied entra nce into the Program, the written report
600990 shall include a description of the reasons for the recommendation
601991 including why a temporary waiver or suspension of the rele vant laws
602992 or agency rules would potentially significantly harm the he alth,
603993 safety, or financial wellbeing of consumers or the public and the
604994 likelihood of such harm occurring.
605995 5. If the agency determines that the consumer’s or public’s
606996 health, safety, or financial wellbeing can be protected through less
607997 restrictive means than the existing relev ant laws or agency rules,
608998 then the applicable agency shall pro vide a recommendation of how
609999 that may be achieved.
6101000 6. If an applicable agency fails to deliver a written r eport
6111001 pursuant to this subsection, the Director shall assume the
6121002 applicable agency does no t object to the temporary waiver or
6131003 suspension of the relevant laws or agency rules for an applicant
6141004 seeking to participate in the Program.
6151005 7. Notwithstanding any ot her provisions of this section, an
6161006 applicable agency may by writt en notice to the regulator y relief

6481062 requested by the applicable agency, reject an
6491063 application if the applicable ag ency determines, in
6501064 the applicable agency ’s sole discretion, t hat the
6511065 applicant’s offering fails to co mply with standards or
6521066 specifications:
6531067 (1) required by federal law or rule, or
6541068 (2) previously approved for use by a federal agen cy,
6551069 or
6561070 b. reject an application preliminarily approved by the
6571071 regulatory relief office, if the applicable agency:
6581072 (1) recommended rejection of the application in
6591073 accordance with paragraph 4 of this subsection in
6601074 the agency’s report, and
6611075 (2) provides in the written notice under paragraph 4
6621076 of this subsection, a description o f the
6631077 applicable agency’s reasons why approval of the
6641078 application would create a substa ntial risk of
6651079 harm to the health or safety of the public or
6661080 create unreasonable expenses for taxpaye rs of
6671081 this state.

6961134 paragraph 7 of this subsection, the regulatory relief office shall

6981136 J. 1. Upon receiving a written report described in subsection
6991137 I of this section, the Director shall provide t he application and
7001138 the written report to the Commission.
7011139 2. The Director may call the Commission to meet as needed, but
7021140 not less than once per quarter if appli cations are available for
7031141 review.
7041142 3. After receiving and reviewing the application and each
7051143 written report, the Commission shall provid e to the Director the
7061144 Commission’s recommendation as to whether or not the applicant
7071145 should be admitted as a participant under this act.
7081146 4. As part of the Commission’s review of each writte n report,
7091147 the Commission shall use the criteria required for an applicable
7101148 agency as prescribed in subsection I of this section.
7111149 K. 1. In reviewing an application and each applicable agency ’s
7121150 written report, the regulatory relief office shall consult with each
7131151 applicable agency and the Commission before admitting an applicant
7141152 into the Program.
7151153 2. The consultation with e ach applicable agency and the
7161154 consultation with the Commission may include seeking information
7171155 about whether:

7501212 L. In reviewing an application under this section, the
7511213 regulatory relief office and applica ble agency shall consider
7521214 whether a competitor to the applicant is or has been a participant
7531215 and, if so, weigh that as a factor in favor of allowing the
7541216 applicant to also become a participant.
7551217 M. In reviewing an application under this section, the
7561218 regulatory relief office shall consider whether :
7571219 1. The applicant’s plan will adequately protect consumers from
7581220 potential harm identified by an applicable agency in the applicable
7591221 agency’s written report;
7601222 2. The risk of harm to consumers is outweighed by the potential
7611223 benefits to consumers from the applican t’s participation in the
7621224 Program; and
7631225 3. Certain state laws or agency rules that regulate an offering
7641226 should not be waived or suspended even if the applicant is approved
7651227 as a participant including applicable antifraud or disclosure
7661228 provisions.
7671229 N. 1. An applicant becomes a participant if the regulatory
7681230 relief office approves the application for the Program and enters
7691231

7991285 2. Notwithstanding any other provisions of this act, the
8001286 regulatory relief office may not enter into a written agreement with
8011287 an applicant that waives or suspends a tax, fee, or charges t hat are
8021288 administered by the Oklahoma Tax Commission.
8031289 O. 1. The Director may deny at the Director ’s sole discretion
8041290 any application submitted under this section for any reason
8051291 including if the Director determines that the preponderan ce of
8061292 evidence demonstrates that suspending or waiving enforcement of a
8071293 law or rule would cause a significant risk or harm to consumers or
8081294 residents of this state.
8091295 2. If the Director denies an application submitted under this
8101296 section, the regulatory relie f office shall provide to the applicant
8111297 a written description of the reasons for not al lowing the applicant
8121298 to be a participant.
8131299 3. The denial of an application submitted under this section is
8141300 not subject to:
8151301 a. agency or judicial review, or
8161302 b. the provisions of the Administrative Procedures Act.
8171303 P. The Director shall deny an app lication for participation in
8181304 the Program described in this section if the applicant or any person
8191305 who seeks to participate with the applicant in demonstrating an

8521362 Q. When an applicant is approved f or participation in the
8531363 Program, the Director may provide notice of the approval to
8541364 competitors of the applicant and the p ublic.
8551365 SECTION 6. NEW LAW A new section of law to be codified
8561366 in the Oklahoma Statutes as Section 802.5 of Title 40, unless there
8571367 is created a duplication in numbering, reads as follows:
8581368 A. If the General Regulatory Business Relief Office approves an
8591369 application under this section, the participant has twelve (12)
8601370 months after approval to demonstrate the offering described in the
8611371 participant’s application.
8621372 B. An offering that is demonstrated within the General
8631373 Regulatory Business Program is subject to the following:
8641374 1. Each consumer shall be a resident of this state; and
8651375 2. No law or rule may be waived or suspended if waiving or
8661376 suspending the law or rule would prevent a consumer from seeking
8671377 restitution in the even t that the consumer is harmed.
8681378 C. This section does not restrict a participant who holds a
8691379 license or other authorization in another ju risdiction from acting
8701380 in accordance with that license or other authorization.

8981432 D. A participant is deemed to possess an appr opriate license or
8991433 other authorization under the laws of this sta te for the purposes of
9001434 any provision of federa l law requiring licensure or other
9011435 authorization by the s tate.
9021436 E. Except as provided in subsection F of this section, during
9031437 the demonstration period:
9041438 1. A participant is not subject to the enforcement of state
9051439 laws or agency rules identified in the written agreement betwee n the
9061440 regulatory relief office and the parti cipant;
9071441 2. A prosecutor may not file or pursue charges pertaining to a
9081442 law or rule identified in the written agreement between the
9091443 regulatory relief office and the participant; and
9101444 3. A state agency may not file or pursue any punitive action
9111445 against a participant including a fine or license suspension or
9121446 revocation, for the violation of a law or rule that is identified as
9131447 being waived or suspended in the w ritten agreement between the
9141448 regulatory relief office and the participant.
9151449 F. Notwithstanding any other provision of this section, a
9161450 participant shall not have immuni ty related to any criminal offense
9171451 committed during the participant’s participation in the Program.
9181452 G. By written notice, the regulatory re lief office may end a
9191453 participant’s participation in the Program at any time an d for any
9201454 reason including if the Director determines that a participant is

9551513 Program, for any reason; and
9561514 2. Ending a participant’s participation in the Program at any
9571515 time and for any reason.
9581516 SECTION 7. NEW LAW A new section of law to be codified
9591517 in the Oklahoma Statutes as Section 802.6 of Title 40, unless there
9601518 is created a duplication in numbering, reads as follows :
9611519 A. Before demonstrating an offering to a consumer, a
9621520 participant shall disclose the following to the consumer:
9631521 1. The name and contact information of the participant;
9641522 2. That the offering is authorized pursuant to this act and, if
9651523 applicable, that the participant does not have a license or other
9661524 authorization to provide an of fering under state laws that regulate
9671525 an offering outside of the General Regulatory Business Program;
9681526 3. That the offering is undergoing testing and may not fu nction
9691527 as intended and may expose the consumer to c ertain risks as
9701528 identified by the applicable agency ’s written report;

10081590 demonstrated and provide the regulatory re lief office’s telephone
10091591 number and website addres s where a complaint may be filed.
10101592 B. The disclosures required by subsection A of this section
10111593 shall be provided to a consumer in a clear and conspicuous form and,
10121594 for an Internet or application -based offering, a consumer shall
10131595 acknowledge receipt of the d isclosure before any transaction ma y be
10141596 completed.
10151597 C. The regulatory relief office may require that a participant
10161598 make additional disclosures to a con sumer.
10171599 SECTION 8. NEW LAW A new section of law to be codified
10181600 in the Oklahoma Statutes as Section 802.7 of Title 40, unless there
10191601 is created a duplicat ion in numbering, reads as follows:
10201602 A. No later than thirty (30) days before the end of the twelve-

10581664 C. If a demonstration inclu des an offering that requires
10591665 ongoing duties, the participant may continue to do so but will be
10601666 subject to enforcement of the laws or agency rules that were waived
10611667 or suspended as part of the Program.
10621668 SECTION 9. NEW LAW A new section of law to be codified
10631669 in the Oklahoma Statutes as Section 802.8 of Title 40, unless there
10641670 is created a duplication in numbering, reads as follows:
10651671 A. No later than thirty (30) days before the end of the tw elve-
10661672 month demonstration period, a pa rticipant may request an extension
10671673 of the demonstration period.
10681674 B. The General Regulatory Business Relief Office shall grant or

11071737 B. If a participant ceases to provide an offer ing before the
11081738 end of a demonstration period, the participant shall notify the
11091739 General Regulatory Business Relief Office and each applicable agency
11101740 and report on actions taken by the participant to ensure consumers
11111741 have not been harmed as a result. The regulatory relief office
11121742 shall establish quart erly reporting requirements for a participant
11131743 including information about any consumer complaints .
11141744 C. The regulatory relief office may request records, documents,
11151745 and data from a partic ipant and, upon the regula tory relief office’s
11161746 request, the participant shall mak e such records, documents, and
11171747 data available for inspection by the regulatory relief office.
11181748 D. 1. The participant shall notify the regulatory relief
11191749 office and each applicable agency of any incidents that result in
11201750 harm to the health, safety, or financ ial wellbeing of a c onsumer.

11531807 immediately remove the par ticipant from the Program.
11541808 E. 1. No later than thirty ( 30) days after the participant
11551809 exits the Program, the participant shall submi t a written report to
11561810 the regulatory relief office and each applicable agency describing
11571811 an overview of the participant’s demonstration includ ing any:
11581812 a. incidents of harm to consumers,
11591813 b. legal action filed against the participant as a result
11601814 of the participant’s demonstration, and
11611815 c. complaints filed with an applicable agency as a result
11621816 of the participant’s demonstration.
11631817 2. No later than thirty (30) days after an applicable agenc y
11641818 receives the quarterly reporting described in subsection B of this
11651819 section or a written report from a participant pursuant to paragraph
11661820 1 of subsection E of t his section, the applicable agency shall
11671821 provide a written report to the regulatory relief office on t he
11681822 demonstration that describes any statutory or rule change the
11691823 applicable agency recommends as a result of the demonstration.
11701824 F. The regulatory re lief office may remove a participant from
11711825 the Program at any time if the regulatory relief office determines

12051883 is created a duplicat ion in numbering, reads as follow s:
12061884 A. The General Regulatory Business Relief Office shall create
12071885 and maintain on the Department of Labor’s website a webpage that
12081886 invites residents and businesses in this state to make sugges tions
12091887 regarding laws and agency rules that could be modified or eliminated
12101888 to reduce the regulatory burden of residents and businesses in this
12111889 state.
12121890 B. On no less than a quarterly basis, the regulatory relief
12131891 office shall compile the results of the sugge stions from the webpage
12141892 and provide a written report to the Governor, the President Pro
12151893 Tempore of the Senate, and the Speaker of the House of
12161894 Representatives that describes the most common suggestions .
12171895 C. In creating the report described in s ubsection B of this
12181896 section, the regulatory relief office and the Commission:
12191897 1. Shall ensure the priv ate information of residents and
12201898 businesses that make sugge stions on the website is not made public;
