8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 25 O.S. 2021, Section 2001, is
8787 amended to read as follows:
8888 Section 2001. A. This act shall be known and may be cited as
8989 the “Parents’ Bill of Rights”.
9090 B. This state, any political subdivision of this state, or any
9191 other governmental entity shall not infringe on the fundamental
9292 right of parents to direct the upbring ing, education, health care ,

145145 compelling governmental interest as app lied to the child involved is
146146 of the highest order, is narrowly t ailored, and is not otherwise
147147 served by a less restricti ve means.
148148 C. As used in the Parents ’ Bill of Rights, “parent” means the
149149 natural or adoptive parent or legal guardian of a minor child.
150150 D. A parent may file a civil a ction against a person or
151151 governmental entity in district court for a violation of this act.
152152 The court may grant injunctive relief, monetary damages, court
153153 costs, and reasonable attorney fees.
154154 SECTION 2. AMENDATORY 25 O.S. 2021, Section 2002, is
155155 amended to read as follows:
156156 Section 2002. A. All parental rights are reserved to a parent
157157 of a minor child without obstruction or interference from this
158158 state, any political subdivision of this state, any other
159159 governmental entity, or any other institution , including, but not
160160 limited to, the following rights:
161161 1. The right to direct the education of the minor ch ild
162162 including the right to choose public, priv ate, religious, or other
163163 means of education and the right to make reasonable choices within
164164 public schools for the education of his or her child;
165165 2. All rights of parents iden tified in Title 70 of the Oklahoma
166166 Statutes, including the right to access and r eview all school
167167 records relating to the minor child;

219219 3. The right to direct the upbringing of the minor child;
220220 4. The right to direct the moral or religious training of the
221221 minor child;
222222 5. The right to make and consent in writing to all physical and
223223 mental healthcare decisions for the minor child, unle ss otherwise
224224 prohibited by law;
225225 6. The right to access and review all medical records of the
226226 minor child unless otherwise pr ohibited by law or the parent is the
227227 subject of an investigation of a crime comm itted against the minor
228228 child and a law enforcement official requests that the information
229229 not be released;
230230 7. The right to consent in writing before a biometric scan of
231231 the minor child is made, shared, or stored;
232232 8. The right to consent in writing befor e any record of the
233233 minor child’s blood or deoxyribonucleic acid (DNA) is created,
234234 stored, or shared, except as required by Sections 1 -516 and 1-524.1
235235 of Title 63 of the Oklaho ma Statutes, or unless authorized pursu ant
236236 to a court order;
237237 9. The right to consent in writing before the state or any of
238238 its political subdivisions makes a video or voice reco rding of the
239239 minor child, unless the video or voice recording is made during o r
240240 as a part of a court proceeding, by l aw enforcement officers during
241241 or as part of a law enforcement investigation, during or as p art of

293293 a forensic interview in a criminal or De partment of Human Services
294294 investigation, or to be used solely for any of the following:
295295 a. safety demonstrations , including the maintenance of
296296 order and discipline in the common areas of a school
297297 or on student transportation vehicles,
298298 b. a purpose related to a legitimate academic or
299299 extracurricular activity,
300300 c. a purpose related to regular classroom instruction,
301301 d. security or surveillance of buildings or grou nds, and
302302 e. a photo identification card; and
303303 10. The right to be notified promptly if an employee of this
304304 state, any political subdivision of this state, any other
305305 governmental entity, or any other institution susp ects that a
306306 criminal offense has been com mitted against the minor child by
307307 someone other than a parent, unless the incident has first been
308308 reported to law enforcement and notification of the parent would
309309 impede a law enforcement or Department of Human Serv ices
310310 investigation. This The provisions of this paragraph does shall not
311311 create any new obligation for school districts and charter schools
312312 to report misconduct between students at school, such as fighting or
313313 aggressive play, that is routinely addressed a s a student
314314 disciplinary matter by the sc hool.
315315 B. This The provisions of this section does shall not authorize
316316 or allow a parent to engage in conduct that is unlawful or to abuse

368368 or neglect a child in violation of the laws of this state. This The
369369 provisions of this section shall not be construe d to apply to a
370370 parental action or decision that wo uld end life. This The
371371 provisions of this section does shall not prohibit courts, law
372372 enforcement officers , or employees of a government agency
373373 responsible for child welfare from acting in their official capacity
374374 within the reasonable and prudent scope of their authority. This
375375 The provisions of this section does shall not prohibit a court from
376376 issuing an order that is otherwis e permitted by law.
377377 C. Any attempt to withhold information that is relevant to the
378378 physical, emotional, or mental health of a minor child or to
379379 encourage or coerce a min or child to withhold information from the
380380 child’s parent shall be grounds for discipli ne of an employee of
381381 this state, any political subdivision of this state , or any other
382382 governmental entity, except for law enforcem ent personnel.
383383 D. Unless those rights h ave been legally waived or legally
384384 terminated, parents have inalienable rights that a re more
385385 comprehensive than those listed in this section. The Parents ’ Bill
386386 of Rights does not prescribe all rights of parents. Un less
387387 otherwise required by law, the righ ts of parents of minor children
388388 shall not be limited or denied. The Parents ’ Bill of Rights shall
389389 not be construed to apply to a parental action or decision that
390390 would end life.

442442 SECTION 3. AMENDATORY 25 O.S. 2021, Section 2003, is
443443 amended to read as follows:
444444 Section 2003. A. The board of education of a school d istrict,
445445 in consultation with parents, teachers, and administrators, shall
446446 develop and adopt a policy to promote the invo lvement of parents and
447447 guardians of children enrolled in the schools within the school
448448 district, including:
449449 1. A plan for parent parti cipation in the schools which is
450450 designed to improve parent and teacher cooperat ion in such areas as
451451 homework, attendance , and discipline;
452452 2. Procedures by which parents may learn about the course of
453453 study for their children and review learning materials , including
454454 the source of any supplement al educational materials;
455455 3. Procedures by which parents who object to any learnin g
456456 material or activity on the basis that it is harmful may withdraw
457457 their children from the activity or from the class or program in
458458 which the material is used. Objection t o a learning material or
459459 activity on the basis that it is harmful includes objectio n to a
460460 material or activity because it questions beliefs or practices in
461461 sex, morality, or religion;
462462 4. If a school district offers a ny sex education curricula
463463 pursuant to Section 11-105.1 of Title 70 of the Oklah oma Statutes or
464464 pursuant to any rules adopt ed by the State Board of Education,

526526 stereotypes, gender identity, gender expression, s exual orientation,

528528 education curricula pursuant to Section 11 -105.1 of Title 70 of the
529529 Oklahoma Statutes;
530530 6. Procedures by which parents may learn about the nature and
531531 purpose of clubs and activities that are part of the schoo l
532532 curriculum, as well as extracurricular clubs and activities that
533533 have been approved by the school , and procedures by which parents
534534 may withdraw their child from any club or activity to which the
535535 parents object; and
536536 7. Procedures by which parents may lea rn about parental rights
537537 and responsibilities under the laws of this state, including the
538538 following:
539539 a. the right to opt out of a sex education curriculum if
540540 one is provided by the school district,

607607 h. the right to review test results,
608608 i. the right to participate in gifted programs pursuant
609609 to Sections 1210.301 through 1210.308 of Title 70 of
610610 the Oklahoma Statutes,
611611 j. the right to inspect instructional materials used in
612612 connection with any research or experimentation
613613 program or project pursuant to Section 11 -106 of Title
614614 70 of the Oklahoma Statutes,
615615 k. the right to receive a school report card,

667667 l. the attendance requirements prescribe d in Section 10-
668668 106 of Title 70 of the Oklahoma Sta tutes,
669669 m. the right to public review of courses of study and
670670 textbooks,
671671 n. the right to be excused from school attendance for
672672 religious purposes,
673673 o. policies related to parental involvement pursuant to
674674 this section,
675675 p. the right to participate in parent -teacher
676676 associations and organizations that are sanctioned by
677677 the board of education of a school district, and
678678 q. the right to opt out of any data collection instrumen t
679679 at the district level that would captu re data for
680680 inclusion in the state longitudinal stu dent data
681681 system except what is necessary and essential for
682682 establishing a student ’s public school record.
683683 B. The board of education of a school district may adopt a
684684 policy to provide to parents the infor mation required by this
685685 section in an electronic fo rm.
686686 C. A parent shall submit a written request for information
687687 pursuant to this section during regular business hours to eith er the
688688 school principal at the school s ite or the superintendent of the
689689 school district at the office of the school district. Wit hin ten
690690 (10) days of receiving the request for information, the school

742742 principal or the superintendent of the school district shall either
743743 deliver the requested info rmation to the parent or submit to the
744744 parent a written explanation of the reasons for the denial of the
745745 requested information. If the request for information is denied or
746746 the parent does not receive the requested in formation within fifteen
747747 (15) days after submitting the request for information , the parent
748748 may submit a written request for the i nformation to the board of
749749 education of a school district, which shall formally consider the
750750 request at the next scheduled pub lic meeting of the board if the
751751 request can be properly noticed on the agenda. If the request
752752 cannot be properly noticed on the a genda, the board of education of
753753 a school district shall formally consider the request at the next
754754 subsequent public meeting o f the board.
755755 SECTION 4. AMENDATORY 25 O.S. 2021, Sect ion 2004, is
756756 amended to read as follows:
757757 Section 2004. A. Except as otherwise provided by law, no
758758 person, corporation, association, organization, state -supported
759759 institution, or individual employed by any of these entities may
760760 procure, solicit to perform , arrange for the performance of, perform
761761 surgical procedures, or perform a physical examination upon a minor
762762 or prescribe or dispense any prescription drugs to a minor without
763763 first obtaining a written consent of a parent or legal guardian of
764764 the minor. Provided, however, that if written consent is provi ded
765765 to a school district for assessment or treatment, such consent shall

817817 be effective for the school year for which it is grant ed and shall
818818 be renewed each subsequen t school year. If an assessment or
819819 treatment is performed through telemedicine at a school site and if
820820 consent has been provided by the parent and is currently effective,
821821 the health professional shall not be required to verify that the
822822 parent is at the site.
823823 B. Except as otherwise provided by law, no hospital as defined
824824 in Section 1-701 of Title 63 of the Oklahoma Statutes may permit
825825 surgical procedures to be performed upon a minor in its facilities
826826 without first having received a written consent from a p arent or
827827 legal guardian of the minor.
828828 C. The provisions of this section shall not apply wh en it has
829829 been determined by a physician that an emergency exists and that it
830830 is necessary to perform such surgical procedures for the treatment
831831 of an injury, illnes s, or drug abuse, or to save the life of the
832832 patient, or when such parent or other adult au thorized by law to
833833 consent on behalf of a minor cannot be located or contacted after a
834834 reasonably diligent effort.
835835 D. The provisions of this section shall not apply to an
836836 abortion, which shall be governed by the provisions of Sections 1 -
837837 740 through 1-740.6 and Sections 1-744 through 1-744.6 of Title 63
838838 of the Oklahoma Statutes or any successor statute.
839839 E. A person who violates a provision of this section is guilty
840840 of a misdemeanor, punishable by a fine of not more than One Thousand

894894 SECTION 5. AMENDATORY 70 O.S. 2021, Section 11-105.1, is
895895 amended to read as f ollows:
896896 Section 11-105.1. A. All curriculum and m aterials including
897897 supplementary materials which will be used to teach or will be used
898898 for or in connection with a sex education class or program which is
899899 designed for the exclusive purpose of discussing s exual behavior or
900900 attitudes,; or any test, survey, or questionnaire whose primary
901901 purpose is to elicit responses on sexual behavior or attitudes shall
902902 be available through the superintendent or a designee of the sch ool
903903 district for inspection by parents an d guardians of the student who
904904 will be involved wit h the class, program or, test, survey, or
905905 questionnaire. Such curriculum, materials, classes, programs,
906906 tests, surveys, or questionnaires shall include information about
907907 consent and shall have as one of i ts primary purposes the teaching
908908 of or informing students about the practice of abstinence. For the
909909 purposes of this section, “consent” shall have the same meaning as
910910 that provided by Section 113 of Title 21 of the Oklahoma Statutes.
911911 The superintendent o r a designee of the school district shall
912912 provide prior written notification to the parents or guardians of
913913 the students involved of their right to inspect the curriculum and
914914 material, and of their obligation to noti fy the parents or guardians
915915 shall provide the school in writing written consent if they do not

968968 or questionnaire. Each local board of education shall determine the
969969 means of providing writ ten notification to the parents and guar dian
970970 which will ensure effective notice in an effic ient and appropriate
971971 manner. No student shall be required to participate in a sex
972972 education class or program which dis cusses sexual behavior or
973973 attitudes if a paren t or guardian of the student objects in writing
974974 to does not provide written consent for such participation. If the
975975 type of program referred to in this section is a part of or is
976976 taught during a credit course, a student may be required to enroll
977977 in the course but shall not be required to receive instruction in or
978978 participate in the program if a parent or guardian objects in
979979 writing does not provide written consent .
980980 B. The superintendent or a designee of a schoo l district in
981981 which sex education is taught or a program is offered which is
982982 designed for the exclusive purpose of discussing sexual beha vior or
983983 attitudes shall approve all cu rriculum and materials which will be
984984 used for such education and any test, survey , or questionnaire whose
985985 primary purpose is to elicit responses on sexual behavior or
986986 attitudes used in the school prior to their its use in the classroom
987987 or school. The teacher i nvolved in the class, program, testing
988988 test, or survey shall submit the curricul um, materials, tests, or
989989 surveys to the superi ntendent or a designee for approval prior to
990990 their use in the classroom or school. Thi s section shall not apply
