5750 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5851 SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -100.7, is
5952 amended to read as follows:
6053 Section 24-100.7. A. This act shall be known and may be c ited
6154 as “Evan’s Law”.
6255 B. The board of education of each school district in this state
6356 shall adopt a policy regarding suicide awareness and training,
6457 requiring staff training , and the reporting of student drug abuse.
6558 B. C. The board of education of each s chool district in this
6659 state shall provide district-wide training to all staff on at least
60+a biennial basis addressing suicide awareness and prevention. The
61+Department of Mental Health and Substance Abuse Services shall make
62+available to school districts curriculum for staff which addresses

94-a biennial basis addressing suicide awareness and prevention. The
95-Department of Mental Health and Substance Abuse Services shall make
96-available to school districts curriculum for staff which addresses
9789 suicide awareness and prevention, without cost to the school
9890 districts. The course outline for the curriculum shall be made
9991 available to the public online through the school district website.
10092 Beginning with the 2021 -2022 school year, every school distric t
10193 shall:
10294 1. Provide a suicide prevention training program whic h includes
10395 as a core element evidence-based approaches;
10496 2. Provide the curriculum made available by the Department of
10597 Mental Health and Substance Abuse Ser vices; or
10698 3. Provide a suicide preve ntion training program that is
10799 selected by the school district from a list maintained by the
108100 Department of Mental Health and Substance Abuse Services to school
109101 district staff that addresses suicide awareness and prevent ion. The
110102 training program may be com bined with any other training provided by
111103 the school district a ddressing bullying prevention.
112104 C. D. Beginning with the 2022 -2023 school year, the board of
113105 education of each school district may provide training to addre ss
114106 suicide awareness and prevention t o students in grades seven through
115107 twelve.
108+D. E. Teachers, counselors, principals, administrators, and
109+other school personnel shall be immune from employment discipline
110+and any civil liability for:
111+1. Calling the 911 emergency telephone number, law enfor cement,
112+or the Department of Human Services if they believe a student poses

143-D. E. Teachers, counselors, principals, administrators, and
144-other school personnel shall be immune from employment discipline
145-and any civil liability for:
146-1. Calling the 911 emergency telephone number, law enforcement,
147-or the Department of Human Services if they believe a student poses
148139 a threat to themselves or others or if a student has committed or
149140 been the victim of a violent act or threat of a violent act;
150141 2. Providing referral, emergency medical care , or other
151142 assistance offered in good faith to a student or other youth; or
152143 3. Communicating information in good faith concerning drug or
153144 alcohol abuse or a potential safety threat by or to any student to
154145 the parents or legal guardians of the student, law enforc ement
155146 officers, or health care providers.
156147 E. F. No person shall have a cause of action for any loss or
157148 damage caused by any act or omission resulting from the
158149 implementation of this section or resulting from any traini ng, or
159150 lack thereof, required by this section, unless the loss or damage
160151 was caused by willful or wanton m isconduct.
161152 F. G. The training required pursuant to this section, or the
162153 lack thereof, shall not be construed to impose any specific duty of
163154 care.
164155 G. H. The board of education of each sc hool district may enter
165156 into agreements with designated Youth Services Agencies youth
157+services agencies for the provision of intervention and prevention
158+services.
159+H. I. Teachers, counselors, principals, administrators , or
160+other school personnel, upon dete rmining that a student is at risk
161+of attempting suicide, shall notify the parents or legal guardians
162+of the student immediately upon determining that such risk exists.

199189 SECTION 2. This act shall become e ffective July 1, 2023.
200190 SECTION 3. It being immediately necessary for the preservation
201191 of the public peace, health, or safety, an emergency is hereby
202192 declared to exist, by reason whereof thi s act shall take effect and
203193 be in full force from and after its passage and approval.
