3363 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3564 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -4-806, is
3665 amended to read as follows:

3866 Section 1-4-806. A. The court may order a trial home
3967 reunification by returning the child to the care o f the parent or
4068 legal guardian from whom the child was removed for a period not to
4169 exceed and setting a date for r eview within six (6) months;

4297 provided, when determined necessary the court may extend the period
4398 of trial reunification to a specific date cer tain by entering such
4499 extension order prior to the expiration o f the initial six-month
45100 trial reunification period . At any time during trial reunification,
46101 when reunification appears successful, the court may return legal

49102 custody to the parent or legal gua rdian and relieve the Department
50103 of Human Services of legal cus tody. If the court determines trial
51104 reunification should be extended, the court shall set a new date for
52105 review. A child shall spend no longer than a total of twelve (12)
53106 months in trial reun ification. The Prior to trial reunification,
54107 the Department of Human Services shall conduct a criminal background
55108 check of any adult in the home, who is not a parent, legal guardian,
56109 or custodian, prior to any trial reunification . The background
57110 check shall include inquiries into Oklaho ma State Bureau of
58111 Investigation and Federal Bureau of Invest igation records for a
59112 national criminal history record check pursuant to the provisions of
60113 Section 150.9 of Title 74 of the Oklahoma Statutes.

62114 During the period of the trial home reunification, the
63115 Department of Human Services shall:

65116 1. Continue to have l egal custody of the child, thereby
66117 permitting the Department to visit the child in the home of the
67118 parent, at school, in a child care facility, or any other setti ng
68119 the Department deems necessary and appropriate;

70147 2. Continue to provide appropriate service s to both the parent ,
71148 if eligible, and the child during the period of the trial home
72149 reunification;

74150 3. Terminate the trial home reunification and remove the chil d
75151 to foster care, without court o rder or authorization, when ne cessary
76152 to protect the child ’s health, safety, or w elfare; and

78153 4. Advise the court and parties within three (3) judicial days
79154 of the termination of the trial home reunification when terminated
80155 by the Department without a cour t order.

82156 B. 1. When trial home reunification is terminated , whether by
83157 the Department or court order, the Department shall prepare a report
84158 for the court which describes the circumstances of the child during
85159 the trial home reunification period and recomm ends court orders, if
86160 any, deemed appropriate to provide for t he safety and stability of
87161 the child.

89162 2. In the event a trial home reunification is terminated by the
90163 Department by removing the child to foster care without pr ior court

93164 order or authorization, the court shall conduct a hea ring within
94165 fifteen (15) days of receiving notice of the termination of the
95166 trial home reunification by the Department and shall determine
96167 whether a continuation of the child in the child ’s home or with the
97168 child’s caretaker is contrary to the welfare of t he child and
98169 whether reasonable efforts were made to prevent the removal of the
99170 child from the trial home reunification.

101198 C. 1. Upon the completion of the six -month If the court
102199 determines that supervision should continue aft er twelve (12) months
103200 of trial home reunification period or any extension thereof , the
104201 court may further extend supervision of the child in the hom e by
105202 awarding award legal custody of the child to the parent or legal
106203 guardian with whom the child has been r eunited and ordering order
107204 the Department to provide supervision in accordance wi th the rules
108205 promulgated by the Commission Department.

110206 2. The duration of the extended s upervision shall not exceed
111207 six (6) months except in circumstances the court deems app ropriate
112208 and necessary to prot ect the health, safety or welfare of the child.

114209 SECTION 2. This act shall become effective November 1, 2023.
