7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 75 O.S. 2021, Section 250.2, is
8181 amended to read as follows:
8282 Section 250.2. A. Article V of the Oklahoma Constitution vests
8383 in the Legislature the power to make laws, and thereby to establish
8484 agencies and to designate agency functions, budge ts and purposes.
8585 Article VI of the Oklahoma Constitut ion charges the Executive Branch
8686 of Government with the responsibility to implement all measures
8787 enacted by the Legislature.
8888 B. In creating agencies and designating their functions and
8989 purposes, the Legislature may delegate rulemaking authority to

141141 executive branch agencies to facilitate administration of
142142 legislative policy. The delegation of rulemaking authority is
143143 intended to eliminate the necessity of establishing every
144144 administrative aspect of gener al public policy by legislation. In
145145 so doing, however, the Legislature reserves to itself:
146146 1. The right to retract any delegation of rulemaking authority
147147 unless otherwise precluded by the Oklahoma Constitution;
148148 2. The right to establish any aspect of ge neral policy by
149149 legislation, notwithstanding any deleg ation of rulemaking authority;
150150 3. The right and res ponsibility to designate the method for
151151 rule promulgation, review, repeal and modification;
152152 4. The right to approve or disapprove or repeal any adopt ed
153153 rule by joint resolution; and
154154 5. The right to disa pprove a proposed permanent, promulgated or
155155 emergency rule at any time if the Legislature determines such rule
156156 to be an imminent harm to the health, safety or welfare of the
157157 public or the state or if th e Legislature determines that a ru le is
158158 not consistent with legislative intent.
159159 C. All rulemaking authority delegated by the Legislature to
160160 executive branch agencies shall be used only to implement law or
161161 policy as set by the Legislature. With in three (3) years of the
162162 effective date of this act, all administrative rules, including
163163 rules approved prior to the effective date of this act , shall

217217 SECTION 2. AMENDATORY 75 O.S. 2021, Section 250.3, is
218218 amended to read as follow s:
219219 Section 250.3. As used in the Administrative Procedures Act:
220220 1. “Administrative head” means an official or agency body
221221 responsible pursuant to law for issuing final agenc y orders;
222222 2. “Adopted” means a proposed emergency rule which has been
223223 approved by the agency but has not been approved or disapproved by
224224 the Governor as an emergency rule as provided by Section 253 of this
225225 title, or a proposed permanent rule which has bee n approved by the
226226 agency and not disapproved by the Governor pursuant to paragraph 6
227227 of subsection A of Section 303 of this title, but has not been
228228 finally approved or disapproved by the Legislature or the Governor;
229229 3. “Agency” includes but is not limited to any constitutionally
230230 or statutorily created state board, bureau, commission, office,
231231 authority, public trust in which the state is a beneficiary, or
232232 interstate commission, except:
233233 a. the Legislature or any branch, committee or officer
234234 thereof, and
235235 b. the courts;
236236 4. “Concurrent majority” means a majority of memb ers on the
237237 Joint Committee on Administrative Rules from both the Oklahoma
238238 Senate and the Oklahoma House of Representatives;

290290 5. “Emergency rule” means a rule that is made pursuant to
291291 Section 253 of this title;
292292 6. “Expedited repeal” means the procedure uti lized by a rule-
293293 making agency as specified in Section 9 303a of this act title;
294294 7. “Final rule” or “finally adopted rule ” means a rule other
295295 than an emergency rule, which has not been published pursuant to
296296 Section 255 of this title but is otherwise in compliance with the
297297 requirements of the Administrative Procedures Act, and is:
298298 a. approved by the Legislature pursuant to Section 308.3
299299 of this title, provided that any such joint resolution
300300 becomes law in accordance with Secti on 11 of Article
301301 VI of the Oklahoma Constitution,
302302 b. approved by the Governor pursuant to subsection C of
303303 Section 308.3 of this title,
304304 c. approved by a joint resolution pursuant to subsection
305305 B of Section 308 of this title, pro vided that any such
306306 resolution becomes law in accordance with Section 11
307307 of Article VI of the Oklahoma Constitution, or
308308 d. disapproved by a joint resolution pursuant to
309309 subsection B of Section 308 of this title or Section
310310 308.3 of this title, which has bee n vetoed by the
311311 Governor in accordance with Section 11 of Article VI
312312 of the Oklahoma Constitution and the veto has not been

365365 8. “Final agency order” means an order that includes findings
366366 of fact and conclusions of law pursuant to Section 312 of this
367367 title, is dispositive o f an individual proceeding unless there is a
368368 request for rehearing, reopening, or reconsideration pursuant to
369369 Section 317 of this title and which is subject to judicial review;
370370 9. “Hearing examiner” means a person meeting the qualifications
371371 specified by Article II of the Administrative Procedures Act and w ho
372372 has been duly appointed by an agency to hold hearings and, as
373373 required, render orders or proposed orders;
374374 10. “Individual proceeding ” means the formal process employed
375375 by an agency having jurisdiction by law to resolve issues of law or
376376 fact between parties and which results in the exercise of discretion
377377 of a judicial nature;
378378 11. “License” includes the whole or part of any agency permit,
379379 certificate, approval, registration, charter, or similar form of
380380 permission required by law;
381381 12. “Office” means the Office of the Secretary of State;
382382 13. “Order” means all or part of a formal or official decision
383383 made by an agency including but not limited to final agency orders;
384384 14. “Party” means a person or agency named and participating,
385385 or properly seeking and ent itled by law to participate, in an
386386 individual proceeding;
387387 15. “Permanent rule” means a rule that is made pursuant to
388388 Section 303 of this title;

440440 16. “Person” means any individual, partnership, corporatio n,
441441 association, governmental subdivision, or public or private
442442 organization of any character other than an agency;
443443 17. “Political subdivision ” means a county, city, incorporated
444444 town or school district within this state;
445445 18. “Promulgated” means a finally adopted rule which has been
446446 filed and published in accordance with the provisions of the
447447 Administrative Procedures Act, or an emergency rule or preemptive
448448 rule which has been approved by the Governor;
449449 19. “Rule” means any agency statement or group of rel ated
450450 statements of general applicability and future effect that
451451 implements, interprets or prescribes law or policy as delegated by
452452 the Legislature, or describes the procedure or practice requirements
453453 of the agency. The term “rule” includes the amendment o r revocation
454454 of an effective rule but does not inclu de:
455455 a. the issuance, renewal, denial , suspension or
456456 revocation or other sanction of an individual specific
457457 license,
458458 b. the approval, disapproval or prescription of rates.
459459 For purposes of this subparagrap h, the term “rates”
460460 shall not include fees or charge s fixed by an agency
461461 for services provided by that agency including but not
462462 limited to fees charged for licensing, permitting,
463463 inspections or publications,

515515 c. statements and memoranda concerning only the internal
516516 management of an agency and not affecting private
517517 rights or procedures availabl e to the public,
518518 d. declaratory rulings issued pursuant to Section 307 of
519519 this title,
520520 e. orders by an agency, or
521521 f. press releases or “agency news releases”, provided
522522 such releases are not for the purpose of interpreting ,
523523 implementing or prescribing law or agency policy;
524524 20. “Rulemaking” means the process employed by an agency for
525525 the formulation of a rule;
526526 21. “Secretary” means the Secretary of State;
527527 22. “Small business” means a for-profit enterprise consisting
528528 of fifty or fewer full-time or part-time employees; and
529529 23. “Technical legal defect ” means an error that would
530530 otherwise invalidate an action by a court of law.
531531 SECTION 3. This act shall become effective November 1, 2023.
