6565 An Act relating to county sheriffs; declaring c ertain

8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new section of law to be codified
8585 in the Oklahoma Statutes as Section 517.2 of Title 19, unless there
8686 is created a duplication in numbering, reads as follows:
8787 A. The elected sheriff of each county is th e senior
8888 authoritative peace officer of that county. The primary duties of
8989 the sheriff are to keep the peace in the county and to secu re and
9090 protect the liberties a nd security of the residen ts of the county.

142142 B. A federal employee who is not desig nated by Oklahoma law as
143143 an Oklahoma peace officer may no t make an arrest, search, or seizure
144144 in this state without th e written permission of t he sheriff or
145145 designee of the sheriff of the county in which the arrest , search,
146146 or seizure will occur unless:
147147 1. The arrest, search, or seizure will take place on a fede ral
148148 enclave for which juri sdiction has been actively ceded to the United
149149 States of America by an Oklahoma statute;
150150 2. The federal employee witnesses the commission of a crime,
151151 the nature of which re quires an immediate arrest;
152152 3. The intended subject of t he arrest, search, or seizure is an
153153 employee of the sheriff ’s office or is an elected county or state
154154 officer; or
155155 4. The federal employee has probable ca use to believe that the
156156 subject of the arrest , search, or seizure has close connections with
157157 the sheriff, which connections are likely to result in the subject
158158 being informed of the impend ing arrest, search, or seizure .
159159 C. The county sheriff or designee of the sheriff ma y refuse
160160 permission for any reason that the sheriff or designee considers
161161 sufficient.
162162 D. A federal employee who is not designated by Oklahoma law as
163163 a peace officer and who desires to exercise an exception to
164164 paragraph 3 of subsection B of this section shall obtain the written
165165 permission of the Attorney General for the arrest, s earch, or

217217 seizure unless the resulting delay in obtain ing permission could
218218 cause serious harm to one or more individuals or to a community or
219219 would potentially cause flight of the s ubject of the arrest, search,
220220 or seizure in order to avoid prosecution. The Attorney General may
221221 refuse the permission for any reason that the Attorney General
222222 considers sufficient.
223223 E. A federal employee who is not designated by Oklahoma law as
224224 a peace officer and who desires to exercise an exception to
225225 paragraph 4 of subsection B of this section shall obtain the written
226226 permission of the Attorney General. The request for permission
227227 shall include a written statement, under oath, describing the
228228 federal employee’s probable cause. The Attorney General may refuse
229229 the request for any reason that the Attorney General considers
230230 sufficient.
231231 F. A permission request to the county sheriff or Attorney
232232 General shall contain:
233233 1. The name of the subject of the arrest, search, or seizure;
234234 2. A clear statement of pro bable cause for the arrest, search,
235235 or seizure or a federal arrest, search , or seizure warrant that
236236 contains a clear statemen t of probable cause;
237237 3. A description of specific assets, if any, to be searched for
238238 or seized;
239239 4. A statement of the date and time that the arrest, search, or
240240 seizure is to occur; and

292292 5. The address or location where the in tended arrest, search,
293293 or seizure will be attempted.
294294 G. The request may be in letter form , either typed or
295295 handwritten, but shall be countersigned with the original signature
296296 of the county sheriff or designee of the sheriff or by th e Attorney
297297 General, to constitute valid permission. The permission is valid
298298 for forty-eight (48) hours after it is signed. The sher iff or
299299 Attorney General shall keep a copy of the permission request on
300300 file.
301301 H. An arrest, search, or seizure or attempted arrest, search,
302302 or seizure in violation o f subsection B is unlawful and individuals
303303 involved shall be prosecuted by the district attorney of the county
304304 for kidnapping if an arrest or attempted arrest occurred, for
305305 trespass if a search or attempted search occurred, for theft if a
306306 seizure or attempted seizure occurred, and for any applicable
307307 homicide offense if loss of life occurred.
308308 I. The district attorney of the county has no discretion not to
309309 prosecute once a claim of violation of th e provisions of this
310310 section has been made by the county sheriff or designee of the
311311 sheriff, and failure to abide by this mandate subjects the district
312312 attorney to be subject to removal in accorda nce with the provisions
313313 of Section 1181.1 et seq. of Title 22 of the Oklahoma Statutes.
314314 J. Pursuant to the Tenth Amendment to the United States
315315 Constitution, the Legislature declares that any federal law

367367 purporting to give federal em ployees the authority of a county
368368 sheriff in this state is not recogn ized by this state, is
369369 specifically rejected by this st ate, and is declared to be null and
370370 void, and of no effect in this state.
371371 SECTION 2. It being immediately necessary for the preservation
372372 of the public peace, health or safety, an emergency is hereby
373373 declared to exist, by reason whereof this act shall take effect and
374374 be in full force from and after its passage and approval.
