8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified
9191 in the Oklahoma Statutes as Section 1017.7 of Title 56, unless there
9292 is created a duplication in numbering, reads as follows:

145145 1. “PACE” stands for program of all-inclusive care for the
146146 elderly; and
147147 2. The terms “PACE program agreement”, “PACE organization”, and
148148 “state administering agency” have the same meaning as provided by 42
149149 C.F.R., Section 460.6.
150150 B. 1. The Oklahoma Health Care Authority shall serve as the
151151 state administering agency responsible for administering PACE
152152 program agreements under 42 C.F.R., Part 460, Subpart C. The
153153 Authority may enter into PACE program agreements with PACE
154154 organizations and the Centers for Medicare and M edicaid Services.
155155 2. The Authority shall enforce applicable federal laws and
156156 regulations governing PACE organizations including but not limited
157157 to regulations of the Centers for Medicare and M edicaid Services
158158 codified at 42 C.F.R. , Part 460. The Authority may enter into an
159159 agreement with the State Department of Health to carry out any
160160 duties or functions of the state administering agenc y under 42
161161 C.F.R., Part 460 or other applicable federal laws or regulations.
162162 C. 1. The State Department of H ealth shall create and issue to
163163 qualifying applicants a license for PACE organizations. Qualifying
164164 PACE organizations shall at a minimum meet all requirements of 42
165165 C.F.R., Part 460, Subpart B.
166166 2. The Department shall perform onsite visits and other
167167 necessary monitoring of PACE organizations under 42 C.F.R., Part

219219 460, Subpart K and as provided by the agreement with the Authority
220220 described in paragraph 2 of subsection B of this section.
221221 3. The Department shall not license or regulate PACE
222222 organizations under the Home Care Act, the Adult Day Care Act, or
223223 any other act that governs a different type of facility or provider.
224224 4. The Department may, in cooperation with the Centers for
225225 Medicare and Medicaid Services and as provided by the agreement with
226226 the Authority described in paragraph 2 of subsection B of this
227227 section, take action against noncompliant PACE organizations under
228228 42 C.F.R., Part 460, Subpart D.
229229 D. The Oklahoma Health Care Authority Board and the State
230230 Commissioner of Health shall promulgate rules to imple ment this
231231 section.
232232 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-872, is
233233 amended to read as follows:
234234 Section 1-872. As used in the Adult Day Care Act:
235235 1. “Adult day care center ” or “center” means a facility which
236236 provides basic day care services to unrelated impaired adults for
237237 more than four (4) hours in a twe nty-four-hour period. A center
238238 shall be a distinct entity, either freestanding or a separate
239239 program of a larger organization. A center shal l have a separately
240240 verifiable staff, space, budge t and participant record system . The
241241 terms “adult day care center” adult day care center or “center”
242242 center shall not include retirement centers and, senior citizen

294294 centers, or PACE organizations as defined by 42 C.F.R. , Section

296296 2. “Basic day care services ” means supervised health, social
297297 supportive, and recreational services in a structu red daytime
298298 program which serves functionally impaired adults who continue to
299299 live in their own homes, usually with the aid of family care givers;
300300 3. “Department” means the State Department of Health; and
301301 4. “Participant” means any person attending an ad ult day care
302302 center.
303303 SECTION 3. AMENDATORY 63 O.S. 2021, Section 1-1961, is
304304 amended to read as follows:
305305 Section 1-1961. As used in the Home Care Act:
306306 1. “Board” means the State Board of Health;
307307 2. “Certification” means verification of appropriate training
308308 and competence established by the Sta te Commissioner of Health by
309309 rules promulgated pursuan t to the Home Care Act for home health
310310 aides and home care agency administrators;
311311 3. “Department” means the State Department of Health;
312312 4. “Healthcare provider” means a physician, physician assistant
313313 or Advanced Practice Registered Nurse recognized by th e Oklahoma
314314 Board of Nursing as a Certified Nurse Practitioner or a Clinical
315315 Nurse Specialist;
316316 5. “Home care agency” means any sole proprietorship,
317317 partnership, association, corporation or other organiz ation which

369369 administers, offers or provides home care services, for a fee or
370370 pursuant to a contract for such services, to clients in their place
371371 of residence. The term “home care agency” home care agency shall
372372 not include:
373373 a. individuals who contract with the Department o f Human
374374 Services to provide personal care services, pr ovided
375375 such individuals shall not be exempt from
376376 certification as home health aides,
377377 b. organizations that contract wit h the Oklahoma Health
378378 Care Authority as Intermediary Services Organizations
379379 (ISO) to provide federal Internal Revenue Service
380380 fiscal and supportive services to Consumer -Directed
381381 Personal Assistance Supports and Services (CD -PASS)
382382 waiver program participant s who have employer
383383 responsibility for hiring, training, directing and
384384 managing an individual personal care attendant, or
385385 c. CD-PASS waiver program employer participants , or
386386 d. PACE organizations as defined by 42 C.F.R. , Section
387387 460.6;
388388 6. “Home care services” means skilled or personal care services
389389 provided to clients in their pl ace of residence for a fee;
390390 7. “Home health aide” means an individual who provides personal
391391 care to clients in their temporar y or permanent place of r esidence
392392 for a fee;

444444 8. “Home care agency administr ator” means a person who
445445 operates, manages, or supervi ses, or is in charge of a home care
446446 agency;
447447 9. “Personal care” means assistance with dressing, bathing,
448448 ambulation, exercise or other personal needs;
449449 10. “Skilled care” means home care services perfor med on a
450450 regular basis by a trained Respiratory Therap ist/Technician or by a
451451 person currently licensed by this state including but not limited to
452452 a Licensed Practical Nurse, Regist ered Nurse, Physical Ther apist,
453453 Occupational Therapist , Speech Therapist, or Social Worker;
454454 11. “Standby assistance” means supervision of client directed
455455 activities with verbal prompting and infrequent, incidental hands -on
456456 intervention only; and
457457 12. “Supportive home assistant ” means an individual employed b y
458458 a home care agency w ho provides standby assistance to ambulatory
459459 clients, in conjunction with other companionship or homemaker
460460 services, in the temporary or permanent place of residence of the
461461 client for a fee.
462462 SECTION 4. This act shall become effective Novem ber 1, 2023.
