89	89	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
90	90	SECTION 1. NEW LAW A new section of law to be codified
91	91	in the Oklahoma Statutes as Section 1017.7 of Title 56, unless there
92	92	is created a duplication in numbering, reads as follows:

145	145	1. “PACE” stands for program of all-inclusive care for the
146	146	elderly; and
147	147	2. The terms “PACE program agreement”, “PACE organization”, and
148	148	“state administering agency” have the same meaning as provided by 42
149	149	C.F.R., Section 460.6.
150	150	B. 1. The Oklahoma Health Care Authority shall serve as the
151	151	state administering agency responsible for administering PACE
152	152	program agreements under 42 C.F.R., Part 460, Subpart C. The
153	153	Authority may enter into PACE program agreements with PACE
154	154	organizations and the Centers for Medicare and M edicaid Services.
155	155	2. The Authority shall enforce applicable federal laws and
156	156	regulations governing PACE organizations including but not limited
157	157	to regulations of the Centers for Medicare and M edicaid Services
158	158	codified at 42 C.F.R. , Part 460. The Authority may enter into an
159	159	agreement with the State Department of Health to carry out any
160	160	duties or functions of the state administering agenc y under 42
161	161	C.F.R., Part 460 or other applicable federal laws or regulations.
162	162	C. 1. The State Department of H ealth shall create and issue to
163	163	qualifying applicants a license for PACE organizations. Qualifying
164	164	PACE organizations shall at a minimum meet all requirements of 42
165	165	C.F.R., Part 460, Subpart B.
166	166	2. The Department shall perform onsite visits and other
167	167	necessary monitoring of PACE organizations under 42 C.F.R., Part

220	220	described in paragraph 2 of subsection B of this section.
221	221	3. The Department shall not license or regulate PACE
222	222	organizations under the Home Care Act, the Adult Day Care Act, or
223	223	any other act that governs a different type of facility or provider.
224	224	4. The Department may, in cooperation with the Centers for
225	225	Medicare and Medicaid Services and as provided by the agreement with
226	226	the Authority described in paragraph 2 of subsection B of this
227	227	section, take action against noncompliant PACE organizations under
228	228	42 C.F.R., Part 460, Subpart D.
229	229	D. The Oklahoma Health Care Authority Board and the State
230	230	Commissioner of Health shall promulgate rules to imple ment this
231	231	section.
232	232	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-872, is
233	233	amended to read as follows:
234	234	Section 1-872. As used in the Adult Day Care Act:
235	235	1. “Adult day care center ” or “center” means a facility which
236	236	provides basic day care services to unrelated impaired adults for
237	237	more than four (4) hours in a twe nty-four-hour period. A center
238	238	shall be a distinct entity, either freestanding or a separate
239	239	program of a larger organization. A center shal l have a separately
240	240	verifiable staff, space, budge t and participant record system . The
241	241	terms “adult day care center” adult day care center or “center”
242	242	center shall not include retirement centers and, senior citizen

296	296	2. “Basic day care services ” means supervised health, social
297	297	supportive, and recreational services in a structu red daytime
298	298	program which serves functionally impaired adults who continue to
299	299	live in their own homes, usually with the aid of family care givers;
300	300	3. “Department” means the State Department of Health; and
301	301	4. “Participant” means any person attending an ad ult day care
302	302	center.
303	303	SECTION 3. AMENDATORY 63 O.S. 2021, Section 1-1961, is
304	304	amended to read as follows:
305	305	Section 1-1961. As used in the Home Care Act:
306	306	1. “Board” means the State Board of Health;
307	307	2. “Certification” means verification of appropriate training
308	308	and competence established by the Sta te Commissioner of Health by
309	309	rules promulgated pursuan t to the Home Care Act for home health
310	310	aides and home care agency administrators;
311	311	3. “Department” means the State Department of Health;
312	312	4. “Healthcare provider” means a physician, physician assistant
313	313	or Advanced Practice Registered Nurse recognized by th e Oklahoma
314	314	Board of Nursing as a Certified Nurse Practitioner or a Clinical
315	315	Nurse Specialist;
316	316	5. “Home care agency” means any sole proprietorship,
317	317	partnership, association, corporation or other organiz ation which

370	370	pursuant to a contract for such services, to clients in their place
371	371	of residence. The term “home care agency” home care agency shall
372	372	not include:
373	373	a. individuals who contract with the Department o f Human
374	374	Services to provide personal care services, pr ovided
375	375	such individuals shall not be exempt from
376	376	certification as home health aides,
377	377	b. organizations that contract wit h the Oklahoma Health
378	378	Care Authority as Intermediary Services Organizations
379	379	(ISO) to provide federal Internal Revenue Service
380	380	fiscal and supportive services to Consumer -Directed
381	381	Personal Assistance Supports and Services (CD -PASS)
382	382	waiver program participant s who have employer
383	383	responsibility for hiring, training, directing and
384	384	managing an individual personal care attendant, or
385	385	c. CD-PASS waiver program employer participants , or
386	386	d. PACE organizations as defined by 42 C.F.R. , Section
387	387	460.6;
388	388	6. “Home care services” means skilled or personal care services
389	389	provided to clients in their pl ace of residence for a fee;
390	390	7. “Home health aide” means an individual who provides personal
391	391	care to clients in their temporar y or permanent place of r esidence
392	392	for a fee;

444	444	8. “Home care agency administr ator” means a person who
445	445	operates, manages, or supervi ses, or is in charge of a home care
446	446	agency;
447	447	9. “Personal care” means assistance with dressing, bathing,
448	448	ambulation, exercise or other personal needs;
449	449	10. “Skilled care” means home care services perfor med on a
450	450	regular basis by a trained Respiratory Therap ist/Technician or by a
451	451	person currently licensed by this state including but not limited to
452	452	a Licensed Practical Nurse, Regist ered Nurse, Physical Ther apist,
453	453	Occupational Therapist , Speech Therapist, or Social Worker;
454	454	11. “Standby assistance” means supervision of client directed
455	455	activities with verbal prompting and infrequent, incidental hands -on
456	456	intervention only; and
457	457	12. “Supportive home assistant ” means an individual employed b y
458	458	a home care agency w ho provides standby assistance to ambulatory
459	459	clients, in conjunction with other companionship or homemaker
460	460	services, in the temporary or permanent place of residence of the
461	461	client for a fee.
462	462	SECTION 4. This act shall become effective Novem ber 1, 2023.
