152 | 152 | | program agreements under 42 C.F.R., Part 460, Subpart C. The |
---|
153 | 153 | | Authority may enter into PACE program agreements with PACE |
---|
154 | 154 | | organizations and the Centers for Medicare and M edicaid Services. |
---|
155 | 155 | | 2. The Authority shall enforce applicable federal laws and |
---|
156 | 156 | | regulations governing PACE organizations including but not limited |
---|
157 | 157 | | to regulations of the Centers for Medicare and M edicaid Services |
---|
158 | 158 | | codified at 42 C.F.R. , Part 460. The Authority may enter into an |
---|
159 | 159 | | agreement with the State Department of Health to carry out any |
---|
160 | 160 | | duties or functions of the state administering agenc y under 42 |
---|
161 | 161 | | C.F.R., Part 460 or other applicable federal laws or regulations. |
---|
162 | 162 | | C. 1. The State Department of H ealth shall create and issue to |
---|
163 | 163 | | qualifying applicants a license for PACE organizations. Qualifying |
---|
164 | 164 | | PACE organizations shall at a minimum meet all requirements of 42 |

232 | 232 | | SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-872, is |

450 | 450 | | regular basis by a trained Respiratory Therap ist/Technician or by a |
---|
451 | 451 | | person currently licensed by this state including but not limited to |
---|
452 | 452 | | a Licensed Practical Nurse, Regist ered Nurse, Physical Ther apist, |
---|
453 | 453 | | Occupational Therapist , Speech Therapist, or Social Worker; |
---|
454 | 454 | | 11. “Standby assistance” means supervision of client directed |
---|
455 | 455 | | activities with verbal prompting and infrequent, incidental hands -on |
---|
456 | 456 | | intervention only; and |
---|
457 | 457 | | 12. “Supportive home assistant ” means an individual employed b y |
---|
458 | 458 | | a home care agency w ho provides standby assistance to ambulatory |
---|
459 | 459 | | clients, in conjunction with other companionship or homemaker |
---|
460 | 460 | | services, in the temporary or permanent place of residence of the |
---|
461 | 461 | | client for a fee. |
---|
462 | 462 | | SECTION 4. This act shall become effective Novem ber 1, 2023. |
