79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-851.1, is
81	81	amended to read as follows:
82	82	Section 1-851.1. For purposes of the Long -term Care Certificate
83	83	of Need Act:
84	84	1. “Board” means the State Board o f Health;
85	85	2. “Commissioner” means the State Commissioner of Health;
86	86	3. “Department” means the State Department of Health;
87	87	4. “Long-term care facility” means:
88	88	a. a nursing facility or a specialized facil ity, as such
89	89	terms are defined by Section 1 -1902 of this title,

142	142	an intermediate care facility for individuals with
143	143	intellectual disabilities,
144	144	b. skilled nursing care provided in a distinct part of a
145	145	hospital as such term is defined by Section 1 -701 of
146	146	this title,
147	147	c. the nursing care component of a continuum of care
148	148	facility, as such term is defined under the Continuum
149	149	of Care and Assisted Li ving Act, or
150	150	d. the nursing care component of a life care communi ty as
151	151	such term is defined by the Long-term Long-Term Care
152	152	Insurance Act;
153	153	5. “Disclosure statement” means a written statement by the
154	154	applicant which contains:
155	155	a. the full name, business address , and Social Security
156	156	number of the applicant, and all persons with
157	157	controlling interest as defined by the Long -term Care
158	158	Certificate of Need Act,
159	159	b. the full name and address of any legal entity in which
160	160	the applicant holds a debt or equity interest of at
161	161	least five percent (5%), or which is a parent company
162	162	or subsidiary of the applicant,
163	163	c. a description of the experience a nd credentials of the
164	164	applicant, including any past or present permits,

219	219	d. a listing and explanation of any administrative, civil
220	220	or criminal legal acti ons against the applicant or any
221	221	person with a controlling interest which resulted in a
222	222	final agency order or final judgment by a court of
223	223	record including, but not limited to, final orders or
224	224	judgments on appeal related to long -term care in the
225	225	five (5) years immediately preceding the fi ling of the
226	226	application. Such actions shall incl ude, without
227	227	limitation, any permit denial or any sanction imposed
228	228	by a state regulatory authority or the Centers for
229	229	Medicare and Medicaid Services, and
230	230	e. a listing of any federal long-term care agency and any
231	231	state long-term care agency outside this sta te that
232	232	has or has had regulatory responsibility over the
233	233	applicant;
234	234	6. “History of noncompliance ” means three standard or complaint
235	235	surveys found to be at the substandard q uality of care level when
236	236	the facility does not achieve compliance by date certain in a
237	237	nursing facility or specialized facility for persons with
238	238	Alzheimer’s disease or related disorders. Additionally, “history of
239	239	noncompliance” for an intermediate care o r specialized facility for

292	292	routine or complaint surveys that resulted in dete rminations that
293	293	the facility was out of compliance with two or mo re Conditions of
294	294	Participation in the Medicaid prog ram within the preceding thirty -
295	295	six (36) months when the facility does not achieve compliance within
296	296	sixty (60) days;
297	297	7. “Person” means any individual, corporation, industry, firm,
298	298	partnership, associatio n, venture, trust, institution, federal,
299	299	state or local governmental instrumentality , agency or body or any
300	300	other legal entity howeve r organized; and
301	301	8. “Person with a controlling interest ” means a person who
302	302	meets any one or more of the following require ments:
303	303	a. controls fifty percent (50%) or more of t he common
304	304	stock of the corporate entity involved or controls
305	305	fifty percent (50%) o r more of the interest in the
306	306	partnership involved,
307	307	b. controls a percentage of stock greater than any other
308	308	stockholder or equal to the other single largest
309	309	stockholder or controls a percentage of partnersh ip
310	310	interest greater than any other partner or equ al to
311	311	the other single largest partnership interest, or
312	312	c. a managing member of a Limited Liability Company
313	313	(LLC).
