38	39		An Act relating to school district elections;
39	40		amending 26 O.S. 2021, Sections 13A-103 and 13A-105,
40	41		which relate to election dates and declaration of
41	42		candidacy; modifying permissible dates for certain
42	43		elections; modifying dates for filing for certain
43	44		office; and providing an effective date .

48	49		BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
49	50		SECTION 1. AMENDATORY 26 O.S. 2021, Section 13A-103, is
50	51		amended to read as follows:
51	52		Section 13A-103. A. 1. The general election of mem bers of the
52	53		board of education of ever y school district and technology cente r
53	54		school district shall be conducted o n the first second Tuesday of
54	55		April November of each odd-numbered year, and on the first Tuesd ay
55	56		after the first Monday of November in each even-numbered year.
56	57		2. The primary election of members of the board of educat ion of
57	58		every school district and technology center school district, if
58	59		necessary, shall be conducted on the second Tues day in February
59	60		September of each odd-numbered year, except in any year when a
60	61		Presidential Prefere ntial Primary is held in February, the n the
61	62		election shall be held on the same day as the Presidential

88	90		Preferential Primary and on the fourth Tuesday of August in each

90	92		3. If only two candidates qua lify to have their names appear on
91	93		the ballot, the names of both c andidates shall appear on the ballot
92	94		at the board of education general election.
93	95		4. If more than two candidates qualify to have their names
94	96		appear on the ballot, the names of all such candi dates shall appear
95	97		on the ballot at the board of education primary election. A
96	98		candidate receiving more than fifty p ercent (50%) of the votes cast
97	99		in the board of education primary election shall be elected to the
98	100		office. If no candidate receives more th an fifty percent (50%) of
99	101		the votes cast in the board of education primary election, then the
100	102		two candidates with the highest number of votes shall appear on the
101	103		ballot at the board of education general elect ion.
102	104		B. Elections on the question of making a l evy or levies for
103	105		schools under Sectio n 9, Section 9B or Section 1 0 of Article X of
104	106		the Oklahoma Constitution shall b e held on the second Tuesday in
105	107		February of each year, except in any year when a Presidenti al
106	108		Preferential Primary is held in February, the n the election shall be
107	109		held on the same day as the Presidential P referential Primary.
108	110		C. The board of education of every school district or
109	111		technology center school district may call a special election for
110	112		the purpose of voting on any matter or question authorized by law.

137	140		SECTION 2. AMENDATORY 26 O.S. 2021, Section 13A-105, is
138	141		amended to read as follows:
139	142		Section 13A-105. Candidates for member of the board of
140	143		education of every scho ol district or technology center school
141	144		district shall file declarations of candida cy in the same place and
142	145		with the same officials as candidates for coun ty office. The
143	146		declaration of candidacy t o be signed by the candidate shall have an
144	147		attachment to be signed by the candidate listing the requirements of
145	148		a candidate for election or ree lection to a school board as set
146	149		forth in Sections 13A-106 and 5-105a of this title and Sec tions 5-
147	150		110, 5-110.1, and 5-113 of Title 70 of the Oklahoma Statutes, and
148	151		the candidate shall swear or affirm that he or she is eligible to
149	152		run for the office or serve in the office if elected. Candidates
150	153		shall file no earlier than 8:00 a.m. on the first Monday second
151	154		Wednesday in December April through no later than 5:00 p.m. on the
152	155		following Wednesday next succeeding Friday. For school districts
153	156		and technology center school districts loc ated in more than one
154	157		county, filing may be either in the county wherein supervision of
155	158		the district is located or in the county where t he candidate
156	159		resides.
157	160		SECTION 3. This act shall become effective November 1, 2023.
