6565 An Act relating to state Medicaid program; requiring

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 5026.2 of Title 63, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. The Oklahoma Health Care Authority shall, to the extent
8484 permissible under federal law and subject to the federal approval
8585 described in subsection D of this section, provide Medicaid coverage
8686 for medically necessary donor human milk-derived products in an
8787 inpatient or outpatient setting for an infant whose gestationally
8888 corrected age is under twelve (12) months ; provided:

140140 1. A physician, physician assistant, or Advanced Practice
141141 Registered Nurse licensed in this state signs an order stating th at
142142 donor human milk-derived products are medically necessary for the
143143 infant Medicaid beneficiary due to any of the following:
144144 a. the infant has a birth weight of less than one
145145 thousand five hundred (1,500) grams or an infant body
146146 weight below healthy levels, as determined by the
147147 ordering provider,
148148 b. the infant’s gestational age at birth was thirty -four
149149 (34) weeks or less, or
150150 c. the infant has any con genital or acquired condition
151151 for which the ordering pro vider determines that the
152152 use of donor human milk-derived products is medically
153153 necessary and will support the treatment and recovery
154154 of the infant; and
155155 2. The donor human milk-derived products adhere to such quality
156156 standards as may be required by the Oklahoma Health Care Authority
157157 Board.
158158 B. Reimbursement under subsection A of this section for donor
159159 human milk-derived products for an infant in an inpatient setting
160160 shall be provided separately from the existing hos pital payment for
161161 inpatient services.
162162 C. The Board shall promulgate rules to implement the provisions
163163 of this section, and may adopt a policy or procedure to implement

215215 the provisions of this sec tion while in the process of promulgating
216216 rules; provided, such policy or procedure shall be posted on the
217217 Internet website of the Authority prior to adoption of the policy.
218218 D. The Authority shall seek any federal approval necessary to
219219 implement this section.
220220 SECTION 2. This act shall become effect ive July 1, 2023.
221221 SECTION 3. It being immediately necessary for the preservation
222222 of the public peace, health or safety, an emergency is hereby
223223 declared to exist, by reason whereof this act shall take effect and
224224 be in full force from and af ter its passage and approval.
