79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Section 5026.2 of Title 63, unless there
82	82	is created a duplication in numbering, reads as follows:
83	83	A. The Oklahoma Health Care Authority shall, to the extent
84	84	permissible under federal law and subject to the federal approval
85	85	described in subsection D of this section, provide Medicaid coverage
86	86	for medically necessary donor human milk-derived products in an
87	87	inpatient or outpatient setting for an infant whose gestationally
88	88	corrected age is under twelve (12) months ; provided:

140	140	1. A physician, physician assistant, or Advanced Practice
141	141	Registered Nurse licensed in this state signs an order stating th at
142	142	donor human milk-derived products are medically necessary for the
143	143	infant Medicaid beneficiary due to any of the following:
144	144	a. the infant has a birth weight of less than one
145	145	thousand five hundred (1,500) grams or an infant body
146	146	weight below healthy levels, as determined by the
147	147	ordering provider,
148	148	b. the infant’s gestational age at birth was thirty -four
149	149	(34) weeks or less, or
150	150	c. the infant has any con genital or acquired condition
151	151	for which the ordering pro vider determines that the
152	152	use of donor human milk-derived products is medically
153	153	necessary and will support the treatment and recovery
154	154	of the infant; and
155	155	2. The donor human milk-derived products adhere to such quality
156	156	standards as may be required by the Oklahoma Health Care Authority
157	157	Board.
158	158	B. Reimbursement under subsection A of this section for donor
159	159	human milk-derived products for an infant in an inpatient setting
160	160	shall be provided separately from the existing hos pital payment for
161	161	inpatient services.
162	162	C. The Board shall promulgate rules to implement the provisions
163	163	of this section, and may adopt a policy or procedure to implement

215	215	the provisions of this sec tion while in the process of promulgating
216	216	rules; provided, such policy or procedure shall be posted on the
217	217	Internet website of the Authority prior to adoption of the policy.
218	218	D. The Authority shall seek any federal approval necessary to
219	219	implement this section.
220	220	SECTION 2. This act shall become effect ive July 1, 2023.
221	221	SECTION 3. It being immediately necessary for the preservation
222	222	of the public peace, health or safety, an emergency is hereby
223	223	declared to exist, by reason whereof this act shall take effect and
224	224	be in full force from and af ter its passage and approval.
