64	64	amending Section 5, Chapter 288, O.S.L. 202 2 (59 O.S.

66	66	exemptions from the Oklahoma Durable Medical
67	67	Equipment Licensing Act; adding exemption; and

73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY Section 5, Chapter 28 8, O.S.L.
75	75	2022 (59 O.S. Supp. 2022, Section 375.5), is amended to read as
76	76	follows:
77	77	Section 375.5. The Oklahoma Durable Medical Equipment Licensing
78	78	Act shall not apply to:
79	79	1. Pharmacies and pharmacists;
80	80	2. Hospitals;
81	81	3. Ambulatory surgical centers;
82	82	4. Health care facilities owned or operated by the state or
83	83	federal government;
84	84	5. Skilled nursing facilities;
85	85	6. Assisted living facilities;
86	86	7. Prosthetic or orthotic practitioners;

138	138	8. Health care practitioners who are licensed to practice
139	139	health care in this state and who provide durable medical equipment
140	140	within the scope of their health care practice;
141	141	9. Manufacturers or wholesale distributors that do not sell or
142	142	rent durable medical equipment directly to consumers;
143	143	10. Manufacturers or wholesale distributors that sell or rent
144	144	durable medical equipment directly to consumers if :
145	145	a. the durable medical equipment is limited to
146	146	prescription-required specialty devices that are
147	147	delivered directly to the patient’s home, and
148	148	b. the initial order for the prescr ibed product is
149	149	delivered by an Oklahoma licensed practitioner
150	150	directly to the patient ’s home for setup and training ;
151	151	11. Suppliers of insulin infusion pumps and related supplies or
152	152	services; or
153	153	11. 12. Suppliers of medical devices approved by the U.S. Food
154	154	and Drug Administration that are used in the treatment of cancerous
155	155	tumors.
156	156	SECTION 2. It being immediately necessary for the pr eservation
157	157	of the public peace, health or safety, an eme rgency is hereby
158	158	declared to exist, by reason where of this act shall take effect and
159	159	be in full force from and after its passage and approval.
