6565 Supp. 2022, Section 375.5) , which relates to

6767 Equipment Licensing Act; adding exemption; and

7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY Section 5, Chapter 28 8, O.S.L.
7575 2022 (59 O.S. Supp. 2022, Section 375.5), is amended to read as
7676 follows:
7777 Section 375.5. The Oklahoma Durable Medical Equipment Licensing
7878 Act shall not apply to:
7979 1. Pharmacies and pharmacists;
8080 2. Hospitals;
8181 3. Ambulatory surgical centers;
8282 4. Health care facilities owned or operated by the state or
8383 federal government;
8484 5. Skilled nursing facilities;
8585 6. Assisted living facilities;
8686 7. Prosthetic or orthotic practitioners;

138138 8. Health care practitioners who are licensed to practice
139139 health care in this state and who provide durable medical equipment
140140 within the scope of their health care practice;
141141 9. Manufacturers or wholesale distributors that do not sell or
142142 rent durable medical equipment directly to consumers;
143143 10. Manufacturers or wholesale distributors that sell or rent
144144 durable medical equipment directly to consumers if :
145145 a. the durable medical equipment is limited to
146146 prescription-required specialty devices that are
147147 delivered directly to the patient’s home, and
148148 b. the initial order for the prescr ibed product is
149149 delivered by an Oklahoma licensed practitioner
150150 directly to the patient ’s home for setup and training ;
151151 11. Suppliers of insulin infusion pumps and related supplies or
152152 services; or
153153 11. 12. Suppliers of medical devices approved by the U.S. Food
154154 and Drug Administration that are used in the treatment of cancerous
155155 tumors.
156156 SECTION 2. It being immediately necessary for the pr eservation
157157 of the public peace, health or safety, an eme rgency is hereby
158158 declared to exist, by reason where of this act shall take effect and
159159 be in full force from and after its passage and approval.
