3263 SECTION 1. AMENDATORY Section 1, Chapter 323, O. S.L.
3364 2022 (70 O.S. Supp. 2022, Section 1-125), is amended to read as

3893 1. "Sex" means the physical condition of being male or female
3994 based on genetics an d physiology, as identified on the individual ’s
4095 original birth certificate; and

4397 in a public school or public charter sch ool building designed or
4498 designated to be used by more than one individual at a time, where
4599 individuals may be in various stages of undress in the presence of

47101 school restroom, locker room, ch anging room, or shower room ;

51102 3. "Coach" means a pe rson employed by a public school district
52103 or public charter school who is involved in the te aching or training
53104 of students participating in a school -sponsored athletic activity;

56106 4. "School-sponsored athletic activity" means a sporting event
57107 that is supported and affiliated with the school such as games,
58108 matches, and tournaments.

60109 B. To ensure privacy and safety, each public school and public
61110 charter school that serves students in prekindergarten through
62111 twelfth grades in this state shall requir e every multiple occupancy
63112 restroom or changing area desig nated as follows:

65113 1. For the exclusive use of the male sex; or

67114 2. For the exclusive use of the female sex.

69115 C. Each public school or public charter school in this state
70116 shall provide a reasonable accommodation to any individual who does

71143 not wish to comply with the provisions of subsection B of this
72144 section. A reasonable accommodati on shall be access to a single-
73145 occupancy restroom or changing room.

75146 D. The provisions of this section shall not apply to
76147 individuals entering a multiple occupancy restroom or changing area
77148 designated for use by the opposite sex when entering in any of the
78149 following circumstance circumstances:

80150 1. For custodial, maintenance, or inspection purposes; or

82151 2. To render emergency medical assistance; or

84152 3. If a suitable meeting room or area is not available, a coach
85153 may enter a locker room before , during, or after a school-sponsored
86154 athletic activity, provided:

88155 a. all students present are fully clothed,

90156 b. the coach shall be accompani ed by at least one
91157 additional adult at all times, and

102163 charter school governing board shall adopt a policy to provide
103164 disciplinary action fo r individuals who refuse to comply with the
104165 provisions of this section.

106192 2. No school district board of education or charter school
107193 governing board shall adopt a policy contrary to t he provisions of
108194 this section.

110195 F. Upon a finding of noncompliance with the provisions of
111196 subsections B, and C, and D of this section by the State Board of
112197 Education, the noncompliant school district or public charter school
113198 shall receive a five percent (5%) decr ease in state funding for t he
114199 school district or public charter school for the fiscal year
115200 following the year of noncompliance .

117201 G. A parent or legal gua rdian of a student enrolled in and
118202 physically attending a public school district or public charter
119203 school shall have a cause of ac tion against the public school
120204 district or public charter school for noncompliance with the
121205 provisions of subsections B, and C, and D of this section.

123206 H. The State Board of Education shall promulgate rules to
124207 implement the provisions of this section.
208+SECTION 2. This act shall becom e effective July 1, 2023.

210+of the public peace, health , or safety, an emergency is hereby
211+declared to exist, by rea son whereof this act shall take effect and
