79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 63 O.S. 2021, Section 683.4, is
81	81	amended to read as follows:
82	82	Section 683.4. A. There is hereby created the Oklahoma
83	83	Department of Emergency Management (OEM). The Governor shall
84	84	appoint a Director of the Department, with the advice and conse nt of
85	85	the Senate, who shall be the head of the Department . The Governor
86	86	shall fix the salary of the Director, in cooperation with standards
87	87	promulgated by the Office of Management and Enterprise Services.
88	88	B. The Director may employ personnel and fix thei r compensation
89	89	in cooperation with standards promulgated by the Office of

142	142	within the appropriation therefor, or from such other available
143	143	funds as may be necessary to carry out the purposes of the Oklahoma
144	144	Emergency Management Act of 2003 and oth er programs specified by
145	145	law.
146	146	C. The Director and other personnel of the Department shall be
147	147	provided with appropriate office space, furniture, equipment,
148	148	supplies, stationery, and printing in the s ame manner as provided
149	149	for personnel of other state agenc ies.
150	150	D. The Director, subject to the direction and control of the
151	151	Governor, shall be the executive head of the Department and shall
152	152	serve as the chief advisor to the Governor on emergency management
153	153	and shall:
154	154	1. Be responsible to the Governor for carryi ng out the programs
155	155	as required by law;
156	156	2. Coordinate the activities of all organizations for emergency
157	157	management within the state;
158	158	3. Maintain liaison with and cooperate with the emergency
159	159	management agencies and organizations of other states and of th e
160	160	federal government;
161	161	4. Develop and maintain a comprehensive all -hazards mitigation
162	162	plan for this state;
163	163	5. Implement the Oklahoma Hazard Mitigation Program State
164	164	Comprehensive All-hazard Mitigation Plan;

216	216	6. Have such additional authority, duties, and responsibilities
217	217	authorized by the Oklahoma Emergency Man agement Act of 2003 and as
218	218	may be prescribed by the Governor;
219	219	7. Supervise the Office of Volunteerism Support and advocate
220	220	volunteerism in accordance with Section 683.26 of this title; and
221	221	8. Report quarterly to the Go vernor, the Speaker of the H ouse
222	222	of Representatives and the President Pro Tempore of the Senate the
223	223	balance and outstanding obligations of the The State Emergency Fund.
224	224	E. The Director shall supervise the formulation, execution,
225	225	review and revisions of th e state Emergency Operations Pla n as
226	226	provided for by Section 683.2 of this title. The plan shall be
227	227	reviewed annually and revised as necessary.
228	228	SECTION 2. AMENDATORY 63 O.S. 2021, Section 683.9, is
229	229	amended to read as follows:
230	230	Section 683.9. The provisions of this section shall be
231	231	operative only during the existence of a natural or man -made
232	232	emergency. The existence of such emergency may be proclaimed by the
233	233	Governor or by concurrent resolution of the Legislat ure if the
234	234	Governor in such proclamation, or the Le gislature in such
235	235	resolution, finds that an emergency or disaster has occurred or is
236	236	anticipated in the immediate future. Any such emergency , whether
237	237	proclaimed by the Governor or by the Legislature, shall terminate
238	238	upon the proclamation of the terminatio n thereof by the Governor , or
239	239	by automatically after thirty (30) days unless renewed by concurrent

291	291	resolution of the Legislature, whichever occurs first. Any such
292	292	emergency proclaimed by the Legislature s hall terminate upon passage
293	293	by the Legislature of a concurrent resolution terminating such
294	294	emergency. During such period as such state of emergency e xists or
295	295	continues, the Governor shall have and may exe rcise the following
296	296	additional emergency powers:
297	297	1. To activate the Emergency Operations Plan, and to assume
298	298	regulatory control over all essentia l resources of this state,
299	299	directly or through the boar ds, agencies, offices and officers
300	300	established by the Emergency Operations Plan, to determine
301	301	priorities of such resources and allocate such resources as the
302	302	Governor may deem necessary in cooperation with the political
303	303	subdivisions of this state, the fede ral government, or other states.
304	304	“Resources” shall mean all economic resources within this state
305	305	including but not limited to food, manpower, health , water,
306	306	transportation, economic stabilization, ele ctric power, petroleum,
307	307	gas, and solid fuel, industrial production, construction and
308	308	housing.;
309	309	2. To enforce all laws, rules and regulations relating to
310	310	emergency management and to assume direct operational contr ol of any
311	311	or all emergency management force s and helpers in this state .;
312	312	3. To provide for the evac uation of all or part of the
313	313	population from any stri cken or threatened area or areas within this

366	366	care of such evacuees .;
367	367	4. Subject to the provisions of the State Constitution, to
368	368	remove from office any public officer having administrative
369	369	responsibilities under this act the Oklahoma Emergen cy Management
370	370	Act of 2003 for willful failure to obey any order, rul e or
371	371	regulation adopted pursuant to this act Section 683.1 et seq. of
372	372	this title. Such removal shall be upon charges after service upon
373	373	such person of a copy of such charges and after giv ing such person
374	374	an opportunity to be heard in the defense of such pe rson. Pending
375	375	the preparation and disposition of charges, the Gover nor may suspend
376	376	such person for a period not exceeding thirty (30) da ys. A vacancy
377	377	resulting from removal or suspension pursuant to this sec tion shall
378	378	be filled by the Governor until it i s filled as otherwise provided
379	379	by law.; and
380	380	5. To perform and exercise s uch other functions, powers, and
381	381	duties as are necessary to prom ote and secure the safety and
382	382	protection of the civilian population and to carry out the
383	383	provisions of the Emergency Op erations Plan in a national or state
384	384	emergency.
385	385	SECTION 3. This act shall become effective N ovember 1, 2023.
