7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 63 O.S. 2021, Section 683.4, is
8181 amended to read as follows:
8282 Section 683.4. A. There is hereby created the Oklahoma
8383 Department of Emergency Management (OEM). The Governor shall
8484 appoint a Director of the Department, with the advice and conse nt of
8585 the Senate, who shall be the head of the Department . The Governor
8686 shall fix the salary of the Director, in cooperation with standards
8787 promulgated by the Office of Management and Enterprise Services.
8888 B. The Director may employ personnel and fix thei r compensation

141141 Management and Enterprise Services, and may make such expenditures
142142 within the appropriation therefor, or from such other available
143143 funds as may be necessary to carry out the purposes of the Oklahoma
144144 Emergency Management Act of 2003 and oth er programs specified by
145145 law.
146146 C. The Director and other personnel of the Department shall be
147147 provided with appropriate office space, furniture, equipment,
148148 supplies, stationery, and printing in the s ame manner as provided
149149 for personnel of other state agenc ies.
150150 D. The Director, subject to the direction and control of the
151151 Governor, shall be the executive head of the Department and shall
152152 serve as the chief advisor to the Governor on emergency management
153153 and shall:
154154 1. Be responsible to the Governor for carryi ng out the programs
155155 as required by law;
156156 2. Coordinate the activities of all organizations for emergency
157157 management within the state;
158158 3. Maintain liaison with and cooperate with the emergency
159159 management agencies and organizations of other states and of th e
160160 federal government;
161161 4. Develop and maintain a comprehensive all -hazards mitigation
162162 plan for this state;
163163 5. Implement the Oklahoma Hazard Mitigation Program State
164164 Comprehensive All-hazard Mitigation Plan;

216216 6. Have such additional authority, duties, and responsibilities
217217 authorized by the Oklahoma Emergency Man agement Act of 2003 and as
218218 may be prescribed by the Governor;
219219 7. Supervise the Office of Volunteerism Support and advocate
220220 volunteerism in accordance with Section 683.26 of this title; and
221221 8. Report quarterly to the Go vernor, the Speaker of the H ouse
222222 of Representatives and the President Pro Tempore of the Senate the
223223 balance and outstanding obligations of the The State Emergency Fund.
224224 E. The Director shall supervise the formulation, execution,
225225 review and revisions of th e state Emergency Operations Pla n as
226226 provided for by Section 683.2 of this title. The plan shall be
227227 reviewed annually and revised as necessary.
228228 SECTION 2. AMENDATORY 63 O.S. 2021, Section 683.9, is
229229 amended to read as follows:
230230 Section 683.9. The provisions of this section shall be
231231 operative only during the existence of a natural or man -made
232232 emergency. The existence of such emergency may be proclaimed by the
233233 Governor or by concurrent resolution of the Legislat ure if the
234234 Governor in such proclamation, or the Le gislature in such
235235 resolution, finds that an emergency or disaster has occurred or is
236236 anticipated in the immediate future. Any such emergency , whether
237237 proclaimed by the Governor or by the Legislature, shall terminate
238238 upon the proclamation of the terminatio n thereof by the Governor , or
239239 by automatically after thirty (30) days unless renewed by concurrent

291291 resolution of the Legislature, whichever occurs first. Any such
292292 emergency proclaimed by the Legislature s hall terminate upon passage
293293 by the Legislature of a concurrent resolution terminating such
294294 emergency. During such period as such state of emergency e xists or
295295 continues, the Governor shall have and may exe rcise the following
296296 additional emergency powers:
297297 1. To activate the Emergency Operations Plan, and to assume
298298 regulatory control over all essentia l resources of this state,
299299 directly or through the boar ds, agencies, offices and officers
300300 established by the Emergency Operations Plan, to determine
301301 priorities of such resources and allocate such resources as the
302302 Governor may deem necessary in cooperation with the political
303303 subdivisions of this state, the fede ral government, or other states.
304304 “Resources” shall mean all economic resources within this state
305305 including but not limited to food, manpower, health , water,
306306 transportation, economic stabilization, ele ctric power, petroleum,
307307 gas, and solid fuel, industrial production, construction and
308308 housing.;
309309 2. To enforce all laws, rules and regulations relating to
310310 emergency management and to assume direct operational contr ol of any
311311 or all emergency management force s and helpers in this state .;
312312 3. To provide for the evac uation of all or part of the
313313 population from any stri cken or threatened area or areas within this

365365 state and to take such step s as are necessary for the recei pt and
366366 care of such evacuees .;
367367 4. Subject to the provisions of the State Constitution, to
368368 remove from office any public officer having administrative
369369 responsibilities under this act the Oklahoma Emergen cy Management
370370 Act of 2003 for willful failure to obey any order, rul e or
371371 regulation adopted pursuant to this act Section 683.1 et seq. of
372372 this title. Such removal shall be upon charges after service upon
373373 such person of a copy of such charges and after giv ing such person
374374 an opportunity to be heard in the defense of such pe rson. Pending
375375 the preparation and disposition of charges, the Gover nor may suspend
376376 such person for a period not exceeding thirty (30) da ys. A vacancy
377377 resulting from removal or suspension pursuant to this sec tion shall
378378 be filled by the Governor until it i s filled as otherwise provided
379379 by law.; and
380380 5. To perform and exercise s uch other functions, powers, and
381381 duties as are necessary to prom ote and secure the safety and
382382 protection of the civilian population and to carry out the
383383 provisions of the Emergency Op erations Plan in a national or state
384384 emergency.
385385 SECTION 3. This act shall become effective N ovember 1, 2023.
