6565 An Act relating to employment discrimination;
6666 amending 25 O.S. 2021, Sections 1101 and 1302, which
6767 relate to exclusive remedy and discrimin atory
6868 practices; extending exclusive remedies to employment

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 25 O.S. 20 21, Section 1101, is
7979 amended to read as follow s:
8080 Section 1101. A. This act Section 1101 et seq. of this title
8181 provides for exclusive remedies within the state of the policies for
8282 individuals alleging d iscrimination in employment on the basis of
8383 race, color, national origin, sex, religion, creed, age, disability ,
8484 or genetic information, vaccination status, or immunization status.
8585 B. This act Section 1101 et seq. of this title shall be
8686 construed according to the fa ir import of its terms to further the
8787 general purposes stat ed in this section and the special purposes of
8888 the particular provi sion involved.

140140 SECTION 2. AMENDATORY 25 O.S. 2021, Section 1302, is
141141 amended to read as follows:
142142 Section 1302. A. It is a discriminatory practice for an
143143 employer:
144144 1. To fail or refuse to hire, to discharge, or otherwise to
145145 discriminate against an individual wi th respect to compensation or
146146 the terms, conditions, privileges or responsibilities of employment,
147147 because of race, color, religion, sex, national origin, ag e, genetic
148148 information, vaccination status, immun ization status, or disability,
149149 unless the employer can demonstrate that accommodation for the
150150 disability would impose an undue hardship on the oper ation of the
151151 business of such employer ; or
152152 2. To limit, segregate, or classify an employee or applicant
153153 for employment in a way which would deprive or tend to deprive an
154154 individual of employment opportunities or otherwise adversely affect
155155 the status of an employee, because of race, color, religion, sex,
156156 national origin, age, genetic information, vaccination status,
157157 immunization status, or disability, unless the employer can
158158 demonstrate that accommodation for the disability would impose an
159159 undue hardship on the operation of the business of such emp loyer.
160160 B. This section does not apply to the employment of an
161161 individual by his or her parents, spouse, or child or to employment
162162 in the domestic service of the employer.

214214 SECTION 3. It being immediately necessary for the pr eservation
