6565 An Act relating to the Oklahoma National Guard;

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new sec tion of law to be codified
7979 in the Oklahoma Statutes as Section 72.1 of Title 44, unless there
8080 is created a duplication in numb ering, reads as follows:
8181 A. This section shall be known a nd may be cited as the “Defend
8282 the Guard Act”.
8383 B. For the purposes of t his section:
8484 1. “Active duty combat” means performing the following services
8585 in the active federal military service of the United S tates:
8686 a. participation in an armed conflict ,
8787 b. performance of a hazardous service in a foreign state ,

140140 c. performance of a duty through an instrumentality of
141141 war; and
142142 2. “Official declaration of war” means an official declaration
143143 of war made by the United States Congress pursuant to Article I,
144144 Section 8, Clause 11 of the United States C onstitution.
145145 C. Notwithstanding any other provision of The Oklahoma Military
146146 Code, the Oklahoma National Guard and any member thereof shall not
147147 be released from the state into a ctive duty combat unless the United
148148 States Congress has passed an official declaration of war or has
149149 taken an official action pursua nt to Article I, Section 8, Clause 15
150150 of the United States Constitution to explicitly call forth the
151151 Oklahoma National Guard and any member thereof for the enumerated
152152 purposes to expressly execute the laws of the Union, repel an
153153 invasion, or suppress an insurrection. The Governor shall take all
154154 actions necessary to comply with the req uirements of this section.
155155 D. Nothing in this act shall limit or prohibit the Governor
156156 from consenting to the deployment of any Ok lahoma National Guard
157157 member on Title 32, United States Code, defense support for civil
158158 authority missions within the United States or United States
159159 territories.
160160 SECTION 2. This act shall become effective November 1, 2023.
