65	65	An Act relating to the Oklahoma National Guard;
66	66	creating the Defend the Guard Act ; defining terms;
67	67	requiring an official declaration of war or an action
68	68	to call forth the state militia by the United Sta tes
69	69	Congress before members of the Oklahoma National
70	70	Guard may be released from state control t o
71	71	participate in active duty combat; allowing for
72	72	consent of certain missions; providing for
73	73	codification; and providing an effective date.

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new sec tion of law to be codified
79	79	in the Oklahoma Statutes as Section 72.1 of Title 44, unless there
80	80	is created a duplication in numb ering, reads as follows:
81	81	A. This section shall be known a nd may be cited as the “Defend
82	82	the Guard Act”.
83	83	B. For the purposes of t his section:
84	84	1. “Active duty combat” means performing the following services
85	85	in the active federal military service of the United S tates:
86	86	a. participation in an armed conflict ,
87	87	b. performance of a hazardous service in a foreign state ,

140	140	c. performance of a duty through an instrumentality of
141	141	war; and
142	142	2. “Official declaration of war” means an official declaration
143	143	of war made by the United States Congress pursuant to Article I,
144	144	Section 8, Clause 11 of the United States C onstitution.
145	145	C. Notwithstanding any other provision of The Oklahoma Military
146	146	Code, the Oklahoma National Guard and any member thereof shall not
147	147	be released from the state into a ctive duty combat unless the United
148	148	States Congress has passed an official declaration of war or has
149	149	taken an official action pursua nt to Article I, Section 8, Clause 15
150	150	of the United States Constitution to explicitly call forth the
151	151	Oklahoma National Guard and any member thereof for the enumerated
152	152	purposes to expressly execute the laws of the Union, repel an
153	153	invasion, or suppress an insurrection. The Governor shall take all
154	154	actions necessary to comply with the req uirements of this section.
155	155	D. Nothing in this act shall limit or prohibit the Governor
156	156	from consenting to the deployment of any Ok lahoma National Guard
157	157	member on Title 32, United States Code, defense support for civil
158	158	authority missions within the United States or United States
159	159	territories.
160	160	SECTION 2. This act shall become effective November 1, 2023.
