5152 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5253 SECTION 1. AMENDATORY 74 O.S. 2021, Section 2212, is
5354 amended to read as follows:
5455 Section 2212. A. The Oklahoma Tourism and Recreation
5556 Commission shall have the authority to exercis e the following
5657 powers, rights and privileges rela ted to state parks:
5758 1. Have the exclusive possession and control of, and t o operate
5859 and maintain for the benefit of the people of the State of Oklahoma
5960 this state, all state parks and all lands and other properties no w
6061 or hereafter owned or leased by the state or Commission for park or
6162 recreational purposes;
62-2. Acquire Except as provided in subsection B of this se ction,

89+2. Acquire Except as provided in subsection B of this se ction,
90+acquire by purchase, exchange, lease, gift, condemnation, or in any
9191 other manner and to maintain, u se and operate any and all property,
9292 real, personal or mixed, necessary or convenient to the exercise of
9393 the powers, rights, privileges and functions conferred upon it by
9494 the Oklahoma Tourism, Parks and Recrea tion Enhancement Act . Title
9595 to all such property shall be vested in the State of Oklahoma this
9696 state, although such property is sometimes herein referred to as
9797 property “of the Commission”. The power of condemnation herein
9898 granted shall be exercised in the manner p rovided by the general
9999 laws of the state for th e condemnation of property by the state;
100100 3. Subject to the provisions of the Oklahoma Tourism, Parks and
101101 Recreation Enhancement Act, from time to time lease, without
102102 restriction as to term, any property which the Commission shall
103103 determine to be necessary or convenient to more full y carry into
104104 effect the duties and powers of said the Commission; and
105105 4. Acquire, conserve, prot ect, construct, extend, reduce ,
106106 improve, maintain and operate any and all facilities of a ll kinds
107107 which in the judgment of the Commissio n will provide recreational or
108108 other facilities for the benefit of the public, or which are
109109 necessary or convenient to t he exercise of the powers of t he
110110 Commission.
111111 B. In the event the Commission elects to terminate or cancel or
112112 elects not to renew a lease for real property upon which a state
113-park is located or takes action resulting in the loss or chan ge of
114-ownership of a state park, which causes the removal of the

142141 property’s status as a state park, the termination, nonrenewal , or
143142 action shall not occur without the approval of the Legislature.
144143 SECTION 2. This act shall become effective November 1, 2023.
