41	42		An Act relating to state parks; amending 74 O.S.
42	43		2021, Section 2212, which relates to powers, rights,
43	44		and privileges of Oklahoma Tourism and Recreation
44	45		Commission; providing for legislative approval for
45	46		certain property decision; updating statutory
46	47		language; and providing an effective date .

51	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	53		SECTION 1. AMENDATORY 74 O.S. 2021, Section 2212, is
53	54		amended to read as follows:
54	55		Section 2212. A. The Oklahoma Tourism and Recreation
55	56		Commission shall have the authority to exercis e the following
56	57		powers, rights and privileges rela ted to state parks:
57	58		1. Have the exclusive possession and control of, and t o operate
58	59		and maintain for the benefit of the people of the State of Oklahoma
59	60		this state, all state parks and all lands and other properties no w
60	61		or hereafter owned or leased by the state or Commission for park or
61	62		recreational purposes;
62		-	2. Acquire Except as provided in subsection B of this se ction,
63		-	acquire by purchase, exchange, lease, gift, condemnation, or in any

	89	+	2. Acquire Except as provided in subsection B of this se ction,
	90	+	acquire by purchase, exchange, lease, gift, condemnation, or in any
91	91		other manner and to maintain, u se and operate any and all property,
92	92		real, personal or mixed, necessary or convenient to the exercise of
93	93		the powers, rights, privileges and functions conferred upon it by
94	94		the Oklahoma Tourism, Parks and Recrea tion Enhancement Act . Title
95	95		to all such property shall be vested in the State of Oklahoma this
96	96		state, although such property is sometimes herein referred to as
97	97		property “of the Commission”. The power of condemnation herein
98	98		granted shall be exercised in the manner p rovided by the general
99	99		laws of the state for th e condemnation of property by the state;
100	100		3. Subject to the provisions of the Oklahoma Tourism, Parks and
101	101		Recreation Enhancement Act, from time to time lease, without
102	102		restriction as to term, any property which the Commission shall
103	103		determine to be necessary or convenient to more full y carry into
104	104		effect the duties and powers of said the Commission; and
105	105		4. Acquire, conserve, prot ect, construct, extend, reduce ,
106	106		improve, maintain and operate any and all facilities of a ll kinds
107	107		which in the judgment of the Commissio n will provide recreational or
108	108		other facilities for the benefit of the public, or which are
109	109		necessary or convenient to t he exercise of the powers of t he
110	110		Commission.
111	111		B. In the event the Commission elects to terminate or cancel or
112	112		elects not to renew a lease for real property upon which a state
113		-	park is located or takes action resulting in the loss or chan ge of
114		-	ownership of a state park, which causes the removal of the

142	141		property’s status as a state park, the termination, nonrenewal , or
143	142		action shall not occur without the approval of the Legislature.
144	143		SECTION 2. This act shall become effective November 1, 2023.
