2855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3056 SECTION 1. AMENDATORY 62 O.S. 2 021, Section 908, is
3157 amended to read as follows:

3358 Section 908. A. There is hereby established the Oklahoma State
3459 Government Asset Reduction and Cost Savings Program.

3660 B. No later than December 31 each year, the Di rector of the
3761 Office of Management and Enterprise Services shall publish a
3862 comprehensive report detailing state -owned properties.

4063 C. The report mandated in accordance with the provisions of
4164 this section shall list the five percent (5%) most underutilized
4265 state-owned properties. T he report shall describe the value of

4494 the potential for purchase should the properties be offered for
4595 sale, and describe the impact on local-level tax rolls in t he event
4696 the properties are purchased by a nongovernmental entity.

5097 D. The Director of the Office of Management and Enterprise
5198 Services shall promulgate rules establishing procedures by which
5299 each state agency, board, commission, and public trust having th e
53100 State of Oklahoma state as a beneficiary, excluding those otherwise
54101 exempted under Section 327 of Title 61 of the Oklahoma Statutes,
55102 shall submit the necessary data to the Office of Management and
56103 Enterprise Services for the development of this report.

58104 E. State agencies, boards, commiss ions, and public trusts
59105 having the State of Oklahoma state as a beneficiary shall comply
60106 with procedures promulgated pursuant to the terms of this section.

62107 F. The report and d ata collected pursuant to this section shall
63108 be published as a data feed on the data.ok.gov website.

65109 G. In addition to the requirements of subsection C of this
66110 section, the Office of Management and Enterprise Services may make
67111 recommendations for the sale of other state-owned properties based
68112 upon the value of the property and the potential for net gain for
69113 the state based upon the data obtained for the Oklahoma State
70114 Government Asset Reduction and Cost Savings Program.

72115 H. There is hereby created the Main tenance of State Buildings
73116 Revolving Fund. The fund shall be a continuing fund, not su bject to

74144 fiscal year limitations, and shall serve as the depository for
75145 proceeds from the sale of state -owned properties pursuant to the
76146 Oklahoma State Government Asset Reduction and Cost Savings Program.
77147 The fund shall further consist of monies appropriat ed thereto and
78148 other funds designated for deposit therein. All monies accruing to
79149 the credit of the fund are hereby appropriated and may be expended
80150 exclusively for maintaining and repairing state-owned properties and
81151 buildings pursuant to the procedures set forth in Section 901.1 of
82152 Title 62 of the Oklahoma Statutes and for acquisition of information
83153 technology tools or resources that state agencies, boards,
84154 commissions, and public trusts having the State of Oklahoma state as
85155 a beneficiary shall use in ca rrying out their obligations in
86156 accordance with this act. The total expenditure for information
87157 technology resources shall not exceed One Hundred Thousand Dollars
88158 ($100,000.00). Expenditures from the fund shall b e made upon
89159 warrants issued by the State T reasurer against claims filed as
90160 prescribed by law with the Director of the Office of Management and

93161 Enterprise Services for approval and payment. Expenditures from th e
94162 Maintenance of State Buildings Revolving Fun d shall be detailed in a
95163 data feed and made available through the data.ok.gov web portal.

97164 I. The Director of the Office of Management and Enterprise
98165 Services shall notify entities found by the Office to be out of
99166 compliance with the reporting provisions o f this section in writing.

101194 J. This section shall not be applicable to the following or
102195 their lands, properties, buildings, funds , or revenue:

104196 1. The Oklahoma Ordnance Works Authority; and

106197 2. The Commissioner s of the Land Office; and

108198 3. Institutions com prising The Oklahoma State System of Higher
109199 Education, except as to the data reporting requi rements in this
110200 section.

112201 K. The report required in subsection B of this section shall
113202 include an indication of whether a property is owned by the Oklahoma
114203 Historical Society, is listed on the Nat ional Register of Historic
115204 Places or with the National Trust for Historic Preservation, or is
116205 potentially of historical significance. The Office of Management
117206 and Enterprise Services shall notify the Oklahoma Historical Soc iety
118207 and obtain its approval pri or to the sale of any such property.
