28	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	56		SECTION 1. AMENDATORY 62 O.S. 2 021, Section 908, is
31	57		amended to read as follows:

33	58		Section 908. A. There is hereby established the Oklahoma State
34	59		Government Asset Reduction and Cost Savings Program.
35		-
36	60		B. No later than December 31 each year, the Di rector of the
37	61		Office of Management and Enterprise Services shall publish a
38	62		comprehensive report detailing state -owned properties.

40	63		C. The report mandated in accordance with the provisions of
41	64		this section shall list the five percent (5%) most underutilized
42	65		state-owned properties. T he report shall describe the value of

43	93		properties falling within the description in this subsection, assess
44	94		the potential for purchase should the properties be offered for
45	95		sale, and describe the impact on local-level tax rolls in t he event
46	96		the properties are purchased by a nongovernmental entity.

50	97		D. The Director of the Office of Management and Enterprise
51	98		Services shall promulgate rules establishing procedures by which
52	99		each state agency, board, commission, and public trust having th e
53	100		State of Oklahoma state as a beneficiary, excluding those otherwise
54	101		exempted under Section 327 of Title 61 of the Oklahoma Statutes,
55	102		shall submit the necessary data to the Office of Management and
56	103		Enterprise Services for the development of this report.

58	104		E. State agencies, boards, commiss ions, and public trusts
59	105		having the State of Oklahoma state as a beneficiary shall comply
60	106		with procedures promulgated pursuant to the terms of this section.

62	107		F. The report and d ata collected pursuant to this section shall
63	108		be published as a data feed on the data.ok.gov website.

65	109		G. In addition to the requirements of subsection C of this
66	110		section, the Office of Management and Enterprise Services may make
67	111		recommendations for the sale of other state-owned properties based
68	112		upon the value of the property and the potential for net gain for
69	113		the state based upon the data obtained for the Oklahoma State
70	114		Government Asset Reduction and Cost Savings Program.

72	115		H. There is hereby created the Main tenance of State Buildings
73	116		Revolving Fund. The fund shall be a continuing fund, not su bject to

74	144		fiscal year limitations, and shall serve as the depository for
75	145		proceeds from the sale of state -owned properties pursuant to the
76	146		Oklahoma State Government Asset Reduction and Cost Savings Program.
77	147		The fund shall further consist of monies appropriat ed thereto and
78	148		other funds designated for deposit therein. All monies accruing to
79	149		the credit of the fund are hereby appropriated and may be expended
80	150		exclusively for maintaining and repairing state-owned properties and
81	151		buildings pursuant to the procedures set forth in Section 901.1 of
82	152		Title 62 of the Oklahoma Statutes and for acquisition of information
83	153		technology tools or resources that state agencies, boards,
84	154		commissions, and public trusts having the State of Oklahoma state as
85	155		a beneficiary shall use in ca rrying out their obligations in
86	156		accordance with this act. The total expenditure for information
87	157		technology resources shall not exceed One Hundred Thousand Dollars
88	158		($100,000.00). Expenditures from the fund shall b e made upon
89	159		warrants issued by the State T reasurer against claims filed as
90	160		prescribed by law with the Director of the Office of Management and

93	161		Enterprise Services for approval and payment. Expenditures from th e
94	162		Maintenance of State Buildings Revolving Fun d shall be detailed in a
95	163		data feed and made available through the data.ok.gov web portal.

97	164		I. The Director of the Office of Management and Enterprise
98	165		Services shall notify entities found by the Office to be out of
99	166		compliance with the reporting provisions o f this section in writing.

102	195		their lands, properties, buildings, funds , or revenue:

104	196		1. The Oklahoma Ordnance Works Authority; and

106	197		2. The Commissioner s of the Land Office; and

108	198		3. Institutions com prising The Oklahoma State System of Higher
109	199		Education, except as to the data reporting requi rements in this
110	200		section.

112	201		K. The report required in subsection B of this section shall
113	202		include an indication of whether a property is owned by the Oklahoma
114	203		Historical Society, is listed on the Nat ional Register of Historic
115	204		Places or with the National Trust for Historic Preservation, or is
116	205		potentially of historical significance. The Office of Management
117	206		and Enterprise Services shall notify the Oklahoma Historical Soc iety
118	207		and obtain its approval pri or to the sale of any such property.

120	208		SECTION 2. This act shall become effective November 1, 2023.
