7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 22 O.S. 2021, Section 812.1, is
7979 amended to read as fol lows:
8080 Section 812.1. A. If any person charged with a crime and held
8181 in jail solely by reason thereof is not brought to trial within one
8282 (1) year after arrest two hundred seventy-two (272) days after the
8383 person’s initial appearance on the charge, the court shall set the
8484 case for immediate rev iew as provided in Section 2 812.2 of this act
8585 title, to determine if the right of the accused to a speedy trial is
8686 being protected.
8787 B. If any person charged with a felony crime who is held to
8888 answer on an appearance bond is not brought to trial within ei ghteen

140140 (18) months after arrest initial appearance, the court shall set the
141141 case for immediate review as provided in Section 2 812.2 of this
142142 act, title to determine if the right of the accused to a speedy
143143 trial is being protected.
144144 C. In the event a mistri al is declared or a convic tion is
145145 reversed on appeal, the time limitations provided for in this
146146 section shall commence to run from the date the mistrial is declared
147147 or the date of the mandate of the Court of Criminal Appeals.
148148 SECTION 2. AMENDATORY 22 O.S. 2021, Section 812.2, is
149149 amended to read as follows:
150150 Section 812.2. A. Whenever the court finds that a case should
151151 be reviewed to determine if the right of an accused to a speedy
152152 trial is being protected, the court shall:
153153 1. Issue notice to the District Attorney district attorney, the
154154 accused, and the attorney for the accuse d that the case will be
155155 reviewed by the court at a date and time which is not less than ten
156156 (10) days nor more than twenty (20) days from the date of the
157157 notice. Each party shall have the opportunity to prese nt evidence
158158 or legal authority in support of it s position; and
159159 2. Take evidence from both parties regarding the
160160 appropriateness of the cause for the delay. At the hearing, the
161161 court shall consider whethe r the delay has occurred f or any of the
162162 following reasons:

214214 a. the delay is the result of due to the application of
215215 the accused or an attorney on behalf of the accused,
216216 b. the delay is the result of due to the fault of the
217217 accused or the attorney for the ac cused,
218218 c. the accused is incompetent to stand trial ,
219219 d. a proceeding to determine the competency o f the accused
220220 to stand trial is pending and a determination cannot be
221221 completed within the time limitations fixed for trial,
222222 e. there is material evidence or a material witness which
223223 is unavailable and that re asonable efforts have been
224224 made to procure such evidence or witness, and there are
225225 reasonable grounds to believe that such evidence or
226226 witness can be obtained and trial commenced within a
227227 reasonable time,
228228 f. the accused is charged as a codefendant or
229229 coconspirator and the court has determined that the
230230 codefendants or coconspirators must be tried before
231231 separate juries taken from separate jury panels,
232232 g. the court has other cases pending for trial that are
233233 for persons incarcerated pr ior to the case in questi on,
234234 and the court does not have sufficient time to commence
235235 the trial of the case within the time limitation fixed
236236 for trial; provided, no more than three conti nuances of

288288 not more than thirty (30) days may be ordered pursuant
289289 to this subparagraph,
290290 h. the court, state, accused, or the attorney for the
291291 accused is incapable of proceeding to trial due to
292292 illness or other reason and it is unreasonable to
293293 reassign the case, and
294294 i. due to other reasonable grounds the court does not have
295295 sufficient time to commence the trial of the case
296296 within the time limit fi xed for trial; provided, no
297297 more than three continuances of not mor e than thirty
298298 (30) days may be ordered pursuant to this subparagraph .
299299 B. If, after After hearing all the evidence an d the legal
300300 arguments properly submitted, if the court finds by a prepon derance
301301 of the evidence that the state is not proceeding with due diligence,
302302 that none of the exceptions set out in paragraph 2 of subsection A
303303 of this section justify additional delay and the right of the
304304 accused to a speedy trial has been violated, the c ourt shall dismiss
305305 the case.
306306 C. If a preliminary hearing has been held, the case may be
307307 refiled, unless the applicable statute of limitations has expired,
308308 upon a showing of newly disc overed evidence which cou ld not have
309309 been discovered prior to trial , unless the applicable statute of
310310 limitations has expired.

362362 D. If a preliminary hearing has not been held, the case may be
363363 refiled, upon good cause shown , unless any applicable statute of
364364 limitations has expired.
365365 E. If, after After hearing all the evidence an d the legal
366366 arguments properly submi tted, if the court finds that the right of
367367 the accused to a speedy trial has not been violated, the court shall
368368 set the case for review in four (4) within three (3) months. If the
369369 case is still pending after the four-month three-month period, the
370370 court shall conduct another review within thirty (30) days. The
371371 four-month review of pending cases every thirty (30) days shall be a
372372 continuing responsibil ity of the court until final disposition of
373373 the case.
374374 SECTION 3. This act shall become effective November 1, 2023.
