79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 11 O.S. 2021, Section 16 -112, is
81	81	amended to read as follows:
82	82	Section 16-112. A. When the municipal governing bo dy shall
83	83	deem it advisable, it may, by resolution or ordinance, authorize the
84	84	mayor to call a special election on a date established in Section 3 -
85	85	101 of Title 26 of the Oklahoma Statutes for the purpose of
86	86	submitting to the registered voters of the municip ality the question
87	87	of issuing municipal bonds, of granting of any franchise, or for any
88	88	other purpose authorized by law.

140	140	B. Notwithstanding any other law, f or purposes of submitting to
141	141	the registered voters of the municipality t he question of issuing
142	142	municipal bonds or any tax, the governing bod y may, by resolution
143	143	ordinance, authorize the mayor to call a special election on a state
144	144	or federal election day in November in an odd or even -numbered year.
145	145	SECTION 2. AMENDATORY 70 O.S. 2021, Section 15-102, is
146	146	amended to read as follows:
147	147	Section 15-102. The Notwithstanding any other law, the board of
148	148	education shall call an election to be held on a state or federal
149	149	election day in Novembe r in an odd or even-numbered year, and to be
150	150	conducted by the county election board in all respects as other
151	151	elections, for the pu rpose of taking the sense of the district upon
152	152	the question of issuing such bonds, naming in the proclamation of
153	153	such election the amount of bonds to be voted on and the purpose for
154	154	which they are to be issued; and it shall cause to be published in a
155	155	newspaper of general circulation in said the district the time and
156	156	place of such election, such notices to be given at least ten (1 0)
157	157	days before such election. In all instances whe re proclamations for
158	158	elections for boards of education are required by statute of t he
159	159	mayor of a city, and in all instances where elections for boards of
160	160	education are provided for by statute wherein the m ayor and city
161	161	clerk are denominated, the president of the board of education shall
162	162	be substituted for the mayor and the clerk of the b oard of education

215	215	hereby declared to be free and indepen dent of cities in all matters
216	216	relating to school el ections legally called upon all school matters,
217	217	and presidents of boards of educati on shall have full power to issue
218	218	proclamations calling school elections; provided, that no election
219	219	shall be called on th e same proposition within four (4) months after
220	220	such proposition has been defeated at an election by the school
221	221	district electors. Th e provisions of this act section as to the
222	222	waiting period shall not apply where the school facilities have been
223	223	destroyed by an act of God. The cost of such elections, toge ther
224	224	with the cost of such proclamations, publication, notices or other
225	225	expenses required, shall be legal costs of boards of education.
226	226	SECTION 3. This act shall become effective July 1, 2 023.
227	227	SECTION 4. It being immediat ely necessary for the preservation
228	228	of the public peace, health or safety, an emergency is hereby
229	229	declared to exist, by reason whereof this act shall take effect and
230	230	be in full force from and after its passa ge and approval.
