7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 11 O.S. 2021, Section 16 -112, is
8181 amended to read as follows:
8282 Section 16-112. A. When the municipal governing bo dy shall
8383 deem it advisable, it may, by resolution or ordinance, authorize the
8484 mayor to call a special election on a date established in Section 3 -
8585 101 of Title 26 of the Oklahoma Statutes for the purpose of
8686 submitting to the registered voters of the municip ality the question
8787 of issuing municipal bonds, of granting of any franchise, or for any
8888 other purpose authorized by law.

140140 B. Notwithstanding any other law, f or purposes of submitting to
141141 the registered voters of the municipality t he question of issuing
142142 municipal bonds or any tax, the governing bod y may, by resolution
143143 ordinance, authorize the mayor to call a special election on a state
144144 or federal election day in November in an odd or even -numbered year.
145145 SECTION 2. AMENDATORY 70 O.S. 2021, Section 15-102, is
146146 amended to read as follows:
147147 Section 15-102. The Notwithstanding any other law, the board of
148148 education shall call an election to be held on a state or federal
149149 election day in Novembe r in an odd or even-numbered year, and to be
150150 conducted by the county election board in all respects as other
151151 elections, for the pu rpose of taking the sense of the district upon
152152 the question of issuing such bonds, naming in the proclamation of
153153 such election the amount of bonds to be voted on and the purpose for
154154 which they are to be issued; and it shall cause to be published in a
155155 newspaper of general circulation in said the district the time and
156156 place of such election, such notices to be given at least ten (1 0)
157157 days before such election. In all instances whe re proclamations for
158158 elections for boards of education are required by statute of t he
159159 mayor of a city, and in all instances where elections for boards of
160160 education are provided for by statute wherein the m ayor and city
161161 clerk are denominated, the president of the board of education shall
162162 be substituted for the mayor and the clerk of the b oard of education

215215 hereby declared to be free and indepen dent of cities in all matters
216216 relating to school el ections legally called upon all school matters,
217217 and presidents of boards of educati on shall have full power to issue
218218 proclamations calling school elections; provided, that no election
219219 shall be called on th e same proposition within four (4) months after
220220 such proposition has been defeated at an election by the school
221221 district electors. Th e provisions of this act section as to the
222222 waiting period shall not apply where the school facilities have been
223223 destroyed by an act of God. The cost of such elections, toge ther
224224 with the cost of such proclamations, publication, notices or other
225225 expenses required, shall be legal costs of boards of education.
226226 SECTION 3. This act shall become effective July 1, 2 023.
227227 SECTION 4. It being immediat ely necessary for the preservation
228228 of the public peace, health or safety, an emergency is hereby
229229 declared to exist, by reason whereof this act shall take effect and
230230 be in full force from and after its passa ge and approval.
