8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 11-203 of Title 70, unless there
8484 is created a duplication in numb ering, reads as follows:
8585 A. Each school district library in this state shall provide an
8686 effective library media program through the acquisition of library
8787 media materials sufficient to meet the instructional needs of
8888 students enrolled in the school district. The library media progra m
8989 shall include a balanced collection o f print materials, nonprint

141141 materials, multimedia resources, and e quipment and supplies to meet
142142 the needs of students and staff .
143143 B. Each school district board of education shall adopt and post
144144 on the school district 's website a comprehensive written policy that
145145 guides the selection, deselection, and reconsideration of l ibrary
146146 media materials. The policy shall:
147147 1. Ensure that the selection of library medi a materials
148148 reflects the school district 's philosophy, mission, g uiding
149149 principles, or other foundatio nal documents;
150150 2. Provide a framework for the consistent selectio n and
151151 acquisition of library resources in all formats using a standard set
152152 of criteria;
153153 3. Avoid haphazard patterns of acquisition that would result in
154154 waste or overlap of content;
155155 4. Designate the staff person or persons responsible for
156156 selecting materials and the parameters for selection decisions;
157157 provided, however, the policy shall allo w for the use of
158158 professional judgment;
159159 5. Ensure a diversity of viewpoints on all topics including
160160 those that may be considered controversial;
161161 6. Identify cooperativ e collection development arrangements
162162 such as resource sharing including interlibrary lo ans, agreements to
163163 purchase or lease electronic content, and reso urce retention

215215 commitments for materials such as government documents, archival
216216 materials, and local au thor materials;
217217 7. Provide standards for collection maintenance and the removal
218218 of library resources for which the library has excess copies or that
219219 are out of date, inaccurate , no longer reflecting the consensus of
220220 the relevant field of study, in poor con dition, rarely used, in an
221221 obsolete format, or not meeting the needs of library patrons;
222222 8. Supply guidelines for consideration of gifts and donations
223223 of library media materials;
224224 9. Establish a process by which individuals may share their
225225 concerns about library media materials or resources in a discussion
226226 with a certified library media specia list if one is available or
227227 other staff person designated pursuant to paragraph 4 of this
228228 subsection. If an individual's concerns are not resolved, he or she
229229 may request a formal reconsideration on a form provided by the
230230 school district; and
231231 10. Affirm the importance of intellectual freedom, referencing
232232 key documents such as the First Amendme nt to the U.S. Constitution,
233233 the Library Bill of Rights, and the Freedom to Read Statement.
234234 C. The school district library, media center, media materials,
235235 equipment, and related school staff shall be available to students
236236 and staff throughout the school da y. Staff shall assist students
237237 and teachers in becoming effective user s of ideas and information

291291 SECTION 2. This act shall become eff ective July 1, 2023.
292292 SECTION 3. It being immediatel y necessary for the preservation
293293 of the public peace, health , or safety, an emergency is hereby
294294 declared to exist, by reason whereof thi s act shall take effect and
295295 be in full force from an d after its passage and approval.
