157157 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
158158 SECTION 1. NEW LAW A new section of law to be codified
159159 in the Oklahoma Statutes as Section 1251 of Title 22, unless there
160160 is created a duplication in numbering, reads as follows:
161161 This act shall be known and may be cited as the “Electronic
162162 Communication and Device Privacy Act ”.
163163 SECTION 2. NEW LAW A new section of law to be codified
164164 in the Oklahoma Statutes as Section 1252 of Title 22, unless there
165165 is created a duplication in numbering, reads as follows:
166166 As used in this act:
167167 1. “Adverse result” means:
168168 a. danger to the life or physical safety of an
169169 individual,
170170 b. flight from prosecution ,
171171 c. destruction of or tampering with ev idence,
172172 d. intimidation of potential witnesses, or
173173 e. serious jeopardy to an investigation o r undue delay of
174174 a trial;
175175 2. “Authorized possessor ” means the possessor of an electronic
176176 device when such person is the owner of the device or has been
177177 authorized to possess the device by th e owner of the device;

229229 3. “Electronic communication ” means the transfer of signs,
230230 signals, writings, images, sounds, data , or intelligence of any
231231 nature in whole or in part by a wire, radio, electromagneti c,
232232 photoelectric, or photo-optical system;
233233 4. “Electronic communication information ” means any information
234234 about an electronic communication or the use of an electronic
235235 communication service including, but not limit ed to, the contents,
236236 sender, recipients, format, or location of the sender or recipients
237237 at any point during the communication, the time or date the
238238 communication was created, sent, or received or any information
239239 pertaining to any individual or device part icipating in the
240240 communication including , but not limited to, an IP address.
241241 Electronic communication information does not include subscriber
242242 information as defined in this act;
243243 5. “Electronic communication service ” means a service that
244244 provides to its subscribers or users the ability to send or receive
245245 electronic communications including any service that acts as an
246246 intermediary in the transmission of elec tronic communications, or
247247 stores electronic communication information;
248248 6. “Electronic device” means a device that stores, generates ,
249249 or transmits information in electronic form;
250250 7. “Electronic device information” means any information stored
251251 on or generated through the operation of an electronic device
252252 including the current and prior locations of the dev ice;

304304 8. “Electronic information ” means electronic communication
305305 information or electronic device information;
306306 9. “Government entity” means a department or agency of the
307307 state or a political subdivision thereof, or an individual acting
308308 for or on behalf of the state or a political subdivision th ereof;
309309 10. “Service provider” means a person or en tity offering an
310310 electronic communication service;
311311 11. “Specific consent” means consent provided directly to the
312312 government entity seeking information including but not limited to
313313 when the government en tity is the addressee or i ntended recipient or
314314 a member of the intended audience of an electronic communication.
315315 Specific consent does not require that the originator of the
316316 communication have actual knowledge that an addressee, intended
317317 recipient, or member of the specific audience is a government
318318 entity; and
319319 12. “Subscriber information” means the name, street addres s,
320320 telephone number, email address or similar contact information
321321 provided by the subscriber to a service provider to establish or
322322 maintain an account or communication channel, a subscriber or
323323 account number or identifier, the length of service, and the ty pes
324324 of services used by a user of or subscriber to a service provider.
325325 SECTION 3. NEW LAW A new section of law to be codified

379379 A. Except as provided in this section, a government entity
380380 shall not:
381381 1. Compel the production of or access to electronic
382382 communication information from a service provider;
383383 2. Compel the production of or access to electronic device
384384 information from any person or entity other than the aut horized
385385 possessor of the dev ice; or
386386 3. Access electronic device information by means of physical
387387 interaction or electronic communication with the elec tronic device.
388388 This section does not prohibit the i ntended recipient of an
389389 electronic communication from voluntarily disclosing electro nic
390390 communication information conc erning that communication to a
391391 government entity.
392392 B. A government entity may compel t he production of or access
393393 to electronic communicati on information from a service provider, or
394394 compel the production of or access to ele ctronic device information
395395 from any person or entity other than the authorized poss essor of the
396396 device only under the fo llowing circumstances:
397397 1. Pursuant to a lawful warrant issued pursuant to federal law
398398 or the laws of this state and subject to subsectio n D of this
399399 section;
400400 2. Pursuant to a wiretap order issued pursuant to federal law
401401 or the laws of this state;

453453 3. Pursuant to an order for electronic reader records issue d
454454 pursuant to federal law or the laws of this state ; or
455455 4. Pursuant to a subpoena issued p ursuant to the laws of this
456456 state provided that the information is not sough t for the purpose of
457457 investigating or prosecuting a criminal offense, and that compelling
458458 the production of or access to the information via the subpoena is
459459 not otherwise prohibited by state or federal law. Nothing in this
460460 paragraph shall be construed to expand any authority under state law
461461 to compel the production of or access to electronic information.
462462 C. A government entity may access electronic device information
463463 by means of physical interaction or electronic comm unication with
464464 the device only:
465465 1. Pursuant to a warrant issued pursuant t o federal law or the
466466 laws of this state and subject to subsection D of this section;
467467 2. Pursuant to a wiretap order issued pursuant to federal law
468468 or the laws of this state ;
469469 3. With the specific consent of the aut horized possessor of the
470470 device;
471471 4. With the specific consent of the owner of the device, on ly
472472 when the device has been reported as lost or stolen;
473473 5. If the government entity believes in good faith that an
474474 emergency involving danger of death or serious phys ical injury to
475475 any person requires ac cess to the electronic device information;

527527 6. If the government entity believes in good faith that the
528528 device is lost, stolen, or aband oned; provided, the entity shall
529529 only access electronic device information in or der to attempt to
530530 identify, verify, or c ontact the owner or aut horized possessor of
531531 the device; or
532532 7. Except where prohibited by state or federal law, if the
533533 device is seized from an inmate’s possession or found in an area of
534534 a correctional facility under the jurisdiction of the Department of
535535 Corrections where inmates have access and the device is not in the
536536 possession of an individual and is not known or believe d to be the
537537 possession of an auth orized visitor. Nothing in this paragraph
538538 shall be construed to supersede or override the laws of this state
539539 or rules promulgated by the Department of Co rrections for electronic
540540 devices.
541541 D. Any warrant for electronic infor mation shall comply with the
542542 following:
543543 1. The warrant shall describe with particul arity the
544544 information to be seized by specifying t he time periods covered and,
545545 as appropriate and reas onable, the target individuals or accounts,
546546 the applications or servic es covered, and the types of information
547547 sought;
548548 2. The warrant shall require that any information obtained
549549 through the execution of the warrant that is unrelated to the
550550 objective of the warrant shall be sealed and not subject to further

602602 review, use, or disclosure without a court order. A court shall
603603 issue such an order upon a finding th at there is probable cause to
604604 believe that the information is relevant to an active investigation,
605605 or if its review, use, or disclosure is required by state or federal
606606 law; and
607607 3. The warrant shall comply with al l other provisions of state
608608 and federal law includi ng any provisions prohibiting, limiting , or
609609 imposing additional requirements on the use of se arch warrants. If
610610 directed to a service provider, the warrant shall be accompan ied by
611611 an order requiring the ser vice provider to verify the authenticity
612612 of electronic information that it produces by prov iding an affidavit
613613 that complies with the requiremen ts set forth in the Oklahoma
614614 Evidence Code. Admission of such information into evidence shall be
615615 subject to the Oklahoma Evidence Code.
616616 E. When issuing any warran t or order for electronic
617617 information, or upon the petition from the target or recipient of
618618 the warrant or order, a court m ay do one or both of the following:
619619 1. Appoint a special maste r charged with ensuring that only
620620 information necessary to achieve the objective of the warrant or
621621 order is produced or accessed; or
622622 2. Require that any informat ion obtained through the execution
623623 of the warrant or order t hat is unrelated to the objective of the
624624 warrant be destroyed as soon as feasible af ter the termination of

676676 the current investigation and any rel ated investigations or
677677 proceedings.
678678 F. A service provider may voluntarily disclose electronic
679679 communication information or subscriber informatio n when that
680680 disclosure is not otherwise prohibited by state or federal law.
681681 G. If a government entity receives electronic communication
682682 information voluntarily pr ovided pursuant to subsection F of this
683683 section, the entity shall destroy such information within ninety
684684 (90) days unless one or more of the following c ircumstances apply:
685685 1. The entity has or obtains th e specific consent of the sender
686686 or recipient of the electronic communications about which
687687 information was disclosed;
688688 2. The entity obtains a court orde r authorizing the retention
689689 of the information. A court shall issue a retention order upon a
690690 finding that the conditions justifying the initial voluntary
691691 disclosure persist, in which case the court shall authorize the
692692 retention of the information only for so long as those conditions
693693 persist, or if there is probable cause to believe that the
694694 information constitutes evidence that a crime has been committed; or
695695 3. The entity reasonably believes that the information relates
696696 to child pornography and the informati on is retained as part of a
697697 multiagency database us ed in the investigation of child pornography
698698 and related crimes.

750750 H. If a government entity obtains e lectronic information
751751 pursuant to an emergency involving danger of deat h or serious
752752 physical injury to a person that requires access to the electronic
753753 information without delay, the entity shall, within t hree (3) days
754754 after obtaining the electronic informa tion, file with the
755755 appropriate court an application for a warrant or o rder authorizing
756756 obtaining the electronic information or a motion seeking approval o f
757757 the emergency disclosure that shall set forth t he facts giving rise
758758 to the emergency, and if applic able, a request supported by a sworn
759759 affidavit for an order delaying notification under paragraph 1 of
760760 subsection B of Section 4 of this act. The court shall promptly
761761 rule on the application or motion . Upon a finding that the facts
762762 did not give rise to a n emergency or upon rejecting the warrant or
763763 order application on any o ther ground, the court shall order the
764764 immediate destruction of all information obta ined and immediate
765765 notification pursuant to sub section A of Section 4 of this act, i f
766766 such notice has not already been given.
767767 I. This section shall not be construed to limit the authority
768768 of a government entity to use an administrative, grand jury, trial,
769769 or civil discovery subpoena to:
770770 1. Require an originator, addressee, or intended recipient of
771771 an electronic communication to disclose any electronic communication
772772 information associated with that communication;

824824 2. Require an entity that provides electronic communications
825825 services to its officers, dire ctors, employees, or agents for the
826826 purpose of carrying out their duties, to disclose electronic
827827 communication information associated with an electro nic
828828 communication to or from an officer, director, employee, or agent of
829829 the entity; or
830830 3. Require a service provider to provide subscriber
831831 information.
832832 SECTION 4. NEW LAW A new section of law to be codified
833833 in the Oklahoma Statutes as Section 1254 of Title 22, unless there
834834 is created a duplication in numbering, reads as follows:
835835 A. Except as otherwise provided in this section, any gove rnment
836836 entity that executes a warrant, or obtains electronic in formation in
837837 an emergency pursuan t to Section 3 of this act, shall serve upon, or
838838 deliver to by registered or first-class mail, electronic ma il, or
839839 other means reasonably calculated to be effec tive, the identified
840840 targets of the warrant or emergency request , a notice that informs
841841 the recipient that information about the recipient has been
842842 compelled or requested, and states with reasonable speci ficity the
843843 nature of the government investigation un der which the information
844844 is sought. The notice shall include a copy of the warrant or a
845845 written statement setting forth facts giving rise to the e mergency.
846846 The notice shall be provided contemporaneousl y with the execution of

898898 a warrant, or in the case of an emergency, within three (3) days
899899 after obtaining the electr onic information.
900900 B. 1. When a warrant is sought or electronic information is
901901 obtained in an emergency under Section 3 of this act, the government
902902 entity may submit a request supported by a s worn affidavit for an
903903 order delaying notification and prohibiti ng any party providing
904904 information from notifying any other party that information h as been
905905 sought. The court shall issue the order if the c ourt determines
906906 that there is reason to believe that notification may have an
907907 adverse result, but only for the peri od of time that the court finds
908908 there is reason to believe that the notification may have that
909909 adverse result, and not to exceed ninety (90) days.
910910 2. The court may grant extensions of the dela y of up to ninety
911911 (90) days each on the same grou nds as provided in paragraph 1 of
912912 this subsection.
913913 3. Upon expiration of the period of delay of t he notification,
914914 the government entity shall serve upon, or deliver to by registered
915915 or first-class mail, electronic mail, or other means reasonably
916916 calculated to be effect ive as specified by the court iss uing the
917917 order authorizing delayed notification, th e identified targets of
918918 the warrant, a document that incl udes the information described in
919919 subsection A of this section, a copy of all electronic information
920920 obtained or a summary of that information inclu ding, at a minimum,
921921 the number and types of records disclosed, the date and time when

974974 grounds for the court’s determination to grant a delay in notifying
975975 the individual.
976976 C. If there is no identified target of a warrant or emergency
977977 request at the time of its issuance, the government entity sha ll
978978 submit to the Department of Public Safety within three (3) days of
979979 the execution of the warrant or issuance of t he request all of the
980980 information required in subsection A of this section . If an order
981981 delaying notice is obtained pursuant to subsection B of this
982982 section, the government entity shall submit to the Department upon
983983 the expiration of the period of delay o f the notification all of the
984984 information required in paragraph 3 of subsection B of this section.
985985 The Department shall publish all those re ports on its website within
986986 ninety (90) days of receipt. The Department may redact names or
987987 other personal identifying information from the reports .
988988 D. Except as otherwise provided in this sectio n, nothing in
989989 this act shall be construed to prohibit or limit a service provider
990990 or any other party from discl osing information about any request or
991991 demand for electronic informat ion.
992992 SECTION 5. NEW LAW A new section of law to be codified
993993 in the Oklahoma Statutes as Section 1255 of Title 22, unless there
994994 is created a duplication in numberin g, reads as follows:
995995 A. Any person in a trial, hearing , or proceeding may move to

10481048 violation of the Fourth Amendment to the United States Consti tution
10491049 or of this act. The motion shall be made, de termined, and be
10501050 subject to review in accordance with the procedures set forth in the
10511051 laws of this state.
10521052 B. The Attorney General may commence a civil action to compel
10531053 any government entity to comply wit h the provisions of this act.
10541054 C. An individual whose information is targeted by a warrant,
10551055 order, or other legal process that is inconsistent with this act or
10561056 the United States Constitution, or a service provider or any other
10571057 recipient of the warrant, ord er, or other legal process may petition
10581058 the issuing court to void or modify the warrant, order , or process,
10591059 or to order the destruction of any information obtained in violation
10601060 of this act or the United States Consti tution.
10611061 D. An Oklahoma or foreign corporation, and its officers,
10621062 employees, and agents are not subject to any cause of action for
10631063 providing records, information, fa cilities, or assistance in
10641064 accordance with the terms of a warrant, court order, statutory
10651065 authorization, emergency certification , or wiretap order issued
10661066 pursuant to this act .
10671067 SECTION 6. This act shall become effective November 1, 2023.
