29	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

31	58		SECTION 1. NEW LAW A new section of law to be codified
32	59		in the Oklahoma Statutes as Section 8-105 of Title 47, unless there
33	60		is created a duplication in numbering, reads as follows:

35	61		A. If a motor vehicle rental company imposes ad ditional
36	62		mandatory charges, the rental company shall:
37		-
38	63		1. Provide a good-faith estimate of the total charges for t he
39	64		entire rental, including all additional mandatory charges, whenever
40	65		a quote is provided to a poten tial customer. The good-faith
41	66		estimate may exclude mileage charge s and charges for opti onal items

42	94		that cannot be determined prior to completing a rental reservation
43	95		based on the information provided by the potential customer ; and

45	96		2. Disclose in the renta l contract provided to the renter the
46	97		total charges for the entire rental, including all additional
47		-

49	98		mandatory charges. Total charges for the entire rental do not
50	99		include any charges that cannot be determined at the time the rental
51	100		commences.

53	101		B. As used in this section:

55	102		1. “Additional mandatory charge” means any separately stated
56	103		charges that a motor vehicle rental company requires a renter to pay
57	104		that specifically relate to the operation of a rental vehicle.
58	105		Additional mandatory charge includes, but is not limited to, a
59	106		customer facility charge, airport concession recovery fee, road
60	107		safety program fee, vehicle license recovery fee, or any government
61	108		imposed taxes or fees;

63	109		2. “Motor vehicle” means the same as set forth in Section 562
64	110		of Title 47 of the O klahoma Statutes;

66	111		3. “Motor vehicle rental agreement ” means an agreement for the
67	112		rental of a motor vehicle for transportation purposes, for a period
68	113		no more than ninety (90) days, in return for a fee that is
69	114		calculated on a daily, weekly, or monthly basis ;

71	115		4. “Motor vehicle rental company” means an entity that is in
72	116		the business of renting, pursuant to motor vehicle rental
73	117		agreements;

75	145		5. “Quote” means an estimated cost of rental provided by a
76	146		motor vehicle rental company to a potential customer based on
77	147		information provided by the customer, including potential dates of
78	148		rental, location, or class of vehicle; and

80	149		6. “Vehicle license recovery fee ” means a charge to recover
81	150		costs incurred by a motor vehicle rental company to license, title,
82	151		register, plate, or inspect a rental vehicle.

84	152		SECTION 2. This act shall become effective November 1, 2023.
