3940 amending 51 O.S. 2021, Section 24A.8, as amended by

5051 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5152 SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.8, as
5253 amended by Section 1, Chapter 12, O.S.L. 2022 (51 O.S. Supp. 2022,
5354 Section 24A.8), is amended to re ad as follows:
5455 Section 24A.8. A. Law enforcement agencies shall make
5556 available for public inspection and copying, if kep t, the following
5657 records:
5758 1. An arrestee description, including the name, date of birth,
5859 address, race, sex, physical description, and occupation of the
5960 arrestee;
6061 2. Facts concerning the arrest , including the cause of arrest
6162 and the name of the arresting officer;

8991 offense report information showing the offense, date, time, general
9092 location, officer, and a brief s ummary of what occurred;
9193 4. Radio logs, including a chronological listing of the cal ls
9294 dispatched;
9395 5. Conviction information, including the name of any person
9496 convicted of a criminal offense;
9597 6. Disposition of all warrants , including orders signed by a
9698 judge of any court commanding a law enforcement officer to arrest a
9799 particular person;
98100 7. A crime summary, including an agency summary of crimes
99101 reported and public calls for service by classification or nature

101103 8. Jail registers, including jail blotter data or jail booking
102104 information recorded on persons at the time of in carceration showing
103105 the name of each prisoner with the date and cause of commitment, t he
104106 authority committing the prisoner, whether committed for a criminal
105107 offense, a description of the prisoner, and the date or manner of
106108 discharge or escape of the prison er;
107109 9. Audio and video recordings from recording equipment attached
108110 to law enforcement vehicles or unmanned aircraft as defined in
109111 Section 322 of Title 3 of the Oklahoma S tatutes, associated audio
110112 recordings from recording equipment on the person of a law
111113 enforcement officer or audio and video recordings from any other

140143 recording provided for in this paragraph, redact or obscure specifi c
141144 portions of the recording which:
142145 a. depict the death of a person or a dead body, unless
143146 the death was effected by a law enforcement officer,
144147 b. depict nudity,
145148 c. would identify minors under the age of sixteen (16)
146149 years or would undermine any requirement to keep
147150 certain juvenile records confidential as provided for
148151 in Title 10A of the Oklahoma Statutes,
149152 d. depict acts of severe violence resulting in great
150153 bodily injury, as defined in Section 11-904 of Title
151154 47 of the Oklahoma Statutes, against persons tha t are
152155 clearly visible, unless the act of severe violence was
153156 effected by a law enforcement o fficer,
154157 e. depict great bodily injury, as defined in Section 11 -

189193 mental health evaluation or treatment or drug or
190194 alcohol detoxification purposes,
191195 h. include personal information other than the name or
192196 license plate number of a perso n not arrested, cited,
193197 charged or issued a written warning. Such personal
194198 information shall in clude any government-issued
195199 identification number, date of birth, address or
196200 financial information, or
197201 i. reveal the identity of law enforcement officers who
198202 have become subject to internal investigat ion by the
199203 law enforcement agency as a result of an even t
200204 depicted in the recording. The option to protect the
201205 identity of a law enforcement office r shall not be
202206 available to the law enforcement agency after the law
203207 enforcement agency has concluded the in vestigation and
204208 rendered a decision as to final discipli nary action.
205209 At such time when an investigation has concluded and
206210 the law enforcement agenc y has rendered its decision
207211 as to final disciplinary action, the por tions of the
208212 recordings previously withh eld as provided for in this
209213 subparagraph shall be availa ble for public inspection
210214 and copying. The audio and video recordings withheld
211215 as provided for in this subparagraph shall be

241246 10. a. Audio and video recordings from recording equipment
242247 attached to the person of a law enforcement officer

244249 (1) the use of any physical force or violence by a
245250 law enforcement officer,
246251 (2) pursuits of any kind,
247252 (3) traffic stops,
248253 (4) any person being arrested, cited, charged or
249254 issued a written warning,
250255 (5) events that directly led to any person being
251256 arrested, cited, charged or receiving a written
252257 warning,
253258 (6) detentions of any length for the purpose of
254259 investigation,
255260 (7) any exercise of authority by a law enforcement
256261 officer that deprives a citizen of his o r her
257262 liberty,
258263 (8) actions by a law enforcement officer tha t have
259264 become the cause of an investigation or ch arges

288294 materially aid a determination of whether law
289295 enforcement officers are appropriate ly performing
290296 their duties as public servants, or
291297 (10) any contextual events occurring before or after
292298 the events depicted in divisions (1) through (9)
293299 of this subparagraph.
294300 b. Notwithstanding the provisions of subparagraph a of
295301 this paragraph, the law enf orcement agency may, before
296302 releasing any audio or video recording provided for in
297303 this paragraph, redact or obscure specific portions of
298304 the recording that:
299305 (1) depict the death of a person or a dead body,
300306 unless the death was effected by a law
301307 enforcement officer,
302308 (2) depict nudity,
303309 (3) would identify minors under the age of sixteen
304310 (16) years or would undermi ne any requirement to
305311 keep certain juvenile records conf idential as
306312 provided for in Title 10A of the Oklahoma
307313 Statutes,
308314 (4) depict acts of severe vi olence resulting in great

340347 (5) depict great bodily injur y, as defined in Section
341348 11-904 of Title 47 of the Oklahoma Statutes,
342349 unless the great bodily injury was eff ected by a
343350 law enforcement officer,
344351 (6) include personal medical information that is not
345352 already public,
346353 (7) undermine the assertion of a privilege as
347354 provided in Section 1 -109 or Section 3-428 of
348355 Title 43A of the Oklahoma Statutes fo r detention
349356 or transportation for mental health evaluation or
350357 treatment or drug or alcohol detoxification
351358 purposes,
352359 (8) identify alleged victims of sex crimes or
353360 domestic violence,
354361 (9) identify any person who provides information to
355362 law enforcement or the information provided b y
356363 that person when that person requests anonymity
357364 or where disclosure of the identity of the person
358365 or the information provided could reasonably be
359366 expected to threaten or endanger the physical

386394 safety or property of the person or the physical
387395 safety or property of others,
388396 (10) undermine the assertion of a privi lege to keep
389397 the identity of an informer confidential as
390398 provided for in Section 2510 of Tit le 12 of the
391399 Oklahoma Statutes,
392400 (11) include personal information other than the name
393401 or license plate numbe r of a person not
394402 officially arrested, cited, charged or issued a
395403 written warning. Such personal information shall
396404 include any government -issued identification
397405 number, date of birth, address o r financial
398406 information,
399407 (12) include information that would ma terially
400408 compromise an ongoing criminal investigation or
401409 ongoing criminal prosecution, provided that:
402410 (a) ten (10) days following the formal
403411 arraignment or initial appearance, whichever
404412 occurs first, of a person charged in the
405413 case in question, the recordi ng shall be
406414 made available for public inspection and
407415 copying with no redaction of the portions
408416 that were temporarily withheld by reliance
409417 on this division. Provided, before

436445 potential release of a recording as provided
437446 for in this subdivision, the prosecut or or
438447 legal representative of the person charged
439448 may request from the appropriate district
440449 court an extension of time during which the
441450 recording may be withheld under the
442451 provisions of this d ivision. When a request
443452 for an extension of time has been filed with
444453 the court, the recording in question may be
445454 withheld until the court has issued a
446455 ruling. Such requests for an extension of
447456 the time during which the recording may be
448457 withheld may be made on the grounds that
449458 release of the recor ding will materially
450459 compromise an ongoing criminal investigation
451460 or criminal prosecution or on the grounds
452461 that release of the recording will
453462 materially compromise the r ight of an
454463 accused to a fair trial that has yet to
455464 begin. Courts considering such req uests
456465 shall conduct a hearing and consider whether
457466 the interests of the public outweigh the
458467 interests asserted by the parties. In
459468 response to such requests, the court sh all

488498 redaction of the portions that were
489499 temporarily withheld by reliance on thi s
490500 division or order an extension of time
491501 during which the recording may be withheld
492502 under the provisions of this division.
493503 Provided further, each such time extension
494504 shall only be ordered by the cour t for an
495505 additional six-month period of time or less
496506 and cumulative time extensions shall not add
497507 up to more than eighteen (18) months, or
498508 (b) in the event that one hundred twenty (120)
499509 days expire from the date of the events
500510 depicted in the recording with out any person
501511 being criminally charged in the case in
502512 question and release of a recording or
503513 portions of a recording have been denied on
504514 the grounds provided for in this division,
505515 an appeal of such denial may be made to the
506516 appropriate district court. In situations
507517 where one hundred twenty (120) days have
508518 expired since the creation of the recording,
509519 criminal charges have not been filed against

537548 on the grounds provided for in this
538549 division, courts considering app eals to the
539550 use of the provisions of this division for
540551 temporarily withholding a recording shall
541552 conduct a hearing and consider whether the
542553 interests of the public outweigh the
543554 interests of the parties protected by this
544555 division. In response to such appea ls, the
545556 district court shall order that the
546557 recording be made available for public
547558 inspection and copying with no redaction of
548559 the portions that wer e temporarily withheld
549560 by reliance on this division or order an
550561 extension of time duri ng which the recording
551562 may be withheld under the provisions of this
552563 division. An order granting an extension of
553564 time shall be applicable to the recording
554565 against all appellants for the duration of
555566 the extension. Provided, each such time
556567 extension shall only be ordered by the
557568 district court for an additional twelve -
558569 month period of time or less and cumulative
559570 time extensions shall not add up to more

590602 time following an arraignment or initial
591603 appearance may be requested by the parties

593605 for in subdivision (a) of this division.
594606 The options presented in this division to
595607 potentially withhold a recording or portions of a
596608 recording on the grounds provided for in this
597609 division shall expire in totality four (4) years
598610 after the recording was made at which time all
599611 recordings previously withheld on the ground s
600612 provided for in this division shall be made
601613 available for public inspection and copying, or
602614 (13) reveal the identity of law enforcement officers
603615 who have become subject to internal investigation
604616 by the law enforcement agency as a result of an
605617 event depicted in the recording . The option to
606618 protect the identity of a law enforcement officer
607619 shall not be available to the law enforcement
608620 agency after the law enforcement agen cy has

636649 decision as to final disciplinary ac tion. At
637650 such time when an investigation has concluded and
638651 the law enforcement agency has rendered its
639652 decision as to final disciplinary action, the
640653 portions of the reco rdings previously withheld as
641654 provided for in this division shall be available
642655 for public inspection and c opying. The audio and
643656 video recordings withheld on the gr ounds provided
644657 for in this division shall be available for
645658 public inspection and copying bef ore the
646659 conclusion of the investigation if the
647660 investigation lasts for an unreasonable amount of
648661 time.
649662 B. 1. Except for the records listed in subsection A of this
650663 section and those made open by other state or local laws, law
651664 enforcement agencies may deny access to law enforcement records
652665 except where a court finds that the public interest or the interest
653666 of an individual outweighs the reason for denial. The provis ions of
654667 this section shall not operate to deny access to law enforcement
655668 records if such records have been previously made availabl e to the
656669 public as provided in the Oklahoma Ope n Records Act or as otherwise
657670 provided by law.
658671 2. a. A law enforcement agency shall deny access to any
659672 audio or video recording that depicts the death of a

686700 law enforcement officer who was acting in the course
687701 of his or her official duties including any related
688702 acts or events immediately preceding or subsequent to
689703 the acts or events that caused or otherwise relate to
690704 the death, except where a court finds that the public
691705 interest or the interest of an individual outweighs
692706 the reason for denial . Provided, however, a law
693707 enforcement agency may allow a family member of the
694708 deceased law enforcement officer to hear or view such
695709 audio or video recording under protocols established
696710 by the law enforcement agency . For the purposes of
697711 this subparagraph, “family member” means a spouse,
698712 adult child, parent or sibling of the decease d law
699713 enforcement officer.
700714 b. Nothing in subparagraph a of this paragra ph shall be
701715 construed to prohibit the prosecution and defense
702716 counsel from access to such audio or video recordings
703717 or the use of such recordings as evidence in a legal
704718 proceeding.
705719 C. Nothing contained in this section imposes any new
706720 recordkeeping requirements. Law enforcement records shal l be kept
707721 for as long as is now or m ay hereafter be specified by law. Absent
708722 a legal requirement for the keeping of a law enforcement record for

735750 a specific time period, law enforcement agencies shall maintain
736751 their records for so long as needed for admini strative purposes.
737752 D. Registration files maintained by the Department of
738753 Corrections pursuant to the provisions of the Sex Offenders
739754 Registration Act shall be made available for public inspection in a
740755 manner to be determined by the Department.
741756 E. The Council on Law Enforcement Education and Training
742757 (C.L.E.E.T.) shall keep confidential all records it maintains
743758 pursuant to Section 3311 of Title 70 of the Oklahoma St atutes and
744759 deny release of records relating to any employed or certified full-
745760 time officer, reserve officer, retired officer o r other person;
746761 teacher lesson plans, tests and ot her teaching materials; and
747762 personal communications concerning individual studen ts except under
748763 the following circumstances:
749764 1. To verify the current certification status of any peace
750765 officer;
751766 2. As may be required to perform the duties imposed by Sectio n
752767 3311 of Title 70 of the Oklahoma Statutes;
753768 3. To provide to any peace officer copies of the records of
754769 that peace officer upon submitting a written request;
755770 4. To provide, upon written request, to a ny law enforcement
756771 agency conducting an official inves tigation, copies of the records
757772 of any peace officer who is the subject of such investigation;

785801 an adverse action was taken against a peac e officer; and
786802 6. Pursuant to an order of the district court of the State of
787803 Oklahoma.
788804 F. The Department of Public Safety shall keep confidential:
789805 1. All records it maintains pursuant to its authority under
790806 Title 47 of the Oklahoma Statutes relating to the Oklahoma Highway
791807 Patrol Division, the Communication s Division, and other divisions of
792808 the Department relating to:
793809 a. training, lesson plans, teaching materials, tests and
794810 test results,
795811 b. policies, procedures and operations, any of which are
796812 of a tactical nature, and
797813 c. the following information from radio logs:
798814 (1) telephone numbers,
799815 (2) addresses other than the location of inciden ts to
800816 which officers are dispatched, and
801817 (3) personal information which is contrary to the
802818 provisions of the Driver’s Privacy Protection
803819 Act, 18 United States Code, Sections 2721 through
804820 2725; and
805821 2. For the purpose of preventing identity theft and invasi on of
806822 law enforcement computer systems, except as provided in Title 47 of
807823 the Oklahoma Statute s, all driving records.

834851 SECTION 2. It being immediately necessary f or the preservation
835852 of the public peace, heal th or safety, an emergency is hereby
