153153 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
154154 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-1950.1, is
155155 amended to read as follows:
156156 Section 1-1950.1. A. For purposes of this section:
157157 1. “Nurse aide” means any person who pr ovides, for
158158 compensation, nursing care or h ealth-related services to residents
159159 in a nursing facility, a specialized facility, a residential care
160160 home, continuum of care facility, assisted liv ing center or an adult
161161 day care center and who is not a licensed health professional. Such
162162 term also means any person who provides such services to individuals
163163 in their own homes as an employee or contract provider of a home
164164 health or home care agency, or as a contract provider of the
165165 Medicaid State Plan Personal Care Program;
166166 2. “Employer” means any of the following facilities, homes,
167167 agencies or programs which are subject to the provision of this
168168 section:
169169 a. a nursing facility or specialized facility as such
170170 terms are defined in the Nursing Home Care Act,
171171 b. a residential care home as such term is defined by the
172172 Residential Care Act,
173173 c. an adult day care center as such term is defined in
174174 the Adult Day Care Act,

226226 d. an assisted living center as such term i s defined by
227227 the Continuum of Care and Assisted Living Act,
228228 e. a continuum of care facility as such term is defined
229229 by the Continuum of Care and Assisted Living Act,
230230 f. a home health or home care agency,
231231 g. the Department of Human Services, in its capacity as
232232 an operator of any hospital or health care institution
233233 or as a contractor with providers under the Medic aid
234234 State Plan Personal Care Program,
235235 h. any facility operated by the Oklahoma Department of
236236 Veterans Affairs, and
237237 i. any facility approved and annu ally reviewed by the
238238 United States Department of Veterans Affairs as a
239239 medical foster home in which care is provided
240240 exclusively to three or fewer veterans;
241241 3. “Home health or home care agency” means any person,
242242 partnership, association, corporation or ot her organization which
243243 administers, offers or provides health car e services or supportive
244244 assistance for compensation to three or more ill, disabled, or
245245 infirm persons in the temporary or permanent residence of such
246246 persons, and includes any subunits or br anch offices of a parent
247247 home health or home care agency;
248248 4. “Bureau” means the Oklahoma State Bureau of In vestigation;

301301 5. “Completion of the sentence” means the last day of the
302302 entire term of the incarceration imposed by the sentence including
303303 any term that is deferred, suspended or subject to parole.
304304 B. Before any employer makes an offer to employ or to contract
305305 with a nurse aide begins employment or a contract to provide nursing
306306 care, health-related services or supportive assistance to any
307307 individual, the employer shall provide for a criminal history
308308 background check to be made on the nurse aide pursuan t to the
309309 provisions of the Long-Term Care Security Act. If the employer is a
310310 facility, home or institution which is part of a larger complex of
311311 buildings, the requirement of a criminal history background check
312312 shall apply only to an offer of employment or contract made to a
313313 person who will work pr imarily in the immediate boundaries of the
314314 facility, home, or institution.
315315 Where the provisions of the Lo ng-Term Care Security Act
316316 pertaining to registry screenin gs and national criminal history
317317 record check checks are not in effect pending an effective date
318318 established in rulemaking, an employer is authorized to obtain any
319319 criminal history background records maintained by the Bureau
320320 pursuant to the following:
321321 1. The employer shall request the Bureau to conduct a criminal
322322 history background check on the nurse aid e and shall provide to the
323323 Bureau any relevant information required by the Bureau to conduct
324324 the check. The employer shall pay a fee of Fifteen Dollars ($15.00)

376376 to the Bureau for each criminal history back ground check that is
377377 conducted pursuant to such a request;
378378 2. An employer may make an offer of temporary employment to a
379379 nurse aide pending the res ults of the criminal history background
380380 check. The employer in such instance shall provide to the Bureau
381381 the name and relevant information relating to the pe rson within
382382 seventy-two (72) hours after t he date the person accepts temporary
383383 employment. The employer shall not hire or contract with the nurse
384384 aide on a permanent basis until the results of the criminal history
385385 background check are received;
386386 3. An employer may accept a criminal history backgr ound report
387387 less than one (1) year old of a person to wh om such employer makes
388388 an offer of employment. The report shall be obtained from the
389389 previous employer or c ontractor of such person and shall only be
390390 obtained upon the written consent of such person; and
391391 4. Every employer while subject to the provisions of this
392392 subsection shall inform each applicant for employment, o r each
393393 prospective contract provider, as app licable, that the employer is
394394 required to obtain a criminal history background record before
395395 making an offer of permanent employment or contract to a nurse aide.
396396 C. 1. If the results of a criminal history backg round check
397397 reveal that the subject person h as been convicted of, pled guilty or
398398 no contest to, or received a deferred sentence for, a f elony or
399399 misdemeanor offense for any of the following of fenses in any state

451451 or federal jurisdiction, the employer shall not hire or contract
452452 with the person:
453453 a. abuse, neglect, or financial exploitation of any
454454 person entrusted to the care or possession of such
455455 person,
456456 b. rape, incest, or sodomy, or any crime that resulted in
457457 the person being registered on a sex offender regi stry
458458 at any time,
459459 c. child abuse,
460460 d. murder or attempted murder,
461461 e. manslaughter,
462462 f. kidnapping,
463463 g. human trafficking,
464464 h. aggravated assault and battery,
465465 h. i. assault and battery with a dan gerous weapon, or
466466 i. j. arson in the first degree.
467467 2. If less than seven (7) five (5) years have elapsed sin ce the
468468 completion of sentence, and the results of a criminal history che ck
469469 reveal that the subject person has been convicted of, or pled guilty
470470 or no contest to, a felony or misdemeanor offense for any of t he
471471 following offenses, in any state or federal jur isdiction, the
472472 employer shall not hire or contract with the person:
473473 a. assault,
474474 b. battery,

526526 c. indecent exposure and indecent exhibition, except
527527 where such offense disqualifies the applicant as a
528528 registered sex offender,
529529 d. pandering,
530530 e. burglary in the first or second degree,
531531 f. robbery in the first or second degree,
532532 g. robbery or attempted robbery with a dangerous weapon,
533533 or imitation firearm,
534534 h. arson in the second degree,
535535 i. unlawful manufacture , distribution, prescription, or
536536 dispensing of a Schedule I through V drug as defined
537537 by the Uniform Controlled Dangerous Substances Act,
538538 j. grand larceny, or
539539 k. petit larceny or shoplifting.
540540 D. An employer shall not employ or continue employing a person
541541 addicted to any Schedule I through V drug as specified b y the
542542 Uniform Controlled Dangerous Substances Act unless the person
543543 produces evidence that the person ha s successfully completed a drug
544544 rehabilitation program.
545545 E. All employment eligibility determination reco rds received by
546546 the employer pursuant to this s ection are confidential and are for
547547 the exclusive use of the State D epartment of Health and the employer
548548 which requested the information. Except on court order or with the
549549 written consent of the person being investigated, the records shall

602602 agency. These record s shall be destroyed after one (1) y ear from
603603 the end of employment of the person to whom such records relate.
604604 F. As part of the inspections required by the Nursing Home Care
605605 Act, Continuum of Care and Assisted Living Act, the Residential Care
606606 Act, and the Adult Day Care Act, the State Depar tment of Health
607607 shall review the employment files of any facility, home or
608608 institution required to obtain a criminal history background
609609 determination to ensure such facilities, homes or institutions are
610610 in compliance with the provisions of this section.
611611 G. A nurse aide who has undergone a criminal history background
612612 check and been deemed eligible for employment by the Department and
613613 who is currently employed or contracted by a facility and works not
614614 less than one hundred sixty (160) hours per month for the facility
615615 may be employed or contracted by one or more secondary facilities
616616 without an additional criminal history background check if:
617617 1. The criminal history record check is dated not more than one
618618 (1) year from the date the nurse aide begins employment or contract
619619 at each applicable secondary facility;
620620 2. Each secondary facility has common ownership with the
621621 primary facility;
622622 3. The nurse aide works a total of not more than eighty (80)
623623 hours per month in all secondary facilities combined ; and

677677 The hours worked by a nu rse aide at a secondary fa cility shall
678678 be available upon by request by the Department for review or audit.
679679 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-1950.3, is
680680 amended to read as follow s:
681681 Section 1-1950.3. A. 1. A Except as provided by paragraph 2
682682 or 3 of this subsection, a nursing facility, specialized facility,
683683 continuum of care facility, assisted living center, adult day care
684684 or residential home, or facility operated by the Oklahoma D epartment
685685 of Veterans Affairs, shall not employ as a nurse aide, on a full -
686686 time, temporary, per diem, or any other basis, any individual who is
687687 not certified as a nurse aide in good standing and is not eligible
688688 for placement on the nurse aide registry main tained by the State
689689 Department of Health.
690690 2. The Department may grant a temporary e mergency waiver to the
691691 provisions of this paragraph 1 of this subsection to any nursing
692692 facility, continuum of care facility, assisted living center or,
693693 adult day care, or residential home which can demonstrate that such
694694 facility, home or institution has been u nable to successfully meet
695695 its staffing requirements related to the provisions of this
696696 paragraph 1 of this subsection.
697697 3. Until November 1, 2026, to the extent allowed under federal
698698 regulations, a nursing facility, continuum of care facility,

750750 assisted living center, adult day care, or residential home that
751751 utilizes an employer-based training and competency evaluation
752752 program approved by the State Department of Health may employ nurse
753753 aides who are not yet certified if the nurse aides are en rolled in
754754 the facility’s training and competency evaluation program.
755755 B. Such The temporary emergency waiver described in paragraph 2
756756 of subsection A of this section or an employer-based training and
757757 competency evaluation program described in paragraph 3 of subsection
758758 A of this section shall require the foll owing:
759759 1. An The individual who is employed as a nurse aide who is
760760 must be enrolled in a Department-approved educational-based or
761761 employer-based training and competency evaluation program for nurse
762762 aides and shall successfully complete such training and competency
763763 evaluations within four (4) months of entering the training program,
764764 after which time no employer may use as a nurse aid e an individual
765765 who has not completed the training and competen cy evaluation
766766 program. The Department may grant a trainee a one-time extension of
767767 the four-month training requirement if:
768768 a. such requirement causes an undue hardship for the
769769 trainee due to unusual circumstances or illness,
770770 b. the trainee has demonstrated a good faith effort to
771771 complete the training and competency evaluation

824824 c. the extension meets such conditions as may b e required
825825 by rules promulgated by the State Commissioner of
826826 Health;
827827 2. The individual sh all obtain certification, and the
828828 Department shall place th e nurse aide on the registry within thirty
829829 (30) days after demonstration of competency; and
830830 3. Any nursing facility, specializ ed facility, continuum of
831831 care facility, assisted living center, adult day care, or
832832 residential care home that employs an individu al who is in nurse
833833 aide training, as provided in this section, shall e nsure that the
834834 trainee shall:
835835 a. complete the required training and competency program
836836 as provided in rules specified by 42 CFR 483.152(b)(1)
837837 prior to any direct contact with a resident or client,
838838 b. not perform any service for w hich the trainee has not
839839 trained and been determined proficient by the
840840 instructor, and
841841 c. be supervised at all times by no less than a licensed
842842 practical nurse; and.
843843 4. No employer may use as a nurse aide an individual who has
844844 not completed the nurse aide training and competency program within
845845 the required four-month period.
846846 C. For purposes of this section, “four (4) months” means the
847847 equivalent of four (4) months of full-time employment as a nurse

899899 aide by any employer in any nursing facility, specialized facility,
900900 continuum of care facility, assisted living center, adult day care
901901 or residential care home.
902902 D. 1. The Department may grant a trainee a one-time extension
903903 of the four-month training requirement if:
904904 a. such requirement causes an undue hardship f or the
905905 trainee due to unusual circumstances or illness, and
906906 b. the trainee has demonstrated a good faith effort to
907907 complete the training and competency evaluation
908908 program.
909909 2. The State Board of Health shall promulgate rules related to
910910 the review of and th e process and conditions for such an extension
911911 (1) if the facility is subject t o federal regulations
912912 governing supervision of nurse aides, the
913913 facility shall comply with the federal
914914 regulations, or
915915 (2) if the facility is not subject to federal
916916 regulations governing su pervision of nurse aides,
917917 the facility shall ensure that the trainee is
918918 assigned a certified nurse aide as a mentor. A
919919 Licensed Practical Nurse or greater shall oversee
920920 the training program, shall conduct all
921921 evaluations of the trainee, and shall provide
922922 initial direction and perio dic inspection of the

975975 work. The plan of care shall not be altered by
976976 the trainee or mentoring certified nurse aide
977977 without prior consultation with and app roval of
978978 the supervising Licensed Practical Nurse or
979979 greater. The supervising Licensed Practical
980980 Nurse or greater need not always be physically
981981 present or on the premises when the trainee is
982982 providing care for which the trainee has been
983983 found competent; however, except in cases of
984984 emergency, the Licensed Practical Nurse or
985985 greater shall be available for consultation with
986986 and direction of the trainee and mentoring
987987 certified nurse aide.
988988 E. C. 1. Certified nurse aides may begin an education-based or
989989 employer-based training and competency evaluation and examination
990990 program to become a ce rtified medication aide immediately after
991991 receiving certification as a nurse aide and being listed on the
992992 nurse aide registry.
993993 2. Certified medication aides, upon success ful completion of
994994 competency standards or pres cribed training courses, shall be
995995 eligible to distribute medications or treatments provided by
996996 paragraph 2 3 of this subsection within a:

12011201 F. D. Any person convicted of violating any of the provision s
12021202 of this section or Section 1-1950.1 of this title sha ll be guilty of
12031203 a misdemeanor, punishable by a fine of not less than One Hundred
12041204 Dollars ($100.00) nor more than Three Hu ndred Dollars ($300.00),
12051205 imprisonment in the county jail for not more than thirt y (30) days,
12061206 or by both such fine and imprisonment.
12071207 E. Not later than November 1, 2026, the State Commissioner of
12081208 Health shall promulgate rules governing employer-based training
12091209 programs including but not limited to rules that allow the
12101210 employment of noncertified nurse aides enrolled in an employer-based
12111211 training program, subject to the conditions allowed in such rules.
12121212 SECTION 3. AMENDATORY 63 O.S. 2021, Section 1-1951, is

12761276 b. The Department may withdraw approval of the program if
12771277 the program or, in the case of an employer-based
12781278 program, the program or facility, is in violation of
12791279 rules promulgated by the State Commissioner of Health
12801280 that govern the program.
12811281 c. Until November 1, 2026, the Department shall
12821282 immediately withdraw approval of an employer-based
12831283 program if:
12841284 (1) the facility’s temporary emergency waiver under
12851285 paragraph 2 of subsection A of Section 1-1950.3
12861286 of this title is withdrawn due to one or more
12871287 deficiencies cited during an investigation or
12881288 inspection; however, the Department shall not
12891289 withdraw approval of the employer-based program
12901290 if the facility’s temporary emergency waiver is
12911291 withdrawn solely due to having a sufficiency of
12921292 staffing that makes the facility ineligible for a
12931293 temporary emergency waiver , or

13501350 on the basis of the amount of monetary penalties the
13511351 facility has accrued unless the facility is assessed
13521352 the maximum civil monetary penalty stipulated under
13531353 federal regulation, in which case the Department shall
13541354 immediately withdraw approval of the employer -based
13551355 training program.
13561356 e. Until November 1, 2026, if an employer-based program
13571357 is withdrawn for any reason, the facility may reapply
13581358 for approval of an employer-based program after
13591359 completion of a plan of correction and certifi cation
13601360 by the Department that the facility is in compliance
13611361 with all applicable laws and r ules and the approval
13621362 may be reinstated as provided by rules promulgated by
13631363 the Commissioner;
13641364 3. Determine curricula and standards for training and
13651365 competency programs. The Department shall require such training to
13661366 include a minimum of ten (10) hours of train ing in the care of
13671367 Alzheimer’s patients;

14931493 8. Administer competency examinations to nurse aides who have
14941494 completed a Department-approved employer-based training program.
14951495 Until November 1, 2026, the Department shall offer both an online
14961496 competency examination and an in-person competency examination. The
14971497 Department may contract with on e or more vendors to administer
14981498 either type or both types of competency examination . An individual
14991499 who has received a passing sc ore on the competency examination and
15001500 has met all other requirements for certification as a nurse aide
15011501 including but not limited to training requirements shall be granted
15021502 certification and shall be placed on the nurse aide registry . The
15031503 provisions of this paragraph shall not be construed to ex empt a
15041504 nurse aide from in-person evaluation by a Licensed Practical Nurse
15051505 before the nurse aide is eligible to take a comp etency examination.
15061506 The Department shall provide a form appropriate for the care
15071507 provided in each different type of licensed care fac ility for in-
15081508 person skills competency evaluation by no less than a Licensed
15091509 Practical Nurse overseeing the training program .
15101510 B. The State Board Commissioner of Health shall promulgate
15111511 rules to implement the provisions of this section and shall have
15121512 power to assess fees.
15131513 1. Each person certified as a nurse aide pursuant to the
15141514 provisions of this section shall be required to pay certification
15151515 and recertification fees in amounts to be determined by the State

15771577 C. Only a person who has qualified as a certified nurse aide
15781578 and who holds a valid current nurse aide certificate for use in this
15791579 state shall have the right and privil ege of using the title
15801580 Certified Nurse Aide and to use the abbreviation CNA after the name
15811581 of such person. Any person who violates the provisions of this
15821582 section shall be subject to a civil monetary penalty to be assessed
15831583 by the Department.
15841584 D. A person qualified by the Department as a certified nurse
15851585 aide shall be deemed to have met the requirements to work as a home
15861586 health aide pursuant to the provisions of the Home Care Act and
15871587 shall require no further licensure for performing services within
15881588 the scope of practice of home health aid es.

16451645 b. provides a process for notification and investigation
16461646 of alleged abuse, exploitation or neglect of residents
16471647 of a facility or home, clients of an agency or center,
16481648 or of misappropriation of resident or client property.
16491649 2. The registry shall contain information as to whether a nurse
16501650 aide has:
16511651 a. successfully completed a certified nurse aide training
16521652 and competency examination,
16531653 b. met all the requirements for certification, or
16541654 c. received a waiver from the Board.
16551655 3. The registry shall inc lude, but not be limited to , the
16561656 following information on each certified nurse aide or nurse aide
16571657 trainee:
16581658 a. the full name of the individual,
16591659 b. information necessary to identify each individual.

17311731 (3) statement by the individual disputing the finding
17321732 if the individual chooses to make one.
17331733 4. The Department shall include th e information specified in
17341734 subparagraph d of paragraph 3 of this subsection in the registry
17351735 within ten (10) working days of the substantiating finding and it

17931793 5. Upon receipt of an allegation of abuse, exploitation or
17941794 neglect of a resident or client, or an allegation of
17951795 misappropriation of resident or client prope rty by a certified nurse
17961796 aide or nurse aide trainee, the Department shall place a pending
17971797 notation in the registry until a final determination has been made.
17981798 If the investigation, or administrative hearing held to determine
17991799 whether the certified nurse aid e or nurse aide trainee is in
18001800 violation of the law or rules promulgated pursuant thereto, revea ls
18011801 that the abuse, exploitation or neglect, or misappropriation of
18021802 resident or client property was unsu bstantiated, the pending
18031803 notation shall be removed within twenty-four (24) hours of receipt
18041804 of notice by the Department.
18051805 6. The Department shall, after notice to the individuals
18061806 involved and a reasonable opportunity for a hearing, make a finding
18071807 as to the accuracy of the allegations.
18081808 7. If the Department after notice and opportunity for hearing
18091809 determines with clear and convincing evidence that abuse, ne glect or
18101810 exploitation, or misappropriation of resident or client property has
18111811 occurred and the alleged perpetrator is the person who committed the

18681868 nurse aide in a long-term care facility, a residential care
18691869 facility, assisted living facility, day care facility, or any entity
18701870 that requires certification of nurse aides, and notice of any
18711871 further appeal rights shall also be sent to the nurse aide.
18721872 8. In any proceeding in which the Departm ent is required to
18731873 serve notice or an order on an individual, the Department may send
18741874 written correspondence to the address on file with the registry. If
18751875 the correspondence is returned and a notation of the United States
18761876 Postal Service indicates “unclaimed” or “moved” or “refused” or any
18771877 other nondelivery markings and the records of the registry indicate
18781878 that no change of address as required by this subsection ha s been
18791879 received by the registry, the notice and any subsequent notices or
18801880 orders shall be deeme d by the court as having been legally served
18811881 for all purposes.
18821882 9. The Department shall require that ea ch facility check the
18831883 nurse aide registry before hiring a person to work as a nurse aide.
18841884 If the registry indicates that an individual has been found, a s a
18851885 result of a hearing, to be personally responsible for abuse, neglect
18861886 or exploitation, that individu al shall not be hired by the facility.

19401940 exploited in a facility, the Department shall notify the appropriate

19431943 or client property occurred.
19441944 11. Upon a written request by a certified nurse aide or nurse
19451945 aide trainee, the Board Commissioner shall provide within twenty
19461946 (20) working days all information on the record of the certified
19471947 nurse aide or nurse aide trainee when a finding of abuse,
19481948 exploitation or neglect is confirmed and placed in the registry.
19491949 12. Upon request and except for the names of residents and
19501950 clients, the Department shall disclose all of the information
19511951 relating to the confirmed determination of abuse, exploitation and
19521952 neglect by the certified nurse aide or nurse aide trainee to the
19531953 person requesting such information, and may disclose additional
19541954 information the Department determines necessary.
19551955 13. A person who has acted in good faith to comply with state
19561956 reporting requirements and this s ection of law shall be immune from
19571957 liability for reporting allegations of abuse, neglect or
19581958 exploitation.
19591959 F. Each nurse aide trainee shall wear a badge which clearly
19601960 identifies the person as a nurse aide trainee. Such badge shall be
19611961 furnished by the faci lity employing the trainee. The badge shall be

20152015 G. 1. For purposes of this section, “feeding assistant” means
20162016 an individual who is paid to feed residents by a facility or who is
20172017 used under an arrangement with another agency or organization and
20182018 meets the requirements cited in 42 CFR Parts 483 and 488.
20192019 2. Each facility that employs or contracts employment of a
20202020 feeding assistant shall maintain a record of all individuals, used
20212021 by the facility as feeding assistants, who have successfully
20222022 completed a training course approved by the state for paid fee ding
20232023 assistants.
20242024 H. 1. Until November 1, 2026, an employer-based training
20252025 program for long term care aides shall consist of at least eighty-
20262026 five (85) hours of training or the equivalent if the facility is
20272027 subject to regulation by the Ce nters for Medicare and Medicaid
20282028 Services. Of the total required hours of training or the equivalent
20292029 as specified in this paragraph, the program shall include :
20302030 a. at least sixteen (16) hours of supervised practical
20312031 training that is documented and signed by the nurse
20322032 aide trainee,

20952095 a. at least sixteen (16) hours of supervised practical
20962096 training that is documented and signed by the nurse
20972097 aide trainee,
20982098 b. all of the curriculum specified in 42 CFR 483.152(b),
20992099 c. pursuant to paragraph 3 of subsection A of this
21002100 section, a minimum of ten (10) hours of training in

21022102 d. completion of a restorative nurse aide training

21772177 I. 1. The recertification requirements of the Department shall
21782178 allow nurse aides to renew certification if the nurse aide works or
21792179 volunteers the equivalent of a single eight-hour shift.
21802180 2. For a nurse aide who volunteers, the nurse aide must have
21812181 undergone a criminal history background check as provided by Section
21822182 1-1947 of this title prior to volunteering and shall only be
21832183 eligible for recertification if the nurse aide would not be
21842184 disqualified for employment or contract based on the criteria of

22432243 J. Not later than November 1, 2026, the State Commissioner of
22442244 Health shall promulgate rules governing employer-based training
22452245 programs including but not limited to rules governing approval and
22462246 withdrawal of employer-based training programs, administration of
22472247 competency examinations to nurse aides who have completed a
22482248 Department-approved employer-based training program, and employer-
22492249 based training program requir ements including but not limited to
22502250 curriculum.
22512251 SECTION 4. This act shall become effective July 1, 2024.
